This permit, issued on MAY 8. 1996 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation and Fill
1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.
2) No vegetated wetlands or open water areas will be excavated or filled.
3) All excavated materials shall be confined above the mean high water line and landward of vegetated
wetlands behind adequate dikes or other retaining structures to prevent spill -over of solids into any
marsh or surrounding waters.
This pemtit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31.1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

4) The placement of riprap is limited to the high ground slopes beneath the proposed bridge.
5) All riprap material must consist of clean rock or masonry materials such as, but not limited to,
granite or broken concrete.
6) The temporary placement or double handling of excavated or fill material within waters or
vegetated wetlands is not authorized.
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction must not visibly increase the amount
of suspended sediments in adjacent waters.
8) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.

Through coordination with the North Carolina Division of Coastal
Management, we have learned of your plans to replace NCDOT Bridge No. 129
over Core Creek, located on State Road 1245, near Cove City, Craven County,
North Carolina.
On January 1, 1992, we renewed General Permit No. 198200031, (copy
enclosed), that authorizes the placement of fill material associated with
the construction, repair, or replacement of bridges across navigable waters
and waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,
you should contact appropriate State and local agencies before beginning work.

I have reviewed the subject application in regards to 07H.0207 & 07H.0208 and have
determined that the proposed project is consistent with those rules. I have no objection to the
permit being issued with the following conditions:
1) The placement of rip rap is limited to the high ground slopes beneath the bridge.
2) All riprap material must consist of clean rock or masonry materials such as, but
not limited to, granite or broken concrete. Materials such as tires, car bodies,
scrap metal, paper products, tree limbs, wood debris, organic material or similar
material, are not considered riprap.
3) No wetlands or open water will be excavated and/or filled.
4) In order to protect water quality, runoff from the construction must not visibly
increase the amount of suspended sediments in adjacent waters.
5) All disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty (30) working days of project
completion.

DATE: April 18, 1996
The North Carolina Department of Transportation proposes to replace
the existing timber bridge on SR 1245, over Core Creek, near Cove
City, Craven County with a new concrete bridge.
AECs impacted by the work include Public Trust Areas. The waters of
Core Creek at the project site are classified as C Sw NSW.
I have reviewed this proposal for consistency with the 1993 Craven
County Land Use Plan (LUP) Update and offer the following comments.
The general area of the project is classified as Rural, while the
Public Trust Areas AEC impacted by the work is classified as
Conservation.
The Craven County LUP allows all uses permitted by 15A NCAC 7H in
conservation classified AECs, including Public Trust Areas (Pages
III-2 and III-3).
Applicable policies contained in the Plan include Resource
Production and Management Policies for Marine Resource Areas (Page
IV-8). These policies reiterate Craven County's support for the
minimum use standards for public trust areas as described in 15A
NCAC 7H. Policies regarding Commitment to State and Federal
Programs (Page, IV-11, Economic and Community Development Policies)
state support for the North Carolina Department of Transportation
road and bridge improvement programs.
Based on the above policies, this bridge replacement project
appears to be consistent with the 1993 Craven County Land Use Plan,
provided all state requirements can be satisfied.

9. NARRATIVE DESCRIPTION:
Project Setting
Bridge #129 is located on SR 1245 near Cove City, over Core Creek, in Craven
County. The Inland Waters of Core Creek, a tributary of the Neuse River, is located
approximately 2 miles upstream of Pitchkettle Landing. At the project site, the creek
is approximately 110' wide and has an average daily flow of approximately 32 cfs.
Water depth is approximately -8' below NWL. The existing timber bridge is 116 feet
long by 19.4 feet wide. It has a navigational clearance of approximately 6.5 feet. A
wooded swamp borders the project site on the southern shore, while low lying yards
border the creek on the north shore. Core Creek is classified C Sw NSW.
Project Description
The applicant proposes to replace the existing timber bridge with a 135'-long by
24'-wide concrete bridge. The NCDOT proposes to construct the bridge using three
45' prestressed cored slabs. Since the proposed bridge is longer than the existing
bridge, approximately 1,110 ft2 of high ground will be excavated to facilitate
construction. Resultant spoil would be trucked off site to a high ground location.
Rock rip rap will be placed beneath the bridge to stabilize the shoreline.
Anticipated Impacts
The project as proposed would have negligible impact on the Public Trust Area
AEC. No excavation or filling below the NWL or in any wetlands is proposed. And
since only limited high ground excavation is proposed (approximately 125 yds3) there
should be minimal adverse effects by project -related sedimentation. The project would
have no adverse effect on navigation (The project would actually increase the clearance
by 0.2 feet).

Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Subject: Craven County, Replacement of Bridge No. 129 on SR 1245 over Core
Creek. State Project No. 5.1751.
The North Carolina Department of Transportation proposes to replace Bridge No 129
over Core Creek on SR 1245 near Cove City in Craven County. The existing two-lane
bridge 116 feet long and 19.4 feet wide will be replaced with a concrete bridge 135 feet
long and 24 feet wide. This bridge replacement will take place on existing alignment and
during construction local traffic will be detoured along existing roadways.
The new structure is longer than the existing bridge (see Sheet 4 of 5). To facilitate the
longer structure the North Carolina Department of Transportation proposes to excavate a
small amount of material (125 C.Y.) above the Normal Water Level (NWL). There will
be no excavation or fill below NWL or in wetlands. The shoreline will be stabilized by the
placement of rip -rap on slopes beneath the bridge.
The elevation of the new structure will be higher ( 0.2 ft.) than the existing bridge. The
proposed bridge will not affect existing water flow and will not affect existing navigation
potential.
The North Carolina Department of Transportation is requesting that the proposed work be
authorized under the appropriate Coastal Area Management Act (CAMA) permit.
Enclosed is a permit application for a CAMA Major Development Permit including permit
drawings and a copy of the fee application check for $250.00.
By copy of this letter, we are also requesting issuance of a 401 Water Quality Certification
from the North Carolina Department of Environmental Management.

We do not anticipate requesting an individual permit from the Corps of Engineers for
discharge of dredge or fill material in waters of the United States, but propose to proceed
under General Permit 31 in compliance with Section 10 of the Rivers and Harbors Act of
1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344).

Core Creek in Craven County. It was received complete on March 27, 1996, and appears to
be adequate for processing at this time. The projected deadline for making a decision is June
10, 1996. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any

This letter is in response to your December 15,1995 request for the staff of the Division
of Coastal Management (DCM) to inspect Bridge #129 and #130 on SR 1245 over Core Creek
and "Core Creek Overflow" in Craven County. The purpose of my site inspections was to
determine the CAMA jurisdiction at the sites and to determine the permit requirements of the
DCM for the replacement of the two aforementioned bridges.
Based upon my December 19, 1996 inspection, I conclude that the waters of Core Creek
are Public Trust waters. And as you are aware, Public Trust Areas are Areas of Environmental
Concern (AECs) and fall under the jurisdiction of the DCM. The replacement of Bridge #129
does constitute development and would require a permit from the Division. On the other hand,
the DCM does not have permitting authority on "Core Creek Overflow", therefore no permit
is needed from this office for the replacement of Bridge #130.
