Hello Brad;
I have been thinking a dock extension would be better for me because the creek actually is the same depth all
the way across. Also if a hurricane heads my way I can always drop a heavy anchor in the middle and hope for
the best.
I have the dock permit application but do not have a pdf format form. Can you send me one if you have it,
they are much easier to fill out.
Can I use the money from the major permit for the dock permit?

My dock extends about 75ft from shore now. The T potion is 20ft wide. I would like to extend the dock 15ft
making the T a 20X20ft platform. I think this would still be out of the channel. If you think I can do that please

SUBJECT: Comments and Recommendations - CAMA Major Permit —David Pugh,
Pamlico County
The following is my assessment and consequent recommendations of the above referenced proposal: these
proposed freestanding moorings would fill 16 square feet and usurp 18,083 square feet of Public Trust Waters.
These waters of Lower Broad Creek are closed to shellfish harvest. This waterbody is a Primary Nursery Area.
This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the
proposal, I recommend the project be authorized as proposed, contingent upon the following conditions:
1) The authorized structure and associated activity must not cause an unacceptable interference with
navigation;
2) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party;
3) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United States;
4) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity

of the permitted structures and the safety of moored boats. The permittee shall not hold the United
States liable for any such damage;
5) Freestanding mooring buoys shall be evaluated based upon the arc of the swing including the length of
the vessel to be moored. Moorings and the attached vessel shall not interfere with the access of any
riparian owner nor shall it block riparian access to channels or deep water, which allows riparian access.
Freestanding moorings shall not interfere with the ability of any riparian owner to place a pier for
access;
6) Freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and the WRC
requirements and the required marking maintained for the life of the moorings.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: This permit does not convey any rights, either in real estate or material.
NOTE: Should either adjacent property be sold prior to the initiation of construction, the permittee shall
be required to obtain a signed riparian corridor waiver from the new property owner prior to the
placement of any structures within the 15 foot riparian corridor.

Project Summary: The applicant wishes to construct two freestanding moorings for
private use in lower Broad Creek, Pamlico County.
8. Narrative Description:
The property is located adjacent to Broad Creek at 129 Juniper Drive near Oriental, Pamlico County.
This 0.8-acre lot is developed with a dock, a bulkhead, and a shed. Both of the adjacent properties are
developed with docks, bulkheads, and single family residences.
The elevation of the high ground of the parcel is about 4' above the normal water level (nwl).
Vegetation on the tract mainly consists of pine trees and lawn grasses, with a fringe of Coastal

Wetlands along the east and west property boundaries. This parcel has approximately 208' of
continuous shoreline along Broad Creek. Immediate offshore water depths adjacent to the parcel
range from -l' to -4' NWL. The subaqueous substrate is firm without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 565' across at this location. These waters are classified as a Primary Nursery Area and
there is not any submerged aquatic vegetation present in the vicinity of the project area. This area is
closed to shellfish harvest and is classified as SA; HQW, Nutrient Sensitive Waters. There is not a
defined Federal Channel in the nearby vicinity of this project area. However, there is a defined
NCWRC channel in the nearby vicinity of the project area.
10. Proposed Development:
General Permit (GP) # 67412C was issued to the applicant on January 22, 2015 for the installation
of two freestanding moorings. The NCWRC notified the NCDCM and the applicant that the proposal
would have a negative impact on navigation by encroaching into a nearby channel that the WRC
maintains. GP #67412C was rescinded on April 27, 2015. That permit is now null and void.
The applicant wishes to construct two freestanding moorings within Broad Creek, near Oriental. The
proposed development will take place across from 129 Juniper Drive, Pamlico County. These
moorings would be for private use.
The proposed mooring anchors are proposed to be 290' waterward, or north, of the applicant's
existing bulkhead. The proposed moorings will support vessels that are 35' in length. The arc of the
swing, which includes the vessel and its appurtenant mooring apparatus, would have a radius of 65'
each. The nearby channel is 130' waterward of the applicant's existing bulkhead. This channel is 95'
wide. The proposed moorings will be greater than 65' from the edge of this marked navigation
channel, in a depth of -6' nwl.
9. Anticipated Impacts: 1" ✓D r 77) 1
The proposed freestanding moorings will usurp 18,083 square feet of shallow bottom in these
Estuarine Waters. The proposed moorings will be in -6' nwl. There is not a cultural resource in the
nearby vicinity of the project area. These waters of Broad Creek are classified as a Primary Nursery
Area and there is no submerged aquatic vegetation present in the vicinity of the proposal. This area is
closed to shellfish harvest and is classified as SA; HQW, Nutrient Sensitive Waters. The defined State
Channel is approximately 65' south of the project area.

