Maintenance Excavation 1) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the area that is expressly and specifically set forth in the attached permit application and workplan drawings. Any proposal to change the area to be excavated shall require permit modification. 2) This permit authorizes a one-time excavation activity. Any additional excavation activities may require prior approval form the Division of Coastal Management in consultation with N.C. Coastal Reserve. 3) Excavation shall not exceed —6.0' feet below normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. may be appealed by the permittee or Signed by the authority of the Secretary other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit # 80-15 Page 2 of 4 ADDITIONAL CONDITIONS 4) In order to minimize impacts, no excavation is permitted between February 15 and June 30 of any year of any year without the prior approval of the Division of Coastal Management. 5) The temporary placement or doubling handling of excavated materials within waters or wetlands is not authorized. Spoil Disposal 6) All excavated materials shall be confined above normal water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 7) Any change in the spoil disposal area shall require additional authorization from the Division of Coastal Management. Docking Facility 8) Unless specifically altered herein, this permit authorizes the additional shoreline docking facility that is expressly and specifically set forth in the permit application. No other structure, whether floating or stationary; shall become a permanent part of this docking facility without permit modification. No non - water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable water at or adjacent to authorized work. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest., 12) This permit authorizes a maximum of 11 formalized boat slips. Upland Development 13) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the redevelopment of the above referenced property all as expressly and specifically set forth in the attached workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Permit # 80-15 Page 3 of 4 ADDITIONAL CONDITIONS Shoreline Stabilization 14) The authorized bulkhead and breakwater shall adhere to the alignments depicted on the attached workplan drawings. 15) The bulkhead shall be constructed prior to any backfilling activities. 16) The bulkhead and breakwater wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by division personnel. 17) All backfrll material shall be clean and free of any pollutants except in trace quantities. 18) All backfill material shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 19) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do -not enter adjacent wetlands, watercourses or property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Easement 21) The permittee may be required to apply for a submerged land lease from the Department of Administration's State Property Office. Contact the Department of Administration's State Property Office directly at (919) 807-4650 for this determination. Should it be determined that an Easement is required, the permittee shall supply a copy of the easement to the Division within 30 days of issuance of the Easement. General 22) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 23) All portions of the access pier/walkway located over Coastal Wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. Permit 4 SO-15 Page 4 of 4 ADDITIONAL CONDITIONS 24) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. 25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 26) The permittee and/or contractor shall meet with a representative of the Division of Coastal Management prior to project initiation in order to discuss the conditions set forth in this permit. 27) No open water areas or vegetated shall be excavated or filled, outside the area indicated on the attached workplan drawings. NOTE: This permit does not eliminate the need to obtain any additional state, federal: or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) W-6491 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The applicant proposes to construct a 6ft by 83ft (498sgft) walkway to connect the structures. The bulkhead and breakwater will be along the property line at NWL. The applicant also proposes to perform 230ft x 22ft maintenance excavation in the canal to -5ft below NWL at the upstream portion of the canal and slope the canal to -6ft below NWL towards the downstream end of the property connecting to -6ft NWL of water found in the boat ramp basin (281 cubic yards). The applicant is not proposing to dredge the emergent and wetland vegetation at the upstream portion of the project. The spoil material will be disposed of on an off -site location. Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in Coastal Shorelines. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208, 15A NCAC 07H.0209 and 15A NCAC 07J.0211 as described below. Staff has reviewed the project, and the applicant has documented the need to bulkhead the property along NWL and breakwater waterward of the wetlands. If the permit is issued, staff would suggest the following conditions: DREDGE & FILL - EXCAVATION Excavation shall not exceed -6 feet below the mean low/normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. No vegetated wetlands/marsh grass shall be excavated or filled. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Bulkhead and Rip Rap Shoreline Stabilization The bulkhead alignment shall approximate the normal high/normal water level at the time of construction. 7 The bulkhead shoreline stabilization shall not extend waterward more than 2 feet from the normal water level at any point along its alignment at the time of construction. The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. WATER QUALITY & STORMWATER I I In order to protect water quality, runoff from the construction shall not visibly increase the amount of suspended sediments in adjacent waters. 