attached workulan drawings as referenced in Condition No. 1 of this permit.
This permit, issued on 10111 /04 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
B-3626, Bridge Replacement
1) All work authorized by this permit shall be carried out in accordance with the following workplan
drawings, except as modified herein:
Permit drawings: five sheets (5 of 11 through 9 of 11) dated 1/20/03
size drawings: Three (3) '/2-size drawings dated as received on 7/19/04
2) The permittee shall implement NC DDT's Stream Crossing Guidelines for Anadromous Fish Passage,
except as modified in Condition No. 3 of this permit.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
No Expiration Date, pursuant to GS 136-44.713
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program

3) Due to the presence of warm water fish and other anadromous fish, no in -water or in -marsh work shall
be conducted from February 15`h to June 30`h of any year without prior approval of the NC Division of
Coastal Management (DCM), in consultation with the NC Wildlife Resources Commission (WRC).
For purposes of this moratorium, in -water is defined as those areas that are inundated at any time
during construction, including the waters or contiguous inundated wetlands of Deep Creek.
4) Turbidity curtains shall be used to contain all bottom disturbing activities, including pile or casement
installation, placement of riprap, excavation or filling. The turbidity curtains are to be properly
maintained and retained in the water until construction is complete and turbidity within the curtains
reaches ambient levels. The turbidity curtains shall be installed parallel to the stream banks on each
side of the stream, extend past the construction limits, and attach to the silt fences containing the work
site. The turbidity curtains shall not fully encircle the work area or extend across the stream. Turbidity
curtains are to be retained in the water until construction is complete and all of the work area contained
by the turbidity curtains has been stabilized by vegetation or other means.
5) In accordance with project commitments made within the permit application, Design Standards for
Sensitive Watersheds shall be used.
6) The NCDOT document "Best Management Practices for Bridge Demolition and Removal' (final
9/20/99) shall be followed during demolition and construction activities.
7) Debris resulting from demolition of the existing bridge, including deck components, shall not enter
wetlands or waters of the State, even temporarily.
8) All excavated materials and debris associated with the removal of the existing bridge and temporary
work bridge shall be disposed of at an approved upland site.
9) The permanent and temporary work bridges shall be constructed with driven piles. Should drilled shaft
construction or jetting of any bridge piles become necessary, a modification to this permit will be
required.
10) Existing bridge pilings shall be extracted or removed flush with the streambed.
11) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the work plan drawing(s).
12) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands are not authorized.
13) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of
solids into any wetlands or surrounding waters.
14) The fill material shall be clean and free of any pollutants except in trace quantities.

15) Live concrete shall not be allowed to contact waters of the State or water that will enter waters of the
State.
16) Placement of riprap shall be limited to the areas as depicted on the attached work plan drawings. The
riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent
its movement from the site by wave or current action. The riprap material shall consist of clean rock or
masonry materials, such as but not limited to, granite or broken concrete.
Mitigation
NOTE: In accordance with the letter of August 5, 2004 from the EEP to the USACE, the EEP will
provide 12.0 acres of riverine wetland preservation as compensatory mitigation at a 10:1 ratio for
the 1.20 acres of unavoidable riverine wetland impacts. The NE Cape Fear Wells Tract in
Pender County will be debited for the preservation mitigation.
17) Due to the possibility that compaction, mechanized clearing and/or other site alterations might prevent
any temporary wetland impact area from re -attaining jurisdictional wetland status, the permittee shall
provide an annual update on the wetland areas temporarily impacted by this project. This annual
update shall consist of photographs provided during the agency monitoring report meeting and a brief
report on the progress of these temporarily impacted areas in re -attaining wetland jurisdictional status.
Three years after project completion, the permittee shall schedule an agency field meeting with DCM,
the NC Division of Water Quality and the NC Wildlife Resources Commission to determine if the
wetland areas temporarily impacted by this project have re -attained jurisdictional wetland status. If at
the end of 3 years the wetland areas temporarily impacted by this project have not re -attained
jurisdictional wetland status, DCM and the above listed agencies will determine whether additional
compensatory wetland mitigation shall be required.
Sedimentation and Erosion Control
18) The permittee shall follow Best Management Practices for Protection of Surface Waters and
sedimentation and erosion control measures sufficient to protect aquatic resources.
19) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
20) This project shall conform to all requirements of the NC Sedimentation Pollution Control Act and NC
DOT'S Memorandum of Agreement with the Division of Land Resources.
General
21) Any relocation of utility lines that is not already depicted on the attached work plan drawings, or
described within the attached permit application, shall require approval by DCM, either under the
authority of this permit, or by the utility company obtaining separate authorization.

