An exception to this deletion is stated in Condition No. 2 below. 2) Removal of the fill associated with the temporary detour will be carried out from October 1-March 31. 3) All excavation and fill activity must adhere to all other applicable terms of the original permit and with paragraph three of the application letter referenced above. NOTE: The permittee is requested to initiate any and all reasonable measures that will prevent turbidity levels from increasing in the environmentally sensitive project•area. _ I This permit action may be appealed by the pemtittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. This material is under the temporary detour bridge at Gales Creek and can not be removed until such time as the bridge is demolished. It is anticipated that this excavation will be complete on or before Mav 31, 1993. Also, there is a minor amount of material which needs to be removed from the boat slip adjacent to the temporary detour road on the east side of Broad Creek and this excavation should be complete by April 16. 1993. Reference is made to condition number two of permit numbers 155-90 and 156-90 as amended which states "Removal of the fill associated with the temporary detour will be carried out from October 1 - March 31". If permission is granted to remove this material, any and all reasonable measures will be taken to prevent turbidity levels from increasing in these areas. I support issuance of the necessary State permits and offer the following conditions for your consideration: 1. Department of Transportation of Raleigh, NC, filed a revised application on August 23, 1990, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application, the applicant is proposing to replace Bridge #23 over Gales Creek with a new structure. A temporary detour and bridge will be installed on the downstream side of NC Hwy. 24, over Gales Creek, in Carteret County. PROJECT SUMMARY: The 'revised' project plans have increased the intertidal bridge opening from 100' (in the original proposal) to 185' at the MHW level (buttress to buttress). The Gales Creek bridge will be constructed similar to the Broad Creek bridge, with 6 individual spans each 37.5' long for a total bridge surface of 225'. 9. NARRATIVE DESCRIPTION: In order to create the increased opening, a,portion of the old causeway will be excavated. On the west side of the bridge, an area measuring 50' x 70' will be excavated to a depth of approximately 2.5' relative to MLW. A similar size area on the east side of the existing bridge will also be removed. The excavation is an effort by DOT to .enhance the tidal flushing capabilities of Gales Creek and create shallow -water habitat. Excavation in these two areas will not directly involve coastal wetlands or any of the known submerged aquatic vegetation since the existing bridge abutments are stabilized by bulkhead construction and the SAVs are located outside of the excavation alignment. In addition, the increased bridge length has eliminated a significant amount of fill in the shallow waters of Gales Creek where the majority of the known SAVs reside. An estimated 13,500 sq. ft. of open -water fill has been eliminated by the increased bridge opening. Approximately 21,000 sq. ft. of intertidal habitat will now be subject to filling. The fill requirements on coastal wetlands, at the project site, remain basically the same at approximately 20;000 sq. ft. The vegetation in all four quadrants of the project is dominated by saltmarsh cordgrass and black needlerush. An estimated 11,800 cu. yds. of improved fill will be placed below the level of the MHW shoreline creating the new wider roadbed. Half of the projected fill operation will take place on the north side of Hwy. 24 within the designated Primary Nursery Area. Fill requirements on the southwest side of the bridge may impact an area of submerged aquatic vegetation estimated to be only 500 sq. ft. The extent of this impact will depend on the offshore extent of the roadway slope. 10. ANTICIPATED IMPACTS: The proposed bridge replacement and subsequent improvements to N.C. Hwy. 24 will greatly improve public safety and the driveability of the highway. Increased vertical clearance 8' under the bridge will improve, to a limited basis, the. accessibility of the upper reaches of Gales Creek by small boats. FIELD INVESTIGATION REPORT - N.C. PAGE #3 The revised bridge opening will -significantly reduce the amount of open -water fill and direct impacts on beds of submerged aquatic vegetation. The proposed remedial excavation associated with the increased intertidal opening should enhance the flushing capability of Gales Creek, and at the same time, provide some 14,000.sq. ft. of substitute habitat. The applicant should be encouraged to employ strong sedimentation measures around the open -water fill requirements, particularly, in the Primary Nursery Area in an effort to reduce.potential impacts of turbidity on juvenile fish populations. Dear Mr Mercer: Per our phone conversation regarding questions on above, I am informally transmitting the enclosed marked -up drawings for your review. Hopefully, the revisions will answer the questions. Re