17 The Division of Water Resources is currently reviewing the permit application to determine if the project is in compliance with North Carolina's Water Quality Certification program. The permittee must receive a Water Quality Certification from DWR prior to the initiation of any construction activities. With the exception of grass swales and the outlet conveyance, no portion of the proposed stormwater system shall be located within the 30 foot Coastal Shoreline buffer. Fred Willard Tyrrell County PROJECT SETTING Fred Willard has submitted a Major CAMA permit request for the redevelopment of a 0.25 acre property adjacent to a manmade canal off of the Alligator River. The project site is located at the end of SR 1316 (Gum Neck Landing) in Gum Neck, Tyrrell County. There is currently remnants of a26ft x 16ft fishing camp with 2 platforms (20ft x 7ft and 18ft x 7ft), a bulkhead,l2ft x 1 Oft skinning shed and 4ft x 80ft dock (with 8 side to slips) that the applicant plans to reconstruct with a new "base camp building," outhouse building, generator building, bulkhead, dock (with 11 side to slips), and perform maintenance excavation in the state owned manmade canal. The canal bottom is owned by the North Carolina Department of Environment and Natural Resources' Buckridge Reserve. There is currently a North Carolina Wildlife Resources Commission boat ramp to the south of the project site, and forested wetlands to the east and west of the canal and agricultural land to the north. The agriculture land has a drainage ditch that connects to the canal through a culvert with a flashboard riser that is operated by Tyrrell County Drainage District. The property is bordered by a berm that separates the farmland and the subject property and adjacent wetlands. Although the applicant's plan drawings include coastal wetlands on site these are incorrectly labeled and should be identified as vegetated wetlands. These wetlands are incorrectly labeled as coastal wetlands as they do not include the coastal wetland species as defined by the Coastal Resources Commission rules. Section 404 wetlands have been delineated on the property. The Alligator River is classified as ORW by the Environmental Management Commission and as a Joint Anadromous Fish Spawning Area by the NC Marine Fisheries Commission and Wildlife Resources Commission. The Alligator River is closed to shellfishing at the project location. Overview: The .25 acre subject property has approximately 190 linear feet of shoreline along a man-made canal that connects to the Alligator River. The canal is approximately 22 feet wide at this location. Existing water depths range from 3 to 5 feet in the center of the canal to 2 feet at the shoreline. The canal bottom is owned by the State as part of NCDENR's Buckridge Reserve. A boat basin is located within the canal just south of the property. The property is wooded with uplands and two (2) areas of Section 404 Wetlands. The property is located within the AE floodzone. Existing site improvements consist of a damaged 26 foot by 16 foot building, a 7 foot by 20 foot platform, a 7 foot by 18 foot platform and a 12 foot by 10 foot shed. Existing shoreline improvements include remnant bulkhead and a 4 foot wide by 80 foot long dock with eight (8) boat slips. The primary building was used as a field station bunkhouse. The property has historically been used by local fisherman and hunters. A review of Submerged Aquatic Vegetation (SAVs) was not provided. A review of potential historic/archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: the shading of 828 sq. ft. of Section 404 Wetlands and 870 sq. ft. of Uplands, and; the dredging of 5,060 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Some of the shading will occur within the Estuarine Shoreline AEC. Basis for Determination: The Tyrrell County/Town of Columbia Land Future Land Use Plan Map identifies the site area as 'Residential - Agricultural". Avg., created from boat launching and loading. The owner plans to dredge the Buck Ridge Canal to a consistent water access depth of 6' maximum depth. The current canal water depths vary from 2.5' to 5', and the bottom is heavy with silt deposit. Dredge can operate from the uplands and excavate the canal without impact to wetlands. All dredged material will be loaded and trucked to an offsite location for stockpile and storage. The existing bunkhouse ( 608 sq.ft.), is severely damaged and will be totally replaced. The new field station will be 24' x 24' ( 576 sq.ft.), in nearly the same footprint as before. The plans do include a 6' porch on 2 sides and walkway to the outhouse. A generator will be located on the backside of the field station and will be covered by roof ( 4' x 13' = 52 sq.ft. ), this is using the square footage of the skinning shed that is to be removed. Contractor will be Jeff Mosley and Assoc. for this project. They will barge in a vibrating hammer and materials as needed for the bulkheading. The vibrating hammer will be supplemented with some manual labor. The dredging will be from a long reach backhoe. Dump trucks will haul the dredged material away. This project will be beneficial to all concerns, with the resulting enhancement of the recreational area becoming closer to regulated compliance. The continued historical uses by local hunters and fishermen, the new location of a field station for research of the historic area, the improvement of site conditions and oversite by responsible ownership, should lead to improved relationships with the adjoining ownership and the agencies that are involved in the area. Cleaning up the site and organizing the use should encourage better long term maintenance of the site and less non-compliance issues for the future. The owners are trying to enhance their existing recreational access. They plan to bulkhead 150' and breakwater 40' (along the eastside of the Buck Ridge canal).
