1) All wetland losses will be mitigated in accordance with the commitment stated
by letter of 10/31/89 from L. R. Goode. A mitigation plan must be prepared
and approved by the DCM and the U. S. Army Corps of F.ngineers before
undertaking any mitigation activities. The mitigation plan must be approved,
and the initial mitigation activities be completed by December 31, 1990.
2) No excavation or fill material will be placed at any time, in any marsh or
surrounding waters outside of the alignment of the filled area indicated on
the work plats.
3) For those areas which are filled, silt screens or other retaining structures
must be installed on the waterward side of the filled areas. Other
appropriate erosion and sedimentation control measures will be employed, where
necessary.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the pemtittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1992
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

SUBJECT: Carteret County, Widening of SR 1161 near Beaufort
(State Project No. 6.162228); General Permit No.
CESAW-CO89-N-000-0291; CAMA Permit No. 220-89;
File No. DESAW-CO89-N-016-0435
The CAMA and DOA 404 Permits were issued for paving of
existing SR 1161 on November 15, 1989 and January 31, 1990,
respectively. At that time, NCDOT had committed to provision
of compensatory mitigation for 0.24 acres of wetland impacts.
Construction at this site has since been completed. The
mitigation and monitoring plan designed to replace the
saltmarsh filled during construction is hereby submitted. We
are proposing to create 0.51 acres of tidal saltmarsh at a
property directly adjacent to the project, less than one mile
north of the wetland impact area. This will be accomplished
by grading of an upland area to the elevation of the
surrounding saltmarsh, followed by planting of Juncus
roemerianus. The mitigation site is currently covered with
pines and shrubs, and is used as an unofficial dumping site.
The trash will be removed to a suitable landfill. It is
likely that dumping at this site will no longer occur after
the shrubby vegetative cover is removed, and vehicular access
to the site is made more difficult. This plan represents a
2:1 ratio of in -kind mitigation within the vicinity of the
lost resource.

NCDOT will consider the above plan acceptable if 'planted
species survive at an estimated rate of 50% after two years
and the planted stand provides at least 50% areal coverage of
salt marsh type and aquatic bed species. (Monitoring data
will be available for all interested agency's review) In the
event that these two conditions are not met and environmental
restoration is not considered successful, consultation will be
Held between the staffs of NCDOT's Planning and Environmental
Branch and Roadside Environmental Unit, the Division of
Coastal Management, the Corps of Engineers, Wilmington

Mr. Jerry McCrain of our Planning and Research staff has
indicated that our September 6, 1989 proposal to debit a
future wetland bank for anticipated wetland losses associated
with the above referenced project is unacceptable. We
understand that acceptance of a banking concept for coastal
wetland losses is still a issue for discussion but that an
alternative strategy should be employed for the SR 1161
project.
As you are well aware from previous visits to the
project area, on site options for mitigation of 0.24 acres of
fringing marsh encroachment along SR 1161 are somewhat
limited. We are currently investigating opportunities for
creation of similar wetland community types at off site
locations. However, suitable sites for such purposes have
yet to be selected.
In the meantime, it is imperative that improvements to
SR 1161 proceed. Work has already been initiated along
adjacent segments of the roadway where wetland involvement is
not expected and continuity with ongoing efforts is critical.
The NCDOT is willing to commit to creation of 0.24 acres of
marsh at a site to be selected at a later date, subject to
concurrence and approval from LAMA.

our NCDOT staff at the site of the above referenced project
on August 24, 1989.
The existing two lane, rural facility will be widened
and paved for a distance of approximately 1.3 miles from NC
101 to SR 1162. Expansion of the right-of-way will infringe
upon an estimated 0.24 acres of intertidal marsh dominated by
Juncus and Svartina species. Every effort will be undertaken
to minimize involvement whenever possible but total avoidance
is impossible. our Department recognizes a need to provide
for mitigation and a number of alternatives were addressed at
our August 24th meeting.
The N.C. Department of Transportation has been
investigating coastal wetland banking as a viable mitigation
option for some time. This approach may provide the best
opportunity for compensation when takings are minor or
unavoidable, as with the SR 1161 project. We fully intend to
pursue wetland banking with a commitment to implementation in
the near future..

I am forwarding available information on the expanded
highway program as discussed at the last CRC meeting in
Beaufort. We are unable at this time to provide a definitive
schedule of projects over the 10 year life of the new funding
package; however, these documents will give you some idea of
anticipated activities. Document ##1 is a "Wish list" of
major projects to be added to the TIP program. Document (#2
is a synopsis of bridge replacements using bridge maintenance
funding and generally handled at the Division level.
Document ##3 is a more detailed breakdown of projects in
Division 1 which includes some of our more sensitive coastal
areas, particularly in Dare, Currituck and Hyde Counties.
Highway funding is expected to increase after Year 3
since State employee raises will not be siphoned from
targeted road monies. Much of our work will be maintenance
oriented to be handled at the Division level. Many of these
projects will be "quick scheduled" on a need basis and,
therefore, will be difficult to predict. Environmental
ramifications and the possible need for permits are also
difficult to assume. As always, the Transportation
Improvement Program (TIP), representing our major project
listings, is also subject to change.

