Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) Compensatory mitigation will be provided in accordance with the permit plans. Prior to commencement of work, the N. C. Dept. of Transportation will submit a plan, for review and approval by the U. S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS), in consultation with the Div. of Coastal Management and key state reviewing agencies, for vegetating and monitoring the marsh restoration areas. The plan will include planting of blackneedle rush at sufficient densities to ensure that vegetative cover of at least 75 percent is achieved within 2 years of establishment of the marsh elevation. 2) The fill material will be clean and free of any pollutants, except in trace quantities. 3) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department Personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. According to said application, the applicant is proposing to replace the existing bridge over Feltons Creek with a new one, fill an existing ditch and excavate a new one, and fill wetlands in conjunction with a new approachway on SR1300, near -the community of North River, Carteret County. A copy of the entire 'application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Charles Pigott, Division of Coastal Management, located in the Division of Marine Fisheries Building, Morehead City, •N6C., 919/726-7021, and/or the office of Preston Howard, Division of Environmental Management, DEHNR Regional Field Office, Wilmington, N.C., (919) 395-3900. NARRATIVE DESCRIPTION: The project site is located on SR1300, approximately 2.7 miles north of the intersection of US Highway 70, east of Beaufort, Carteret County. The present bridge spans Feltons Creek, a small brackish water tributary of North River. This bridge was originally constructed in 1940 and has an overall length of 47' with a roadway width of 291. The vertical clearance of the bridge over Feltons Creek -is approximately 2=' MLW and it does not appear that navigation occurs underneath the structure. The existing approachways immediately adjacent to the bridge have an approximately 19' wide pavement and a narrow road shoulder which grades into adjacent wetlands vegetation. On the northeast quadrant, an unapproved boat launching area exists and on the northwest quadrant, an approximately 5' wide ditch was excavated in wetlands many years ago and provides drainage for upland properties. Coastal wetlands adjacent to the roadway consists primarily of Juncus roemerianus marsh with scattered amounts of Spartina patens, Spartina alterniflora, and Distichlis spicata. Feltons Creek has been designated as 'SA' and a Primary Nursery Area, and are closed to the harvesting of shellfish. NCDOT is proposing to remove the existing bridge and replace it with a new structure which would be approximately 90' long x 28' wide. A 22' pavement with 6' shoulders are proposed on the approaches for a distance of 300' on each side of the bridge. The new bridge alignment would be shifted slightly to the west so that one (1) lane of traffic - could be maintained on the existing bridge during construction activities. Because of this shift in bridge and roadway alignments, approximately 3,200 sq.,ft. of coastal wetlands would be filled. Additionally, approximately 235 ln. ft. of an existing drainage ditch on the northwest side of the rodd would be filled. A new drainage ditch (approximately 235' long x 4' wide) would be excavated parallel to the old ditch alignment. This new drainage ditch would be excavated through primarily Juncus roemerianus marsh. The DOT is also proposing to lower the elevation.of approximately 6,000 sq. ft. of highground road shoulder to adjacent wetlands elevations. 10. ANTICIPATED IMPACTS: The project as proposed will result in approximately 3,200 sq. ft. of coastal wetlands vegetated primarily with Juncus roemerianus marsh (and including Spartina alterniflora, Spartina patens, and Distichlis spicata) being filled in conjunction with the relocated approachways. An existing drainage ditch, measuring approximately 235' long x 5' wide would also be filled FIELD REPORT - NCDOT - SR1300, CARTERET COUNTY with approximately 85 cu. yds. of fill material being placed below the MHW line. A new ditch would be excavated through approximately 940 sq. ft. of Juncus roemerianus marsh. The applicant has indicated that approximately 7,100 sq. ft. of existing highground road shoulders would be excavated to elevations matching adjacent wetlands vegetation. •It appears, however, that approximately 1100 sq. ft. of this area is presently considered to be coastal wetlands. 