This permit, issued on /e9/9/R5— , is subject to compliance with the application (where consistent
with the permit), all applicable r4ulSttions, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The foundation pilings and the waste treatment system must be located landward of the first
line of stable natural vegetation (FLSNV) a minimum distance of 360 feet at the time of
construction. The FLSNV must be identified by a representative of DCM no more than 60
days prior to construction.
2) The finished, first floor level must comply with the elevation requirements of the Hyde
County Flood Prevention Ordinance as required by the National Flood Insurance Program.
3) The structure and the associated waste disposal system shall be relocated or dismantled when
they become imminently threatened by changes in shoreline configuration. The structure and
waste disposal system shall be relocated or dismantled within two years of the time when it
becomes imminently threatened, and in any case upon their collapse, subsidence or failure.
However, if natural shoreline recovery or beach renourishment takes place within two years
of the time, the structure and waste disposal system become imminently threatened, so that
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

that time. This condition shall not affect the permit holder's right to seek authorization of
temporary protective measures allowed under NCAC 711.0308(a)(2).
4) All structures in the ocean hazard area shall be on pilings not less than eight inches in
diameter if round or eight inches to a side if square.
5) All construction within the ocean hazard area must comply with building requirements in
Chapter 34, Volume 1 and/or Section 39, Volume 1B of the NC Building Code.
6) All foundations and structures must be designed to be stable during applicable fluctuations
in ground elevation and wave force during a 100 year storm.
7) All pilings must have a tip penetration greater than eight feet below the lowest ground
elevation under the structure. For those structures so located on the primary dune or nearer
to the ocean, the pilings must extend to rive feet below mean sea level.
8) In accordance with 15 NCAC 7H.0308(a), no seawall or riprap revetments will be allowed
in the future should the structure and/or waste disposal system become threatened by
erosion.
9) The permittee will maintain the authorized work in good condition and in conformance with
the terms and conditions of this permit. The permittee is not relieved of this requirement if
the project is abandoned without having the permit transferred to a third party.
NOTE: Revegetation of any bare sand areas around the building and waste disposal area
should be initiated during the next growing season to reduce erosion.
NOTE: High priority should be placed on the preservation of as much natural vegetation as
possible within the project area. Incorporation of at least 50% of the native
vegetation in to "islands" as part of the landscape design would continue to provide
habitat for some wildlife species.
NOTE: The permittee and/or his contractor is urged to meet with representatives of the
Division of Coastal Management and the Army Corps of Engineers prior to project
initiation.
NOTE: Future development at the project site may require a modification of this permit.

This proposal, while on Ocracoke Island, is not included in the Ocracoke Village portion of the
May 1992 CRC certified Hyde County Land Use Plan update. Therefore, no specific dialogue
on proposals of this type are included in the Ocracoke portion of the plan. A general statement
is included in the policy topic Commitment to State and Federal Programs, page IV-19, that
notes "The county will continue to fully support such programs, especially the North Carolina
Department of Transportation road and bridge improvements program and ferry service, which
are vital to Ocracoke."
It is not possible to provide an opinion to this proposal's consistency with the Ocracoke plan,
as the project is outside of Ocracoke Villages planning authority.

SUBJECT: NC Department of Transportation Major Permit Application to Construct a
Restroom at the Ocracoke to Hatteras Ferry Terminal
This is submitted as an addendum to my 25 August 1995 memorandum. To further
substantiate my reasons for recommending denial of the permit, North Carolina General Statutes
(NCGS) 113A-120(a) says, "The responsible official or body shall deny an application for a
permit upon finding:
(6) In the case of natural hazard areas, that the development would occur in one or
more of the areas identified in subdivisions a through e of G.S. 113A-113(b)(6)
in such a manner as to unreasonably endanger life or property.
(8) In any case, that the development is inconsistent with the State guidelines or the
local land use plans."
Since the proposed project is in the Inlet Hazard Area of Environmental Concern, and is situated
seaward of the oceanfront setback requirement, there is the possibility of endangerment to the
structure and the area designated for the subsurface waste disposal due to erosion and the
instability of the Inlet Hazard AEC. Development seaward of the setback is inconsistent with
our rules [7H.0310(a)(1)]. NCGS 113A-120(a)(6) refers to NCGS 113A-113(b)(6) which
describes the designation of AEC's by the Coastal Resources Commission.
Furthermore, if the decision is made to issue the permit, and the permit is conditioned
to where significant changes are made to the project, the applicant must submit new plats
showing all changes prior to the commencement of construction.