Another issue which we have discussed in the past is the
problem of mitigation for highway takings in coastal
communities. Our Department is very conscious of the
environmental concerns associated with infringement in
intertidal communities or on coastal waters; every project is
scrutinized in order to minimize impacts whenever feasible.
However, total avoidance is impossible. In many cases, on -
site restoration or creation is not feasible or cost
effective. A detailed analysis of our Broad and Gales Creek
Projects in Carteret County indicate a cost of $144,800/acre
for on site creation or $1.4 million/acre for expansion of
the bridge openings to alleviate marsh impacts. I don't
believe these options represent a viable solution that is in
the best public interest nor do the costs necessarily justify
the benefits received.
I believe a practical solution to the problem may be
through mitigation banking. Our Company Swamp Bank on the
Roanoke River was established in 1985 as an alternative
mitigation strategy for bottomland hardwood losses. The bank
is only utilized as a last resort and only under mutual
agreement by all parties of the Memorandum of Understanding
including the U.S. Fish and Wildlife Service, NCDOT, Wildlife
Resources Commission and the N.C. Nature Conservancy.
Although initially viewed with skepticism by other agencies,
the concept has worked well and agency acceptance has
been broad based.
The NCDOT would like to propose a similar mitigation
banking program for coastal wetlands. At the present time,
we are investigating a number of sites where salt marsh
creation could be undertaken. I also understand your desire
to consider causeway removal in instances where an obvious
water quality degradation issue is at stake. The bank
"credits" would be derived from upstream habitat improvement,
we are certainly willing to discuss all viable alternatives
with your office.

SR 1161.

9. NARRATIVE DESCRIPTION: The proposed project is located
north of Beaufort, approximately 5 miles off of SR 101, on
SR 1161, adjacent to tributaries of Bell and Eastman Creeks,
in Carteret County. The North Carolina Department of
Transportation proposes to improve 1.3 miles of SR 1161 from
an existing approximately 18' wide soil road to 20' of
asphalt pavement for a two-lane facility. The majority of
the road is not within the CAMA 75' AEC or coastal wetlands.
Three (3) areas of coastal wetlands would be filled by
widening of the road. Area 1 (see plat) is adjacent to Bell
Creek and would impact up to 370 ln. ft. of coastal wetlands
vegetated primarily with Spartina Alterniflora and to a
lesser degree, Spartina patens, Juncus roemerianus, and
Distichlis spicata. Road width will be expanded from an
existing width of approximately 30' (ditch -to -ditch) to 50'
(toe -to -toe) of fill. Area 1-A is adjacent to Eastman Creek
and would impact up to 430 ln. ft. of coastal wetlands
vegetated primarily with Spartina alterniflora, Spartina
Patens and Distichlis spicata. The road width will be
expanded from an existing width of 28' to 30' to a new width
of 321. The existing bridge will not be replaced or
widened. Area 1-B (see plat) is adjacent to Eastman Creek
and would impact up to 500 ln. ft. of coastal wetlands
vegetated primarily with Spartina alterniflora, Spartina
Patens and Distichlis spicata. The road width will be
expanded from an existing width of 20' (ditch -to -ditch) to
32' (toe -to -toe) of fill.
10. ANTICIPATED IMPACTS: The project, as proposed, will result
in widening and paving of 7,900 ln. ft. (1.3 miles) of NCSR
1161. Three (3) areas of coastal wetlands would be filled.
Area 1 would contain approximately 0.14 acres of primarily
Spartina alterniflora marsh, Area 1-A would contain
approximately 0 Al acres of coastal wetlands, and Area 1-B
has approximately .03 acres of wetlands. The proposed
project would also result in approximately 1,189 cu. yds. of
material being placed in coastal wetlands, and approximately
340 cu. yds. of fill material being placed below the MHW
line. Eastman Creek and Bell Creek are designated as
Primary Nursery Areas by the N.C. Division of Marine
Fisheries. Pavement of this road will increase stormwater
runoff. The applicant proposes to use silt fencing to
contain all fill material on the site to prevent
sedimentation runoff of material.

other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-

An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 rh x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of•
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by

of pavement for a 2 lane facility. In the process, an
estimated total of 0.24 acres of tidal marsh land will be
impacted at three locations. In Area 1 there will be an
estimated 340 cu. yds. of fill material placed below mean
high water. In Areas 1-A & 1-B there will be no excavation of
material or fill placed beyond existing shoulder point.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under

sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.

ing that agency's. use. of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These

The Division of Coastal Management hereby acknowledges

property located on SR 1161 in Carteret County. It was received
on June 19, 1989, and appears to be adequate for processing at
this time. The projected deadline for making a decision is
September 2, 1989. An additional 75-day review period may be
necessary and if so you will be advised of the extension and the

NCGS 113A-119(b) requires that Notice of an application be
posted at the location of the proposed development. Enclosed you
will find a "Notice of Permit Filing" postcard which must be
posted at the property of the proposed development. You should
post this notice at a conspicuous point along the property where
it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting the property; or at a point along the
road right-of-way where a private road would lead one into the
property. Failure to post this notice could result in an
incomplete application.
