permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp and fin fish populations, no excavation
of filling will be permitted between April 1 and September 30 of any year
without the prior approval from the Division of Coastal Management in consul-
tation with the Division of Marine Fisheries.
(2) No excavated or fill material will be placed at any time in any marsh or
surroundina waters outside the alignment of the filled areas as indicated on
the work plat drawings.
(3) Filter fabric or other appropriate underlayment must be employed over the
detour route prior to the placement of fill material.
(4) All fill material placed in any coastal wetlands area as delineated by
the workplat drawings must be contained and retained in such a way as to
prevent sedimentation and erosion from entering the adjacent waterways
of Harlowe Creek and other vegetated wetland areas.
(5) All fill material associated with the detour route on the north side of
the bridge rust be removed from that alignment prior to completion of the
project.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

(6) All spoil materials generated from the excavation of the marsh restoration
area will be placed on the high ground property in a singular motion without
impact to the adjacent vegetated wetland areas.
(7) The elevation requirements for the marsh restoration area will be coordinated
with Field Representatives from the Division of Coastal Management during
that phase of construction.
(8) In -stream turbidity curtains must be employed across the Harlowe Creek
upstream and downstream of the project alignment.
(9) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction -related
discharge (increases of 25 NTUs or less are not considered significant).
(10) All fill material and other land -disturbing activities will be properly
graded and provided with a ground cover sufficient to restrain erosion
within 30 days of project completion.
NOTE: Prior to initiation of the project, the applicant and his contractors
are encouraged to join with representatives of the Division of Coastal
Management to review project plans and permit conditions prior to initiating
work activities.
NOTE: The proposed project is certified under General Water Quality Certification
No. 1734 for bridge modification or reconstruction.

Success Criteria calls for a 50% survival rate of both species and 50% area coverage.

Notes from Report:
Site is well established with Spartina Alterniflora. Juncits roemerianits is currently
invading from eastern area but boundaries are still well. defined.
VI. Summary
Areas on both sides of the eastern bridge approach were graded to wetland elevation and
planted with Spartina alterniflora. There were no plots established. By visual
observation we obtained approximately 95% area coverage of.Spartina alternii fora and
Juncos roemerianus within the reclaimed areas.

Dear Colonel Suermann:
Please reference the N. C. Department of Transportation's (NC DOT)
recent bridge replacement at the N. C. Highway 101 crossing of
Harlowe Canal, Carteret County, permitted under General Permit 82-
N-000-0031, U. S. Coast Guard PN 5-653, and CA14A 52-88.
Based on July 30, 1990, August 15, 1990, and September 19, 1990,
on -site inspections of the area, we have determined that the
permittee may not be in compliance with the following conditions
of the General Permit:
SSRecial Condition f. "Upon completion of any work authorized by
this general permit, all temporary fills will be completely removed
and pre-existing land contours restored. Restored areas will be
sprigged with appropriate wetland species."
Special Condition a. "All fill, temporary and permanent, must be
stabilized to prevent erosion of fill material into adjacent waters
or wetlands."
Our inspections revealed that the bridge approach fill material is
eroding and being deposited in the immediately adjacent wetlands.
We are concerned that this material is adversely impacting adjacent
natural marsh, the waters of Harlowe Canal, and especially the
restored wetland area adjacent to the approach fills.
Some effort has been made by the NC DOT to stabilize the bridge
approach fills. However, the success of this effort is
questionable and to date no attempt has been made to remove the
eroded fill material from the marsh restoration sites.
In view of the above, we request that you inspect the project site
and assess the work's compliance with Special Conditions f and g
of General Permit 82-N-000-0031.

The National Marine Fisheries Service has reviewed Public Notice 5-653
whereby the North Carolina Department of Transportation (NC DOT) proposes
to replace the existing Harlowe Canal Bridge on NC 101 in Carteret County,
North Carolina.
We are concerned that the public notice indicates that 0.65 acre of
wetlands, predominately vegetated with Juncus roemerianus and Spartina
alterniflora marsh, would be lost while the Finding of No Significant
Impact FONSI), dated June 20, 1986, stated (pages 8 and 9) that there
would be a temporary loss of 0.25 acre and a permanent loss of 0.14 acre.
These wetlands provide food, habitat, and water quality maintenance functions
that are important for continued fishery production.
Also, wetland replacement which is proposed as a part of this work is
dependent upon a number of parameters, any one of which .can limit the
success of the mitigation effort. Therefore, we are also concerned that,
to date, no information has been provided regarding the procedures to
be followed in the proposed marsh replacement effort.
In view of the above, we recommend that this permit not be issued. We
will reconsider our position on this project when the following information
has been provided by the NC DOT for our review and comments:
1. An explanation regarding the difference
described in the FONSI and the Coast Guard public
2. A plan which describes in detail the marsh replacement/mitigation
effort proposed for this project.

