authorizing development in Carteret County at Cullie Creek, near Merrimon, at the
Sk1316 crossing (Bridge #86) as requested in the permittee's application dated 8/15/94 including
attached workplan drawings, sheets 1-7 of 7 dated 6/94 and drawing dated rec. 11/16/94.
This permit, issued on APRIL 5, 1995 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Mitigation
1) Prior to construction initiation, a Mitigation Plan, or a letter of commitment to prepare such
plan, will be submitted to the Division describing mitigation for 1/1 replacement of the
approximately 7700 sq. ft. of coastal wetlands impacted. Dissimilar and innovative mitigation
may be considered adequate by the Division. The mitigation must be approved and in place
prior to the expiration date of this permit.
2) The cross sectional opening of three culverts shall be equal to of greater than that of the existing
bridge.
Construction
3) A silt screen will be placed immediately upstream and downstream of the project site prior to
any excavation and not removed until 24 hours after the completion of all excavation and fill.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 25 NTUs or less are not considered significant.
5) The inlet headwalls will be constructed prior to any backfilling activities and be structurally tight
so as to prevent seepage of bacldill materials.
6) Prior to any land -disturbing activity associated with the upgrading of SR1316, appropriate
erosion and sedimentation control devices, measures, or structures shall be used to prevent
sediment from entering the adjacent wetlands and watercourses (e.g., silt fence, diversion
swales/berms, sand fence, etc.).
7) All fill materials will be obtained from a highground source.
8) The fill material will be clean and free of any pollutants, except in trace quantities.
9) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
10) No excavated or fill materials will be placed at any time in any marsh or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.
11) A permanent ground cover sufficient to restrain erosion shall be provided on all exposed areas
withint the shorter of 15 working or 60 calendar days after project completion.

As discussed at the March 2002 annual mitigation monitoring report meeting, the N.C. Division of
Coastal Management (DCM) concurs with the N.C. Department of Transportation's (DOT'S)
request to close out the following mitigation site:
• Bogue Sound (Weeks Property) Mitigation Site, Carteret County.
This site provides mitigation for the following NCDOT projects: (1) TIP No. R-2105AA, CAMA
Permit No. 52-00; (2) TIP No. R-2105AB, CAMA Permit No. 146-96; (3) TIP No. B-1098, CAMA
Permit No. 21-92; (4) Bridge No. 86 over Culley Creek on SR 1316, CAMA Permit No. 38-95; and
(5) Bridge No. 3 over Back Creek on SR 1300, CAMA Permit No. 133-95.
DCM is pleased that this site has met its goals and success criteria. We appreciate DOT'S attention
to DCM's comments and suggestions during the phases of planning, implementation and
monitoring.

Reference your application for a Department of the Army permit to place
fill material in approximately 4,000 square feet of wetlands and open water,
and dredge 800 square feet of wetlands in and adjacent to Cullie Creek, for
the purpose of replacing Bridge No. 4, and raising the existing road elevation
of SR 1300, near Merrimon, in Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

SUBJECT: Mitigation Plan for Permit # 38-95 - Improvement on SR 1316 in
Carteret County
I would first of all like to thank you and Charles Jones for taking time to meet with Jerry
Lindsey and myself on Tuesday, June 6th, to discuss the innovative mitigation option in
Atlantic relating to re -opening of a natural drainage area.
The area under consideration is adjacent to the Morris Marina Road just beyond the section
of roadway on the State Highway System (SR 1442). This particular area was observed in our
investigation into the addition of the remaining roadway up to the marina. It appears this
natural drainage area, containing salt water marshland, was severed and the drainage re-
routed to the marina when the construction of the road, formerly known as the Old Shell
Road, occurred. During our meeting, and in previous conversations it was confirmed the
proposal to install pipelines in the roadway, at the natural drainage area location, would be
considered for an innovative mitigation plan for the impacts under subject permit if
preliminary information results confirmed certain benefits could be obtained.
At this time I am moving forward to collect preliminary data, as outlined in our meeting, to
determine if "improved flushing of the area" would be accomplished. This information will
include, but not be limited to, data relative to water levels on each side of the roadway
collected at hourly intervals for a 12 hour tidal cycle. I will present the information for
review as soon as it is evaluated and assembled for report.

Thank you for meeting with us on April 19th.
In accordance with our discussions relating to the subject of mitigation, and Item #1 as
contained in subject permit, this is to express commitment on behalf of the North Carolina
Department of Transportation to prepare a mitigation plan for 1:1 replacement of impacted
coastal wetlands (7,700 sq. ft.).
Further, it is understood the mitigation plan is to be approved and in -place prior to the
expiration date of the permit, December 31, 1998. By copy of this letter and attachments, I
am forwarding the permit information to the Division Engineer, Mr. G. R. Shirley, Jr., P.E.,
for review and to request assistance in mitigation plan development.

