This permit, issued on August 22, 1983 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
pemtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All back fill material will be obtained from a highground source and confined
behind the permitted bulkhead.
(2) All fill material to be placed below the mean high water level will be confined
behind the permitted bulkhead.
(3) No marsh grass will be excavated and/or filled.
(4) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction
related discharge.
NOTE: This project is certified under General Water Quality Certification No. 1272
for bulkhead construction.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on

Members of the staff of the Wilmington Regional Office have reviewed the
application for the subject project. The applicant proposes to construct a
bulkhead structure approximately 64' in length along an irregular, eroded
shoreline an average distance of 8 feet from the MHW line. Approximately 19 cubic
yards of upland material are to be placed below MHW.
The subject project appears to meet the conditions of the General Certification
for Bulkheads. If you have any questions, please so advise.

8. Project summary NC DOT proposes to construct a buikneaa at its orioge
operation yard located on the SW side of Bwy. 12 immediately west of where
the bridge goes over the Thorofare Bay channel between the communities of
Atlantic and Cedar Island.
9. Narrative description
The NC Dept. of Transportation is requesting a -permit to construct a
bulkhead at property belonging to the Department located on the SW
side of NC Hwy. 12 immediately west of where the bridges goes over
the Thorofare Bay channel between the communities of Atlantic and
Cedar Island, Carteret County.
The Thorofare Bay channel provides access from Core Sound to Pamlico
Sound. The area to be bulkheaded was the roadway approach to an old
bridge location which was present some time ago. It is now used as
a bridge operation yard and there are a series of docks located along
the shoreline areas. The shoreline at this location is severely
eroded and highly irregular, with vertical banks ranging from 2 - 8'
in height. Immediately east of this eroded area is an approximately
20' long by 5' wide border of Spartina alterniflora marsh.
The applicant is requesting a permit to construct an approximately
64' long bulkhead along the irregular shoreline area which has ero-
ded, and will be located from 0 - 14' waterward of the MEW line
(avg. 8'). About 19 cu.yds. of upland material will be placed below
the MHW line in conjunction with the proposed bulkhead.
10. Anticipated impacts
The project as proposed will result in thefilling in of about 512 sq.ft
of bottom area, which is below the MHW line. About 19 cu.yds. of upland
fill material will be placed below the MHW line and will be confined
by the proposed bulkhead. `

I have no objections to the issuance of this permit with the follow-
ing conditions:
I. All back fill material will be obtained from a highground

NOTE: To date this office has not received the $25 .application

Operation Yard Near Atlantic, Carteret County.
The North Carolina Department of Transportation - Division of
Highways makes application for a Section 404 and State Permits
as•required for the subject work. The permit application is
for the construction of a bulkhead as part of the bridge
operation yard on the southwestern side of NC 12 near the
bridge over Thorofare Bay Channel.
Attached are three copies of the permit application and three
copies each of drawings depicting proposed work.
Application is being made, by copy of this letter, for
permits required from the North Carolina Department of Natural
Resources and Community Development. .

Dear Mr. Waters:
Our Raleigh office has forwarded to us DOT's application
for a permit to construct a bulkhead at the Bridge Opera-
tion Yard near Atlantic, Carteret County. The applica-
tion was received in this office on May 23, 1983.
The material you have submitted appears adequate for pro-
cessing at this time. However, we will need the following
to complete the application: A check for $25 made payable
to the Dept. of Natural Resources and Com. Development. A
copy of the application should be furnished the adjacent
riparian landowner (U.S.Dept. of Interior, National Wild-
life Refuge) and the post Office receipt for certified
mail should be sent to us (see X.0 of application form).
Processing will require an on -site inspection within the
next two weeks. Additional information may be required as
a result of this investigation and further review of the
proposal by other state and federal agencies. Additional
information may also be required by the Div. of Environ-
mental Management to determine if a 401 Water Quality Certi-
fication is required.
You may contact this office at any time if you have questions
regarding the status of this application.

Pursuant to NCGS 113A-119(b), the Department -of Natural Resources and
Community Development hereby gives public notice that an application for a
development permit in an Area of Envirionmental Concern as designated under
the CAMA was received on June 9, 1983 According to said applica-
tion NC Dept. of Transportation proposes to construct an approximately
64' long bulkhead at its bridge operation yard located on SW side of
NC 12, west of bridge crossing over the Thorofare Bay Channel between
the communities of Atlantic and Cedar Island, Carteret County .
A copy of the entire application may be examined or copied at the site
,or at the office of Charles. Jones Division of Marine
Fisheries Office in Morehead City after this date during normal business
hours.
Comments mailed to Mr. Kenneth Stewart, Executive Secretary, Office of

On January 27, 1981, after extensive coordination between
State and Federal agencies, we issued general permit No.
SAWC080-N-000-0291 (enclosed), which provides Federal
authorization for those construction activities that require and
receive authorization from the State of North Carolina in the form
of a Coastal Area Management Act (CAMA) permit for major
development, and/or a permit to excavate/fill, and/or a Water
Quality Certification.
A review of your application received May 17, 1983, for a
Department of the Army permit to construct and backfill a bulkhead
on Thorofare Bay at the bridge operation yard on the southwestern
side of N. C. Highway 12 near Atlantic, Carteret County, North
Carolina, indicates that your proposal is a candidate for Federal
authorization under this general permit. Accordingly, the
processiof your application will be accomplished by the N. C.
Office of Coastal Management. You should be responsive to any
requests they should make regarding improved plans or additional
information to facilitate the handling of your application. The
N. C. Division of Environmental Management will review your
proposal, and a determination will be made as to the need for a
State Water Quality Certification. Comments from Federal review
agencies will be furnished to the State. If there are no
unresolved differences of State -Federal positions or policy, the
final action taken on your application by the State will satisfy
the terms of our general permit. The terms of the general permit
will not be satisfied if any of the following situations exist:
a. There is an unresolved objection from any Federal
agency.

b. A State Water Quality Certification has not been issued
(if required). Section 401 of the Clean Water Act requires that
prior to the issuance of any Federal permit that may result in a
discharge into waters or wetlands, the State agency responsible
for water pollution control (N. C. Division of Environmental
Management) must certify that the discharge will not violate
applicable Water Quality Standards.
c. The proposed work would have a significant effect on the
quality of the human environment. The District Engineer will make
this determination prior to the conclusion of the State process.
d. There is a significant and substantive unresolved
objection from any individual, group, or.agency.
If your application is withdrawn from this general permit
process, you will be so notified and informed of its further
management in writing.. When your application is successfully
processed to conclusion under this general permit, you will
receive written notice from the District Engineer. Only after
receiving such confirmation should you begin work.
