Construction
1) In order to protect juvenile shrimp and ftnftsh populations, no excavation or filling will be

Dear Mr. O'Quinn:
Reference your application of August 8, 1994, for Department of the Army
(DA) authorization to discharge fill material in waters/wetlands of Hadnot
Creek associated with replacement of Bridge No. 24 on North Carolina Highway
58, near Peletier, Carteret County, North Carolina.
For the purposes of the Corps of Engineers Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided for discharges of
dredged or fill material incidental to the construction of bridges across
navigable waters of the United States, including cofferdams, abutments,
foundation seals, piers and temporary construction and access fills provided
such discharges have been authorized by the U.S. Coast Guard as part of the
bridge permit.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM) and a Coastal Area Management Act
(CAMA) permit from the North Carolina Division of Coastal Management (NCDCM).
You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water
quality certification, and Mr. James L. Mercer, telephone (919) 726-7021,
regarding the CAMA permit. This nationwide permit does not relieve you of the
responsibility to obtain other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur by January 21, 1997. It is incumbent
upon you to remain informed of changes to the nationwide permits, which will
be announced by public notice when they occur. If you commence, or are under
contract to commence, this activity before the date the nationwide permit is
modified or revoked, you will have twelve months from the date of the
modification or revocation to complete the activity under the present terms
and conditions of this nationwide permit.

I recently returned to the project site to find a small amount of
coastal wetlands growing in each of the 4 quadrants of the bridge.
My field report indicates no marsh involved. I estimate a total of
about 40 square feet of sparsely growing saltmarsh cordgrass and
needle rush h e erged within the project shoreline as a result
of the warm lather The marsh will be subject to the proposed
excavation requirements to replace the bridge.
I have no problem with the proposed project and offer the following
conditions for your review:
1. In order to protect juvenile SHRIMP AND FINFISH populations,
no excavation or filling will be permitted between 15 OCTOBER and
15 MAY of any year without the prior approval of the Division of
Coastal Management, in consultation with the Division of Marine
Fisheries.
2. Excavation will not exceed -3 feet below the MEAN LOW water
level.
3. Silt screens shall be employed across the creek above and
below the project site prior to the initiation of excavation and
construction.
4. All excavated spoil will be retained of the highground
landward of the Mean High Water Level in such a way that it will
not return or erode into the surface waters of the creek or the
adjacent wooded wetlands.
5. No excavated or fill material will be placed at any time, in
any marsh or surrounding waters, outside of the alignment of the
fill area indicated on the workplat(s).
6. NOTE: The permittee and/or his contractor is urged to meet
with prior to project initiation.

DATE: April 21, 1995
The North Carolina Department of Transportation proposes to replace
Bridge #24 over Hadnot Creek on Highway 58 in Carteret County. The
applicant plans to use the same bridge alignment as the existing
structure. Construction plans include excavation of some of the
creek bank and the placement of rock riprap at the bridge
abutments.
AECs impacted by the project include Estuarine Waters, the
Estuarine Shoreline, and Public Trust Areas. Waters at the site are
classified as SA and are closed to the harvesting of shellfish. The
area is not a Primary Nursery Area. 1404' wetlands will also be
impacted by the activity.
I have reviewed this proposal for consistency with the 1991
Carteret County Land Use Plan (LUP) Update, as amended September
24, 1993, and offer the following comments.
The general area surrounding the project is classified as Rural.
The bridge crossing appears to be located in an area of
concentrated 1404' wetlands, as shown on the Land Classification
Map of the LUP. The 1404' wetlands and AECs impacted by the project
are classified as Conservation.
Section V Land Classification System of the amended Plan describes
the 1404' Wetlands conservation classification, as well as the
various AEC conservation classifications. The Plan states that in
areas delineated as 1404' wetlands on the Land Classification Map,
as is the area of this project, only uses consistent with the
policy statements section of the plan will be allowed. Section III
Relationship of Policies and Land Classifications reiterates that
the County's intentions regarding development in Conservation
classified areas are addressed in the policy section of the Plan.
Resource Production and Management Policies prohibiting
residential, commercial and industrial development in freshwater
wetland areas, as delineated on the Land Classification Map, are
contained in the plan (Page IV-10). However, Recreation Resources
Policies (Page IV-9) state that while freshwater wetlands are
considered valuable passive recreations area and should be
protected in their natural state, some development, as allowed by
the LUP, may occur in freshwater wetlands.
Economic and Community Development Policies regarding Commitment to
State and Federal Programs (Page IV-16) state that the County will
continue to fully support state and federal programs, particularly
those which provide improvements to the County. The LUP
specifically mentions the North Carolina Department of
Transportation road and bridge improvement programs. Full support
for these programs, which are very important to Carteret County, is
stated.
Other relevant policies include Resource Production and Management
Policies for Marine Resource Areas (Page IV-11). Carteret County
supports the 7H Use Standards for Development in Estuarine Waters
and Public Trust Areas, with certain exceptions, none of which
appear to be applicable to this project. Resource Protection
Policies on Page IV-3 state the County's intentions to cooperate
with the U.S. Army Corps of Engineers in the regulation/enforcement
of the 1404' wetlands permit process. Bulkhead Construction
policies contained on Page IV-8 state that Carteret County will
allow bulkhead construction, consistent with state standards.
Based on the absence of any policy which prohibits this activity,
and the stated support for the NCDOT bridge improvement program,
this project appears to be consistent with the amended 1991
Carteret County Land Use Plan, provided all state and federal
requirements can be satisfied.

