Shoreline Stabilization and Culvert Installation 1) The authorized alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The riprap will not extend waterward more than 11 feet from the normal water level at any point along its alignment at the time of construction. 3) No vegetated wetlands will be excavated or filled. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2005 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation Permit #129-02 Page 2 of 3 ADDITIONAL CONDITIONS 4) Filter fabric associated with riprap/backfill, as shown on the attached workplan drawings, must be in place prior to the placement of any buekfill. 5) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 6) All fill material will be obtained from a high ground source. No unconfined fill material may be discharged into estuarine or public trust waters. The fill material will be clean and free of any pollutants except in trace quantities. 7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8) All excavated materials and debris associated with the replacement and removal of the collapsed 8" terra cotta farm tiles will be disposed of at an approved upland disposal site. Sedimentation and Erosion Control 9) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 10) Immediately prior to the initiation of construction, the permittee shall install turbidity curtains in the water area parallel to the canal bank immediately adjacent to the are•of shoreline stabilization and culvert installation. The turbidity curtains shall be removed when turbidity within the curtains reaches ambient levels. 11) This project is in a High Quality Water Zone and must comply with the Design Standards in Sensitive Watersheds, 15A NCAC 4B .0124. 12) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. NOTE: Because of the sensitivity of the adjacent waters and the potential for fill material to be eroded away prior to becoming stabilized, the permittee is encouraged to implement all practicable measures to adequately stabilize this area to prevent sediment from entering adjacent waters. Department of Transportation Permit #129-02 Page 3 of 3 ADDITIONAL CONDITIONS General 15) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 16) The authorized activity will not cause an unacceptable interference with navigation. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit Number 3 (Action ID Number 200210971) for the culvert replacement and Nationwide Permit Number 13 (Action ID Number 200210982) for the placement of riprap. Both Nationwide Permits were issued on August 21, 2002. . NOTE: The N.C. The replacement of this tile was not covered under the original Major Permit (129-02) for shoreline stabilization. The damaged tile was discovered after the permit was issued. This damaged tile is located approximately 150 feet North of the existing stabilization project. The shoulder of the canal has become unstabilized and is eroding into the canal bottom, which has caused tho road to begin to collapse. Therefore, NCDOT is requesting a letter of refinement from DCM to allow the replacement of the drain file and the placement of additional rip -rap to be covered under Major Permit 129-02. This will stabilize the canal bank and prevent and further damage to the roadway. This will result in an additional 320 square feet of rip -rap to be placed in the canal bottom. The rip -rap will be carried up the canal bank to stabilize the shoulder. DATE: July 17, 2002 The following are my comments and recommendations regarding the above -mentioned proposal. The proposal consists of repairing 415 feet of eroded canal bank/road shoulder by installing rip rap from the canal bottom to 2 feet above MHW to form a base for a 5-foot soil road shoulder to conform more closely with the adjacent road shoulders and to provide for the safety of the traveling public. NCDOT has reduced the shallow bottom fill impacts associated with this proposal by proposing 2:1 fill slopes on the canal bank. PROJECT SUMMARY: The N.C. Department of Transportation is proposing to stabilize 415 feet of Rattlesnake Canal shoreline along SR 1111 and replace 8" terra cotta farm tiles with 24" culverts where two farm ditches cross SR 1111. FIELD INVESTIGATION REPORT NC DOT — SR 1111, Hyde County PAGE 2 9. PROJECT DESCRIPTION: The site of this proposal is SR 1111, between SR 1110 and SR 1108, approximately 1.5 miles southwest of Middletown, in Hyde County. Farm Tile One and Two are 1140 feet and 1368 feet respectively, southeast of SR 1110. The proposed stabilization begins 2060 feet southeast of SR 1110 and ends 2475 southeast of SR 1110.The general purpose of the project is to stabilize the road shoulder and repair the broken farm tiles under SR 1111, to alleviate erosion into Rattlesnake Canal and provide safer driving conditions for the traveling public. State Road 1111 parallels Rattlesnake Canal and provides a 15-foot gravel travelway and a road shoulder averaging 7 feet wide on the southwest side and 5 feet