Dear Sir or Madam:
The U. S. Fish and Wildlife Service (Service) has reviewed Public
Notice 5-653 concerning a proposal by the North Carolina Department of
Transportation (NCDOT) to replace a bridge and perform related work
over Harlowe Canal, mile 4.0, Carteret County, North Carolina. This
is the report of the Service and the Department of the Interior and is
submitted in accordance with provisions of the Fish and Wildlife
Coordination Act (16 U.S.C. 661-667e) and the Endangered Species Act,
as amended (16 U.S.C. 1531-1543) .
According to the information provided with the Public Notice, the
applicant proposes to replace the existing bridge in its current
location over Harlowe Canal, resulting in the loss of a total of 0.65
acres of wetland along the fringe of the existing embankment. The
anticipated wetland loss is expected in association with a temporary
detour alignment west of the existing bridge.
While the Service has attempted to assess the environmental impacts of
this project proposal, the Public Notice is so inadequate that our
review must be considered preliminary. The Public Notice deficiencies
include the following items:
o the Public Notice was undated and did not include a due
date;
o the Public Notice included only sheets No. 1, 3, and 4 of
the applicant's plan; thus it is unclear whether the
missing sheet might provide information needed by
reviewers;
o there is no description of the type or quality of the
wetlands to be impacted, nor is there a distinction
between wetlands to be lost permanently and those to be
lost only temporarily during construction;
o the total wetland acreage to be affected, 0.65 acre,
represents a significant departure from the 0.39 acre
total shown in the June, 1986, Finding of No Significant
Impact document. Despite this difference, there is no
explanation for this change nor is there any indication
of how much of this acreage is to be permanently lost.
We believe that the cumulative lack of the above basic information
prevents adequate public review and may inhibit conservation of high
quality fish and wildlife resources.
According to Dr. Charles Bruton at the NCDOT, the wetland acreages
included in the FONSI were estimates made prior to the final
engineering design, and those included in the Public Notice include
0.25 acre to be permanently lost and 0.40 acre to be temporarily
covered during construction. Since the decision to select the current
alternative was intended to minimize impacts on wetlands, we recommend
that a Supplemental FONSi should be prepared by the applicant to
reevaluate the alternatives and particularly to assess the impacts on
wetland resources.
Service personnel visited the site with representatives of the NCDOT
on July 26, 1984, and identified the wetland habitat to be impacted as
estuarine, intertidal emergent wetlands consisting of saltmarsh
cordgrass (Spartina alterniflora) and black needlerush (Juncus
romerianus). The Service recognizes estuarine, intertidal emergent
wetlands as valuable habitat for fish and wildlife. In general, these
wetlands provide high quality resting, feeding, cover and/or nesting
habitat for a large number of wildlife species, including bitterns,
herons, rails, muskrat and several species of reptiles. The shallow
water and associated bottoms also may support a large and diverse
benthos which is utilized as a food source for finfish and shellfish _
which are of economic importance. Fish and invertebrates which may
utilize the project area include flounder, trout, shrimp, crabs and
oysters.
A significant portion of the nation's original estuarine, intertidal
emergent wetlands have been eliminated. It is estimated that over
half of the wetlands originally present in the United States had been
converted to other categories by the early 1970's (Hefner, J and J.
Brown. 1984. Wetlands 4:1-11 .) . In the two decade period between the
early 1950's and 1970's estuarine intertidal emergent wetlands were
reduced nationally by 8.25 percent (Frayer, W. E., T. J. Monahan, D.
C. Bowden and F. A. Graybill. 1983. Status and Trends of Wetlands and
Deepwater Habitats in the Conterminous United States: 1950's to
1970's. U.S. Fish and Wildlife Service, Washington, D. C. 32 pp.) .
Fully 85 percent of the national losses in estuarine intertidal
emergent wetlands occurred in the southeastern United States (Hefner
and Brown 1984)•
Based on the above described habitat values and the fact that such
areas are relatively scarce or becoming scarce on a national basis and
in the ecoregion, the Service's Mitigation Policy (Federal Register
46(15): 7656-7663, January 23, 1981) for resources of this type calls
for no net loss of in -kind habitat value. After minimizing losses of
such habitats, the unavoidable losses should be replaced with similar
habitat values so that populations of the species associated with the
habitats will remain relatively stable in the area over time.
Specific ways to achieve this include: 1) physical modification of
replacement habitat to convert it to the same type lost; 2)
restoration or rehabilitation of previously altered habitat; 3)
increased management of similar replacement habitat so that the
in -kind value of the lost habitat is replaced; or 4) a combination of
measures.
In consideration of the value of the project area to fish and
wildlife, we believe that the public interest would best be served
through impact avoidance and/or minimization. If this is not
possible, the Service continues to recommend, as we did in our
comments to NCDOT on October 22, 1985, and August 11, 1986, that
creation of replacement habitat be performed on a 2 for 1 basis; that
is, if 0.25 acre is to be lost permanently, 0.50 acre of similar marsh
should be created from adjacent upland. To insure that that any
wetland area that receives temporary fill recovers optimally, fill
should be handled in a manner that allows it to be lifted off with
minimal disturbance to the substrate while reducing erosion. Since
investigations by the National Marine Fisheries Service indicate that
removal of temporary fill is not sufficient in itself to facilitate
marsh regeneration, supplemental planting and monitoring are necessary
also.
Therefore, should the Coast Guard decide to authorize the proposed
work, the Service recommends that the following conditions be made a
part of any issued permit:
1. Creation of replacement habitat shall be performed
on a 2 for 1 basis; This area should be graded to
a similar slope and sprigged with J. romerianus
and S. alterniflora in the same percentages as
occur in the current habitat.
2. All fill material shall be placed on filtercloth.
3. Temporarily filled areas shall be sprigged with
plantings as described in condition 1.
4. The site shall be monitored to assess restoration
success on a semi-annual basis for two years after
completion of the project. If NCDOT and Service
biologists believe additional restoration measures
are necessary at the end of the two-year period,
they shall be instigated.