22) If the permittee determines that additional permanent and/or temporary impacts will occur that are not
shown on the attached permit drawings, additional authorization from DCM shall be required.
23) This permit does not eliminate the need to obtain any additional permits, approvals or authorizations
that may be required, including a U.S. Army Corps of Engineers permit, a copy of which shall be
provided to DCM prior to initiation of construction.
24) The N.C. Division of Water Quality (DWQ) has authorized the proposed project under a General
Water Quality Certification (DWQ Project No. 04-1175), which was issued on 8/24/04. Any violation
of the Certification approved by the DWQ will be considered a violation of this CAMA permit.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action ID No.
200411590.

Dear Mr. Thorpe:
The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major
Permit Application for CAMA/DREDGE & FILL applicaton on July 30, 2004. Staff review of the
plans and specifications has determined that the development activities proposed at this time will
not pose a threat to surface water quality from stormwater runoff. The Director has determined that
projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of
15A NCAC 21-1.1000. By copy of this letter, we are informing you that your project will not require a
stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for stormwater
discharge from projects meeting these criteria. The stormwater rules require the Division to permit
the common plan of development, therefore, any future development on the property, regardless of
whether a CAMA Major permit is also required, will require a Stormwater Management Permit
application and permit issuance from the Division of Water Quality prior to any construction.

Replacement of Bridge No. 26, Crossing Deep Creek, on SR 1154 in Carteret
County

The following are my comments and recommendations regarding the above -mentioned proposal.
The proposal is to replace the existing 53-foot long by 24-foot wide timber and concrete bridge
with a 90-foot long by 39-foot wide cored slab concrete bridge on the existing alignment. Phased
construction will be utilized, building one half of the bridge at a time and maintaining one lane
open to traffic, to avoid requiring an on -site detour. The proposed bridge would have a vertical
clearance equal to the existing bridge (approximately 2.5 feet). The bridge is being widened from
24 feet to 39 feet to more closely correspond to the 10 foot paved travel lanes and 7-14 foot grassed
shoulders of SR 1154 and to facilitate the proposed phased construction. NC DOT Best
Management -Practices would be used for Bridge Demolition and Design Standards for Sensitive
Watersheds would be used for erosion control. The NCWRC and USFWS have requested an in
water moratorium from Feb 15 to June 30 of each year, including areas inundated at the project site
with connectivity to the subject stream crossing.
The project is well designed with minimization of impacts. I would recommend the project be
approved contingent upon the following conditions:
1) No bridge demolition debris or excavated or fill material will be placed at any time, in any
wetlands or surrounding waters, outside of the alignment of the fill area indicated on the work
plats.
2) The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands are not authorized.

3) All excavated materials will be confined above normal high water and landward of regularly
or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent
spillover of solids into any wetlands or surrounding waters.
4) In order to protect anadromous and warm water fish populations, no excavation or filling will
be permitted in the waters or contiguous inundated wetlands of Deep Creek between February
_ =-- 15 and June 30 of any year without the prior approval of the DCM, in consultation with the
DMF and NC WRC.
5) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
6) All fill material must be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
7) The riprap material must be free from loose dirt or any pollutant. It must be of a size
sufficient to prevent its movement from the site by wave or current action.
8) Mitigation for the project impacts are debited from the EEP in accordance with the MOA.
9) Turbidity curtains shall be used to isolate all work areas from the stream at Deep Creek,
including pile or casement installation, placement of riprap, excavation or filling. The turbidity
curtains shall be installed parallel to the stream banks on each side of the stream. The turbidity
curtains shall extend past the construction limits and attach to the silt fences containing the
work site. The turbidity curtains shall not encircle a work area or extend across the streams.
The turbidity curtains are to be properly maintained and retained in the water until construction
is complete and all of the work area contained by the turbidity curtains has been stabilized by
vegetation or other means. The turbidity curtains shall be removed when turbidity within the
curtains reaches ambient levels.
10) All commitments in the application and CE made by NC DOT are observed.

