This permit, issued on 12/19/89 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) In order to protect juvenile slrinp.& fin fish populations, no excavation or fill-
ing will be permitted between April 1 and September 30 of any year without
the prior approval of the Division of Coastal Management, through the Division
of Marine Fisheries.
2) The bridge will be replaced with (4) 128" by 83" steel pipe arches in accordance
with the attached plats.
3) All fill materials will be obtained from a highground source and confined with-
in the proposed roadway width.
4) The fill materials will be clean and free of any pollutants except in trace
quantities.
(See Attached Sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1992
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

5) Appropriate erosion and sedimentation control devices, measures, or structures
(e.g., silt fence, diversion swales/berms and sand fence, etc.) will be used to
prevent sediment from entering the adjacent wetlands and watercourses.
6) The activity will be conducted in such a manner as to prevent significant in-
creases in turbidity outside the area of construction or construction -related
discharge.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1665 issued on September 19, 1983, for incidental bridge construction.

After further discussions with the Division of Marine Fisheries,
I recommend denial of a Dredge and Fill permit based on G.S.
113-229(e)(5) and a CAMA permit based on inconsistencies with the
following rules:
1. 15 NCAC 7H.0206(c) which are the Management Objectives of
Estuarine Waters; and,
2. 15 NCAC 7H.0208(a)(2)(B) which requires that the applicant
has selected a site (design) which will have a minimum
adverse impact upon the spawning and nursery areas.

Management Act major development and State Dredge and Fill permit to carry out
construction on SR 1300, Merrimon Road, Bridge $4, Carteret County. Although
processing of the application is nearing completion, additional time is needed
for this office to complete the review and make a decision on your request.
Therefore, it is necessary that the standard review time be extended. An
additional 75 days is provided by G.S. 113A-122(c) which would make December
30, 1989 the new deadline for reaching a decision on your request. However,
we expect to take action prior to that time and will do so as soon as
possible. In the interim, if you have any question on the status of your
application, do not hesitate to contact this office.

DEVELOPMENT PERMIT
The Department of Environment, Health and Natural Resources
hereby gives public notice as required by NCGS 113A-119(b) that
application for a development permit in an Area of Environmental
concern as designated under the CAMA was received on August 2,
1989.
According to said application, the North Carolina Department
of Transportation is proposing to replace the existing bridge
with steel pipe arches located at Cullie Creek (off Adams Creek),
on SR 1300, Bridge #4, near Merrimon, Carteret County.
A copy of the entire application may be examined or copied
at the office of David Noble, Division of Coastal Management,
located in the Division of Marine Fisheries Building, Morehead
City, N.C., (919/726-7021) during normal business hours.
Comments mailed to Dr. George Everett, Director, Division of
Coastal Management, P. O. Box 27689, Raleigh, N. C., 27611, prior
to October -l0, 1989, will be considered in making the permit
decision. Later comments will be accepted and considered up to
the time of permit decision. Project modification may occur
based on review and comment by the public and state and federal
agencies. Notice of the permit decision in this matter will be
provided upon written request.

8. PROJECT SUMMARY: The proposed project is to replace the existing

9. NARRATIVE DESCRIPTION: The proposed project is for NCDOT to
replace an existing bridge with four (4) 128" x 83"
corrugated steel pipe arches.
The project site is located at Cullie Creek (off Adams
Creek), on SR 1300, near Merrimon, in Carteret County.
Approximately 555 cu. yds. of sand and muck will be removed
from below MHW and about 185 cu. yds. of material will be
excavated from highground from a total area of 4,000 sq. ft.
(50' x 801). Approximately 335 cu. yds. of fill material
and the four (4) steel pipes will be placed below MHW.
The proposed work is to be conducted by dragline and dump
truck. All spoil materials will be trucked to a highground
disposal site.
The project site has a partial marsh fringe primarily
consisting of Juncus roemerianus, Typha spp. and Cladium
jamaicense. Approximately 100-200 sq. ft. of high marsh
will be excavated from this fringe but it is expected that
the marsh will reestablish a fringe around the stabilized
fill area.
10. ANTICIPATED IMPACTS: The project will place 335 cu. yds. of
fill material below MHW in a 4,000 sq. ft. area of estuarine
waters in Cullie Creek.
The waters of Cullie Creek are open to shellfishing by the
Division of Health Services and Division of Marine
Fisheries, classified as 'SA' by the Division of
Environmental Management, and designated as a Primary
Nursery Area by the Division of Marine Fisheries.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of laid property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner, to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 ii4 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7j.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the US. Army Corps of Engineers regard-
ing that agency's *use of larger drawings) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal' Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

SUBJECT: Replacement of Bridge No.4 along SR 1300 over
Cullie Creek, Carteret County (Div. maintenance)
The North Carolina Department of Transportation proposes
to replace the bridge over Cullie Creek near the town of
Merrimon in Carteret County. The structure will be replaced
in existing location with four, 128 in. % 83 in. corrugated
steel pipe arches. The existing bridge is 50 feet in length
which spans the 35 ft. wide creek basin. Replacement will
require widening of the creek channel in order to allow 42.6
feet of surface water movement through the pipes. This
action will involve the placement of approximately 335 cu.
yds. of fill below ordinary high water.
Several replacement alternatives were investigated
during planning phases of this project. A "no build"
alternative was not selected because of the need to replace
the existing facility in an effort to provide continued
service along SR 1300.
A second option involved bridge replacement in existing
location utilizing an on -site detour. However, this
alternative was not selected because of extensive wetland
involvement and prohibitive cost ($215,000 vs $45,000 for the
preferred alternative). Utilization of pipes is not only
less expensive, but will also provide for improved water flow
through expansion of the existing channel.
Application is hereby made for Department of the Army
authorization as required for the subject work. Attached is
the permit application and drawings depicting proposed
improvements.

Although Carteret County is within the jurisdictional
limits of the N.C. Coastal Area Management Program, we
believe that communities involved with bridge replacement may
not come under LAMA control for permit purposes. Should LAMA
jurisdiction prevail, it is requested that this letter and
application package be considered for LAMA permit
authorization.
By copy of this letter, we also request issuance of 401
Water Quality Certification by the Division of Environmental
Management, NRCD.

NCGS 113A-119(b) requires that Notice of an application be
posted at the location of the proposed development. Enclosed you
will find a "Notice of Permit Filing" postcard which must be
posted at the property of the proposed development. You should
post this notice at a conspicuous point along the property where
it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting the property; or at a point along the
road right-of-way where a private road would lead one into the
property. Failure to post this notice could result in an
incomplete application.