David Taylor has brought to my attention that the Harlowe Creek
waterway is in fact a designated Primary Nursery Area off the
Newport River and that the proposed project warrants the care and
concerns for juvenile shrimp and finfish populations. Therefore,
after a careful review, I have no objections with the issuance of
the necessary State permits to authorize the bridge replacement
as proposed. It is clear that the public benefits greatly
outweigh the loss to those high marsh wetlands as described in
my Field Report. The following conditions are offered for your
consideration:
1. In order to protect juvenile shrimp and finfish populations,
no excavation or filling will be permitted between April 1
and September 30 of any year without the prior approval from
the Division of Coastal Management.
2. No excavated or fill material will be placed at any time in
any marsh or surrounding waters outside the alignment of the
filled areas as indicated on the workplat drawings.
3. All fill material and other land disturbing areas will be
properly graded and provided with a ground cover sufficient
to restrain erosion within 30 days of project completion.
4. The in -stream turbidity must not be increased to more than 50
NTU's as a result of the proposed activity after a
reasonable opportunity for dilution and mixture.
5. Or, during construction, in -stream turbidity curtains must be
employed across the Harlowe Creek upstream and downstream of
the project alignment.
NOTE: The permittee and his contractors are urged to meet
with representatives of the Division of Coastal Management
and the Army Corps of Engineers prior to project initiation.

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A-119(b) and 143-215 3(a)(1)(c) that the North Carolina
Department of Transportation, filed an application on November
17, 1987, for a permit from the Division of Coastal Management to
develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of
fill material in project wetlands will not violate applicable
water quality standards.
According to said application the North Carolina Department
of Transportation is proposing to replace Bridge #10 over Harlowe
Canal. This will involve the temporary placement of'fill
material in coastal wetlands to create a detour. Approximately
one quarter of an acre of marsh will be permanently displaced by
the proposed project, located at N. C. 101, at SR 1155 and
Harlowe Canal, in Carteret County.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of

9. NARRATIVE DESCRIPTION: The project site is known as DOT's
Bridge #10 over the Harlowe Canal, on N.C. Highway 101, near
the intersection of SR 1155, in Carteret County. The North
Carolina Department of Transportation proposes to replace
the existing 68' long single span steel bridge which was
built in 1924. The alternative course of action chosen by
DOT involves the construction of a traffic, detour in an area
of coastal wetlands on the north side of the existing
bridge. The detour is required so that the replacement
bridge can be positioned on the original road alignment. An
estimated 17,424 sq. ft. of coastal wetlands vegetation will
be temporarily filled in the construction of the detour .
road. The onsite visit indicates that the high marsh
vegetation is dominated by Black Needlerush, Giant Cordgrass,
Salt Meadow Hay, Salt Grass and Marsh Elder. Other ecotone
species include wax myrtle, cedars, bay and pond pine. The
construction technique usually employed covers the fill area with
an underlayment of filter fabric prior to the placement of
roadway quality material. The temporary detour will occupy an
area approximately 264' long x 33' wide on both the east and west
sides of the Harlowe Canal.
Because the new roadway approaches will be widened, an
additional area of coastal wetlands will be permanently
filled. An estimated .25 acres, or approximately 10,890 sq.
ft.,, of high marsh vegetation similar to that which has -
already been described. will be directly lost on the south
side of the existing bridge. This area of permanent fill is
calculated at approximately 5,445 sq. ft. on either side of
the canal. The DOT plans to restore a portion of the
coastal wetlands by excavating a 2200 sq. ft. area of
highground property and cultivating the growth of Saltmarsh
Cordgrass. The enhancement area is located less than 100'
south of the existing bridge span on the east side of the
canal. The new bridge span measuring approximately 70' long
will not restrict the width of Harlowe Canal. The vertical
clearance between the normal water level and the bottom of
the concrete bridge span will measure approximately 8' and
should have no appreciable impact on public navigation or
traditional use of the Harlowe waterway.
Additional information can be obtained by reviewing the NC
DOT Finding of No Significant Impact distributed in June of
1986.
10. ANTICIPATED IMPACTS: The proposed project will generate a
net loss to coastal wetlands of some 8,712 sq. ft. This
area is dominated by high marsh species and little to no

