Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 5) The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 6) The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. 7) The breakwaters must be marked at the waterward end with a yellow reflector extending at least three feet above the normal water level. GENERAL 8) Prior to any work being done at the site, a pre -construction meeting shall be held between the applicant and a representative of DCM. 9) All work authorized by this permit must be performed in strict compliance with the permit plans. 10) If any work is conducted from a barge, no work channels shall be excavated to enable equipment to reach the site. 11) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. The application involved a shoreline stabilization project at the Pamlico River ferry basin and adjacent properties owned by Mr. H.G. Roper and Mr. Keith Mason in Beaufort County, North Carolina. During this conversation I relayed deficiencies to him concerning the application package. Mr. Gottfried acknowledged that he understood my concerns and stated that he would re -submit a complete application package for review noting the following deficiencies that were discussed: (1) La. NC DOT is not the only land owner in regards to this project. DOT is also performing development activities on the properties of Mr. H.G. Roper and Mr. Keith Mason. These two individuals must also be included in this section along with NC DOT. (2) l.b. This section was left completely blank. NC DOT should be listed in this section as authorized agent. (3) 4.a. Should be completed for entire tract on which project is proposed. (4) 4.b. The development activities will occur on three individual pieces of property - NC DOT, H.G. Roper and Keith Mason. Sizes of all three properties should be listed. (5) 4.f. Other manmade features exist other than ferry basin, e.g. pier on Roper property- (6) 4.1. (11) Plats (a) In general the plats were very light making reproducing difficult. I have requested darker plats. (b) Plat 7 of 7 was laid on the copy machine wrong and only one-half of the plat was copied. This entire plat needs to be submitted. (c) Plat 3 of 7 - normal water line needs to be shown. I hope this listing of deficiencies will be beneficial to Mr. Gottfried in completing this application package. As you are probably aware, I first met with NC DOT officials at this site in October 1994. Upon a review of the proposal and discussions with other Division of Coastal Management staff members, it has been determined that an Environmental Assesment as required by the North Carolina Environmental Policy Act (NCEPA) is needed for this project due to the excavation of a new navigation channel. The purpose of the NCEPA is to provide a method by which decision makers may consider environmental aspects and consequences of a proposed development. When an Environmental Assesment is required for a project, an initial environmental document review must be completed by the DCM prior to the submittal of a CAMA Major Development Permit application package. Due to this requirement, I am returning the application package that you submitted. This package has several defencies that I will not go into detail at this time, however, these will need resolving prior to resubmittal. We can discuss these at a later date at your request. Public Trust, Estuarine Shoreline and Estuarine Water AECs are involved. The plan offers the following limited guidance on proposals of this type: • County policy on AECs (page VIII-4) note "c. Support development in AECs only if such development meets the management objectives in 15 NCAC 7H.0203 and the use standards in 15 NCAC 711.0208 and .0209." • County policy on State and Federal Programs (page VM-19) include "The county remains committed to state and federal programs in planning areas, where applicable, related to community and economic development, including erosion control, public access, highway improvements, port facilities, dredging and military facilities." • By definition (page IX-9) the Conservation land classification includes all AECs. County policy is to support development within AECs only if it meets appropriate use and performance standards. • Non AEC portions of this proposal are shown in the Limited Transition land classification on the county's land classification map. That class (page IX-5) calls for emerging intense urban type development and the provision of services to support that type development. PROJECT SUMMARY: The applicants are proposing shoreline stabilization measures at the Bayview Ferry and on two privately owned adjacent properties. /i NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DORA ROPER AND ROLAND MASON Pamlico River Ferry Basin (North Dock) Beaufort County Environmental setting The project that is being proposed by this application will be located on properties owned by NC DOT, Dora Roper, and Roland Mason. NC DOT is acting as agent for Mrs. Roper and Mr. Mason. The NC DOT property is the Pamlico River ferry basin located at Bayview on the north side of the Pamlico River in Beaufort County. Mrs. Roper is an adjacent riparian property owner located to the east of the NC DOT property. Mr. Mason is also an adjacent riparian property owner located to the west of the NC DOT property. The NC DOT property has located on it the ferry loading facilities, along with offices and restrooms. The majority of the basin has a concrete bulkhead, however, riprap has been placed on both the east and west sides of the basin. There is an area on the east side vegetated with SSaartina cynosuroides which has no riprap, and an area on the west side vegetated with pines which has no riprap. The majority of Mrs. Roper's property is vegetated with S_ an rtina cynosuroides. A small boat basin is present into which is, a ± 15' long pier. Mr. Mason's property is a mixture of upland pines and Spartina cynosuroides. The majority of the property is used as a pasture, and heavy grazing is occurring within the coastal wetlands. Present on the property is a barn and single family dwelling. Proiect proposal The applicant is proposing the following: (1) NC DOT property - the placement of 165' of riprap near the eastern property line. The riprap, which will be a continuation of existing riprap, will be placed so that it will average 1.5' beyond the NWL. The riprap will be placed at the toe and waterward of an area of marsh vegetated with Snartina cynosuroides. _ See plat 3 of 7 for details. (2) Dora Roper property - the construction of a 45' long by 15' wide bottom width rock breakwater. The breakwater will have a 3.0' wide top width and will extend above the NWL by 0.5'. The purpose of the breakwater is to help protect an area which is being utilized as a boat basin. See plat 3 of 7 for details. (3) Roland Mason property - the placement of 175' of riprap near the NC DOT western property line: The riprap, which will connect to existing NC DOT riprap, will be placed so that it will average 1.5' beyond the NWL. The majority of the riprap will be placed along a wooded shoreline, however, the southern most portion will be adjacent to an area of Spartina cynosuroides. (2) Dora Roper property - ±675 square feet of open water area will be filled by the construction of the rock breakwater. (3) Roland Mason property - ±262.5 square feet of open water area will be filled by the placement of the riprap. David L. Please find enclosed a copy of the CAMA Permit application, drawings, deed of adjacent property owners, tax map, letters of consent and a copy of the fee check for the above referenced project. The proposed action includes the installation of rip rap along 340 feet of shoreline and the placement of a 45 foot breakwater to protect the adjacent properties shorelines from erosion. The majority of this work will be performed on existing NCDOT property. However, the placement of the breakwater and some of the shoreline stabilization will take place on the two adjacent properties. NCDOT has received a letter (enclosed) from these two adjacent property owners authorizing NCDOT to acquire the necessary permits on their behalf and to perform the proposed work. The letters have been signed by Mr. Keith Mason, who has power of attorney for Mrs. Anna M. Mason the western property owner, and by Mr. Harvey G. Roper who has power of attorney for Mrs. Dora M. Roper the eastern property owner. Their adjacent property owners (Mr. Dwight R. Casper and Mrs. Polly M. Strickland) have also been sent a copy of the permit information for their review.
