with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) A silt screen will be left between the area to be excavated and the existing
creek.
(2) The fill material will be clean and free of any pollutants except in trace
quantities.
(3) No excavated or fill material will be placed at any time in any marsh or
surrounding waters outside of the alignment of the fill area indicated on
the workplat(s).
(4) All excavated materials will be confined above MHW and landward of regularly
or irregularly flooded marsh.
(5) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or constrttction-
related discharge.
This permit action may be appealed by the perttittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

DEVELOPMENT PERMIT
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A-119(b) that application for a development permit in an Area
of Environmental concern as designated under the CAMA was
received on October 1, 1987.
According to said application, the North Carolina Department
of Transportation proposes to replace highway drainage pipes and
clean out adjacent ditches to improve road drainage on U. S.
Highway 70, at Otway, near Wards Creek, at Otway Free Will
Baptist Church, in Carteret County.
A copy of the entire application may be examined or copied
at the office of W. David Noble, Division of Coastal Management,
Located in the Division of Marine Fisheries Building, Morehead
City, N.C., (919/726-7021) during normal business hours.
Comments mailed to Mr. David Owens, Director, Division of
Coastal Management, P. O. Box 27689, Raleigh, N. C., 27611, prior
to December 23, 1987, will be considered in making the permit
decision. Later comments will be accepted and considered up to
the time of permit decision. Project modification may occur
based on review and comment by the public and state and federal

9. NARRATIVE DESCRIPTION: The applicant's proposed project is
located on U. S. Highway 70, east of Beaufort, in Otway, at
the Otway Free Will Baptist Church, near Ward's Creek.
The proposed project is to clean out an existing highway
ditch (approximately 10' x 301) and to extend two (2) 4' x
24' drainage pipes on each side of the road.
After installation, the pipes will be anchored with sand
bags.
The proposed ditch maintenance is to be performed with.a
hydraulic excavator (drott).
10. ANTICIPATED IMPACTS: The proposed pipe and ditch
maintenance will require the excavation of approximately 500
sq. ft. of Spartina alterniflora and will place 10 cubic .
yards of sand fill material around the pipes. A total of
approximately 18 cubic yards of material will.be excavated
over a 10' x 30' area.
The adjacent waters are classified "SA" by the Division of
Environmental Management and are open to shellfishing.by the
Division of Health Services.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the -owner of said property, then for-
ward a copy of the deed or other instrument under.
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 1h x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if 16
high quality copies *are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the siteAnclude
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

The Division of Coastal Management hereby acknowledges

property located U. S. Highway 70, at Otway, near Ward's Creek,
at Otway Free Will Baptist Church, in,Carteret County. It was
received on October 1, 1987, and appears to be adequate for
processing at this time, with the exception of the $100.00 permit
application fee and the adjacent riparian property owner's
statement which you need to send to our Raleigh office. The
projected deadline for making a decision is December 14, 1987.
An additional 75-day review period may be necessary and if so you
will be advised of the extension and the new deadline.
NCGS 113A-119(b) requires that Notice of an application be
posted at the location of the proposed development. Enclosed you
will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should
post this notice at a conspicuous point along your property where
it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the
road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an
incomplete application.

The N. C. Department of Transportation proposes to extend a pair of 24 in. pipes
and remove silt from the existing ditch in an effort to improve drainage near
Otway Free Will Baptist Church. The work is to be accomplished by DOT Mainte-
nance Personnel and no Federal funds will be used on the project.
Application is hereby made for a Section 404 permit as required for the subject
work. Attached is the permit application and drawings depicting proposed work.
Application is being made, by copy of this letter, for a CAMA Permit and a
Section 401 Water Quality Certification from the N. C. Department of Natural
Resources and Community Development.

Dear Mr. Marley:
Thank you for your inquiry of September 24, 1987, regarding
your plans to extend two 24-inch culverts under Highway 70 across
from the Otway Free Will Baptist Church in Otway, Carteret County,
North Carolina. The culverts allow passage of water to a tidally
influenced ditch which eventually flows into the North River.
On January 1, 1987, we renewed general permit No. SAWCO82-N-
000-0031 (enclosed), that authorizes the placement of fill
material associated with the construction, repair, or replacement
of bridges across navigable waters and waters of the United States
in North Carolina, including cofferdams, abutments, foundation
seals, temporary construction and access fills, approach fills,
detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and
specifications of the North Carolina Deparwent of Transportation.
Your proposed work is authorized if you can comply with all
permit conditions. Please read the enclosed permit to prevent an
unintentional violation of Federal law. As this Department of the
Army general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact
appropriate State and local agencies before beginning work.
