This permit, issued on 9124/01 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Widening, culvert replacement culvert replacement
1) In order to protect anadromous fish within Great Neck Creek, no in -water work will be permitted
between February 15t" to June 15th of any year without the prior approval of the Division of Coastal
Management, in consultation with the Wildlife Resources Commission.
2) No excavated or fill material will be placed at any time in any wetlands or surrounding waters outside of
the alignment of the fill area as indicated on the workplan drawing(s).
3) No excavation will occur within waters or wetlands of the United States, except for that associated with
the authorized culvert replacement at Great Neck Creek.
4) The roadway fill material will be clean and free of any pollutants, except in trace quantities.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2004
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS .1
5) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
6) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The
riprap material must consist of clean rock and be free from loose dirt or any other pollutant. It must be
of a size sufficient to prevent its movement from the site by wave or current action.
7) The culvert inverts must be buried at least one foot below normal streambed elevation to allow for
passage of water and aquatic life.
8) Live concrete shall not be allowed to contact the water in or entering into the stream. `
9) ' If the permittee determines that additional permanent and/or temporary impacts (such as temporary
access roads, detours, or matting to transport equipment across wetlands) will occur that are not shown
on the attached permit drawings, additional authorization from DCM will be required. Depending upon
the magnitude of the impacts and the habitat types that are impacted, additional DCM authorization may
be in the form of a refinement of this permit or a permit modification.
Sedimentation and Erosion Control
10) The permittee will install turbidity curtains in the water area immediately adjacent to the replacement
culverts at Great Neck Creek. The turbidity curtains shall be removed when turbidity within the curtains
reaches ambient levels.
11) Any work conducted within the portion of this project that is in a High Quality Water Zone (575 feet on
either side of Great Neck Creek) must comply with the Design Standards in Sensitive Watersheds, 15A
NCAC 4B .0124.
12) The permittee shall follow Best Management Practices for the Protection of Surface Waters and
sedimentation and erosion control measures sufficient to protect aquatic resources.
13) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
14) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
15) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within 15 working days or 60 calendar days of project completion.

Morehead City Office at (252) 808-2808 to request a preconstruction conference prior to project
initiation.

ADDITIONAL CONDITIONS -
16) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions
caused thereby, without expense to the United States. No claim shall be made against the United States
on account of any such removal or alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The N.C. Division of Water Quality authorized the proposed project on 6/22/01 (DWQ Project
No. 01-0929) under General Water Quality Certification No. 3274.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
Number 18 (COE Action ID. No. 200110782), which was issued on 7/16/01.

Dear Mr. Johnson,
This office is in receipt of your request that you submitted on behalf of NCDOT to
upgrade SR 1704 to comply with State Highway Standards for secondary roads. The
project site is located off SR 1704 adjacent to Great Neck Creek, which is tributary to the
Neuse River in Craven County.
The following information is requested before we can consider the application as
complete and processing can begin.
• Within the application under location of proposed project letter (e), the name of the
nearest water -body would be Great Neck Creek. Please make this change.
• Under land and water characteristics letter 0) the question is answered NO but a
group is listed as completing the assessment. Please clarify this section.
• On the excavation and fill sheet, the amount of disturbance needs to be separated
between which is high -ground disturbance, wetland fill, and open water excavation.
Please clarify this under the Other category by breaking down the disturbance into
three sub categories.
• Also on the excavation and fill sheet section (4)(b), please clarify whether the listed
impact of 5' avg. x 660' is a combined area or for each side of the road project.
• Currently there is no shoreline stabilization listed in the excavation and fill sheet but
later in the application (Bridges and Culverts Worksheet) shoreline stabilization
around the culvert is proposed. Please fill out the Shoreline Stabilization portion of
the excavation and fill sheet.

• On the Upland Development sheet the size of the disturbed area is approximated at
20' wide while on the first page of the application the disturbance is noted to be 20'
wide with 6' shoulders for a total width of 32'. Please clarify which number
accurately depicts the impact.
• On the Bridges and Culverts sheet please fill out N/A for section (1)(k).
• It would be helpful to have a cross section of the existing culvert situation to
compare with the proposal. On the proposed cross section diagram provided, the
NWL depth needs to be shown as well as the undercut and backfill depth.
• Certified letters (Return Receipt Requested) with copies of the permit
APPLICATION package (permit application forms and appropriate workplan
drawings) must be sent to all adjacent property owners. The signed return receipts
must be provided with the permit application. This notification must also include
instructions to the adjacent property owner that any objections they have about your
proposed development should be provided in writing to the Division of Coastal
Management. The provided notifications are sufficient for the issuance of a general
permit but not appropriate for a Major Permit.
At this time, the application is considered to be incomplete and processing will not begin
until these items are addressed. I have enclosed the application you sent so that you can