SUBJECT: NC Department of Transportation Major Permit Application
I have initiated my review of this project even though the application is incomplete. The
applicant has not provided all the information necessary to evaluate a project in the Inlet Hazard
Area of Environmental Concern. The' proposed project is in the Inlet Hazard AEC on the north
end of Ocracoke Island on Highway 12 adjacent Hatteras Inlet. During my 23 August 1995
onsite inspection, I measured the oceanfront setback required for this project calcuated using 30
times the average annual erosion rate for a total of 360'. My measurements indicate that over
50% of the proposed project is located waterward of the established oceanfront setback. Based
upon my onsite investigation, this project is inconsistent with 711.0310(a)(1) which states, "All
development in the inlet hazard area shall be set back from the first line of stable natural
vegetation a distance equal to the setback required in the adjacent ocean hazard area. ",_as well
as .0306 which says. "...The erosion setback line shall be set at a distance of 30 times the long-
term annual erosion rate..." Due to these inconsistencies,.I recommend denial of the permit.
Should the decision be made to issue the requested permit, it should be conditioned to
compensate for the above referenced inconsistencies and insufficient information required to
determine the project's consistency with other standards such as NCAC 7H.0308(d)(1) and (3).
All other aspects of the proposal appear to be consistent with 711.0310, USE STANDARD_ S
FOR INLET HAZARD AREAS. I recommend the following conditions:

imminently threatened, so that they are no longer imminently threatened, then it need not
be relocated or' dismantled at that time. This condition shall not affect the permit
holder's right to seek authorization of temporary protective measures allowed under
NCAC 711.0308(a)(2).
4. No development shall begin until the oceanfront setback requirement can be established.
When the possessor of a permit or a ruling of exception is ready to begin construction,
that person shall arrange an onsite meeting with representatives from the Washington
Regional Office of the Division of Coastal Management to determine the oceanfront
setback. This setback determination shall replace the one done at the time the permit was
processed and approved and construction must begin within 60 days from the date of that
meeting. In the case of a major shoreline change within that period a new setback
determination will be required before construction begins. Upon completion of the
measurement, the Division will issue a written statement to the permittee certifying the
same.

8. PROJECT SUMMARY: The applicant is proposing to construct a new restroom building and, its
associated waste disposal system to replace the previously existing facility and its failed septic
system.

Project setting
The project site is located off NC 12 adjacent the Atlantic Ocean, Pamlico Sound and
Hatteras Inlet at the North Dock Ferry Terminal situated at the north end of Ocracoke Island in
Hyde County, North Carolina. The proposed project is situated entirely in the Inlet Hazard Area
of Environmental Concern (AEC).
The area affected by the proposed project is high ground and is predominately vegetated
by Spartina patens, sea oats, green brier and wax myrtle. Based upon my 23 August 1995 onsite
inspection, field indicators suggest that the area designated for subsurface waste disposal, as
shown on the'attached plats, was at one time a dredge spoil site or that area has been filled with.
dredged material (sand and shell). Structures already existing on the project site are an asphalt
parking lot, the Ocracoke to Hatteras Ferry office building and ferry basin. According to the
applicant, the previously existing restroom facility and septic field have already been removed.
The Atlantic Ocean is classified as SB waters, and Pamlico Sound and Hatteras Inlet are
Estuarine Waters classified as SA waters by the Environmental Management Commission. This
area of Pamlico Sound is not designated as a Primary Nursery Area. Although shellfish inhabit
this area, this portion of Pamlico Sound is closed to harvest.
Project description
The applicant is proposing to construct a new restroom building and its associated waste
disposal system to replace the previously existing facility and its failed septic system. During
an onsite inspection, I measured the distance from the first line of stable natural vegetation to
establish the oceanfront setback of 360' (30 x 12' Average Annual Erosion Rate). Based upon
my measurements, over 50% of the proposed project is located seaward of the oceanfront
setback requirement in the Inlet Hazard AEC (see attached Field Plat). The proposed footprint
of the building is 45' long by 28' wide with an 18" roof overhang totalling 1,488 square feet of
covered area. On the north side of the proposed building, the applicant plans to install a wooden
ramp and deck to allow for access by handicapped persons. As proposed, the waste disposal
system has a design flow of 5,000 gallons per day and consists of a 5,000 gallon septic tank with
dual effluent filters installed in parallel; a 4,000 ,gallon pump tank; a duplex pump dosing
system, with 2 inch pump discharge piping, 3 inch supply line, 4 inch manifold and associated
appurtenances; and two low pressure pipe drainfields totaling 2,070 linear feet. The proposed
drainfield, including repair areas measures 180' long by 120' wide and is situated east of the
proposed restroom building.
Anticipated impacts
The project proposed will result in the disturbance of ±25,700 ftz of high ground within
the Hatteras Inlet Hazard Area. The excavation activities associated with this project should not
have any direct affect on the surrounding waters.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules onbuilding standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
12,_ feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as /oa feet landward in a major storm.
The floodwaters in a major storm are predicted to be about
7_ feet deep in this area.
-Preferred oceanfront protection. measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for development in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established: It is unlawful to continue work
after permit expiration without this approval.