the question on scour: the refers to that caused by the contraction in the stream due to the causeway. Local scour is caused by the flow right at the piers. Both are calculated per federal highway admin rules for assumption of "sand only." This is a worst case. Actual geotechnical borings will be taken and usually show something less than worst case is likely to occur. In any case, the scour lines are only for "at storm flow" conditions and if it does occur, it will silt back up again to a higher elevation. The design of the bridge and its approaches need to be constructed with the future in mind. The Marine Corps has designated Highway 24 as a primary route from the staging areas of Camp Lejeune to the embarkation ships in Morehead City. This route is across the proposed replacement bridge. The past two years has seen a significant increase of Marine Corps deployment as their mission is expanded in answer to world crisis. The County Evacuation Plan (June 1984) designated Highway 24 as a primary route. The past year saw the plan used to the maximum, as a storm passed thru the area. On the citizen aspect, Carteret County is growing at a 10.9% rate, the fourth fastest in the state. With the increase of population, we have felt the increase pressure for additional recreation areas. We have interfaced all the above into the following recommendations: 1. The replacement bridge should be four lanes with a pedestrian walkway. Highway 24 is in the D.O.T.'s ten year program to be widen to four lanes. 2. Maximum weight limit should be 40 tons. Military movements require this limit. 3. The height of the bridge should be at least 10 feet above mean sea level for the lowest support member. Carteret County is under the Federal Flood Program, the area of Gales Creek is in a V-7, Elevation 10 feet. 4. For traffic safety the approaches should be improved. Presently there exists a curve and dip on the approaches to both sides. Numerous accidents have occurred over the years, particularly at night because of the present configuration. the abutment should be built on the natural shoreline, this would help eliminate the dips. 'These jetties restrict the normal tidal actions of flushing the area north of the bridge. This area is designated a primary nursery and as such does need the normal tidal flow. This designation does not prevent the north area being used for recreational purposes, such as boating, swimming, fishing, etc. Dredging activities are banned. As you know, we are currently processing DOT's applications for the two bridge replacement projects. During the course of my site evaluation on June 14, I encountered an area of submerged aquatic vegetation on the west side of Gales Creek above and below the bridge abutment adjacent to the highway alignment. The vegetation is dominated by eelgrass (Zostera marina). I have estimated an area of 2500 sq. ft. will be directly displaced by the proposed filling requirements. Additional habitat conducive to the growing of eelgrass may also be impacted. Hopefully, the National Marine Fisheries Service will quantify these impacts in their evaluation of the permit request. I think the idea of grass beds at this location will come as a revelation to most of the review agencies. The grass bed resource was not discovered by DOT in its field survey, and thus, was not addressed in their environmental assessment or FONSI. As you know, grass beds are a most sensitive resource on the order of Primary Nursery Areas in terms of resource productivity. Please let me know if we can be of further assistance. DOT proposes to replace Bridge #23 a section of Hwy. 24 over Gales Creek; 'fill' requirements will displace coastal wetlands and estuarine habitat. A detour will be provided. 9. NARRATIVE DESCRIPTION: The project site, known as Gales Creek Bridge (#23), is located on N.C. Hwy. 24, about 6 miles west of Morehead City, just off Bogue Sound, in Carteret County. Highway 24 is classified as a Federal Aid Primary Route, and a National Defense Highway, providing military access to -and -from Camp Lejeune in Jacksonville and the State Port in Morehead City. The original concrete pile supported structure was built in 1942. The N.C. DOT proposes to replace the 100' long bridge and widen the highway approaches on the existing alignment. The new bridge span will measure 140' from riprap buttress to riprap buttress and,will produce an intertidal opening of approximately 100' to 120' at MHW. This represents an increase of about 20' in the channel opening under the bridge. The width of the proposed bridge will be increased from 3 lanes at 38' to 5 lanes at 761. The proposed right-of-way will vary from 120' to 150'-. Some 35,000 cu. yds. of fill material will be used to raise the roadway height and increase its width. Fill requirements for the new road will displace approximately 2&,000 sq. ft. of coastal wetlands and 35,000 sq. ft. of shallow water habitat. The coastal wetlands which occur as fringed marshes are equally distributed along the existing right-of-way above and below the bridge. The regularly flooded marsh vegetation is dominated by saltmarsh cordgrass (Spartina alterniflora) and