Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) Silt screens must be erected between the spoil area, adjacent wetlands, and Fodrev Creek before deposition of any fill material commences. These silt fences must be maintained until the fill materials are vegetated. No fill materials should be deposited in or allowed to enter adjacent wetlands or Fodrey Creek. 2) No fill material, other than topsoil for the purpose of planting vegetation to increase the stability of the site, will be placed within the 30' ORW buffer zone. A vegetative cover in this area must be provided with 30 working or 120 calendar days after project completion. 3) The fill area must be properly graded. Slopes must be at an angle no steeper than 1-1/2 H : 1 V. 4) The alignment of the 30' buffer zone must be flagged by a representative from the Division of Coastal Management prior to project initiation. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1993 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Your request to modify the aforementioned permit to allow the installation of a 55, long wooden bulkhead to help retain permitted fill material is hereby authorized. All permit conditions including the 31 December 1993 expiration date still apply and remain unchanged. Your modified plat illustrating the authorized change will become a part of ,your permit and file and construction should be accomplished accordingly. PROJECT SUMMARY: The applicant is proposing to place fill material on top of an existing + 9460 sq ft spoil bed within an ORW designated area in order to create an access area for his commercial seafood operation. The spoil bed is sparselV ve e tated with J. roenerianus, Scirpus spp., S. patens, D.spicata and a variety of other species including wax myrtles, cedars, broomstraw and other upland grasses. The area outside of the 30' ORW buffer zone will be filled with Crush & Run stone. Project setting The applicant's property is located in Hyde County off SR 1129 near the Town of Swan Quarter adjacent the south side of Fodrey Creek. Fodrey Creek is located within the Swan Quarter Bay Outstanding Resource Waters Area. This area includes a 575' Estuarine Shoreline Area of Environmental Concern and a buf- fer zone of at least 30' from the mean high water line. The site is + 2' above MSL and is bordered on the west side by a boat basin and a homogeneous Juncus ►oemr rianus marsh on the east. As a result of the previous excavation and maintenance activities of the existing boat basin on the adjacent property, there is an existing + 9460 sq.ft. spoil bed -located on the project site. The spoil bed is vegetated with a variety of upland grasses, broomstraw, wax myrtles, cedars, and a sparse mixture of Juncus roemerianus, .Scirpus spp., Spartina patens, and Distichlis spicata. Based upon information provided by the applicant this boat basin excavation occurred prior to permit requirements. The adjacent coastal waters are classified as SA-ORW by the Environmental Management Commission. Project description The applicant is proposing to place fill material on top of an existing + 9460 sq.ft. spoil bed within the boundaries of the ORW Estuarine Shoreline AEC. The purpose of the proposed activity is to create a stable access area for the ac- tivities associated with the loading and unloading of commercial fishing boats. The portion of the project site within the 30' ORW buffer zone will be filled with topsoil and revegetated with a mixture of upland lawn grasses to increase the stability of the site. The portion of the project site outside of the 30' ORW buffer zone will be filled with topsoil and covered with a.4" layer of crush & run stone; this area will be used as an access and turn -around area for large trucks. Anticipated impacts The project as proposed will result in the filling of + 9460 sq.ft. of Estuarine Shoreline within an ORW area. This will result in the filling of approximately 946 sq.ft. of J. rnnrmr9anus, Scimpus spp., S. patens, and D_ spicata growing on top of an existing spoil bed and at an elevation higher than the adjacent wetlands. Inundation of this area is questionable at best and any flooding would result from only an extreme flood tide occurrence. Raleigh W. If the applicant is not claiming to be the owner of said property, then for- ward a copy of the deed or other instrument under which the owner claims title, plus written permis- sion from the owner to cant' out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on 8 rh x 11 white paper. (Refer to Coastal Resources Commission Rule 7).0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant. A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency per- sonnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. These individuals have 30 days in which to submit com- ments on the proposed project to the Division of Coastal Management. The applicant must advise the adjacent landowners of this opportunity by sen- ding a copy of the permit application to them by registered or certified mail.