This letter is with reference to your application for a Coastal Area Management Act
Major Development and state Dredge and Fill permit to replace an existing bridge on SR1316
south of Merriman, Cullie Creek, in Carteret County. Although processing of the application
is nearing completion, additional time is needed for this office to complete the review and make
a decision on your request. Therefore, it is necessary that the standard review time be extended.
An additional 75 days is provided by G.S. 113A-122(c) which would make April 14, 1995 the
new deadline for reaching a decision on your request. However, we expect to take action prior
to that time and will do so as soon as possible. In the interim, if you have any question on the
status of your application, do not hesitate to contact this office.

SUBJECT: Permit 38-95, SR 1316
Bridge No. 86, Carteret County
In reference to Item 5 under additional conditions for the
above permit that was discussed with you at our meeting April 19,
1995, NCDOT Bridge Maintenance would like to construct a
temporary wall between each pipe line to prevent the backfilling
from spilling beyond the end of the proposed pipe. The wall
would be constructed of timber with a tight fit around the pipe
and bottom. The proposed permanent headwall will be a fabric
placed on the fill and rip rap installed at both ends of the
pipe.
This crossing is located on a dead end road. One way
traffic will be maintained over a ramp. The above method of
backfilling will speed up our operation and shorten the time
required for traffic moving one way.

Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If there is a need to extend the duration of this Federal authorization
or if any change in your work is required because of unforeseen or altered
conditions or for any other reason, a written request for renewal of
authorization or plans revised to show any change must be sent promptly to
this office and the North Carolina Division of Coastal Management prior to
continuing work or performing any change or alteration. Such action is
necessary as specific renewal of authorization must be obtained or revised
plans must be reviewed and the authorization modified. A request for
extension of authorization must be received no later that thirty (30) days
prior to expiration of the permit.

Reference your application for Department of the Army (DA) authorization
to discharge fill material in the waters/wetlands of Cullie Creek, associated
with replacement of Bridge No. 86 on S.R. 1316, south of Merrimon, Carteret
County, North Carolina.
After review of your proposal, by letter of January 31, 1995 (copy
enclosed), the National Marine Fisheries Service (NMFS) recommended denial of
your application unless an approved compensatory mitigation plan is part of
the permit and information is provided to them to verify that the proposed
culverts will not impede access of fishery resources to the upper reaches of
Cullie Creek.
Our administrative process provides you the opportunity to propose a
resolution and/or to rebut any and all objections before a final decision is

Dear Sir:
Reference your letter dated February 14, 1995,
requesting that the N.C. Department of Transportation respond
to permit conditions recommended and information requested by
the National Marine Fisheries Service (NMFS).
It is our understanding that no evidence exists to
support NMFS' concern that the proposed culverts may reduce
the ability of aquatic species to access the upper reaches of
the creek, and thereby impairing the creeks' nursery area
function. It has been confirmed by David Taylor, District
Manager of the Morehead City Field Office of the N.C.
Division of Marine Fisheries that Cullie Creek does not
support any population of anadromous fish.
In addition, NCDOT does not propose to mitigate for the
0.17 acres of wetland impacts or the 0.05 acres of impacts to
waters. These impacts are minimal and the impacts associated
with the road widening are primarily to naturalized roadside
ditches of low ecological value. This issue has been
discussed with field staff of the N.C. Division of Coastal
Management and they are not proposing to require mitigation
as a condition of the CAMA permit.
We hope that this letter will address the concerns
raised and allow permitting of this project to move forward.

RECOMMENDED CONDMONS OR PERMIT RESTRICTIONS: Conversations with
DMF indicate that this portion of the creek is a primary nursery area. It is recommended that
the applicant consider replacement of the existing bridge with a similar structure. This Office
has concerns over the use of culvert pipes in place of bridges especially in tidal creeks. In terms
of aquatic life movement, tidal flushing and filling primary nursery area bottom habitat a
proposal such as this would only further degrade a system ah=dy impacted from past road
construction.
This Office has no objection to the widening of the existing bridge approaches provided that
strict erosion control measures are in place prior to filling.

