This permit, issued on May 11, 1993 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Bridge Construction
1) The area of the opening associated with the culverts will be equal to or
greater than the area currently available for tidal exchange and
ingress/egress of aquatic organisms.
2) In order to protect populations of juvenile finfish and crustaceans, no
construction, including excavation or filling will be permitted between the
dates of April 1 and September 30 of any year without prior approval by the NC
Division of Coastal Management in consultation with the NC Division of Marine
Fisheries.

3) A silt screen will be placed immediately upstream and downstream of the

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.

project site prior to any excavation and not removed until 24 hours after the
completion of all'excavation.
4) No excavated or fill material will be placed at anytime in any marsh or
surrounding waters outside of the alignment of the fill area indicated on the
workplan drawings.
5) -All fill materials will be obtained from a highground source and placed in
accordance with permit plans.
6) The fill material will be clean and free of any pollutants, except in trace
quantities.
7) The temporary placement or double -handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
NOTE: The proposed work is covered by Water Quality Certification
#2823 issued by the NC Division of Environmental Management
on.4/19/93.
Erosion and Sedimentation Control
8) A permanent ground cover sufficient to restrain erosion will be provided on
all exposed areas within the shorter of 15 working or 60 calendar days after
project completion.
9) Appropriate erosion and sedimentation control devices, measures, or structures
will be used to prevent sediment from entering the adjacent
wetlands/watercourses/property,(e.g., silt fence, diversion swales/berms, sand
fence, etc.)
10) The slopes of the fill will be at an angle no steeper than 2H: 1 V.
11) A ground.cover sufficient,to restrain erosion will be provided within 15
working days of completion of any phase of grading on cut or filled slopes.

Dear Colonel Tulloch:
The National Marine Fisheries Service (NMFS) has reviewed Public
Notice 199203615(GP) dated March 22, 1993, whereby the N. C.
Department of Transportation proposes to place fill in wetlands
adjacent to Pamlico Sound near Swan Quarter, Hyde County, North
Carolina.
The proposed work consists of replacing an existing bridge with two
metal culverts. Fill material will be placed in 0.03 acre of tidal
creek bottom and 0.01 acre of Juncus roemerianus marsh. Concrete
headwalls will retain the fill. Prior to culvert installation, the
area will be de -mucked with resultant spoil material being placed
in a high ground disposal site.
Based on an April 12, 1993, on -site inspection by a NMFS biologist,
we have determined that this project, as proposed, would be
detrimental to fishery resources due to the alteration of tidal
exchange with the adjacent marsh and Pamlico Sound. The existing
bridge has a 24-foot-wide opening, however, the proposed culverts
have a total width of 13.83 feet resulting in an 11 foot reduction
in the area available for water flow.
Tidal creeks and Juncus marshes adjacent to Pamlico Sound provide
valuable forage and nursery areas for a variety of estuarine
dependent species. These species include flounders (Paralichthvs
spp.), spotted seatrout (Cynoscion nebulosus), blue crab
(Callinectes sapidus), penaeid shrimp (Peneaus spp.), Atlantic
croaker (Micropocfonias undulatus), and spot (Leiostomus xanthurus).
The larvae and juveniles of these species are dependent upon these
areas for cover and as a source of organic detritus which forms the
basis of estuarine food webs. Reduction in tidal exchange in these
areas would result in a decrease in available nutrients and habitat
for these species.

In view of the above, we recommend that this permit not be issued
unless the area of opening associated with the culverts is equal to
the area currently available for tidal exchange and ingress/egress
of aquatic organisms.

