Bridge Construction 1) In order to protect populations of finfish and crustaceans, no work will be permitted between the dates of February 1 and June 30 of any year without prior approval of this Division in consultation with the Division of Marine Fisheries. 2) Vertical and horizontal navigational clearances shall be no less than that shown in the August 6, 1993 application and the July, 1993 supplemental sheet 1 of 1. 3) The seal between the wing walls and the pipe arch should be adequate to prevent continual seepage of backfill into the canal. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. OCT 12 1993 -- ----------- SUBJECT: f Replacement of Bridge over Oyster Creek with an aluminum structural plate pipe arch on Ocracoke Island in Hyde County The applicant proposes to replace an existing 10' wide by 54' long bridge with an 18' wide by 11'4" aluminum structural plate pipe arch approximately 35' long. If the permit is issued, I recommend the following conditions. CONDITIONS 1. Vertical and horizontal navigational clearances must be maintained at least that proposed in the 6 August 1993 application and as shown on the July 1993 supplemental sheet 1 of 1. 2. The temporary or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 3. No excavated or fill material will be placed at anytime in any marsh or surrounding waters outside of the alignment of the fill area indicated on the project drawings dated July 1993. 4. M EM0R.ANDUM TO: Ted Tyndall FROM: John Crew DATE: 17 August 1993 SUBJECT: Bridge Replacement - Ocracoke Village - Hyde County This proposal involves replacing an existing bridge in Ocracoke Village over Oyster Creek with an aluminum pipe arch and falls under the auspices of the May 1992 CRC Certified Hyde County Land Use Plan Update. The Plan (Ocracoke Island Section) offers the following on proposals of this nature: The Ocracoke Section of the Plan places a high regard and emphasis on protecting the abundant natural/marine resources that make Ocracoke an interesting place to live and visit. This theme is noted throughout the Plan. Much emphasis is placed on protecting Ocracoke's shorelines, State regulated wetlands and Federal (Army Corps of Engineers 404) wetlands. A narrow reading of the resource protection policy section of the Plan notes significant language to protect the aforementioned resources. Yet, County policy on commitment to State and Federal programs (Pg. IV-19) includes; "The County will continue to fully support such programs, especially the North Carolina Department of Transportation road and bridge improvement programs and ferry service, which are vital to Ocracoke." The proposal project site is shown in the Developed Classification on the Land Classification Map. This class acknowledges urban development with the full range of services necessary to support urban level development activities. FIELD INVESTIGATION REPORT: N. C. Department of Transportation/Hyde County PAGE #2 C 9. NARRATIVE DESCRIPTION: Project Setting The project is located at the first bridge on the extension of SR 1362 entering Oyster Creek Ranks Subdivision on Ocracoke Island in Hyde County, North Carolina. The existing bridge is approximately 10' wide by 54' long. The bridge crosses a 55' to 60' wide channelized section of Oyster Creek and is immediately upstream from the manmade canal system that flows into the Pamlico Sound from a. westwardly direction. Boat traffic is prevalent in the canal and numerous docks exist upstream from the bridge. Average water depths are 3' to 4' below MHW. Adjacent each terminus of the bridge are undeveloped upland lots created decades ago through filling activities. Vegetation along both banks of the canal/creek are typical of areas with this origin and include scattered live oak Ouercus vir ing iana, wax myrtle Myrica cerifera, and Yucca spp. Herbaceous species present include the marsh pennywort Hydrocotvle bonariensis. Various grasses and vines including a small amount of salt meadow hay Sp2gin atens and black needlerush Juncus roemerianus grow on the canal/creek bank above the high water mark. The waters of the canal/creek are classified SA by the Division of Environmental Management. The canal/creek is not a Primary Nursery Area and is closed to shellfishing by Shellfish Sanitation. Project Description The applicant proposes to replace the existing bridge with an 18' wide by 11'4" tall aluminum structural plate pipe arch 35' long. An area approximately 35' X 18' X -0.5' (approximately 12 yds') will be excavated prior to placement of the pipe arch. Interlocking sheet pile bulkhead will confine and fill material to within the road right-of-way crossing the pipe arch (approximately 160 yds'). The source of the fill material is the dredge spoil disposal area at the north end of Ocracoke. Upland fill areas measuring approximately 100' by 25' on each end of the existing bridge will be filled and graded for the approaches. The travelways will be gravel. FIELD INVESTIGATION REPORT: N.C. Department of TransportatioWHyde County PAGE N3 Anticipated Impacts