The following are my comments and recommendations regarding the above mentioned proposal.
The project consists of replacing existing culverts and paving an existing roadway. The roadway will
be widened just enough to allow compliance with Federal Highway Standards. Relatively small areas
of coastal wetlands, 404 wetlands, and shallow bottom will be filled at the Great Neck Creek crossing.
Roadside ditches, required by Federal Highway Standards, will terminate on high ground and sheet
flow over upland vegetation before reaching wetlands. I would recommend the project be approved
contingent upon the following conditions:
1) The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
2) No excavated or fill material will be placed at anytime, in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the work plats.
3) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent
spillover of solids into any marsh or surrounding waters.
4) The riprap material must consist of clean rock and be free from loose dirt or any other
pollutant. It must be of a size sufficient to prevent its movement from the site by wave or
current action.
5) The roadway fill material will be clean and free of any pollutants, except in trace quantities.
6) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.

8. PROJECT SUMMARY: The applicant is the N.C. Department of Transportation. The
proposal is to upgrade the existing gravel secondary road to a 2 lane paved road that complies
with State Highway standards for secondary roads.
9. PROJECT DESCRIPTION:
The site of this proposal is State Road 1704(Becton Road) in the community of Bachelor, NC. The
road is approximately 2 - 10' above msl. 'The culverted crossing at Great Neck Creek is flanked
with wooded Cypress/Gum swamp wetlands and coastal wetlands on either side. This area is
primarily residential, and undeveloped wooded swamp and forest. The site consists of a 15' wide
creek body at the existing culvert crossing with the remainder of state road 1704 on high ground.
The coastal wetland consists of Juncus roemerianus, Typha spp. and Cladium jamaicense. The
adjacent uplands are forested, and are vegetated primarily with various pines, Tulip Poplar, and
Oak. Soils in the area are loams and sandy loams. Great Neck Creek is coastal waters at the
project site, and is classified SA -NSW by the Division of Water Quality and subject to the Neuse
River Buffer Rules. The area is open to shellfishing, and is not designated as primary nursery
area by the North Carolina Division of Marine Fisheries. The project begins at State road 1700
(Adams Creek Road) and terminates at the existing road end (6864 feet). The Craven County Land
Use Plan designates the project area as Limited Transition, with all areas lying within CAMA
Areas of Environmental Concern, designated as Conservation.
The proposal is to replace the 3 existing 30-inch diameter by 48 feet long culverts with 4 new 36-
inch diameter by 60 feet long culverts on the existing alignment, to allow for State Highway
standards. The ends of the culverts will be stabilized with riprap. The roadway, shoulders and
slopes will extend for a width of 43 feet or less (12 feet wider than existing) at the culverted
crossing, to minimize impacts to coastal and 404 type wetlands. The approaching roadway will be
widened to 20' and paved. The road shoulders will be widened from 6' to 8'. The pavement,
shoulders and ditches of the high ground portion of State Road 1704 will encompass the entire 60-
foot right of way. Silt fences, silt basins and temporary rock silt check damns will be used to
minimize erosion and sedimentation. Roadside ditches will terminate in high ground and the flow
will be dispersed through vegetated uplands before entering wetlands.

10. ANTICIPATED IMPACTS:
As proposed, this culvert replacement, road widening and paving will result in the following
impacts: Approximately 1597 square feet of coastal wetlands will be filled by road shoulder and
culvert, 1451 square feet of 404 type wetlands will be filled by road shoulder and culvert, and 240
square feet of shallow bottom will be filled by culvert and riprap. Approximately 9.45 acres of
high ground will be graded, filled or. excavated for the roadway and paving. There is a high
probability of turbidity to be expected during the replacement of the culverts. Stringent
sedimentation/erosion control measures can minimize this. Storm water concerns have been
addressed by terminating ditches with diffuse flow over vegetated high ground. Principally local
residents use state Road 1704. The widening and paving of the roadway and replacement of the
deteriorated culverts should enhance the safety of motorists using SR 1704. Public trust waters end
at the existing culverts and will not be affected.
The collective disturbance area for the project is 9.55 acres.

NCDOT is making application for a CAMA Major Permit to widen and pave SR
1704 (Becton Road) from SR 1700 to the end. Please find enclosed revisions to the
drawings and application from your March 5, 2001 letter.
Avoidance and minimization was initiated so that a maximum of 1,597 Sq. Ft. of coastal
wetlands will be filled, 1,451 Sq. Ft. of 404 wetlands and 240 Sq. Ft of open water will be
impacted by the widening of SR 1704. New upland side ditches are designed to enter
settling basins and filter through vegetated uplands prior to entering the wetlands or the
stream buffers eliminating water being discharged directly into the stream. Please let me
know if there is additional information required.

18, 2001. An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify mein writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.