black needlerush (Juncus romerianus). A portion of the shallow water habitat on the west side of the creek, above and below the bridge abutment, is occupied by submerged aquatic vegetation. The 2 grass beds appear to cover an area of 50' x 20' and 50' x 30'. The dominate vegetation appears to be eelgrass (Zostera marina). Although the apparent size of the grass beds cover an estimate 2500 sq. ft., scientific experts in this discipline may conclude that additional grass habitat occurs within the project alignment. It is noted that the 'SA' surface waters of Gales Creek above the bridge are designated as a Primary Nursery Area by the Division of Marine Fisheries. The overall elevation of the roadway will be increased by 51. This will produce a vertical clearance under the bridge of 7.5' between MHW and the lowest support structure of the bridge. This should provide limited FIELD INVESTIGATION REPORT - N.C. DOT/L. R. GOODE, PH.D., P.E., GALES CREEK BRIDGE #23, CARTERET COUNTY PAGE #3 boating access to the upper reaches of Gales Creek. A temporary bridge, or detour, will be constructed on the south side of NC Hwy. 24. As proposed, the pile supported structure will span the entire distance across Gales Creek about 800'. The project design does not include mitigation on or off site for the wetland losses and impacts to the shallow water resources. 10. ANTICIPATED IMPACTS: The proposed bridge replacement and subsequent improvements to NC Hwy. 24 will greatly improve public safety and the drive -ability of highway. Increased vertical clearance under the bridge will improve, on a limited basis, the accessibility of the upper reaches of Gales Creek by.small boat traffic. From an environmental viewpoint, the proposed project will adversely impact the designated Primary Nursery Area by directly filling 0.25 acres of coastal wetlands and 0.40 acres of shallow water habitat. These figures represent half of the overall estimated fill on wetlands and open water areas. Recent onsite inspections reveal the presence of approximately 2500 sq. ft. of submerged aquatic vegetation dominated by eelgrass. These resources, part of which occur in the Primary Nursery Area, are scheduled for displacement by the proposed filling operation. Workplat Sheet 2 of 6 illustrates how the 'filling' requirements around the approaches will extend beyond bridge abutments causing a closure or restriction in the overall channel opening. The issue of restricting the channel opening in the Primary Nursery Area is compounded by DOT's requirement to widen the right-of-way to a full 150' at the abutments. It seems logical to assume that current velocities will increase as the tidal waters pass through a longer restricted channel area. This may give rise to increased scour in the channel bottom, creating sediment fallout on the upstream side of the new bridge. CAMA REVIEW SECTION: The 1985 Land Use Plan for Carteret County classifies the Primary Nursery Area of Gales Creek as a 'conservation zone'. Although public bridges and approach roads may be considered water dependent uses, the proposed project will directly displace a significant amount of coastal wetlands and shallow water habitat that include FIELD INVESTIGATION REPORT - N.C. This was developed with input from several of you. Secretary Cobey has reviewed this statement and strongly supports the policy that DOT must modify their proposals along the lines we suggest to adequately address the environmental impacts of the bridge construction projects. This statement should serve as a springboard for our discussions with DOT staff on Monday. Background The existing bridges on NC24 over Broad and Gales Creeks were built in 1942. Each two lane structure is about 95 feet long. Earthen causeways traverse the balance of the creeks. Broad Creek is about 600 feet wide and Gales Creek is about 700 feet wide. Both creeks are designated as primary nursery areas but they are closed to shellfishing. They have been closed for some time due to high fecal coliform counts. Improved tidal flushing reduces this problem. Examples are the construction of the on -site detour downstream of the current structure, providing material from demolished bridges for our artificial reef program, and build fishermens walks if NRCD arranges funding for the catwalks, parking, and pedestrian access. DOT has consistently failed to acknowledge repeated concerns raised by NRCD and Federal agencies to.lengthen the span of both bridges in order to promote tidal flushing while reducing adverse effects on wetlands. THE DIVISION OF MARINE FISHERIES (DMF) HAS REQUESTED A MINIMUM LENGTH OF 300 FEET FOR EACH BRIDGE. DMF and the Division of Coastal Management (DCM) have both raised objections to the Finding Of No Significant Impact (FoNsi). we will attempt to resolve our differences with DOT prior to objecting formally through the state clearinghouse process by meeting with them June 5 at 10 A.M. The Division of Environmental Management (DEM) and the Division of Planning & Assessment (P&A) staff will also represent NRCD. National Marine Fisheries•Service and the Fish and Wildlife Service are federal agencies invited to