(1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (2) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (3) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 days of project completion. (4) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction -related discharge (increases of 25 NTUs or less are not considered significant). NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division of Coastal Management and/or the U. S. Army Corps of Engineers prior to project initiation. NOTE: The proposed project is certified under General Water Quality Certification No. 1734 issued 8/28/84 for bridge replacement. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Project Description The site is located 0.15 miles south of the intersection of SR 1162 and SR 1161 in Carteret County. The 0.38 acre site was planted with Juncas roemeramrs. II. Project Association This mitigation project offsets marsh wetland impacts associated with the widening of SR 1161 (Project Number 6.162228). III. Success Criteria • 50% survival rate of planted species • 50% area coverage n V. Results (See Wetland Mitigation Report - Vegetation, for more i4formation) No monitoring plots were established. By visual observation, the plants have failed. The site was originally planted with Juncus. At the time of first monitoring, the plants showed signs of stress, and the site was replanted the following spring. At that time, the drainage was improved slightly by cleaning the outlet ditch. Soil tests were taken at intervals from original planting to present. The test reveled signs of stagnate and trapped tidal water, but no toxicity problems. The vegetation failed again after the second planting. The elevation of the site may be slightly low. VI. Summary The site consists of approximately 0.38 acres of brackish marsh creation. To date, the vegetation continues to fail. VII. D.O.T.'s work related to bridge replacement in Carteret County and how this activity may be inconsistent with the County Land Use Plan, I am of the opinion that this would not be contrary to the stated policies of protecting coastal wetlands since this is an upgrading of an existing public roadway structure. I feel confident that the county would not want to impose more restrictive standards than those established by the state when permitting road development projects. Therefore, the county does want the wording in our Land Use Plan to be interpreted in a similar fashion as current state regulations are applied. Paul Comments on pending application of N.C. DOT. Bridges 81, 87, 88, Wiregrass Community May 5, 1987 These projects, individually, involved the excavation and filling of moderate amounts of marsh and unvegetated subaqueous substrate. These projects are typical of small bridge replacement projects in coastal North Carolina. The applicants have designed.the projects to use a headwall retaining system on both sides of the roadway in order to minimize excavation and filling requirements. The proposed width of the culverted crossing is the minimum necessary to construct a safe road passage. Some minor constriction of waterflow should be expected by using the aluminum arched culverts versus structures similar to the existing bridges. This is not expected to be a constriction serious enough to hamper the productivity that occurs in the tributary headwaters. Because of this the added expense of replacement bridges (similar to the Russell Creek project) ds not a justifiable requirement. Carteret County has some wording in the county Land Use Plan that suggests public roadways should not be`allowed in coastal wetlands. We have written the county about this and are hopeful that this only pertains to new public roadways and not to refurbishing existing public systems. If the problems with the county can be sorted out, I have no objections to the project as proposed as long as the following conditions are met: 1. Department of Transportation to .replace three bridges in the Wir-egrass Community off Highway 101 on SR 1161 at the. head of Eastman Creek in Carteret County. The application proposes alteration of coastal wetlands marsh in conjunction with the bridge replacement and this may be inconsistent with the Carteret County Land Use Plan. Clarification is needed from you as to the intent of the county on a particular statement. The 1985 version of the Carteret County Land Use Plan discusses the coastal wetland AEC beginning on page 106. The county plan describes this AEC, discusses its significance, designates a management objective and then establishes use standards to be followed in development of these wetlands. on page 10.8 the unacceptable uses include "public and private roads and highways". Corresponding state standards restrict "private roads and highways" (15NCAC 7J.0205(d)) from coastal wetlands, however, this is not extended to activities considered to be upgrading of existing public roadway structures. The proposal by,.NCDOT is enclosed for your review. This office needs to know if the county desires the wording in their Land Use Plan to be interpreted and applied the same as the corresponding state regulations are applied.or is some other interpretation intended by this statement. Project summary. are 7500 SF 5115 SF br 9. Narrative Description The applicants are the state agency in North Carolina responsible for roadways and bridges throughout the state. This present proposal is to replace three bridges on SR 1161, where the road intersects the multiple heads of Eastman Creek near the community of Wiregrass in Carteret County. These crossings are presently made with wooden bridges. The replacement structures will be culverts and fill. Bridge No. 81 presently spans about 33' and is about 16' wide. Upstream and downstream of the structure are large stands of smooth cordgrass marsh, except in the main body of the creek. The presence of spoil banks downstream next to the creek indicates channelization in the past. In the project vicinity, - bordering the road bed, the marsh becomes mixed with irregularly flooded species such as black needlerush and salt meadow grass. The applicants are proposing to "muck out" a 50' square area and fill this with a solid base. Three 73" by 55" aluminum pipe arches will be placed on this in line with the stream flow. To limit the fill area, concrete bag headwalls will be constructed to obtain the 40' roadway bed width. Bridge *88 is next traveling west and has a similar environmental situation as bridge #81. Upstream, however, the stream is completely channelized and minor amounts of marsh have pioneered this stream bed. This bridge seems to mark the landward most limit of this prong of Eastmam Creek. Construction method will also'be the same, except slightly smaller culverts (661lx51") will be used. Bridge #87 crosses the westernmost branch of Eastman Creek. The environmental situation is similar to bridge #81. Construction is similar also except 601lx46" culverts will be used. 10. Anticipated Impacts Conducting these three bridge replacement projects as proposed will involve the disturbance of approximately 1192.5 SF of mixed marsh containing smooth cordgrass, black needlerush and salt meadow grass. Approximately 1192.5 SF of intertidal previously disturbed creek bottom will be disturbed also. The roadbed will cause 2385 SF of this area to be refilled and additional highground areas measuring 5115 SF will be disturbed in these bridge constructions. Total area disturbed would be 7500 SF . Eastman Creek is a designated primary nursery area by the Division of Marine Fisheries. According to the Division of Health Services, it is closed to shell fishing. water classification is SA according to the Division of Environmental Management. CAMA Review Secondary road development is not referred to specifically in the Carteret County Land Use Plan. The area surrounding these projects is classified as rural -residential and the marshes and waters are classified as conservation. The county lists "public and private roads and highways" as unacceptable land uses for coastal wetlands. Nelson G. Department of Transportation proposes to replace the bridges with triple aluminum pipe arches. D.O.T. - Bridges 81, 87 and 88 Carteret County The applicant is proposing to replace existing wooden bridges with culverts with fill. The 3 bridges, Nos. 81, 87 and 88, are located on SR 1161 crossing Eastman Creek classified SA and closed to shellfishing. There will be a total of 2385 square feet of creek bottom filled. The project has been reviewed to determine impacts to water quality.