8. PROJECT SUMMARY: The N.C. Department of Transportation is proposing to replace the
existing 53-foot long by 24-foot wide timber and concrete bridge. over Deep Creek with a 90-foot
long cored slab concrete bridge spanning Deep Creek and the adjacent floodplain.

9. PROJECT DESCRIPTION:
Tlie site of this proposal is Bridge No. 26 on SR 1154,1.1 miles southeast ofNewport at the dkd ing
of Deep Creek, in Carteret County. The general purpose of the project is to replace the deteriorated
53-foot long by 24-foot wide timber .and concrete bridge with an 90-foot long by 39-foot wide
concrete cored slab bridge Spanning Deep Creek and the adjacent floodplain, to allow safer driving
conditions for the traveling public.
Bridge No. 26 crosses Deep Creek 0.3 miles north of its confluence with the Newport River. The
bridge crossing Deep Creek is flanked with 404 type wetlands. Creek width at the crossing is
approximately 35 feet. Vertical clearance between the water and bridge bottom is approximately2.5
feet. An approximately 1500-foot long by 60-foot wide causeway was constructed through wetlands
on Masontown Mucky loam soils when the bridge was constructed. The Cypress -Gum Swamp
Wetland area exists immediately adjacent to Deep Creek and consists of Bald Cypress, Black Gum,
Tupelo Gum, Wax Myrtle, Greenbriar, Carex and Netted Chain Fem. Approximate elevations on the
site range between 0 feet and 6 feet above Normal High Water (NHW). No evidence of SAV beds
was noted. The North Carolina Division of Water Quality classifies waters of Deep Creek as C at the
project site. Deep Creek is not classified as Primary Nursery Area, as designated by the North
Carolina Division of Marine Fisheries, at this site. The project area is within CAMA Areas of
Environmental Concern and is designated as Transition and Conservation by the Carteret County
Land Use Plan.

grassed shoulders of SR 1154 and to facilitate the proposed phased construction. NC DOT Best
Management Practices would be used for Bridge Demolition and Design Standards for Sensitive
Watersheds would be used for erosion control. The NCWRC and USFWS have requested an in
water moratorium from Feb 15 to June 30 of each year, including areas inundated at the project
site with connectivity to the subject stream crossing.

10. ANTICIPATED IMPACTS:
As proposed, the construction of the bridge app caches with 3:1 slopes_ would require the_filling of ----
approximately 0.386 acres of 404 type wetlands and approximately 0.61 acres of impacts to high
ground. To maintain the existing roadside ditch profile that would be filled by expanding the road
shoulders, approximately 0.492 acres of 404 type wetlands would be excavated. The proposed
Method III Clearing,10 feet outside construction limits, would disturb approximately 0.324 acres of
404 type Wetlands adjacent to the road shoulders. The additional width of the bridge would cause
approximately 525 square feet of additional shading impacts to Public Trust Waters AEC. A minimal
disturbance of the creek bottom is expected when driving or vibrating the pre -stressed concrete piles
for the bent in the stream.
NC DOT has reduced the fill in wetlands that would have occurred in raising the causeway and
widening the bridge by eliminating the proposed on site detour and using Phased construction with
no on -site detour and using 3:1 shoulder slopes. NC DOT has committed to dropping no materials
from the bridge demolition in the water and to using top down construction to minimize impacts.
The NC DOT has proposed to use Best Management Practices for the protection of Surface Waters.
NC DOT has committed to cutting off at the mud line or removing the pilings from the existing
bridge and the previous bridge formerly crossing Deep Creek just north of the existing bridge.
NC DOT would be impacting approximately 1.202 acres of 404 type wetlands caused by the
permanent bridge in this proposal and has requested to debit the EEP to offset these impacts.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed

the proposed development. You should post this notice at a conspicuous point along the roadway
where it can be observed from the road. An example would be: nailing the notice card to a
telephone pole ortree along the road right-of-way near the project. Failure to post this notice could