8. PROJECT SUMMARY: NC DOT proposes to replace Bridge #24 over Hadnot Creek using the
same alingment. Some excavation of the creek banks will be required. Rock riprap will be placed at
the bridge abutments. No fill in wetlands will be required. All vehicular traffic will be detoured
around the site via State Road #1104.

9. NARRATIVE DESCRIPTION: The project site is located in the upper, reaches of
Hadnot Creek a tributary of the White Oak River in Carteret County. The project site
is Bridge #24 on Highway 58 in Carteret County. The highway basically runs north
and south through the rural areas of the county between Maysville and Cape Carteret.
The referenced USGS 7.5 minute Quad., "HADNOT CREEK", can help orient the
project site to the general vicinity. The pile supported bridge was originally construct
in the mid-1940's. The proposed work activities associated with the bridge
replacement will take place on and within the existing Right -of -Way. During
construction, all vehicular traffic will be detoured via SR # 1104 to the east.
The applicant proposes to replace the existing 2 span bridge with a new triple span
structure. The.creek is about 100 feet wide at the project site. A limited amount of
excavation along the creek banks will be required in order to accommodate the
increased width the new bridge with abutments. The creek banks that are scheduled
for excavation are considered 404 Wetlands. As the project plans show on sheet 2 of
6, an area on each side of the bridge measuring about 82 feet by 9 feet will be
excavated to depth of -3 feet on mean low water. An estimated 255 cubic yards of
spoil will be removed from a combined area of about 1500 square feet. The new
bridge will be about 2 feet higher in overall elevation that a the old structure. In terms
of support, the new 3 span bride will be supported by a series of 7 concret piers.
Sheet 3 of 6 shows the alingment of the 7 piers within Hadnot Creek.- -It has been
estimated that about 18 feet of horizontal clearance will be maintained between each of
the new support piles. The new shoreline and bridge abutments will be stabilized with
rock riprap. Each section of riprap will measure about 82 feet by 14 feet and will
displace no new areas of wetlands. The new bridge will require a reshaping the
highway approaches. The details and sectional view of the fill requirements are shown
on sheet 4 of 6. Although the shoulders of the Highway will be enhanced, no new fill
will be placed in the surrounding 404 wetlands. Finally, the new bridge and roadway
has been designed to collect and discharge stormwater. A 12 inch funnel drain will be
constructed along the shoulder in each quadrant. The project plans show the
installation of Class B stone at the end of the drain adjacent to the 404 wetlands.
The surface waters of Hadnot Creek below the HWY 58 bridge are classified as SA
and Estuarine; above the bridge, the waters are designated "Inland". The on -site
inspection revealed no coastal marsh within the project boundaries.
10. ANTICIPATED IMPACTS: The proposed project will displace about 1500 square
feet of 404 Wetlands in order to accommodate the increased length of the 3rd bridge
span. Excavating the creek banks under the new bridge should have no significant
impact on the local estuarine resources particularly if adequate sedimentation

measures are employed. The upper reaches of Hadnot Creek maybe used by
anadromous fish in the spring or fall of the year. Public navigation and acess to the
upper reaches of Hadnot Creek will be uncompromised by, the proposed bridge
replacement. The overall impacts of the project have been greatly reduced by NCDOT
in the pre -planning stages. Specifically, the original on -site detour through coastal and
404 wetlands has been eliminated. SR #1104 has been approved as the detour for the
project.

archaeologist after completing an archaeological evaluation of the
referenced project. This work was done to comply with Section 106 of
the National Historic Preservation Act following the guidelines
issued by the Advisory Council on Historic Preservation.
Please submit this report -to the North Carolina State Historic
Preservation Office (SHPO) for their consultation. If the SHPO
concurs with these findings, please provide our office with a copy of
the concurrence documentation.
Because the project is within the Croatan National Forest, we
also were requested to conduct an archaeological assessment of the
project by the National Forests in North Carolina (attached is copy
of letter). Please submit a copy of the report to C.-Mitch Gurganus
of that agency for Forest Service review and comments.

complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of the proposed development. You should post this notice at a
conspicuous point along the property where it can be observed from a public road. Some