1 Vegetative plantings are not proposed. I.D. NO. B-2010 Bridge No. 1 has been included in the current Transportation Im- provement Program. The location is shown in Figure 1. No substantial environmental impacts are anticipated. The project is classified as a Federal "categorical exclusion" by the Federal Highway Administration. I. SUMMARY OF RECOMMENDATIONS Bridge No. 1 should be replaced at the existing location as shown by Alternate 1 in Figure 3. A structure length of 90 feet and a width of 28 feet are recommended. Minor improvements to the existing approaches will be necessary for a distance of about 300 feet on each side of the bridge. The approach roadway should consist of a 22-foot pavement with 6-foot graded shoulders. The roadway grade of the new structure should be approximately the same as the existing grade at this location. Traffic (one lane) will be maintained on the existing bridge by constructing the new bridge in half sections. Estimated cost, based on current prices., is $ 531,000. The estimated cost of the project, as shown in the 1990-1996 Trans- portation Improvement Program, is $ 310,000. II. EXISTING CONDITIONS SR 1300 is classified as a rural major collector in the Statewide Functional Classification System and is not a part of the Federal Aid System. - u Some sparse residential development is present along SR 1300 south of the project area. The land adjacent to and north of the bridge is rural and marshy. In the vicinity of the bridge, SR 1300 has a 19-foot pavement with 10-foot to 18-foot shoulders (see Figure 6). Vertical alignment is flat. Horizontal alignment is tangent over the existing structure and to the north; however, a curve of about 12.5 degrees is located immediately south of the bridge and continues for a distance of about 200 feet (see Figure 2). The roadway is situated approximately eight feet above the creek bed. 2 The current traffic volume of 900 VPD is expected to increase to 1500 by the year 2010. The projected volume includes 0% truck -tractor semi -trailer (TTST) and 2% dual -tired vehicles (DTT). The posted speed limit is 55 mph. The existing bridge (see Figure 6) was originally constructed in 1940 and was reconstructed in 1964. The structure consists of a timber floor on timber joists and abutments. Overall length is 47 feet. Clear roadway width is 29.3 feet. The posted weight limit on this bridge is 11 tons for single vehicles and 25 tons for trucks with trailers. Bridge No. 1 has a sufficiency rating of 18.9 compared to a rating of 100 for a new structure. Five accidents have been reported in the vicinity of Bridge No. 1 during the period from January, 1986 to October, 1989. School buses make a total of six crossings daily. III. ALTERNATIVES Three methods of replacing Bridge No. 1 were studied. Each of these alternatives include a replacement structure 90 feet long and 28 feet wide. The alternatives are as follows: Alternate 1 (Recommended)- Replace structure at its existing loca- tion usinT�se construct o to build the new bridge in half -sections. One lane of traffic would be maintained on the existing structure during the construction period (see Figure 3). Alternate 2 - Replace structure at existing location. Traffic would be maintai n d cn-site by constructing a temporary detour to the west of the existing structure. The temporary detour would require two 60" pipes (see Figure 4). Alternate 3 - Replace structure on new location approximately 50 feet west oche existing structure. Traffic would be maintained on the existing structure during the construction period (see Figure 5). The "do-nothing" alternate would eventually necessitate closure of the bridge. This is not prudent due to the traffic service provided by SR 1300. Investigation of the existing structure by the Bridge Maintenance Unit indicates that rehabilitation of the old bridge is not feasible due to its age and deteriorated condition. 3 IV. RECOMMENDED IMPROVEMENTS Bridge No. 1 should be replaced at its existing location with a new structure having a length of 90 feet as shown by Alternate 1 in Figure 3. During construction, traffic (one lane) should be maintained on the existing bridge by constructing the new bridge in half -sections. A 22-foot pavement with 6-foot graded shoulders should be provided on the approaches for a distance of 300 feet on each side of the re- placement structure. A 28-foot clear roadway width is recommended on the replacement structure in accordance with current Bridge Policy. This bridge width will provide for a 22-foot travelway with 3-foot shoulders on the structure. Phase construction will permit one lane of traffic to be maintained on the existing bridge during construction of the new bridge. Approxi- mately 12 feet should be severed from the west side of the existing bridge, leaving about 17 feet of the existing bridge intact. This 17-foot segment would be strengthened and reinforced as necessary. A New Jersey type barrier would be placed along the severed edge, leaving 12 feet of the bridge to serve as a travel lane. 4 The new 28-foot wide bridge would be phase constructed. The first half would be built immediately adjacent to the intact portion of the old bridge. A minimum of ten feet of working clearance would be required between the two structures. Traffic would be transferred to the first half of the new bridge, and the remaining portion of the old bridge would be removed. The second half of the new bridge could then be constructed. Alternate 1 will also provide some improvement in the horizontal alignment just south of the bridge. By constructing