This letter is in reference to the 15 August 1994 CAMA Major Permit Application that the North
Carolina Department of Transportation (NCDOT) submitted to this office for the replacement of an
existing bridge structure over Cullie Creek, and for the widening and paving of SR 1316 near Merrimon
in Carteret County. The bridge proposal involves replacing the existing bridge with three 117" X 79"
corrugated steel pipe arch culverts approximately 60' in length.
The information provided on the bridge replacement appears thorough and complete, however
there is limited information on the activities involving the widening and paving of the existing dirt road.
This information is essential since the road approaches within a few feet of the open waters of 011ie
Creek. Therefore, additional information must be provided before the application can be accepted as
complete and a review by the agencies can begin. I am returning the application package along with
this request for more information.
Please address the following items:
1) Under 5a.--You propose to replace a bridge and pave a road.
2) Under 5d.--Widening and paving of the road should involve grading and disturbing.
3) Under 5f.--The newly paved road will be impermeable.
4) Under 5g.--What material is to be used for the pavement?
5) Under 51.--Surface runoff?
6) Under 6q.--It appears that the "fill in wetlands" just west of the present bridge site will
be within a few feet of the open waters of Cullie Creek. Please provide a better
explanation as to how the fill will be contained on site. What stabilization efforts are you
proposing? Are guard rails proposed along this section? Additional plat work is needed
to address this concern.

In addition, my field investigation revealed that approximately 500' to 600' west of the existing
bridge, the road right-of-way approaches the open waters of Cullie Creek. How much and what kind
of land -disturbing activity is proposed within this right-of-way. How close will the wider and paved
road be to the creek? This area does not appear on any platwork. Please address this omission.
After the above items have been addressed, please resubmit the application package to this office

Reference your letter dated February 6, 19951 requesting
that -the N.C. Department of Transportation respond to
concerns specified In that letter that could result in denial
of the requested 401 Certification.
We have confirmed with David Taylor, District Manager of
the Morehead City Field Office of the N.C. Division 'of Marine
Fisheries, that Cullie Greek °does not'serve as habitat for
any population of anadromous fish, therefore removal of that
use is not an issue.
Because there are no impacts to snadromous fish and
minimal impacts to wetlands and waters, we do not intend to
replace the existing bridge with a bridge. The comparative
cost of a bridge to the proposed culverts is estimated at
$75,000 versus $28,000, respectively. Furthermore, long-term
maintenance costs for culverts are minimal while bridges cost
approximately $2000 a year to maintain. The existing bridge
is located in a curve, thus the wider road section over the.
pipes will allow a wider shoulder, thus improving the safety
for the public. The crossing itself cannot be eliminated,
thus there are no practicable alternatives to this project as
proposed.

SUBJECT: Field Recommendation and Conditions for the North Carolina Department of
Transportation's project on SR 1316 over 011ie Creek south of Merrimon,
Carteret County
DATE: January 18, 1995
A quick glance at the amount of coastal wetlands being impacted by this proposed
project is initially shocking. However, a closer look reveals that a good percentage includes
jurisdictional wetlands within the roadside ditches along both sides of the dirt road. There is
no doubt that the bridge is in poor condition and needs replacing. The applicant has not
proposed any mitigation for the impact to the wetlands. However, since the applicant has
also proposed to upgrade SR 1316 at the same time they work on the creek crossing, new
roadside ditches will need to be dug and over time it can be expected that they too will
become vegetated with coastal wetland species. Thus I believe the overall impact will not be
nearly as great as the numbers indicate. All things considered, I have no objections to the
proposed project with the following conditions:
1. The temporary placement or double -handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
2. No excavated or fill material will be placed at anytime in any marsh or surrounding
waters outside of the alignment of the fill area indicated on the work plat(s).
3. In order to protect water quality, runoff from the construction must not visibly
increase the amount of suspended sediments in adjacent waters.
4. A silt screen will be placed immediately upstream and downstream of the project site
prior to any excavation and not removed until 24 hours after the completion of all
excavation.
5. The inlet headwalls will be constructed prior to any backfilling activities.
and be structurally tight so as to prevent seepage of backfill materials.
6. Prior to initiating any land -disturbing activity associated with the upgrading of SR
1316, appropriate erosion and sedimentation control devices, measures, or structures
shall be used to prevent sediment from entering the adjacent wetlands and
watercourses (e.g., silt fence, diversion swales/berms, sand fence, etc.).

A permanent ground cover sufficient to restrain erosion shall be provided on all
exposed areas within the shorter of 15 working or 60 calendar days after project
completion.