wide on the northeast side (outside of the proposed project area). In the proposed project area the canal bank has eroded into the gravel travelway in several areas and is less than 5 feet in the majority of the project area. Rattlesnake Canal was originally excavated for agricultural drainage and the proposed project area is completely surrounded by agricultural fields. A small marina exists approximately 4000 feet downstream of the proposed project area on the southeast side of the bridge crossing Rattlesnake Canal on SR 1108. In the proposed project area Rattlesnake Canal is approximately 50 feet wi de, with the canal bottom 7.5 feet below the ground surface and terminates at the Pamlico Sound. Approximately 2.5 feet of water is in the canal at Normal High Water. Farm Tile One and Two are 8" terra cotta pipe sections connecting the existing farm ditches to Rattlesnake Canal. Both farm tiles have collapsed sections allowing water to escape under SR 1111 causing undermining of the road travelway and shoulder. The surrounding agricultural fields were planted with wheat, soybeans and corn. The ditch banks are vegetated with Dewberry, Honeysuckle, Poison, Ivy, Virginia Creeper, Cat Brier and Bermuda grass. The NC Soil Conservation Service classifies soils in the project area as Hyde Land Silty Loam. Approximate elevations on the site range between -2 feet and 5 feet above normal high water. No evidence of SAV beds was noted. The North Carolina Division of Water Quality classifies waters of Pamlico Sound adjacent to the proposed project area as SA-HQW and they are subject to the Tar -Pamlico River Buffer Rules. No Primary Nursery Area, as designated by the North Carolina Division of Marine Fisheries, is located at this site. The Hyde County Land Use Plan designates the project area as Rural, with all CAMA Areas of Environmental Concern designated as Conservation. The proposal is to armor 415 feet of canal bank with rip rap, in an alignment approximating the original canal bank, to a height 2 feet above NHW to provide a stable base to backfill a 5 -foot wide soil road shoulder to more closely correspond to the adjacent road shoulders. This riprap armament alignment would extend water -ward of the existing eroded areas from 6 feet to 11 feet and be covered with soil stabilizing fabric. The proposed soil road shoulder would be installed above the soil stabilizing fabric and include the same fabric between the existing canal bank and the soil backfill. Two 8" farm tiles that have degraded and collapsed would be replaced with 24" corrugated aluminum culverts after the erosion sediment is excavated from the canal bottom at the end of the farm tiles. The canal bank will be armored surrounding the culverts for a 15 -foot radius. NC DOT Best Management Practices will be used for erosion control. FIELD INVESTIGATION REPORT NC DOT — SR 1111, Hyde County PAGE 3 10. ANTICIPATED IMPACTS: As proposed, the construction of the riprap armament would require the filling of approximately 3652 square feet of shallow (canal) bottom. The replacement of the two farm tiles with culverts would require the excavation of approximately 300 square feet of shallow bottom and 280 feet of high ground in addition to the filling of approximately 300 square feet of shallow bottom and 404 square feet of high ground (canal bank around culverts). NC DOT has reduced the shallow bottom excavation and fill impacts associated with this proposal by increasing the canal bank side slopes to 2:1. The NC DOT has proposed to use standard BMP's to minimize the impacts of erosion. Principally local residents use State Road 1111. The repair of the road shoulder and replacement of the deteriorated farm tiles with culverts should enhance the safety of motorists using SR 1111. The North Carolina Department of Transportation proposes to stabilize a section of SR l l 11. This road parallels a drainage canal that flows out to the Pamlico Sound. Along a portion of this canal, the bank has become destabilized and significant amounts of erosion have taken place. The erosion of the canal bank has caused SR I 1 11's roadbed to be undermined. If the canal banks are not stabilized then further erosion will continue and the roadbed will eventually be washed out completely, resulting in road closure. The length of the area to be stabilized along the canal bank with class B riprap is 415 feet, with an average distance waterward (NWL) of 6.8 feet. This will result in 65 cubic yards of fill below the NWL. The primary cause of the bank erosion was two drainage pipes that carry water from adjacent agricultural fields, under the road, and into the canal. These pipes are old pipes that have collapsed under the roadbed. These pipes will be replaced in conjunction with the bank stabilization. Once this work is complete we do not anticipate having any further problems with bank destabilization along this canal. The purpose of this letter is to request authorization under a CAMA major permit for impacts to Public Trust Waters. Rattlesnake Canal is a navigable water and can be accessed by way of the Pamlico Sound. In the area of the proposed work there is essentially no recreational use of the canal as Public Trust Water. Approximately 0.5 miles south of the project area, there are a few commercial boats that dock along the bank of the canal. The purpose of the canal is drainage of the adjacent agricultural fields. No unconfined fill material may be discharged into estuarine or public trust waters. The fill material will be clean and free of any pollutants except in trace quantities. 