the new bridge on a slight skew to the existing structure, the 12.5-degree curve can be lessened to about six degrees. Based on preliminary design, a design speed of approximately 50 mph will be provided with implementation of the recommended alternate. In this case, a design exception will be required during the design phase. The existing sharp curvature contributed to two of the five accidents which occurred in the vicinity of the bridge between January, 1986 to October, 1989. As a result of phase construction and placing the new bridge on a slight skew, the new roadway centerline will be shifted approximately 17 feet west of the existing centerline. Traffic control measures during the construction period are esti- mated to cost about $ 33,000 (including 15% engineering and contingen- cies). The Traffic Engineering Branch recommends signalization be provided during the construction period to effectively control one -lane operation. Consideration should be given to establishing a construction availability date which will accommodate seasonal traffic variations. Based on preliminary studies, the Hydrographics Unit recommends the new structure should have a length of approximately 90 feet. It is anticipated the elevation of the new bridge will be approximately the same as the elevation of the existing bridge. The length and height may be increased or decreased as necessary to accommodate peak flows as determined by further hydrologic studies. Alternate 1 is the preferred alternate because it costs the least of the three alternates. Moreover, Alternate 1 is the most environmentally sound alternate because it utilizes existing fill material on the west side of the existing bridge and minimizes the amount of additional fill in the adjacent marshland area. Alternates 2 and 3 would both require the placement of fill material in the channel which parallels the roadway north of the existing bridge on the west side. Alternate 1 retains the channel on the west side and minimizes environmental impacts to the marshland. The division engineer concurs with this alternate. The Carteret County School Bus Supervisor has indicated traffic must be maintained on -site since no detour route exists. IV. ENVIRONMENTAL EFFECTS The project is expected to have an overall positive impact. Re- placement of an inadequate bridge will result in safer traffic operations. The project is classified as a Federal "categorical exclusion" due to its limited scope and insignificant environmental consequences. The bridge replacement will not have a significant adverse effect on the quality of the human or natural environment with the use of current NCDOT standards and specifications. The project is not in conflict with any plan, existing land use, or zoning regulation. No significant change in land use is expected to result from construction of the project. No adverse impact on families or communities is anticipated. No significant adverse effect on public facilities or services is expected. The project is not expected to adversely affect social, economic, or religious opportunities in the area. The project does not involve any Section 4(f) properties. There are no publicly owned parks, historic sites, recreational facilities, or wildlife and waterfowl refuges of national, state, or local significance in the vicinity of the project. There appear to be no properties in the vicinity of the project that are eligible for inclusion in the National Register of Historic Places. The structure itself is not historically significant. The State Historic Preservation Officer will be given an opportunity to review both the architecture and the archaeological aspects of the project to determine whether an intensive survey should be undertaken. If necessary, the survey will be accomplished prior to construction. The structure is to be replaced.at the existing location. There- fore, the project is exempt from the Farmland Protection Policy Act. The existing structure spans Felton Creek, a small brackish water tributary of the North River System. Felton Creek originates approxi- mately 1.75 miles west of the North River and its channel meanders eastward through marsh systems to its confluence with the North River about 2.7 miles north of the intersection of SR 1300 and US 70. This site is a typical coastal creek setting in a rural section of Carteret County. The plant community along the shoulder of the existing alignment is predominantly exotic -weedy, consisting mainly of bermuda and mixed turfgrass species, such as centipede and carpetgrass. Other plants noted in this upland community include Baccharis halimifolia, _J_uni�eru�s vir iniana and Borrichia frutescens. T e toe of the existing fill on the west locatesthe top of a channel which parallels SR 1300 from the bridge northward for a distance of about 275 feet. No such channel exists south of the bridge on the west side. Marsh vegetation, primarily Juncus roemerianus, grows at the interface with the toe of the roadbed soutFof t e ri ge on the west side. The margin of this wetland com- munity will be impacted by construction of