participate. The remaining critical issue to be resolved is the length of each bridge. Length of Bridge There are two environmental impacts associated with bridge length, wetlands and tidal flushing of the primary nursery area. Wetlands mitigation is dismissed because it is too expensive to protect or create about two acres. Estimates range from $217,500 to $2 million. "No net loss" is a new federal policy that DOT should consider. NRCD reviewers have not raised serious objections about environmental impacts on wetlands in the review process to date. DOT has dismissed tidal flushing as an issue by contracting with two North Carolina State University (NCSU) faculty members for a "Broad and Gales Creek Flushing Analysis". The results of the study are that there is no significant difference in tidal flushing between a bridge opening of 30 meters compared to an opening of 100 meters. "These results indicate for the conditions and assumptions used in this analysis that there is no increase in tidal flushing to be gained from increasing the width of the bridge openings for these two creeks." NRCD objects to the dismissal of tidal flushing on several grounds: 1. The closed shellfishing in the PNA is exacerbated by insufficient flushing. Our fisheries biologists maintain improved tidal flushing will significantly reduce the problem. TIDAL FLUSHING IS IMPORTANT. We have serious reservations about the data chosen to run the model. a. The dispersion rate was assumed to be one square mile per day. This greatly exceeds dye dispersion tests conducted in similar situations by DEN. b. The predicted salinity differences were greatly exaggerated compared to DEN experience. C. The assumed freshwater inflow was an average rate where a lower 60 to 90 day low flow rate is more appropriate. In short, all assumptions bias the results toward no significant difference in flushing with a longer bridge span. No sensitivity analyses (model runs with different assumptions) were displayed to reinforce the robustness of the model nor was the model calibrated to local conditions. THE FLUSHING ANALYSIS IS FATALLY FLAWED. 3. The costs of a longer bridge and wetlands mitigation appear to be exaggerated. DOT estimates the cost of the bridge at $4,800 per linear foot (page 12). However, in the Environmental Assessment Section concerning each bridge, structure costs are only an average of about $3,400 per linear foot (page 2, table of estimated costs). Project costs are not consistent in the document, e.g, page 14 of the FONSI document compared to page 2 of each Environmental Assessment. 1985 data indexed to 1989 put the estimate at slightly more than $3,000 per linear foot. in addition, these are average costs per foot rather than marginal costs per foot (the Cost of an additional foot in the center of the bridge) which should be even lower. Finally, approach costs will decline as the bridge lengthens. Approach costs must be subtracted from the increased bridge cost to obtain the change in cost for the project. Wetlands mitigation cost of $145,000 per acre is highly suspicious, especially the land cost of $98,000 per acre. PROJECT COSTS MUST BE RECOMPUTED. DOT is systematically decreasing the benefits to any action reviewers propose which mitigates environmental damage and is increasing the cost to achieve the mitigation. It appears that these bridge replacement projects will have a significant environmental impact to estuarine resources with the filling in of almost 2 acres of either coastal wetlands or shallow bottom and water habitat areas. This document indicates that no mitigation to these adverse impacts are proposed and that best management practices will be substituted as appropriate mitigation measures. This is clearly inconsistent with the Coastal Resources Commission's mitigation policy (15 NCAC 7M .0700) and the general guidelines for development in AEC's (15 NCAC 7H). Furthermore, the document indicates that the justification for not doing mitigation is due to infeasible and/or costs of wetlands creation estimated between $145,000.00 to $1,350,000.00 per acre. These estimates seem particularly high, especially in terms of the value assigned to land acquisition ($98,000.00 per acre). The document also contains justification of why a larger bridge span would not improve water quality conditions in the upstream portions of the creeks. I'certainly would have to defer to other agencies with expertise in evaluating water quality models as to whether the assertions made in this document is correct. But, from a layman's perspective, I would question whether wind conditions should not have been factored into the model. This is particularly relevant when one realizes that there is generally always a sea breeze blowing across Bogue Sound, and it is not uncommon for winds to blow steadily in the summer from the south to southwest at 10 to 15 knots for days at a time. Previous studies done by DOT have evaluated different alternatives for the location of a new bridge. One of the proposals looked at was for the construction of a new bridge which would span the entire width of the creeks. While the initial cost of the structure