7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8) All excavated materials and debris associated with the replacement and removal.of the collapsed 8" terra cotta farm tiles will be disposed of at an approved upland disposal site.. Sedimentation and Erosion Control 9) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 10) Immediately priorto the initiation of construction, the permittee shall install turbidity curtains in the water area parallel to the canal bank immediately adjacent to the are of shoreline stabilization and. culvert -installation. The turbidity curtains shall be removed when turbidity within the curtains reaches ambient levels. 11) This project is in a High Quality Water Zone and must comply with the Design Standards in Sensitive Watersheds, 15A NCAC 4B .0124. 12) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures must be implemented'to ensure that eroded materials do not.enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales`or berms, sand fence, etc.). 14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. i NOTE: Because of the sensitivity of the adjacent waters and the potential for fill material to be eroded away prior to becoming stabilized, the permittee is encouraged to implement all practicable measures to adequately stabilize this area to prevent sediment from entering adjacent waters. The project consists of replacing an existing culvert, elevating and paving an existing roadway. Areas of coastal wetlands and 404 wetlands will be filled and excavated to install road shoulders and shallow roadside ditches. The existing road blocks the natural stream course at the crossing of the unnamed tributary of Middle Town Creek. The stream has been channelized in a shallow ditch approximately 50 feet east of the natural stream course where the Coastal Marsh transitions to Riverine Pine Flats (404 type wetlands). Wind driven high tides sheet flow over the existing road. I would recommend the project be approved contingent upon the following conditions: 1) NC DOT install a culvert in the roadway at the natural stream course, in addition to the culvert proposed at the ditch crossing. This would restore a portion of the natural stream hydrology that was impeded previously and mitigate for restricting sheet flow over the road from wind driven high tides 2) NC DOT Mitigate for 0.23 acres of Coastal Marsh impacts (9981 square feet, as on application DCM-MP-2, 4. b.) instead of the 0.2 acres proposed. 3) The roadway fill material will be clean and free of any pollutants, except in trace quantities. 4) In orderto protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 5) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 6) . No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the work plats. 7) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) In no case shall excavation exceed the depth of connecting waters. 9) In order to protect shrimp and finfish populations, no excavation or filling will be permitted below NWL or in inundated wetlands between ??? and ??? of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. Department of Transportation is proposing to upgrade the existing 18 foot wide gravel road to an 18 foot wide paved road with 5 foot shoulders and replace the existing culvert where SR 1109 crosses an unnamed tributary of Middle Town Creek. FIELD INVESTIGATION REPORT " NC DOT — SR 1109 March 4, 2002 PAGE 2 9. PROJECT DESCRIPTION: The site of this proposal is State Road 1109 (Marsh Road) south of the community of Middletown, in Hyde County, NC. The road is approximately 3' - 5' above NWL. The general purpose of the project is to elevate .and pave the existing gravel road and install road shoulders to allow a pavement width of 18 feet, shoulder widths of 5 feet, and a road elevation one foot above the existing surface. State Road 1109 is approximately 0.48 miles long from its beginning at SR 1108 to the dead end. This area is primarily undeveloped and is vegetated with Coastal Wetlands, Riverine and Non- Riverine Pine Flat (404 wetlands), with one house at the end of the road. State Road 1109 originates in an easterly direction from SR 1108 between a Non-Riverine Pine Flat and an unnamed 10' wide canal. At approximately 0.2 miles from SR 1108 the road bears in a southerly direction through approximately 0.1 miles of Coastal wetlands before continuing 