This permit, issued on March 22, 1993 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action, or may cause the permit to be null and void.
Bridge Construction
1) All construction debris, including concrete, asphalt and earthen material
will be disposed of on highground and landward of all CAMA Areas of
Environmental Concern unless otherwise approved.
2) The permittee must employ adequate silt and sediment control measures to
prevent erosion and. to prevent runoff from entering the adjacent waters
of Hunter's Creek.
3) The riprap material must be free from loose dirt and other pollutants,
except in trace quantities. It must be of sufficient size to prevent its
movement from the site by wave or current action.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be -accessible, on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on

I have no problems with the proposed project and support issuance of the necessary CAMA
permit for the bridge replacement. The following permit conditions are for your
consideration:
1. The project alignment and the other aspects of construction must be undertaken in
strict accordance with the permitted workplat drawings as dated in the CAMA office
received January 14, 1993.
2. All construction debris, including concrete, asphalt and earthen material must be
disposed of on highground and landward of all CAMA Areas of Environmental
Concern unless otherwise approved.
3. The permittee must employ adequate silt and sediment control measures to prevent
erosion and runoff from entering the adjacent waters of Hunters Creek.
4. The riprap material must be free from loose dirt and other pollutants. It must be of
sufficient size to prevent its movement from the site by wave or current action.

DATE: February 24, 1993
The North Carolina Department of Transportation (DOT) proposes to replace Bridge #30, on
NC Highway 58, over Hunters Creek, a tributary of the White Oak River, on the
Carteret/Jones County line.
Project plans include replacing existing wooden piles with concrete pilings. Marl riprap will
be placed to protect the bridge abutments, with portions of the riprap being placed on
Federal wetlands. Additionally, DOT proposes to regrade and resurface the approaches to
the bridge from both directions. While some highground excavation will be required,
erosion control methods will be used to control silt and sedimentation. No dredging or
filling within the creek bed or in Federal wetlands is proposed.
AECs impacted by the project include Public Trust and Estuarine Waters and the Estuarine
Shoreline.
I have reviewed this project for consistency with the 1991 Carteret County Land Use Plan
(LUP) Update and offer the following comments.
The general area of the project is located within an area of concentrated, conservation
classified '404' wetlands. The AECs impacted by the project are also classified as
'Conservation'.
The '404' Wetlands Conservation classification description on Page V-3 states that only uses
consistent with the Policy Statement section of the Plan will be allowed in these areas.
The County's policy regarding commitment to State and Federal programs (IV-16) states that
"Carteret County is generally receptive to State and Federal programs, particularly those
which provide improvements to the County. The County will continue to fully support such
programs, especially the North Carolina Department of Transportation Road and Bridge
Improvement programs, which are very important to Carteret County."

Based on this statement of support for NCDOT bridge projects, it would appear that Carteret
County intended to allow such work to occur in the '404' Conservation classification areas.
Therefore, provided the project can be permitted in accordance to State and Federal
standards, this project appears consistent with the LUP.

9. NARRATIVE DESCRIPTION: The North Carolina Department of Transportation
proposes to replace on line Bridge #30, a J50' segment of Highway 58 over Hunters
Creek, located about 1/2 mile north of Kuhns, on the Carteret/Jones County line.
During construction, vehicular traffic will be detoured to the east along existing
roadways, i.e. SR1100 and SR1103. The project should require an estimated 6-8
months to complete. The existing bridge was originally constructed in 1957.
Hunters Creek is a tributary of the White Oak River. The surface waters of the creek
are classified by the Division of Environmental Management as 'C'. The upper
reaches of the creek at the project site .involve the Public Trust and Estuarine Waters
designated Areas of Environmental Concern. The onsite inspection revealed no coastal
wetlands occur within the project boundaries. Wooded swamp wetlands of the '404'
type dominate all four quadrants of the highway/creek intersection.
As. proposed, there will be no dredging or filling within the existing creek bed. A
series of two (2) concrete pile supports will replace the four (4) rows of wooden piles
now located in the creek. Marl riprap will be used to protect the bridge abutments
above the MHW line. A portion of the riprap about 7'/z' wide x 80' long on each side
of the bridge will be placed on section '404' wetlands. A total of 1200 sq. ft. of
shaded vegetation will be displaced under the bridge. The project plans include
regrading and resurfacing the two 30' wide approaches for a distance of 150' in either
direction. No wooded swamp wetlands will be excavated or filled in this activity. The
applicant plans to keep silt and sediment to a minimum by employing stringent erosion
control measures along the construction alignment. A limited amount of highground
excavation about 86' x 10' is scheduled within the bridge abutments to make way fora
slightly longer bridge span. The off -site disposal area has not yet been determined by
DOT.
10. ANTICIPATED IMPACTS: The bridge replacement project involves no excavation
or filling of Hunters Creek. Although the new bridge span will be slightly longer than
the existing 150' structure, the overall impact of the 30' wide roadway on the public
trust values of Hunters Creek will remain the same at approximately 2,250 sq. ft. of
air space over the creek bed. In addition, the vertical clearance will be increased by
approximately 1'. The proposed project will reduce the number of support piles in
Hunters Creek which should improve navigation for small recreational boats that may
use the area. The proposed marl riprap under the new bridge will help protect the
abutments from runoff erosion. The riprap will, however, displace a total of 1,200 sq.
ft. of '404' type vegetation.

In addition to the completed application form, the follow-

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to cant' out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the

Creek, at Bridge #30, near Kuhns, on the Carteret/Jones County line, NC It was received
on January 14, 1993 , and appears to be adequate for processing at this time. The projected
deadline for making a decision is March 31, 1993 An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this.notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any

SUBJECT: Carteret -Jones Counties, Proposed Replacement of
Bridge No. 30 over Hunters Creek on NC 58 near
Kuhns, State Project 8.1161101, TIP No. B-1104.
The North Carolina Department of Transportation proposes
to replace Bridge No. 30 over Hunters Creek on NC 58 near
Kuhns on the Carteret County and Jones County line. The
proposed action will involve replacing the existing bridge
structure with a 150' long by 30' wide bridge. The proposed
replacement bridge will be of the same elevation as the
existing bridge and will provide for a slightly wider
underbridge opening. This bridge replacement will take place
on existing alignment and local traffic will be detoured
along existing roadways.
The new structure will span from bank to bank. In order
to facilitate a slightly longer bridge structure, NCDOT
proposes that a small amount of material be excavated from
behind the present bridge abutments (see Permit Sheet 3 of
4). The new shoreline will be stabilized with Class B stone.
The proposed action will not lead to encroachment into
Hunters Creek, nor will clearance under the bridge be
reduced. The proposed bridge construction will impact 404
jurisdictional wetlands only.
On December filth, 1992, NCDOT personnel met with NCWRC
representatives and NCDCM representatives. During this
meeting, the proposed project was outlined. Also stated was
that due to the small amount of non -coastal wetland impacted
(less than 0.03 acres) and limited opportunities for on -site
mitigation, NCDOT is not proposing any active mitigation to
offset wetland losses at this site. No strong opposition was
expressed by either agency to the project as proposed. Best
management practices will be implemented to minimize any
adverse effects which may be caused by project -related
sedimentation.
NCDOT is requesting that the proposed work be authorized
under the appropriate Coastal Area Management Act (LAMA)
permit. By copy of this letter, we are also requesting
issuance of a 401 Water Quality Certification from the N.C.
Division of Environmental Management and a Section 404 Permit
from the Army Corps of Engineers. Included for your
information is a permit application and permit drawings (4
pages). A processing fee of $250 is also included.