DATE: January 11, 1995
NCDOT proposes to replace an existing bridge with three 117' X 79'
corrugated steel pipe arch culverts approximately 60' in length and
upgrade and pave SR 1316.
The project site is located on SR 1316 near Merrimon on a tributary
of Cullie Creek, a tributary of Adam's Creek, in Carteret County.
Waters at the site are classified as SA/NSW and are closed to the
harvesting of shellfish. The area is not a Primary Nursery Area.
AECs impacted by the project include Coastal Wetlands, Estuarine
Shoreline, Estuarine Waters, and Public Trust Areas.
I have reviewed this proposal for consistency with the 1991
Carteret County Land Use Plan (LUP) Update, as amended September
23, 1993, and offer the following comments.
The general area of the project is classified as Rural, while the
AECs impacted by the proposal are classified as Conservation.
Applicable policies contained in the amended LUP include Resource
Production and Management Policies for Marine Resource Areas (Page
IV-11). With certain exceptions, none of which appear to be
applicable to this project, Carteret County supports the use
standards for estuarine and public trust areas.
Economic and Community Development Policies include those for
Stormwater (Page IV-13). This section of the Plan states that
Carteret County supports the policy that all NCDOT projects should
be designed to limit to the extent possible stormwater runoff into
estuarine waters. Policies regarding the County's Commitment to
State and Federal Programs are discussed on Page IV-16. Carteret
County is generally receptive to state and federal programs which
provide improvements to the county, especially the NCDOT road and
bridge improvement programs, which the Plan notes are very
important to the County.
Regarding development in. Coastal Wetlands, the LUP notes that
except as prohibited in the policies section of the plan,
development allowed by the 7H Use Standards will be allowed in
areas identified by the NC Division of Coastal Management as
coastal wetlands. I can find no policy in the amended LUP which
would appear to prohibit this project.
Based on the above policies and land classifications, this project
appears to be consistent with the amended 1991 Carteret County Land
Use Plan, provided all state use standards can be met. Also, note
should be made by the applicant of the County's desire that all
NCDOT projects limit to the extent possible stormwater runoff into
estuarine waters.

9. NARRATIVE DESCRIPTION.
Project Setting
The project is located on SR 1316 near Merrimon on a tributary of 011ie Creek
in Carteret County. 011ie Creek is a tributary to Adam's Creek. A 40'-long existing
wooden bridge currently spans the tributary. Vertical clearance under the bridge is
only 18" to 24". The tributary flows in a northerly direction and reaches 011ie Creek
approximately 275' downstream from the bridge. Approximately 500' to 600' west of
the bridge location, Cullie Creek turns and "parallels the existing roadway. For
approximately 100', the creek approaches within-15' to 18' of the roadside ditch. An
extensive brackish marsh system vegetated with black needlerush Juncus roemerianusl
dominates the area. Patches of giant cordgrass S artina cvnosuroidesl can be found
scattered throughout the marsh. The roadside ditches are vegetated with salt meadow
grass (S. patens , bulrush (Scirpus sp.), and cattail (kpha sp.). Neither this tributary
of Cullie Creek nor Cullie Creek itself are designated as a Primary Nursery Area.
Both creeks are Class SA NSW waters. The area is not open to shellfishing.
Project Description
The applicant proposes to replace an existing bridge with three 117" by 79"
corrugated steel pipe arch culverts approximately 60' in length, and to upgrade and
pave SR 1316. The project includes "preping" an area 70' X 57' (the site of the
existing bridge) for installation of the three culverts. The "preping" process involves
excavating the area to a depth of -7' below MHW, installing the three culverts,
constructing the inlet headwalls, and backfilling the area with sand and stone.
Approximately 600 yds' of fill is proposed to be placed below the mean high water
line. In addition, the applicant proposes to upgrade and pave the road, providing two
10' lanes with 6'-wide shoulders.
Anticipated Impacts
The project as proposed would involve the following AECs: Coastal Wetlands,
Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. Excavation and
filling activities within the 70' X 57' area where the culverts are to be placed, directly
removes approximately 253 ft' of Coastal Wetlands and approximately 2,280 ft2 of
aquatic habitat in creek bottom (Public Trust Area). Approximately 1,457 ft' of high
ground (Estuarine Shoreline) would also be affected by the excavating and filling
activities. These excavation and filling activities would probably result in. short-term
and localized turbidity within the Estuarine Waters of the tributary to Cullie Creek.
Also at the same time, the applicant proposes to upgrade and pave the road. This

activity would destroy another 7,200 ft2 of Coastal Wetlands as a result of the
placement of fill for the 6'-wide road shoulders. In addition, approximately 15,000 ft2
of high ground (existing dirt road) would be graded and paved. These filling activities
approach within 15' of the Estuarine Waters of 011ie Creek and therefore increase the
potential for short-term, localized turbidity as well as for long-term increased runoff
into Cullie Creek. The applicant proposes to implement Best Management Practices to
minimize any adverse effects which may be caused by project -related sedimentation.
Specifically, the applicant proposes to install a silt fence at the top of the back slope of
the proposed roadway ditch from the bridge location to a point where the edge of the
creek is more than 75' from the excavation and filling activities.