Dear Mr. Pugh:
The NC Division of Coastal Management hereby acknowledges receipt of your application for State approval
for development of your property located adjacent to Broad Creek at 129 Juniper Drive near Oriental, Pamlico
County. It was received on June 8, 2015 and appears to be adequate for processing at this time. The projected
deadline for making a decision is August 22, 2015. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from June 8, 2015, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include
the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to a
telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-
way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.

unable to leave a voicemail message so I thought I would send you an email....
Being that your proposal is now on the north side of the WRC channel, we just need a signed statement from the
riparian property owner, Mr. Johnson Sanbornton, (across the creek from you) granting you permission to install these 2
moorings within his riparian property area of Broad Creek.

This permit application is for the construction of two freestanding moorings located in
the waters in front of my property as described above. The mooring located on the west side,
adjacent to lot 5 owned by Miss. Eleaner Knudson, will be new and the proper setback of 15 feet
to the vessel circle will be maintained. The mooring located on the east side, adjacent to lot 7
owned by Ken Coit, is existing and is encroaching on Ken Coits' space. SEE ATTACHED

April 28, 2015
This proposed development was applied for under a General permit application and was
denied due to the location of the existing channel in Broad Creek passing through the
designated riparian corridor for the property owned by David Pugh @ lot 6 in Broadview
Subdivision. During the application process Keith Andrews, a field representative for the
NCWRC was asked to conduct a survey of the proposed site to determine the location of the
existing channel and what needs to be done with respect to the installation of the moorings I
have applied for. After his finding were examined it was determined that a major permit shall
be applied for.
The Major Permit Application will include all information required with the omission of
some inapplicable information including, wetland delineation approval, stormwater
management plan, Ocean and inlet hazard notice and consultant authorization notice.
The permit fee of $200.00 already paid for the general permit #67412C will be applied
to the $250.00 application fee leaving a balance of $50.00 to be paid with the Major Permit
Application.
The site plan I have obtained from Keith Andrews is current and accurate to the best of
my knowledge. It shows the creek as being 565ft. wide at its' narrowest point. The north side of
the channel is 225ft. from the South shoreline. Adding a 130ft. diameter mooring circle to that
equals 355ft. from the South shoreline. A riparian right of way on the North side of the creek
will remain at 210ft. from that shore.
There is a commercial dock across from the easterly mooring which will conflict with
another mooring there and the westerly mooring will be located where the creek is much wider
so no conflict will exist.

This deed, made and entered into this day of September, 2013 by and between
Matthew P. Kulick and wife, Susan S. Kulick, hereinafter referred to as "Grantor"; and
David Charles Pugh, hereinafter referred to as "Grantee". Grantor's mailing address is 1
Carriage Lane, Barnes Landing, East Hampton, New York 11937. Grantee's mailing address is
19741 NC Hwy 55, Merritt, NC 28556.
WITNESSETH:
That said Grantor, for and in consideration of valuable consideration paid to Grantor, the
receipt of which is hereby acknowledged, does grant, bargain, sell and convey unto the Grantee in
fee simple all that certain tract or parcel of land lying and being in Number Two (2) Township,
Pamlico County, North Carolina, and more particularly described as follows:
Lot Numbered Six (6) of BROAD VIEW SECTION 2, as shown on the map prepared by
Josh Nobles, entitled `BROAD VIEW SECTION 2, SURVEYED FOR MAHUGH
SLADE", dated March 27,1981, and recorded in Map Book 12, at Page 8, Pamlico County
Registry.
This conveyance is made subject to restrictive covenants dated May 26,1981, and recorded
in Book 211, at Page 641, Pamlico County Registry.
The property hereinabove described is subject to ad valorem taxes for the current year (prorated
through the date of closing); utility easements and unviolated restrictive covenants that do not
materially affect the value of the Property.
The property described above was acquired by Grantor by instrument recorded in Book
487, Page 906, Pamlico County Registry.
To have and hold the aforesaid tract or parcel of land and all privileges thereunto
belonging in fee simple forever.
And Grantor covenants with Grantee that Grantor is seized of the premises in fee simple,
has the right to convey the same in fee simple, that title is marketable and free and clear of all
encumbrances, and that Grantor will warrant and defend the title against the lawful claims of all
persons whomsoever, except for the exceptions hereinafter stated.
Title to the property described above is subject to ad valorem taxes for the current year
and utility easements and restrictive covenants of record, if any.
The designation Grantor and Grantee as used herein shall include the parties hereto, their
heirs, successors, assigns and legal and/or personal representatives.

ADJACENT RIPARIAN PROPERTY OWNER STATEMENT
June 4, 2015
In December of 2014 1 applied for a mooring permit under the General Permit
Application guidelines. You filled out an ownership statement indicating my intentions; you
signed the document and returned it to me. Unfortunately the NCDCM denied my application
due to the existing channel being located in my riparian corridor. Now I am applying for a Major
permit from the NCDCM. The same conditions apply with regards to setbacks and requirements
however I do need to inform you of this new development via registered return receipt mail.
There is no need for you to respond to this letter, just keep it for future reference.