saltmarsh cordgrass is directly involved. DOT proposes to
restore approximately 2200 sq. ft. of highground property to
an area of saltmarsh cordgrass (Spartina alternifloia). In
addition, once the temporary detour fill has been removed,
significant efforts will be made to cultivate residual marsh
vegetation in an effort to repopulate the road alignment.
The project will create an impact on coastal wetlands that
can be properly managed without significant loss to the
estuarine ecology. The proposed project will increase the
public benefit by developing a much safer road and bridge
system between the Towns of Havelock and Beaufort.
CAMA REVIEW: A brief review of the Land Use Plan for
Carteret County indicates that the project is consistent
with the goals and objectives of that document where no
development constraints can be identified for the
construction and maintenance of existing roads and bridges
where public health and safety benefits will be increased.

After a careful review of the proposed project and the merits of
the bridge replacement activity, I have no objections with the
issuance of the CAMA Dredge and Fill permit for the replacement
of Bridge #10 over Harlowe Canal. It is my belief and
determination that the increased public benefits from the new
bridge far outweigh the net losses to the high marsh wetlands as
described in my bio-report. The following conditions are offered
for your review:
1. All construction and fill operations must be accomplished in
accordance with the permitted workplat drawing.
2. Filter fabric or other appropriate underlayment must be
employed over the detour route prior to the placement of
fill material.
3. All fill material associated with the detour route on the
north side of the bridge must be removed from that alignment
prior to completion of the project.
4. All fill material placed in any coastal wetlands area as
delineated by the workplat drawings must be contained and
retained in such a way as to prevent sedimentation and
erosion from entering the adjacent waterways of Harlowe
Creek or other vegetated wetland areas.
5. All spoil materials generated from the excavation of the
marsh restoration area will be placed on the highground
property in a singular motion without impact to the adjacent
vegetated wetland areas.
6. The elevation requirements for the marsh restoration area
will be coordinated with Field Representatives from the
Division of Coastal Management during that phase of
construction.
NOTE: Prior to initiation of the project, the applicant and
his contractors are encouraged to join with representatives
of the Division of Coastal Management and the Corps of
Engineers to review project plans and permit conditions
prior to initiating work activities.

NCGS 113A-119(b) requires that Notice of an application be
posted at the location of the proposed development. Enclosed you
will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should
post this notice at a conspicuous point along your property where
it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the
road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an
incomplete application.

SUBJECT: Carteret County, NC'101 bridge over Harlowe Canal (B-1090)
The North Carolina Department of Transportation proposes to replace the
subject substandard bridge with a new structure on the existing alignment. The
replacement structure will provide 7.5.feet of vertical clearance above mean
high tide and a 32-foot wide channel. Traffic service will be maintained during
construction on a temporary detour structure and approaches immediately north of
the existing location.
The proposed project will require the placement of 0.40 acre of fill in
wetlands for the temporary structure, which will be removed. In addition, the
'widened -roadway will require the placement of 0.25 acre of permanent fill in
wetlands. As compensation for that 0.25 acre loss, the Department of Transporta-
tion proposes to acquire a 0.25 acre permanent drainage easement south of the
highway right of way just east of the Canal. In that area, at -least 0.05 acre of
wetland will be created. The creation of this small area of wetlands will
enhance a much larger area of wetlands by enlarging,a connection to the canal,
thus improving water exchange.
Application is hereby made for a CAMA Permit as required for the subject
work. Attached is the permit application and drawings depicting proposed work.
Application is being made, by copy of this letter, for a section 401 Water
Quality Certification. In that a permit will be required from the U. S. Coast
Guard, a Department of the Army permit will not be required.