The project involves the removal and replacement of Bridge Number 26 carrying
SR 1154 over Deep Creek in Carteret County. A new bridge approximately 90 feet (27.3
meters) long and clear width of 39 feet (11.8 meters) will be constructed to carry SR 1154
over the floodplain and creek. By utilizing phased construction, SR 1154 will remain
open by maintaining half of the existing bridge while the new structure is under
construction. The project is shown in the approved Categorical Exclusion.
Water Resources
The project is located near the confluence of Deep Creek and the Newport River. The
majority of the area surrounding SKI 154 and bridge No.-26 is comprised of wetlands
and/or surface waters. The main wetland complex, through which the existing roadway
and bridge are located, is dominated by a cypress -gum swamp community. This
community type comprises the majority of the project area and occurs adjacent to SR
1154 and the banks of Deep Creek, except where human development or disturbance has
displaced it. Approximately 0.386 acre of wetland will be filled by the proposed project
and 0.492 acres will require excavation in wetlands. The project will also require 0.324
acre of wetland to be mechanically cleared to provide room for bridge construction.

In order to reduce impacts to wetlands, phased construction will be utilized making an
on -site detour unnecessary. The project will also be using a structure of increased length
to improve the existing flood plain and associated wetland community.
Mitigation
Based upon the agreements stipulated in the "Memorandum of Agreement Among the
North Carolina Department of Environment and Natural Resources, the North Carolina
Department of Transportation, and the U.S. Army Corps of Engineers, Wilmington
District" (MOA), it is understood that the North Carolina Department of Environment
and Natural Resources Ecosystem Enhancement Program (EEP), will assume
responsibility for satisfying the federal Clean Water Act compensatory mitigation
requirements for NCDOT projects that are listed in Exhibit 1 of the subject MOA during
the EEP transition period which ends on June 30, 2005.
Since the subject project is listed in Exhibit 1, the necessary compensatory mitigation to
offset unavoidable impacts to waters that are jurisdictional under the federal Clean Water
Act will be provided by the EEP. The offsetting mitigation will derive from an inventory
of assets already in existence within the same 8-digit cataloguing unit. The Department
has avoided and minimized impacts to jurisdictional resources to the greatest extent
possible as described above. The remaining, unavoidable impacts to 1.202 acres of
jurisdictional will be offset by compensatory mitigation provided by the EEP program.
Bridge Demolition
Bridge No. 26 is composed of a reinforced concrete deck and railings on timber joists.
The substructure consists of timber caps on timber caps on timber piles. The bridge was
constructed in 1959. The bridge has a clear roadway width of 24 feet (7.3 meters) and is
53 feet (16.2 meters) long. As stated in the NCDOT Best Management Practice for
Construction. and Maintenance Activities, because a CAMA permit is required, dropping
any component of Bridge No. 26 into "Waters of the United States," will not be
permitted.
NCDOT will also remove, or cut at mud line, all previously installed pilings under bridge
No 26.
Federally Protected Species
Plants and animals with federal classifications of Endangered, Threatened, Proposed
Endangered, and Proposed Threatened are protected under provisions of Section 7 and
Section 9 of the Endangered Species Act of 1973, as amended.
As of January 29, 2003, the USFWS lists 7 federally protected species for Carteret
County. Table 1 depicts these species and their biological conclusions.

Regulatory Approvals
Section 404 Permit: This project is being processed by the Federal Highway
Administration as a "Categorical Exclusion" in accordance with 23 CFR 771.115(b).
Therefore, we do not anticipate requesting an individual permit but propose to proceed
under a Nationwide 23 as authorized by a Nationwide Permit (67 FR 2020; January 15,
2002).
Section 401 Water Ouality Certification: We anticipate 401 General Certification
numbers 3403 will apply to this project. In accordance with 15A NCAC 2H, Section
.0500(a) we are providing two copies of this application to the North Carolina
Department of Environmental and Natural Resources, Division of Water Quality, for their
review.
The NCDOT hereby requests that this project be authorized by the issuance of a Coastal Area
Management Act Major Development Permit. Please find attached the completed MP forms
along with the appropriate permit drawings. The certified mail "green cards" from the
adjacent riparian landowner notifications are also included. The NCDOT has also requested
authorization from the North Carolina Division of Water Quality and the U. S. Army Corps
