This permit, issued on July 1, 1992 . is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these tents may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) Navigational clearance must be at least that of the present bridge
structure.
2) In order to protect the nursery area characteristic of Little Creek, no
excavation or filling within the waters or adjacent wetlands may take
place between April 1 - September 30.
3) The temporary or double -handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
4) No excavated or fill material will be placed at anytime in any marsh or
surrounding waters outside of the alignment of the fill area indicated on
the project drawing. ,

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance worst or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on

Coastal Management Program.

5) In order to protect water quality, runoff from the construction area must
not visibly increase the amount of suspended sediments in adjacent
waters.
6) A silt screen will be placed immediately upstream and downstream of the
project site prior to any excavation and not removed until 24 hours after
the completion of all excavation.
7) A permanent ground cover, sufficient to restrain erosion, must be
provided on all exposed areas_ within the shorter of 30 working or 120
calendar days after project completion on all affected areas, including
road shoulders.
8) Appropriate erosion and sedimentation control devices, measures, or
structures must be used to prevent sediment from entering the adjacent
wetlands/watercourses/property (e.g., silt fence, diversion swales/berms,
sand fence, etc.).
9) All construction ruts will be smoothed upon project completion to reduce
mosquito breeding habitat.
NOTE: The Division of Environmental Management has authorized this project
under General Water Quality Certification No. 2675 issued on May 8,
1992.

Permit No. CESAW-0082-N-000-0031.

This letter is in reference to CAMA Major Permit No. 66-92 issued to your
Department for the replacement of Bridge No. 314 over Little Creek in Beaufort County,
North Carolina. The N.C. Department of Transportation (NC DOT) was issued CAMA Major
Permit No. 66-92 on 1 July 1992 for the replacement of Bridge No. 314 with 3 - 45' long
culverts.
Mr. H.E. (Hank) Norfleet talked with David Hoye of my staff on 18 September 1992.
Mr. Norfleet contends that he is the owner of record of the property on the north side
of Little Creek on both sides of NC DOT's right-of-way. The application package
submitted to this office by NC DOT showed Cora E. Ellis and Dorothy W. Topping as
adjacent riparian property owners. Mr. Norfleet also stated that NC DOT right-of-way
was only 30' wide measured from center of shoulder ditch to center of shoulder ditch.
NC DOT's application package contained plat Sheet 2 of 2 (revised 22 April 1992) which
shows a right-of-way of 60' measured 30' each side of the center line.
Subchapter 7J of the NCAC Section .0202(c) says "regardless of whether any advise
or information was provided by other persons, including department officials, the
applicant is responsible for the accuracy and completeness of the information provided
in the application". Therefore, I request that any and all "Development" authorized
by CAMa Permit No. 66-92 be suspended until proper notification including sufficient
time to comment can be accomplished and questions regarding right-of-way, etc. can be
addressed. If necessary, depending upon information gathered, modification of existing
plats may be required.

8. PROJECT SUMMARY: The applicant proposes to replace an existing bridge with
three metal culverts.
Project setting
N.C. Department of Transportation (NC DOT) proposed bridge replacement site is
located on SR 1721 at the Little Creek crossing in Beaufort County, North
Carolina. The bridge is bordered on both sides by coastal wetlands primarily
vegetated with Juncus roemerianus and containing Spartina alterniflora and some
S. patens. Adjacent to the marsh are wax myrtle, pines, shrubs and a few mixed
hardwoods scattered with upland grasses. The site is approximately 2'-3' above
mean sea level. Little Creek is classified as SC NSW by the Environmental
Management Commission.
Project description
NC DOT proposes to replace an existing 20' x 25' bridge with three - 67" x 95"
x 45' long metal culverts and fill an area approximately 45' x 50'. Concrete
headwalls are proposed to retain the fill. The fill area consist of
approximately 1,306.8 ft2 of creek bottom and 871.2 ft of coastal wetlands.
Prior to the placement of the culverts and filling, the area will be mucked out
and the spoil material transported to a highground disposal site.
Anticipated impacts
The project as proposed would resu2lt in the filling of approximately 871.2 ft2
of coastal wetlands and 1,306.8 ft of creek bottom. Localized turbidity would
occur as a result of the mucking out and filling activities. The replacement of
the existing bridge with culverts would impact navigation upstream of the bridge.

SUBJECT: NCDOT Bridge Proposal: SR 1721, Beaufort County
This proposal is for a bridge replacement and falls under the auspices of the
December 1987 CRC certified land use plan update for Beaufort County.
The 1987 plan provides the following limited guidance on proposals of this nature:
Page 48 - Policy on preservation and protection of AEC's.
"a. Support development in AEC's only if such development meets the management
objectives in 15NCAC 7H .0203 and the use standards in 15NCAC 7H .0208 and
.0209.
No other policy guidance is noted in the 1987 plan on proposals of this nature.
The Land Classification System shows this area in the Rural land class. That
classification (page 73, 74.1) calls for the following:
"4. Rural
As shown on the Map of Land Classification, most of the County has been
classified Rural. Agricultural, silvacultural, and low density residential
uses predominate in Rural areas. The results of the 1987 public survey
indicate that many residents appreciate the rural character of the Beaufort
County area. The County supports continued use of its Rural lands for
farming and forestry activities that meet the policy objectives outlined in
its Land Use Plan. Residential development is also deemed an appropriate
use of Rural lands, however the density of that development should not
necessitate public or private water or sewer service. Large lots would
characterize residential development in Rural areas, and project density
would be low, generally less than or equal to one unit per acre."

Given the very limited guidance in the 1987 Beaufort County Land Use Plan, I can
only assume that if this proposal is constructed in accordance with the AEC
standards it would not be inconsistent with county policy on development within
AEC's. No guidance can be determined from the counties Land Classification System
by this reader on this proposal.

The preferred alternative would be to replace the bridge in kind. If the permit
is issued to replace the bridge with culverts I suggest the following conditions:
CONDITIONS

The North Carolina Department of Transportation (NCDOT)
intends to replace the above mentioned bridge upon the
recommendation of our Bridge Maintenance Unit. We applied
for the CAMA permit for this activity on November 4, 1991.
This application was returned with a letter dated November
20, 1991 by David Moye of your Washington Office. Mr. Moye
requested several items of additional information.
The changes he requested in the plat and application
have all been addressed. Although the CAMA application form
does not require the headwall information, we have included
it per his request. We have also enclosed a map shorting the
location of the spoil disposal area. Mr. Moye's letter
indicated that he did not receive postage receipts to
indicate notification of adjoining property owners. The two
adjoining property owners were notified at the time of our
initial application and the receipts are enclosed.
