1) This permit modification authorizes road shoulder improvements as depicted
in the attached revised plans.
2) This modification should be attached to the original of permit No. 87-91
and both documents must be available on site when a Division representative
inspects the project for compliance.
3) All conditions and stipulations of the original remain in force under
the modification unless altered herein.
This permit action may be appealed by the pemuttee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1994
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Attached is a request from the Department of Transportation (DOT)
to modify CAMA Permit #87-91. As you will recall, this permit
authorized the widening of U.S. Hwy. 70 between the communities
of Smyrna and Sea Level, in Carteret County. DOT is now
requesting permission to fill wetland and water areas at two (2)
additional locations in order to maintain a 5' shoulder from the
existing pavement. The first site is approximately 1.3 miles
north of Smyrna and will consist of two (2) approximately 75'
long sections of roadway. Approximately 150 sq. ft. of Juncus
roemerianus marsh would be filled at this area and approximately
600 sq. ft. of bottom area below the MHW line would also be
impacted. Fill material associated with the widening of the
shoulder would be stabilized by the use of rock riprap.
Site 'B' is located south of the community of Davis and will also
involve the filling in of approximately 150 sq. ft. of wetlands
vegetated primarily with Juncus roemerianus marsh. Approximately
500 sq. ft. of bottom area below the MHW line would also be
filled. As before, riprap material would be used to prevent the
expanded shoulder from being eroded into adjacent wetland or
waterbodies.

This permit, issued on May 24, 1991 , is subject to compliance with the application (where consistent

1) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated on
the workplats.
2) All excavated materials will be confined above MHW and landward of
regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or
surrounding waters'.
3) All fill materials to be placed below MHW level will be confined behind
the permitted riprap or silt screens in order to prevent spillover of
solids into any marsh or surrounding waters.
4) The riprap material must be free from loose dirt or any other pollutant
other than trace quantities.

This permit action may be appealed by the permittee or

5) The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTUs or less are not considered significant.
6) Appropriate sedimentation and erosion control measures will be employed.
NOTE: The Division of Environmental Management has authorized this project
under General Water Quality Certification No. 1734.

In reply to your letter of May 28, 1991 concerning our application for a CAMA
permit for work on US 70 in Carteret -County we offer the following comments:
a. This work is for widening US 70 in Carteret County from Davis to Sealevel.
The widening will consist of adding 2 feet of base course material on each side
of the existing roadway and resurfacing the entire roadway with 1" of bitumin-
ous concrete surface course. By widening the entire roadway by 4 feet, this
will necessitate the extension of three sets of pipelines. Also, several areas
along the existing roadway have had some erosion which has caused the waterline
to come very close to the existing roadway. These eroded areas were going to
be repaired even if the roadway were not being widened.
US 70 is the only highway that connects eastern Carteret County with the
remainder of Carteret County and serves as a valuable link for the transporta-
tion of commodities and for the traveling public. Also it leads to the ferry
terminal at Cedar Island which connects to Okrakoke Island. Unfortunately there
is no other alternative route which can be improved.
b. We are taking every action to minimize wetland losses but due to a minimum
amount of shoulder widening there will be a small amount of loss. If we did
not widen the shoulders through these sections we would have no shoulders after
the pavement widening which would present a hazardous situation to the travell-
ing public using US 70.

c. We are indicating that we will lose about 10 square yards of wetlands as
shown on the drawing for site # 4. This loss is unavoidable since it is
imperative that the shoulder be widened for safety considerations. If it is
necessary to mitigate this area of loss, the 10 square yards could be mitigated
at site # 6 by increasing the area of wetlands shown on the northeast side of
Site # 6.
Mr. Jahnke of your branch visited the locations shown under this permit
previously with us and representatives of the Morehead City Division of Coastal
Management Office.
We would appreciate your earliest consideration of this request, since we will
be starting the asphalt widening this summer.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources
hereby gives public notice as required ,by NCGS 113A-119(b) and
143-215 3(a)(1)(c) that the North Carolina Department of
Transportation of Raleigh, NC, filed an application on April 4,
1991, for a permit from the Division of Coastal Management to
develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of
fill material in project wetlands will not violate applicable
water quality standards.
According to said application, the applicant is proposing to
widen U.S. Hwy. 70 between the communities of Smyrna and Sea
Level, in Carteret County.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
Charles Jones, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C.,
919/726-7021, and/or the office of Preston Howard, Division of
Environmental Management, DEHNR Regional Field Office,
Wilmington, N.C., 919/395-3900.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
May 19, 1991. The issuance of the CAMA Major Development permit
and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and
subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Roger N. Schecter, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
May 14, 1991 for consideration in the CAMA permit decision, and
to Mr. Bill Mills, Division of Environmental Management, P.O. Box