0.2 miles (with 404 type wetlands on the east side of the road), to the end. The culverted crossing of the unnamed tributary to Middletown Creek is approximately 50 feet east of the natural streambed in an excavated ditch at the transition zone from Coastal Wetlands to Riverine Pine Flat (404 Type Wetland). Previous filling of the roadbed prevents the normal movement of water in the natural stream course. However, wind driven high tides sheet flow over the road. The coastal wetland consists of Juncus roemerianus S ap rtina patens and Distichlis s in cata. The adjacent Riverine Pine Flats are vegetated primarily with Pinus taeda. Phragmites australis Juncus effuses. Myrica cerifera and Helenium amarum. Soils in the area are Backbay Mucky Loam. Middle Town Creek is coastal waters adjacent to the project site, and is classified SA-HQW by the Division of Water Quality and subject to the Tar -Pamlico River Buffer.Rules. The area is not open to shellfishing, and is designated as Primary Nursery Area by the North Carolina Division of Marine Fisheries. The Hyde County Land Use Plan designates the project area as Rural, with all areas lying within CAMA Areas of Environmental Concern, designated as Conservation. The proposal is to raise the existing 18 foot wide gravel road surface one foot, install 5-foot road shoulders, and pave 18 feet wide to provide a safer road for school buses and the traveling public. The existing 15".diameter by 40-foot long culvert at the ditch crossing adjacent to the Coastal Marsh would be replaced with a 30" diameter by 40-foot long culvert. The roadway, shoulders, slopes and shallow storm -water ditches will extend for a width of 45 feet or less (15 -20 feet wider than existing). ANTICIPATED IMPACTS: As proposed, this road elevation, culvert replacement, and paving will result in the following impacts: Reduction/prevention of sheet flow of brackish estuarine water over the road surface during wind tides, approximately 5490 square feet of coastal wetlands will be filled by road shoulders, approximately 4491 square feet of coastal marsh will be excavated for the shallow storm -water ditches, Approximately 7427 square feet of 404 type wetlands will be filled by road shoulder, approximately 6077 square feet of 404 type wetlands will be excavated for the shallow storm water ditches and 50 square feet of shallow bottom will be filled by culvert. Approximately 2.08 acres of high ground will be graded, filled or excavated for the roadway and paving. NC DOT is proposing to mitigate for the Coastal Marsh and 404 type wetland impacts at a 1:1 ratio at the Bishop Road Mitigation Site. NC DOT has avoided and minimized the Coastal Marsh and 404 type wetland impacts'by reducing the pavement width from 20 feet to 18 feet, reducing the shoulder width from 7 feet to 5 feet, maintaining the existing road alignment, and installing ditch banks at a 2:1 slope. There is a high probability of turbidity to be expected during road filling and grading, and replacement of the culvert. The NC DOT has proposed strict enforcement of sedimentation and erosion control BMP's for the protection of wetlands and surface waters to minimize these impacts. The primary use of SR 1109 is daily school bus and local resident traffic. The elevation, installation of shoulders, culvert replacement and paving of the roadway should enhance the safety of motorists using SR 1109. The North Carolina Department of Transportation (NCDOT) proposes to upgrade SR 1109 (Marsh Road) from SR 1108 to end of state maintenance in Hyde County. SR 1109 is an unpaved roadway that will be upgraded to a paved roadway. Total project length is 0.48 miles. Transportation and highway laws of North Carolina (G.S. 136-44.6, 136-44.7, 136-44.7A, 136-44.8, and 136-44.9) require the NCDOT to develop annual work programs for construction and maintenance of secondary roads. These general statutes specifically set forth requirements for annual construction and paving of existing unpaved roads. Paving of these roads is performed in priority order as established by the NCDOT for each unpaved road within a given county. This number is based on characteristics of each road, including number of homes, schools, churches, businesses, industries, recreational facilities, traffic counts, presence of school bus routes, and value as a thoroughfare. Marsh Road is scheduled to be paved in the 2000-2001 Secondary Roads Construction Program. The purpose and need is to provide a safe, efficient roadway serving as the access to the one house located on SR 1109. The new roadway width and the eventual addition of pavement will greatly increase the safety of the traveling public, including a school bus that travels this road daily during the school year. SR 1109 currently consists of a gravel surface. Maintenance activities are also considered. Gravel roads require re -grading a minimum of 10 to 15 times per year. This may be increased depending on weather patterns and traffic