The mitigation plan must be approved, and the initial mitigation activities be completed by December 31, 1990. 2) No excavation or fill material will be placed at any time, in any marsh or surrounding waters outside of the alignment of the filled area indicated on the work plats. 3) For those areas which are filled, silt screens or other retaining structures must be installed on the waterward side of the filled areas. Other appropriate erosion and sedimentation control measures will be employed, where necessary. (See attached sheet for Additional Conditions) This permit action may be appealed by the pemtittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. At that time, NCDOT had committed to provision of compensatory mitigation for 0.24 acres of wetland impacts. Construction at this site has since been completed. The mitigation and monitoring plan designed to replace the saltmarsh filled during construction is hereby submitted. We are proposing to create 0.51 acres of tidal saltmarsh at a property directly adjacent to the project, less than one mile north of the wetland impact area. This will be accomplished by grading of an upland area to the elevation of the surrounding saltmarsh, followed by planting of Juncus roemerianus. The mitigation site is currently covered with pines and shrubs, and is used as an unofficial dumping site. The trash will be removed to a suitable landfill. It is likely that dumping at this site will no longer occur after the shrubby vegetative cover is removed, and vehicular access to the site is made more difficult. This plan represents a 2:1 ratio of in -kind mitigation within the vicinity of the lost resource. STATE HIGHWAY ADMINISTRATOR Mr. Jerry McCrain of our Planning and Research staff has indicated that our September 6, 1989 proposal to debit a future wetland bank for anticipated wetland losses associated with the above referenced project is unacceptable. We understand that acceptance of a banking concept for coastal wetland losses is still a issue for discussion but that an alternative strategy should be employed for the SR 1161 project. As you are well aware from previous visits to the project area, on site options for mitigation of 0.24 acres of fringing marsh encroachment along SR 1161 are somewhat limited. We are currently investigating opportunities for creation of similar wetland community types at off site locations. However, suitable sites for such purposes have yet to be selected. In the meantime, it is imperative that improvements to SR 1161 proceed. Work has already been initiated along adjacent segments of the roadway where wetland involvement is not expected and continuity with ongoing efforts is critical. The NCDOT is willing to commit to creation of 0.24 acres of marsh at a site to be selected at a later date, subject to concurrence and approval from LAMA. Every effort will be undertaken to minimize involvement whenever possible but total avoidance is impossible. our Department recognizes a need to provide for mitigation and a number of alternatives were addressed at our August 24th meeting. The N.C. Department of Transportation has been investigating coastal wetland banking as a viable mitigation option for some time. This approach may provide the best opportunity for compensation when takings are minor or unavoidable, as with the SR 1161 project. We are unable at this time to provide a definitive schedule of projects over the 10 year life of the new funding package; however, these documents will give you some idea of anticipated activities. Document ##1 is a "Wish list" of major projects to be added to the TIP program. Document (#2 is a synopsis of bridge replacements using bridge maintenance funding and generally handled at the Division level. Document ##3 is a more detailed breakdown of projects in Division 1 which includes some of our more sensitive coastal areas, particularly in Dare, Currituck and Hyde Counties. Highway funding is expected to increase after Year 3 since State employee raises will not be siphoned from targeted road monies. Much of our work will be maintenance oriented to be handled at the Division level. Many of these projects will be "quick scheduled" on a need basis and, therefore, will be difficult to predict. Environmental ramifications and the possible need for permits are also difficult to assume. As always, the Transportation Improvement Program (TIP), representing our major project listings, is also subject to change. Our Department is very conscious of the environmental concerns associated with infringement in intertidal communities or on coastal waters; every project is scrutinized in order to minimize impacts whenever feasible. However, total avoidance is impossible. In many cases, on - site restoration or creation is not feasible or cost effective. A detailed analysis of our Broad and Gales Creek Projects in Carteret County indicate a cost of $144,800/acre for on site creation or $1.4 million/acre for expansion of the bridge openings to alleviate marsh impacts. I don't believe these options represent a viable solution that is in the best public interest nor do the costs necessarily justify the benefits received. I believe a practical solution to the problem may be through mitigation banking. Our Company Swamp Bank on the Roanoke River was established in 1985 as an alternative mitigation strategy for bottomland hardwood losses. The bank is only utilized as a last resort and only under mutual agreement by all parties of the Memorandum of Understanding including the U.S. Fish and Wildlife Service, NCDOT, Wildlife Resources Commission and the N.C. Nature Conservancy. Although initially viewed with skepticism by other agencies, the concept has worked well and agency acceptance has been broad based. The NCDOT would like to propose a similar mitigation banking program for coastal wetlands. At the present time, we are investigating a number of sites where salt marsh creation could be undertaken. I also understand your desire to consider causeway removal in instances where an obvious water quality degradation issue is at stake. The bank "credits" would be derived from upstream habitat improvement, we are certainly willing to discuss all viable alternatives with your office. NARRATIVE DESCRIPTION: The proposed project is located north of Beaufort, approximately 5 miles off of SR 101, on SR 1161, adjacent to tributaries of Bell and Eastman Creeks, in Carteret County. The North Carolina Department of Transportation proposes to improve 1.3 miles of SR 1161 from an existing approximately 18' wide soil road to 20' of asphalt pavement for a two-lane facility. The majority of the road is not within the CAMA 75' AEC or coastal wetlands. Three (3) areas of coastal wetlands would be filled by widening of the road. Area 1 (see plat) is adjacent to Bell Creek and would impact up to 370 ln. ft. of coastal wetlands vegetated primarily with Spartina Alterniflora and to a lesser degree, Spartina patens, Juncus roemerianus, and Distichlis spicata.