The project as proposed would result in the loss of approximately 2,030 fe of creek/canal bottom which includes 1,400 W of earthen fill and 630 ftz of pipe. Localized turbidity will occur as a result of excavation and filling activities. Navigation on the creek/canal would be impeded during construction activities but no long-term negative impacts are anticipated. The proposed horizontal clearance would be approximately 18' at normal water level but would decrease to approximately 8.5' near the top of the arch. Currently, there is a horizontal clearance of two 18' spans on each side of an existing center piling. Vertical clearance would be approximately 7' in the center of the arch, an increase of two feet of clearance from the bottom of the existing bridge. The width of the crossing will increase from 10' to 12'. No wetlands will be filled. M. The North Carolina Department of Transportation is proposing to replace a bridge over Oyster Creek in the Town of Ocracoke in Hyde County. The bridge will be relocated on existing location, and will be replaced with a 18' x 1114" aluminum structural plate pipe arch approximately 35' long. The structure will provide one 12 foot gravel travelways and one three foot shoulder in each direction. The roadway grade will be slightly elevated. No paving of the approaches or bridge surface is proposed. It is proposed that traffic be maintained on the _ existing bridge while the majority of construction work takes place underneath the structure. The old bridge will then be removed, after which final grading and gravel placement will take place. By utilizing this construction method, the bridge and boating access under the bridge should only be blocked for one day. Arrangements are being made to notify local residents of the closure, and to provide any emergency services that may be required. The U.S. Coast Guard will also provide NCDOT with a form letter notifying users of Oyster Creek that the creek will be closed to boat traffic , for one day. NCDOT will fill in the date the bridge is expected to be closed, and will then distribute the letter to all properties upstream of the bridge on Oyster Creek at least 10 days prior to the bridge closing. The proposed activity will lead to the placement of. approximately 160 cubic yards of fill below ordinary high water. Approximately 12 cubic yards of material will be excavated from the bottom of Oyster Creek toallow for placement of the pipe arch. it does not appeary submerged aquatic vegetation exists in the area of proposed work. No fill in wetlands will.take place. The Department is also proposing to widen the approaches to the bridge (see sheet 3 of 4). The proposed aluminum structural plate pipe arch will allow for one 18' wide open water travel lane in the middle of Oyster�Creek, while the present structure allows for two 18' wide lanes to either side of the central support structure in the middle of the creek. However, due to shallow depths near the stream banks, only approximately 15' of the 18' lanes area currently usable to most boat traffic. The proposed structure will also provide a two foot higher vertical clearance in the middle of the channel (see supplemental sheet 1 of 1). The proposed horizontal clearance at the elevation of the bottom of the existing bridge will be 11.51. Local residents who use boats in Oyster Creek have requested a 10' minimum horizontal width at the elevation equal to the bottom of the existing bridge. Therefore, it does not appear that the traditional and current uses of Oyster Creek will be limited. Please note that the profile drawing showing the proposed pipe arch (sheet 4 of 4) is an approximation, and is not drawn totally to scale due to difficulties associated with the utilization of different vertical and horizontal scales. Supplemental sheet 1 of 1, which was supplied by a contractor to NCDOT, does accurately depict the proposed pipe arch. This roadway and bridge have previously been in private ownership. NCDOT is currently in the process of obtaining the roadway and bridge and adding both to the state highway system. NCDOT assures all concerned that all required properties will be in state ownership before commencement of any construction activity. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. Included for your information is a permit application package, including permit application form, permit drawings (sheets 1 of 4 through 4 of 4 and supplemental sheet 1 of 1), and evidence of adjacent property owner notification. A processing fee of $250 is also included. This project may be authorized by 404 Permit 14 (Road Crossings) from the U.S. Army Corps of Engineers, and by 401 General Certification 2732 from the N.C. Division of Environmental Management. Because all fill will be confined to Waters of the U.S., and no fill will take place in special aquatic sites, including wetlands, formal notification to these agencies is not required. We are therefore providing one copy of this application package to the Corps of Engineers for information purposes only. The N.C.
