other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification notcovered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2002
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

Dear Mr. Safrit:
This is in response to your recent letter concerning renewal of the Marsh
Harbor Resorts Coastal Area Management Act Permit (Permit No. 11'-97), for
which a Major Modification was recently issued. Your letter indicated that
you wished for the permit be renewed, and were of the belief that such a
renewal would be made at the time the major modification was issued.
However, in order to issue a renewal of this permit, a specific request, in
writing, must be made to the Division's Wilmington Regional Office, along
with a check for $100. Because this request and fee were not made at the time
of your recent application, the Division was unable to issue a renewal for your
project at that time. With this in mind, if you would submit the request letter
and processing fee to DCM's Wilmington office, we should be able to issue
an extension to the permit before the end of the year. Please be aware that the
Rules of the Coastal Resources Commission do not allow for permit
extensions in excess of two years. Additional two year renewals may be
available in the future if work has begun and is continuing on the project.

In accordance with the issuance of the subject permit on July 31, 2000, enclosed you will find the
signed copy of the permit as requested in your cover letter.
As we had briefly discussed previously, I was under the impression that our permit would have
been processed as a renewal since the permit is scheduled to expire December 31, 2000. I am
sorry if the renewal intent was not clearly communicated in our application or other
communications but I thought that with such a short time frame remaining until expiration,
renewal would have been in order. We would appreciate if you could administratively take the
steps necessary to issue the permit for a ten- (10) year period.
If this can not be handled in an administrative manner, please provide me the details necessary to
accomplish this task. If you have any questions regarding these matters, please do not hesitate to

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(buff -colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698
within twenty (20) days of this decision on your permit. You should also be aware that if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be
resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any
appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance require additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

In accordance with the attached letter dated October 4, 2000, from Mr. Doug Huggett,
please accept this letter as our formal request to renew CAMA Permit No. 11-97. Enclosed
you will find a check for $100 to address the processing fee.
The subject permit was issued July 31, 2000, to reflect a major modification that included
substantial modifications to the previous plan for the development. These changes required
many years of cooperative work with the Town of Calabash and other interested parties to
enhance the development plan. The scope of this project is large and very complicated due
to the project being bisected by the North Carolina / South Carolina state line.
The current plan for the North Carolina portion of the property includes a proposed nine
hundred (900) unit (or keys as known in the resort hotel industry) resort hotel and
convention center; an existing high ground marina (257 slips permitted — 120 existing);
eighty (80) townhome units; sixty six (66) mid -rise condominiums units; an existing golf
course (Marsh Harbour Golf Links); a proposed Sports Center; a proposed Office Center
and associated infrastructure for the development. These plans have not chanu from the
plans submitted with the major modification request that was approved July 31, 2000.
Please renew the permit for the maximum period allowed under North Carolina General
Statutes and Administrative Code. If you have any questions or desire a meeting regarding