the newly aligned roadway. Animal species such as periwinkle (Littorina sp.), fiddler crab (Uca sp.), oyster (Crassostrea virginica), b uecra allinectes sa idus), numerous other invertebrates, raccoon, rodents, reptiles, bird an R extensive list of fish species are known to inhabit or migrate through the area. Of principal concern is the nursery function of the project area, which suggests that the water serves to support populations involved in spawning, breeding, and migration throughout the year. Felton Creek and all tributary waters of the North River (north of the US-70 bridge at Bettie) are designated as Primary Nursery Waters by the North Carolina Marine Fisheries Commission. The marsh, the water, and the adjacent upland are also given special status protection by CAMA's Coastal Management Division as AEC's (Areas of Environmental Concern). These three zones are Coastal Wetland, Estuarine Waters, and Estuarine Shoreline. The native soil within the project area is Hobucken muck, listed as a hydric soil by the United. States Soil Conservation Service. These soils are typically flooded on a frequent basis. Felton Creek is designated Class SA (tidal salt waters which are suited for shellfishing for market purposes) with a supplemental classi- fication of NSW (nutrient sensitive waters) by the North Carolina Department of EHNR's Division of Environmental, Management. A search of resource files at the Natural Heritage Program (Natural Resource Division of the North Carolina Department of EHNR) reveals that only two organisms known to inhabit the project vicinity have been assigned North Carolina population prevalence status. The black rail (Laterallus jamaicensis) is listed as SR (significantly rare), which suggests that t e it exists in North Carolina in small numbers, but generally has not shown declines in populations. The yellow rail (Coturnico ss noveboracensis) is listed as UNK (unknown), indicating that ins u i dent data is avai a le for precise assessments. Neither species is recognized on federal status lists. While these birds do not appear in imminent danger of extirpation, it is important that these organisms are recognized to be in the vicinity of proposed construction and could suffer due to imprudent design or construction activities. Best Management Practices should be strictly employed to preclude adversely impacting endemic or transient populations. Less that 0.1 acre of wetland will be impacted by fill operations, predominantly associated with the south approach of the project. Best Management Practices (33 CFR 330.6) should be employed to minimize adverse effects of construction activities on marine life from siltation and benthic perturbations caused by jetting/driving piles, placement of fill, and other activities. Following further design and geotechnical Y studies, consideration may be given to "coffer dam" isolation of pile - installment sites to minimize sediment -loading of the water. Overall environmental impacts are expected to be negligible as a result of this project. The project is located within the Southern Coastal Plain Air Quality Region. The ambient air quality for Carteret County has been determined to be in compliance with the National Ambient Air Quality Standards. Since this project is located in an area where the State Implementation Plan (SIP) does not contain any transportation control measures, the conformity procedures of 23 CFR 770 do not apply to this project. 7 This project will not substantially increase traffic volumes. Therefore, its impact on noise levels and air quality will be insig- nificant. Noise levels could increase during construction but will be temporary. If vegetation is disposed of by burning, all burning shall be done in accordance with applicable local laws and regulations of the North Carolina State Implementation Plans for air quality in compliance with 15 NCAC 2D.0520. This evaluation completes the noise and air quality assessment requirements of FHPM 7-7-3 and no additional reports are required. Carteret County is a participant in the National Flood Insurance Regular Program. The approximate 100-year floodplain in the project area is shown in Figure 7. The project site lies within the floodplain zone. An individual permit may be required from the Corps of Engineers if the Nationwide Section 404 permit provisions of 33 CFR 330.5(b) and 330.6 can not be followed. It appears that construction may require some fill material to be deposited immediately adjacent to the existing fill on the west side. A U. S. Coast Guard permit is not required for navigational clearance under the replacement structure (see attached correspondence in Attachment 1). On the basis of the above discussion, it is concluded that no serious adverse environmental effects will result from the implementation of this project. Since the Branch of North River is subject to tidal influence, it is considered a navigable waterway of the United States for Bridge Administration purposes. It also meets the criteria for advance approval set forth in the CODE OF FEDERAL REGULATIONS at the bridge site.