9. NARRATIVE DESCRIPTION: The North Carolina Department of
Transportation (NCDOT) is proposing to widen the roadway
pavement of U.S. Hwy. 70, between the communities of Smyrna
and Sea Level, in Carteret County. The project will involve
the widening of the roadway pavement from 20' to 24' with
improvements (fill being added) to roadway shoulders ranging
in widths from 2' to 71. Additionally, numerous equalizers
or cross -pipes will be replaced along the entire road system
as needed. All work will be within existing DOT
right-of-ways, and for the most part, all activities will
occur on highground. The only exceptions to this are: 1) In
several areas along tidal borrow canals (man-made canals in
which roadbed material was obtained in the original
construction of the highway) where the road shoulders have
eroded away over the years to a point where they are'
extremely close to the existing road pavement; and, 2) In
several areas where cross -pipes have to be extended. A
description of these areas follows:
SITE #1: (Photo Index 89 #148-28, U-13; 1984 #152-354, T-6)
is located just north of the community of Davis and will
consist of the placement of riprap and backfill material
below the MHW line of an existing tidal borrow canal.
Approximately 530. n..,ft. of canal would be filled by an
average width of approximately 51. Plans show that all
backfill material will be contained by riprap and filter
cloth material. It is estimated that approximately 2,750
sq. ft. of canal bottom would be filled with approximately
50 cu. yds. of material being placed below the MHW line.
SITE #2: (Photo Index 1989 #148-25, V-15; 1984 #152-356,
T-15) is located just south of Stacy and Maria Creek. Plans
for this site include the spot stabilization of the roadway
shoulder over an approximately one-half mile long area. DOT
has indicated that only those areas which have an erosion
escarpment 10' or less from the existing pavement, and which
have no wetlands vegetation, will be stabilized with rock
riprap. The rock will be placed immediately adjacent to the
erosion escarpment and will have an approximately 3' wide
bottom base. It is estimated that approximately 500 ln. ft.
of road stabilization would occur over this stretch of
highway. Approximately 1500 sq. ft. of canal bottom would
be filled with approximately 28 cu. yds. of rock material
being placed below the MHW line.

SITE 3: (Photo Index 1989 #148-22, Q-7; 1984 #152-357,
V-13) is located in the community of Stacy and will involve
the stabilization of approximately 40 ln. ft. of roadway
shoulder. Approximately 2' of rock riprap will be placed
below the MHW line which will result in approximately 80 sq.
ft. of canal bottom being filled. Approximately 1.5 cu.
yds. of material will be placed below the MHW line.
SITE $4: (Photo Index 1989 #152-357, V-5; 1984 ##148-22,
R-15) is located near the Stacy Volunteer Fire Department.
Plans show the replacement of 3 pipes (each approximately
32' long x 36" in diameter) with 2 pipes (each approximately
46' long x 48" in diameter). Also proposed is the widening
of the highway shoulders to provide a minimum 5' shoulder in
the general area of the new culvert pipes. It is estimated
that approximately 232 sq. ft. of canal bottom would be
filled, as well as approximately 162 sq. ft. of coastal
wetlands. Approximately 3 cu. yds. of material would be
placed below the MHW line. Some minor excavation below the
MHW line could also be expected in conjunction with the
placement of the new pipes.
SITE 5: (Photo Index 1989 #148-22, R-15; 1984 ##152-357,
L-Y) is located north of Stacy and will involve the
replacement of a 34' long x 36" pipe with a 50' long x 36"
pipe. Approximately 200_sq. ft. of canal bottom would be
filled in conjunction with the replacement pipe installation
and associated backfill. Silt fences will be used to
contain filled areas. Approximately 3 cu. yds. of material
would be placed below the MHW line and it, could be expected
that some minor excavation would occur.
SITE ##6: (Photo Index 1989 ##148-22, T-16; 1984 #152-357,
T-2) is located north of Stacy and just south of the
entrance road to.the Open Ground Farms. Plans show the
replacement of two (2) 32' to 36' long x 36" pipes with two
(2) 50' long x 36" pipes. The new pipes will be placed at a
450 angle in order to avoid wetland filling. An
approximately 9' wide x 23' long area of existing canal
would be filled for an expanded road shoulder as well as a
small area of the existing canal being excavated to
facilitate pipe installation. Approximately 200 sq. ft. of
canal bottom would be filled with approximately 4 cu. yds.
of material being placed below the MHW line.

ANTICIPATED IMPACTS: The project, as proposed, will result
in the widening of U.S. Hwy. 70 from the communities of
Smyrna to Sea Level. As a result of this widening,
approximately 162 sq. ft. of coastal wetlands and 4962 sq.
ft. of canal bottom would be filled either for roadway
shoulder expansion, or for stabilization of the existing
shoulder. Approximately 90 cu. yds. of fill material would
be placed below the MHW line. Also, minor amounts of
excavation below the MHW line will most likely occur in the
installation of new pipes. Turbidity levels will be
increased during construction, but, should be relatively
short-term. I

An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink'on an 8"
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule W.0203 for a`detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's

I have no objections to the issuance of a permit with the
following conditions:
1. No excavated or fill material will be placed at any time in
any marsh or surrounding waters outside of the alignment of
the fill area indicated on the workplats.
2. All excavated materials will be confined above MHW and
landward of regularly or irregularly flooded marsh behind
adequate dikes or other retaining structures to prevent
spill -over of solids into any marsh or surrounding waters.
3. All fill materials to be placed below MHW level will be
confined behind the permitted riprap or silt screens in
order to prevent spill -over of solids into any marsh or
surrounding waters.
4. The riprap material must be free from loose dirt or any
other pollutant other than trace quantities.

The Division of Coastal Management hereby acknowledges
receipt of your application for state approval for development of
your property located on U.S. Highway 70, between the communities
of Smyrna and Sea Level, in Carteret County. It was received
(complete) on April 4, 1991, and appears to be adequate for
processing at this time. You will, however, need to provide us
with proof that adjacent riparian property owners have been
notified of this project. The projected deadline for making a
decision is June 18, 1991. An additional 75-day review period is
provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an -
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be
posted at the location of the proposed development. Enclosed you
will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should
post this notice at a conspicuous point along your property where
it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the
road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an
incomplete application.