usage. The project crosses a tributary of Middletown Creek which is designated as estuarine waters with adjacent coastal marshes (Table 1). One 15- inch wide, 40-foot long corrugated metal pipe will be replaced with a 30-inch wide, 40- foot long corrugated metal pipe. This pipe is under CAMA jurisdiction. Table 1. Creating a road shoulder will impact four contiguous wetland community types. The two brackish marsh wetland areas were determined to be within Division of Coastal Management jurisdiction. Impacts to wetlands associated with roadside shoulder and ditch construction are anticipated to be greater than 0.1 acres. Because these wetlands and associated ditches are tidal, the use of the ellipse equation for drainage effects was not calculated. Table 2. Alternative 1, the no build alternative, consists of the original, unpaved road. This road is currently 18 feet wide and 0.48 miles long and no shoulders. The road turns sharply in a right angle at approximately 0.24 miles from the SR 1108. Storm water is currently directed through ditches along both sides of the road that are approximately 1.8 feet deep. Areas delineated as wetlands begin at the backside of the existing roadside ditches. Alternative 1 was not pursued further since it did not allow for any of the needed improvements to this road. Alternative 2 utilized a standard 60-foot right of way consisting of an 20-foot paved road a 7-foot shoulder and 12-foot wide, 2-foot deep ditches with a 2:1 slope. This road would utilize the existing roadbed. Construction using this design would impact 0.98 acres of adjacent wetlands. One pipe within a tributary of Middletown creek will be replaced. Stormwater will be directed through new ditches. Alternative 3 utilizes a 40-foot right of way consisting of an 18-foot paved road, 5-foot shoulders and a 5-foot wide, 2-foot deep ditch. The road was shifted to allow for the most gradual slope around the sharp turn. This more gradual turn would require the additional fill of 0.05 acres of coastal brackish wetlands. Total wetland impact would be 0.56 acres. One pipe within a tributary of Middletown creek will be replaced. Stormwater will be directed through new ditches. Alternative 4 utilized a 40-foot right of way consisting of an 18-foot paved road, 5-foot shoulders and 5-foot wide, 2-foot deep ditch. The road will remain within the existing roadbed without shifting the road for the sharp turn. Total wetland impact will be 0.51 acres. No staging of construction equipment or storage of construction supplies will be allowed in or near wetlands or surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. No ditches will be constructed in wetland areas deeper than existing ditches. Strict Enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to waters of the U.S. at these sites. Compensatory Mitigation: Construction of the project will result in more than 0.1 acres of total impacts to waters of the U.S., therefore mitigation is required. Impacts have been minimized to the maximum extent possible during the design process. NC DOT will provide wetland compensation in a 1:1 ratio at the Bishop Road mitigation site (Table 4). Table 4. This watershed is subject to riparian buffer rules. Initial review of Natural Heritage data and a habitat field review show no effect of threatened or endangered species found in Hyde County. Permit Issues The purpose of this letter is to request authorization under a CAMA major permit for wetland impacts under CAMA jurisdiction. Notification for the use of this major permit to the CAMA is required for this project since the discharge associated with the project is within areas designated as coastal marshes and estuarine waters. Also, notification to the ACOE and North Carolina Division of Water Quality (NCDWQ) for Section 401 Water Quality Certificate (WQC) No. 3289 and Tar -Pamlico Buffer rule conditions is required for this project for 404 wetland impacts. Notification to the ACOE and DWQ for non - coastal impacts will be submitted in a separate Individual Permit application. NCDOT will comply with all conditions associated with this CAMA major permit, the IP and WQC conditions. Summary NCDOT proposes to upgrade and pave SR 1109 in Hyde County. There one stream crossing and four contiguous wetland impacts associated with this project. Four adjacent wetland communities will be impacted consisting of riverine pine flat, coastal brackish marsh, and non -riparian pine flat wetlands for a total of 0.51 acres. Compensation for wetland impacts will total 0.3 acres for riparian and non -riparian pine flat and 0.2 acres for coastal brackish marsh making for total compensation of 0.51 acres. The project is located in the Tar -Pamlico River Basin. Both a CAMA major permit and an IP application are being submitted to the appropriate agencies for review. The NCDOT will adhere to all applicable Section 404 IP, Section 401 WQCs, CAMA major conditions, and Section 401 Tar -Pamlico Buffer rule conditions.
