Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling may take place in the Jonaquin Creek PNA between March 1 and Septembef 30 without prior approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. 2) The culverts authorized for this project are to be no greater than forty (40) feet in length in keeping with the application letter. Any remaining reference to a seventy foot culvert in the application or workplans is hereby voided. 3) The fill material will be clean and free of any pollutants, except in trace quantities. 4) All backfill material will be obtained from a highground source and confined behind the permitted endwall. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31 1996 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coas tat Management Program. Briggs 1W ..�........................� SUBJECT: Review agency concerns over the replacement proposal for Bridge #5 on SR 1300 over Jonaquin Creek in Carteret County At your request, I am sending this memorandum to summarize the concerns of the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC) over the above -referenced project. The concerns of both the DMF and the WRC are primarily with regard to the potential for diminished biological productivity of this area, as it is a designated primary nursery area. They feel strongly that the amount of fill proposed and the potential for culverts to impede water flow as they fill with sediment could have a negative effect on the marsh system. They are also concerned that the culverts may impede navigation at the site. The DMF is also concerned that approval of this proposal as requested might set an undesirable precedent for similar proposals in this area in the future. The preferred alternative in this case would be the replacement of the existing bridge with a new short spanning structure. However, both agencies would accept a modification of the project that would include shorter (50' - 60') culverts with enlarged diameters to allow for increased water flow and provision of at least the clearance that currently exists. If your agency chooses to have the processing of this application put on hold to allow time for modification of the project, we will need to receive a written request stating such no later than Friday, October 15. Box 27687 Raleigh, North Carolina 27611 ATTENTION: Mr. John Parker Dear Sir: SAM HUNT SECRETARY SUBJECT: Carteret County, Replacement of Bridge #5 on SR 1300 over Jonequin Creek, South of Merrimon. On May 10, 1993, an application package was distributed to the Office of Coastal Management (OCM) with the request that the above -referenced project be authorized under the appropriate Coastal Area Management Act (CAMA) permit. On July 7,1993, we received acknowledgement of receipt of our application on June 15, and stated that it was adequate for processing with a projected deadline of August 30, 1993. On August 30, 1993, we received a letter from OCM extending the processing deadline an additional 75 days, until November 12, 1993. On August 11, 1993, we received notification from the Army Corps of Engineers (COE) that National Marine Fisheries Service (NMFS) concerns had caused the permit to be elevated to individual status, but on September 9, we received authorization from the COE under Nationwide 14. On August 19, 1993, we received Water Quality Certification from the Division of Environmental Management. Due to the concerns expressed by the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC) we have reevaluated the design of the above -referenced project. As communicated to us by Stephanie Briggs of OCM, on September 27, 1993, their concerns were as follows; that due to the Primary Nursery status of this area, the potential for diminished biological productivity exists due to the impedance of flow as a result of filling and culvert installation; and that the existing navigational clearance should be preserved. The cost of a 60' spanning structure is estimated to be $90,000, while the cost of a 40' spanning structure would be approximately $60,000. Forty feet is the minimum length possible for this site. The proposed culverts are estimated to cost $19,000. We feel that the cost of the bridge options are prohibitively high and thus we have attempted to mitigate by changing the design to maximize navigation clearance and to minimize the length of the proposed culvert by using endwalls. The proposed alternative utilizes endwalls to reduce the length of the culverts from 70' to 40', and eliminate filling in wetlands. By raising the•culverts' elevation we were able to match the existing bridges' clearance elevation. We hope that these changes will satisfy the concerns expressed by WRC and DMF, as mentioned in your letter dated October 6, 1993. By copy of this letter, we request that the Corps of Engineers and Division of Environmental Management review the proposed modified design and advise us as to the status of the Nationwide permit and Water Quality Certification. Briggs 1W mlaam,__........ ........ am SUBJECT: Review agency concerns over the replacement proposal for Bridge ##5 on SR 1300 over Jonaquin Creek in Carteret County At your request, I am sending this memorandum to summarize the concerns of the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC) over the above -referenced project. The concerns of both the DMF and the WRC are primarily with regard to the potential for diminished biological productivity of this area, as it is a designated primary nursery area. They feel strongly that the amount of fill proposed and the potential for culverts to impede water flow as they fill with sediment could have a negative effect on the marsh system. They are also concerned that the culverts may impede navigation at the site. The DMF is also concerned that approval of this proposal as requested might set an undesirable precedent for similar proposals in this area in the future. The preferred alternative in this case would be the replacement of the existing bridge with a new short spanning structure. However, both agencies would accept a modification of the project that would include shorter (50' - 60') culverts with enlarged diameters to allow for increased water flow and provision of at least the clearance that currently exists. If your agency chooses to have the processing of this application put on hold to allow time for modification of the project, we will need to receive a written request stating such no later than Friday, October.15. The existing bridge is to be replaced with 2 corrugated steel pipe culverts. The project involves excavation of the creek bottom and of a highground area. An area of Coastal Wetlands and '404' wetlands would be filled, as would approximately 1400 sq. ft. of Public Trust Areas. I have reviewed this project for consistency with the 1991 Carteret County Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as 'Rural', while the Coastal Wetlands, Estuarine Waters, Estuarine Shoreline, and Public Trust Areas impacted by the project are classified as 'Conservation'. (The affected '404' wetlands are not located in a concentrated area of '404' wetlands, as shown on the Land Classification Map. As such, these isolated wetlands are not classified as Conservation by the LUP and policy statements contained in the Plan addressing '404' wetlands do not apply, but rather, the County defers to applicable Federal regulations.) The County's policy regarding commitment to State and Federal programs (Page IV-16) states that "Carteret County is generally receptive to State and Federal programs, particularly those which provide improvements to the County. The County will continue to fully support such programs, especially the North Carolina Department of Transportation Road and Bridge Improvement Programs, which are very important to Carteret County." Based on this statement of support for North Carolina DOT projects, it would appear that Carteret County intended to allow such work to occur in Conservation classified areas. NARRATIVE DESCRIPTION: The NC Department of Transportation proposes to replace Bridge #5 over Jonaguin Creek on SR 1300, south of the community of Merrimon in Carteret County. SR1300 is a paved secondary two-lane road serving several small communities in the area. SR1300 crosses over Jonaquin Creek near its headwaters by way of a bridge approximately 60' long. Waters at the project site are classified as 'SA' and 'PNA' by the Division of Environmental Management and are open to shellfishing. NC DOT proposes to replace the bridge with two (2) 103" x 71" corrugated steel pipe culverts approximately 70' in length. An area approximately 45' long x 5' wide of highground would be excavated for the installation of the culverts. Approximately 320 sq. ft. of coastal wetlands and '404' wetlands would be filled. Approximately 1400 sq. ft. of Public Trust Area would be filled from the installation of the culverts and associated backfill. Prior to the installation of the culverts, an approx. 67' long x 21' wide x 1' deep area of creek bottom would be excavated. 10. ANTICIPATED IMPACTS: NC DOT proposes to replace an existing bridge over Jonaquin Creek with two (2) 103" x 71" corrugated steel pipes approximately 70' in length. Approximately 320 sq. ft. of coastal wetlands consisting mainly of black needlerush, Spartina patens, and Saartina cynosuroides, plus some '404' type species would be filled. Approximately 1400 sq. ft. of Public Trust Area would be filled from the installation of the culverts, plus the associated backfill. Approx. 225 sq. ft. of highground and approx. 1,400 sq. ft. of creek bottom would be excavated. The approx. 55 cu. yds. of mostly mud and silt material will be hauled -off the site. Jonaquin Creek narrows at the project site to approximately 20' wide and finally dead - ends not far upstream from the bridge. The bridge clearance presently is approximately 3' at NWL. PIGOTT SUBJECT: COMMENTS & RECOMMENDATIONS - MAJOR PERMIT APPLICATION NC DOT - SR1300 - JONAQUIN CREEK, CARTERET COUNTY DATE: July 7, 1993 This project would result in a bridge being replaced in a Primary Nursery Area with 2 culverts. It does not appear that navigation is at issuance since the creek ends shortly upsstream from the bridge. I would however defer to the N.C. Div. of Marine Fisheries to determine what impacts the culverts would have to the Primary Nursery Area. If they do not object, I would have no objections to the proposed project with the following comments: 1. The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 2. All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. 3. No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the workplat(s). 4. This bridge replacement will take place on existing alignment and local traffic will be detoured along existing roadways. Fill in wetlands and below ordinary high water will total 0.02 acres in salt marsh habitat. The average daily flow is estimated to be 0.7 cfs. Excavation in wetlands will be less than 0.01 acres and below ordinary high water will be approximately 52 cubic yards. Best management practices will be implemented to minimize any adverse effects which may be caused by project -related sedimentation. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. This project may be authorized under Nationwide Permit 26 "Above Headwaters " and the corresponding General Water Quality Certification, and because the acreage impacted will be less than 1/3 of an acre, no agency notification will be required.