was higher than the recommended existing alignment, there are certain positive benefits of a new bridge at a new location which I feel DOT should re-evaluate. One benefit would, of course, be the bridge expanding the entire creek and consequently not having any adverse impact to estuarine resources. Such a proposal would be consistent with CRC MEMORANDUM: RE: CONSISTENCY REVIEW - sCH89-0790 APRIL 27, 1989 PAGE #2 guidelines and would not require any additional monetary costs to DOT for needed mitigation. This proposal would also eliminate any need for a temporary detour bridge. This would not only represent a savings of at least $390,000.00 (1988 estimate for Broad Creek), but certainly would allow for a far more safer movement of cars over the creeks than would be available over a temporary bridge structure. Spanning the creeks would also eliminate any perceived or real concerns over the issue of enhancement of water quality conditions. Additionally, small portions of the old approach ways could be left in tact and provide public access and parking to these water bodies. The professional opinion of Dr. John Miller, North Carolina State University (NCSU) Zoology Department, is that causeways across tidal creeks have undoubtedly altered circulation patterns within the creeks, which would therefore impact sedimentation, the benthic biota, and periods of inundation. Dr. Miller is currently working with a French scientist who has demonstrated that impedance to flow in lagoons has produced areas prone to anoxic conditions and this is clearly demonstrated in the benthic biota. He recommended that a study of sediment cores from these creeks be undertaken to determine if anoxic conditions were created by the causeways. Gary Evink of the Florida Department of Transportation studied a bridge -causeway system in the Indian River, FL before and after construction. His observations of the effect of the causeway included wastewater loading, formation of organic sinks, low dissolved oxygen, and sedimentation in the corner areas. He stated that the flow in a system with causeways is in a straight line rather than in a sheet across the system and thus there is a tendency for "dead" areas to form. NRCD strongly recommends further study be undertaken in Broad and Gales Creeks to investigate sedimentation away from the channels, effects on.the benthic biota, and the potential for anoxic conditions to develop behind the causeways. Until a more thorough study is conducted NRCD cannot concur with the results or assume that the hydrologic study conducted at NCSU adequately addresses our concerns about tidal flushing. This document also indicates that best management practices will be substituted as appropriate mitigative measures. This is inconsistent with the Coastal Resources Commission's mitigation policy and general guidelines for development in AEC's. Adopting mitigation measures would not only comply with these laws but would protect the aquatic vegetation recently discovered by the Division of Coastal Management (DCM) on the west side of Gales Creek. According to DCM the vegetation is dominated by eel grass and about 2500 sq. ft. would be directly displaced by the proposed filling requirements proposed by DOT. With grass beds being a sensitive resource, on the order of Primary Nursery Areas in terms of resource productivity, DCM continues to find these projects inconsistent with the CAMA use standards for development. In conclusion, this Department feels that before these bridge replacements are allowed, adequate assessment of their impacts on our resources must be made. Concerns revealed by our review show that the FONSI is not warranted in this instance. Before such a determination can be accepted outstanding issues previously discussed must be addressed by amending the EA/FONSI to support such a finding. Additional habitat conducive the growing of eelgrass may also be impacted. Hopefully, the National Marine Fisheries service will quantify these impacts in their evaluation of the permit request. I think the idea of grass beds at this location will come,as a - revelation to most of the review agencies. The grass bed resource was not discovered by DOT in its field survey, and thus, was not addressed in their environmental assessment or FONSI. The hearing will consist of an explanation of the proposed design, right of way requirements and procedures, relocation advisory assistance, and State -Federal relationship. The hearing will be open to those present for statements, questions, comments and/or submittal of material pertaining to the proposed design. Additional material may be submitted for a period of ten days from the date of the hearing to: W. A. Garrett, Jr., P. O. Box 25201, Raleigh, NC 27611. The proposed project is the widening of existing NC 24 to 0 641 pavement. This will provide 4 travel lanes and a center left turn lane. An additional 10, of right of way will be required from each side of the present right of way. U A map setting forth the location and design and copies of the environmental assessment are available for public review at the N. C. D. O. T. Maintenance Office, Newport.