9. Permittee will remove the old restroom building and drain field and restore
the site to its natural condition.
10. Permittee may construct and maintain a restroom building and sewer field
based on the metes and bounds shown on the site plan P1 submitted October 24,
1994.
11. Maintenance of the parking, area. will continue to be the responsibility of
the Park Service.
12.. District Ranger Ed Whitaker has been designated as the Superintendent's
representative. He should be notified prior to beginning the project. He can
be reached at (919) 995-5041.
13. Permittee shall immediately halt activities and notify the Superintendent
.upon discovery of any archeological, paleontological, or historic findings.
14. Permittee is responsible for obtaining any State or Federal permits (Corps
of Engineers, CAMA, etc.) required. This special use permit will be valid con-
tingent upon approval by CAMA; construction will not commence until all necessary
approvals have been acquired.
15. Permittee will maintain the construction site in a neat and orderly manner.
16. In consideration for obtaining privileges granted herein, permittee agrees
to indemnify and save harmless the United States from any loss to it, including
not only damage to government property and injury to government employees but
also judgments, settlements, or compromises for property damage or in to all
persons for which the United States may be liable, resulting from the exercise
by the permittee and its employees of the privileges granted herein.

I received a letter on July 12, 1995 from Jeff Schaffer (attached) itemizing information
that was needed to complete our CAMA Major Permit application for the above -referenced
project. There are only two items out of the eight requested (a cross -sectional drawing of some
of the work proposed and a copy of the permit for the onset waste disposal system) that are valid
requests and even the need for those items is certainly not just cause for Mr. Schaffer to have
returned all application materials, not having started the review process or the 75-day processing
period. He could have requested the items concurrently with starting the regulatory timeclock
and we could have provided them immediately. This project is to be let for contract this month
and this delay will force us to reschedule. It is unfortunate Mr. Schaffer considers DDT's
application as incomplete. This has resulted in unnecessary delays in providing needed facilities to
the traveling public.
Our specific responses to Mr. Schaffer's requests are as follows:

• We have been assured by both Mr. Preston Pate and by Mr. John Parker that certified mail
receipts, or copies thereof, as required by T15A: 07J .0204(b)(5)(A), not green cards, should be
submitted with permitted applications. If green cards are returned to us (and often thgy are not)
we will be happy to provide them to you at that time, although we understand that they are not
required and none of the other DCM field offices ever request them. Please pass this along to
your other staff members, because this is a request that we get regularly from your office.

that he has no problem reading the drawings and that they do not appear to be overly
congested to him. Please look at it yourself and see what you think. For Mr. Schaffer's
benefit, we have slightly darkened the figures given for structure dimensions.
The scale on the reduced drawing may not be equivalent to any increment on
W. Schaffer.'s scale,- however; it accurately correlates with distance shown on the
drawing. _.
We are, however, providing an "exploded plan view" for Mr. Schaffer's use. Mr.
Parker assures us that the drawings submitted originally are entirely adequate for
circulation to the agencies.
A cross-section of the building is also enclosed. The boardwalk and platform have
been deleted from plans.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules onbuilding standards, oceanfront
setbacks and dune alteration are designed to minimize,but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
12, feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as /0a feet landward in a major storm.
The flood waters in amajor storm are predicted to be about
7 feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.
Without the proper signature, the application will not be
complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for development in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new

Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfront you take a calculated
risk. Natural forces of water and wind collide with tons of
force, even on calm days.
Man-made structures cannot be guaranteed to survive the
force of a hurricane. Long-term erosion (or barrier island
migration) may take from two to ten feet of the beach each
year and, sooner or later, will threaten oceanfront struc-
tures. These are the facts of life for oceanfront property
owners.
The Coastal Resources Commission (CRC) has adopted
rules for building along the oceanfront. The rules are in-
tended to avoid an unreasonable risk to life and property
and to limit public and private losses from storms and
Ion — term erosion. These rules lessen but do not eliminate
the element of risk in oceanfront development.
As you consider building along the oceanfront, the CRC
wants you to understand the rules and the risks. With this
knowledge you can make a more informed decision about
where and how to build in the coastal area.
The Rules
When you build along the oceanfront, coastal manage-
ment rules require that the structure be sited to fit safely
into the beach environment.
Structures along the oceanfront must be behind the frontal
dune, landward of the crest of the primary dune and set
back from the first line of natural stable vegetation a dis-
tance equal to 30 times the annual erosion rate (a minimum
of 60 feet). Large s tructures (mul ti-family residential struc-
tures greater than 5,000 square feet and non-residential
structures greater than 5,000 square feet) must be set back
from the first line of natural stable vegetation a distance
equal to 60 times the annual erosion rate or 120 feet,

whichever is greater. If the erosion rate is greater than 3.5
feet/year, the setback is 30 times the erosion rate plus 105
feet.
The Reasons
The beachfront is an ever -changing landform. The beach
and the dunes are natural"shock absorbers", taking the
beatings of the winds and waves and protecting the inland
areas. By setting back 30 or 60 times the annual long-term
erosion rate, you have a good chance of enjoying the full
life of the structure. At first, it seems very inviting to build
your dream house as close to the beach as possible, but in
five years you could find the dream has become a
nightmare as high tides and storm tides threaten your
investment.
The Exception
The Coastal Resources Commission recognized that these
rules, initially passed in June of 1979, might prove a
hardship for some property owners. Therefore, thev estab-
lished an exception for lots which cannot meet the setback
requirement. The exception allows buildings infrontof the
setback line if the following conditions apply.
(1) the lot must have been platted as of June 1, 1979, and
not capable of being enlarged by combining with adjoining
land under the same ownership, (2) development must be
as far back on the property as possible and in no case less
than 60 feet landward of the vegetation line, (3) no
development can take place on the frontal dune (4) special
construction standards on piling depth and square footage
must be met and (5) all other CAVIA, state and local
regulations must be met.
The exception is not available in the Inlet Hazard Area.
To determine eligibility for the exception, the Local Permit
Officer will make these measurements and observations:

The North Carolina Department of Transportation proposes to construct a public
restroom facility on N.C. 12 at the Ocracoke Island North Dock Ferry Terminal. The
project will include the construction of a new rest area building and sewer system to serve
ferry passengers and visitors to the Cape Hatteras National Seashore.
The existing restroom building is approximately 29 years old and does not contain
enough toilet fixtures to meet current needs. The existing sewer field has failed and been
closed by the Hyde County Health Department. Portable toilets are currently being used
to provide public restroom facilities.
After reviewing a faxed copy of our preliminary plans back in January you advised
that more information was needed on several items, although the plans that had been faxed
were not the final plans. The following information is provided in response.

originally that the waters of Hatteras Inlet were classified SB; since you take
exception to that alleged classification, I am in the process of requesting that

know when we receive that information from them.

are provided. Very little, possibly no grading will be required for the building, as it
will be elevated on pilings.
The preliminary plans that you have already reviewed have been modified slightly.
As noted above, the area to be graded or disturbed has been changed to 0.59 acre. The
configuration of the building has also changed slightly, although the footprint of the
building has not changed significantly. Dimensions are shown on the drawing, as stated
above. In addition, a 154' x 4' wooden boardwalk is now proposed to extend from the
parking area toward the inlet. A 14' x 14' deck is proposed at the end of the boardwalk.
The NCDOT is requesting that the proposed work be authorized under the
appropriate Coastal Area Management Act (CAMA) permit. Enclosed is a permit
application package that includes the permit application form, permit drawings, a copy of
a S250 check for the application processing fee, a copy of the NPS Special Use Permit,
the signed AEC Hazard Notice, and copies of the certified mail receipts from adjacent
riparian property owner notification.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, bu t
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
12, feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as /oo feet landward in a major storm.
The floodwaters in a major storm are predicted to be about
7 feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.

requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for developmentin this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfrontvou take a calculated
risk. Natural forces of water and Nvind collide with tons of
force, even on calm days.
Man-made structures cannot be guaranteed to survive the
force of a hurricane. Long-term erosion (or barrier island
migration) may take from two to ten feet of the beach each
year and, sooner or later, will threaten oceanfront struc-
tures. These are the facts of life for oceanfront property
owners.
The Coastal Resources Commission (CRC) has adopted
rules for building alone the oceanfront. The Hiles are in-
tended to avoid an unreasonable risk to life and property
and to limit public and private losses from storms and
lon- term erosion. These rules lessen but do not eliminate
the element of risk in oceanfront development.
As you consider building along the oceanfront, the CRC
wants you to understand the rules and the risks. With this
knowledge you can make a more informed decision about
where and 'now to build in the coastal area.
The Rules
When you build alone the oceanfront, coastal manage-
ment rules require that the structure be sited to fit safely
into the beach environment.
Structures along the oceanfront must be behind the frontal
dune, landward of the crest of the primary dune and set
back from the first line of natural stable vegetation a dis-
tance equal to 30 times the annual erosion rate (a minimum
of 60 feet). Large structures (multi-famiivresfdential struc-
tures greater than 5,000 square feet and non-residential
structures greater than 5,000 square feet) must be set back
from the first line of natural stable vegetation a distance
equal to 60 times the annual erosion rate or 120 feet,

whichever is greater. If the erosion rate is greater than 3.5
feet/year, the setback is 30 times the erosion rate plus 105
feet.
The Reasons
The beachfront is an ever -changing landform. The beach
and the dunes are natural "shock absorbers", taking the
beatings of the winds and waves and protecting the inland
areas. By setting back 30 or 60 times the annual long-term
erosion rate, you have a good chance of enjoying the full
life of the structure. At first, it seems very inviting to build
your dream house as close to the beach as possible, but in
five vears you could find the dream has become a
nightmare as high tides and storm tides threaten your
investment.
The E:;caption
The Coastal Resources Commission recognized that these
rules, ir:itially passed in June of 1979, might prove a
hardship for some property owners. Therefore, they estab-
lished an exception for lots which cannot meet the setback
requirement. The exception allows buildings in front of the
setbaokpme if the following conditions apply:
(1) the lot must have been platted as of June 1, 1979, and
not capable of being enlarged by combining with adioinin a
land under the same ownership, (2) development must be
as far back on the property as possible and in no case less
than 60 feet landward of the vegetation line, (3) no
development can take place on the frontal dune (4) special
construction standards on piLng depth and square footage
must be met and (5) all other CAIvIA, state and local
regulations must be met.
The exception is not available in the Inlet Hazard Area.
To determine eligibility for the exception, the Local Permit
Officer will make these measurements and observations:

9. Permittee will remove the old restroom building and drain field and restore
the site to its natural condition.
10. Permittee may construct and maintain a restroom building and sewer field
based on the metes and bounds shown on the site plan P1 submitted October 24,
1994.
11. Maintenance of the parking area will continue to be the responsibility of
the Park Service.
12. District Ranger Ed Whitaker has been designated as the Superintendent's
representative. He should be notified prior to beginning the project. He can
be reached at (919) 995-5041.
13. Permittee shall immediately halt activities and notify the Superintendent
upon discovery of any archeological, paleontological, or historic findings.
14. Permittee is responsible for obtaining any State or Federal permits (Corps
of Engineers, CAMA, etc.) required. This special use permit will be valid con-
tingent upon approval by CAMA; construction will not commence until all necessary
approvals have been acquired.
15. Permittee will maintain the construction site in a neat and orderly manner.
16. In consideration for obtaining privileges granted herein, permittee agrees
to indemnify and save harmless the United States from any loss to it, including
not only damage to government property and injury to government employees but
also judgments, settlements, or compromises for property damage or injury to all
persons for which the United States may be liable, resulting from the exercise
by the permittee and its employees of the privileges granted herein.