This is to provide information requested by Mr. M. Ted Tyndall, Field
Representative, DENHR, in his letter dated August 31, 1994. The
additional information is relative to subject construction project activities
near the proposed bridge replacement location at Cullie Creek. This
information was inadvertently omitted in the original permit application.
The area of concern is where Cullie Creek, after leaving the bridge site
running in a northerly direction, turns and paralleh the roadway, then
approaches the roadway coming within 15' - 18' of the proposed roadway
ditch. This area is approximately 100' in length and located approximately
500' west of the Cullie Creek bridge.
Please find attached revised plan drawing and cross-section copies for your
review. It is proposed to install silt fence at the top of the back slope of the
proposed roadway ditch from the bridge location to where the edge of
creek distance from excavation activities is greater than 75 feet.

SUBJECT: Carteret County, Replacement of Bridge No. 86 on SR
1316 over Cullie Creek,. South of Merrimon.
The North Carolina Department of Transportation proposes
to replace Bridge No. £6 over Cullie Creek on SR 1316, south
of Merrimon. The proposed action will involve replacing the
existing bridge structure with three 117" by 79" corrugated
steel pipe arch culverts approximately 60' in length. This
bridge replacement will take place on existing alignment and
local traffic will be detoured along existing roadways. The
entire length of the roadway will be upgraded and paved, to
provide two ten foot lanes with six foot shoulders, in order
to improve safety parameters.
Fill in wetlands will be approximately 0.171 acres and
below ordinary high water will total 0.05 acres in salt marsh
habitat. Excavation in wetlands will be less than 0.01 acres
and excavation below ordinary high water will be
approximately 600 cubic yards. Upgrading and paving SR 1316
will require approximately 600' by 12' area of fill in
wetlands in order to provide adequate shoulder width, 2:1
slopes and to provide safe roadway design. The additional
width is needed to provide two 10' lanes with 6' shoulders
throughout the length of the project. Best management
practices will be implemented to minimize any adverse effects
which may be caused by project -related sedimentation.
NCDOT is requesting that the proposed work be authorized

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that the North Carolina
Department of Transportation of Raleigh in Wake County, filed an application on November
16, 1994, for a permit from the Division of Coastal Management to develop in an Area of
Environmental Concern and for certification from the Division of Environmental
Management that a discharge of fill material in project wetlands will not violate applicable
water quality standards.
According to said application the applicant proposes to replace an existing bridge with
three 117" X 79" corrugated steel pipe arch culverts approximately 60' in length and upgrade
and pave SR 1316.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of M. Ted Tyndall, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C., (919) 726-7021, and/or the
office of Rick Shiver, Division of Environmental Management, DEHNR Regional Field
Office, Wilmington, N.C., (919) 395-3900.
The Division of Environmental Management p poses to take final action on this
water quality certification on or before January 10, 19W The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
January 5, 1994 for consideration in the CAMA permit decision, and to Preston Howard,
Director, Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611,
prior to December 31, 1994 for consideration in the water quality certification decision.
Later comments on the CAMA application will be accepted and considered up to the time of
permit decision. Project modifications may occur based on review and comment by the
public and state and federal agencies. Notice of the permit decision in this matter will be
provided upon request.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development on property located in Carteret County on SR 1316 south of
Merrimon adjacent Cullie Creek. It was received on November 16, 1994, and appears to be
adequate for processing at this time. The projected deadline for making a decision is January
30, 1995. An additional 75-day review period is provided by law when such time is necessary
to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or

SUBJECT: CULLIE CREEK BRIDGE REPLACEMENT AND PAVING OF SR 1316
The Division of Marine Fisheries recommends that the existing bridge over
Cullie Creek be replaced with a bridge instead of the three steel culverts.
Cullie Creek is a primary nursery area by virtue of its being tributary to Cedar
Creek, [15A NCAC 3R .0003 (8) (b) (vii)] and serves as an area important to the
development of juvenile finfish, crabs and shrimp: The marsh surrounding Cullie
Creek provides nutrients and serves as a sediment trap to reduce turbidity in
that system. The potential for culverts to become filled with sediment and
impede water flow could have a negative effect on the flushing of the marsh.
Due t-o the excessive fill of sensitive wetlands associated with the
widening..and paving of SR 1316, it is recommended that the pavement and shoulders
be only as wide as the existing disturbance. Installation of silt curtains
during construction is absolutely essential for the reduction of turbidity from
the fill activities.
Based on the above, the .Division objects to the project as proposed and
recommends the changes as stated above.