SUBJECT: NCDOT Bridge No. 48 Replacement, Swanquarter, Hyde County
This proposal is for the replacement of the existing bridge over Oyster Creek,
Swanquarter, North Carolina, SR 1128 with 2 metal culverts and associated fill
of both coastal wetlands AEC's and creek bottom according to the proposal, Oyster
Creek is classified as SA, ORW by the Environmental Management Commission. This
proposal comes under the auspices of the May 1992 CRC Certified Hyde County Land
Use Plan Update which provides the following guidance on proposals of this type:
The Transportation section of the data collection and analysis section of the
Plan (pg. II-11) notes only the replacement of Bridge No. 50, canal bridge on US
264. This section of the Plan is silent on Bridge No. 48.
County policy on ORW (pg. IV-7) is : "Hyde County objects to any mainland water
areas being designated as Outstanding Resource Waters and desires to have the
Alligator River and Swanquarter Bay/Juniper Bay area ORW designations repealed."
County policy on Commitment to State and Federal Programs (pg. IV-13) includes
the following: "Hyde County is receptive to all State and Federal programs which
provide improvements to the County. The County will continue to fully support
such programs, especially the following: The North Carolina Department of
Transportation road and bridge improvement programs, the CAMA planning process
and permitting programs, and the Community Development Block Grant programs.
However, the County objects to 404 wetland regulations and the designation of
outstanding resource waters within the County."
The County's transportation policy (pg. IV-15 thru IV-16) is silent on this
proposal.
County policy on Industrial Impacts on Fragile Areas (pg. IV-6) includes the
following: "Industrial development which can comply with the use standards
specified by 15 NCAC 7H and applicable ORW management plans may be located within
conservation classified areas."
The County's Land Classification Map (III-3) shows Swanquarter in the Developed
Land Class. That class provides for the full range of land uses and varying
densities with the provision of necessary urban services to support urban
development. Note 3 on the map is as follows: "All waters of Hyde County are
classified as Estuarine Waters as described by 15A NCAC 7H .0206, or Public Trust
areas as described by 15A NCAC 7H .0207. In areas not designated as Outstanding
Resource Waters or Primary Nursery Areas, all development shall be consistent
with the use standards contained in 15A NCAC 7H .0206 and .0207."

While no specific mention of this proposal is noted in the Hyde County Land Use
Plan, I believe if the proposal can be accomplished in accordance with applicable
AEC and other State and Federal regulatory standards, the proposal will not be
inconsistent with the spirit of the County Plan.

8. PROJECT SUMMARY: The applicant proposes to replace an existing bridge
with two metal culverts.
Project setting
The N. C. Department of Transportation's (NC DOT) proposed bridge replacement site
is located on SR 1128 at Bridge No. 48 crossing Oyster Creek in Hyde County, North Carolina.
The bridge is bordered on the west by coastal wetlands primarily vegetated with Juncus
roemerianus and containing S artina altemiflora and some S. Patens. The bridge is bordered
on the northeast by a developed lot with a dock and building and on the southeast by a spoil
bank containing pines, cedars, and mixed shrubs and grasses. The spoil bank gives way to
coastal marsh Vegetated primarily with J. roemerianus and containing S. Patens and some S.
alterniflora. The site is approximately 2' to 3' above mean sea level. Oyster Creek is classified
as SA ORW by the Environmental Management Commission.
Project description
NC DOT proposes to replace an existing ±28' X ±24' bridge with two - 128" X 83"
X ±50' long metal culverts and fill an area approximately 50' X 70'. Concrete headwalls are
proposed toretainthe fill. The fill area consist of approximately 1,500 ft2 of creek bottom and
500 ft2 of coastal wetlands. Prior to the placement of the culverts and filling, the area will be
mucked out and the spoil material transported to a highground disposal site.
Anticipated impacts
The project as proposed would result in the filling of approximately 500 ft2 of coastal
wetlands and 1,500 ft2 of creek bottom. Localized turbidity would occur as a result of the
mucking out and filling activities. -

In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view;.and cross
sectional drawings) drawn to scale in black ink on an 8
12 x 11 white paper. (Refer to Coastal Resources
Commission Rule 71.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies ate provided by applicant (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be.sufficiently detailed
to ide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.

adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments

Oyster Creek on SR 1128.

The North Carolina Department of Transportation (NCDOT)
intends to replace :he above -mentioned bridge in Hyde County.
This bridge must be replaced due to its deteriorated
condition. The bridge will be replaced on existing location,
and the road will be closed during construction for about one
month. No temporary detour structure will be necessary. The
replacement structure will consist of two 128" x 83"
corrugated steel pipe arches with headwalls. This will
require the placement of 360 cubic yards of fill below
ordinary high water. The total fill in wetlands will be less
than 0.01 acres, with 0.02 acres of fill in open water. Any
temporary impacts from erosion and sedimentation will be
minimized using NCDOT best management practices, which your
agency has reviewed.
NCDOT hereby applies for the CAMA Major Development
•permit as required for this project. A copy of this
application is being provided to the U.S. Army Corps of
Engineers and the N.C. Division of Environmental Management
for their -,review. If you need any additional information,
