Any violation of these terms may subject pemtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All back fill material will be obtained from a highground source and confined behind the permitted bulkhead. (2) All fill material to be placed below the mean high water level will be confined behind the permitted bulkhead. (3) No marsh grass will be excavated and/or filled. (4) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction related discharge. NOTE: This project is certified under General Water Quality Certification No. 1272 for bulkhead construction. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary NC DOT proposes to construct a buikneaa at its orioge operation yard located on the SW side of Bwy. 12 immediately west of where the bridge goes over the Thorofare Bay channel between the communities of Atlantic and Cedar Island. 9. Narrative description The NC Dept. of Transportation is requesting a -permit to construct a bulkhead at property belonging to the Department located on the SW side of NC Hwy. 12 immediately west of where the bridges goes over the Thorofare Bay channel between the communities of Atlantic and Cedar Island, Carteret County. The Thorofare Bay channel provides access from Core Sound to Pamlico Sound. The area to be bulkheaded was the roadway approach to an old bridge location which was present some time ago. It is now used as a bridge operation yard and there are a series of docks located along the shoreline areas. The shoreline at this location is severely eroded and highly irregular, with vertical banks ranging from 2 - 8' in height. Immediately east of this eroded area is an approximately 20' long by 5' wide border of Spartina alterniflora marsh. The applicant is requesting a permit to construct an approximately 64' long bulkhead along the irregular shoreline area which has ero- ded, and will be located from 0 - 14' waterward of the MEW line (avg. 8'). About 19 cu.yds. of upland material will be placed below the MHW line in conjunction with the proposed bulkhead. 10. Anticipated impacts The project as proposed will result in thefilling in of about 512 sq.ft of bottom area, which is below the MHW line. You should be responsive to any requests they should make regarding improved plans or additional information to facilitate the handling of your application. The N. C. Division of Environmental Management will review your proposal, and a determination will be made as to the need for a State Water Quality Certification. Comments from Federal review agencies will be furnished to the State. If there are no unresolved differences of State -Federal positions or policy, the final action taken on your application by the State will satisfy the terms of our general permit. The terms of the general permit will not be satisfied if any of the following situations exist: a. There is an unresolved objection from any Federal agency. -2- b. A State Water Quality Certification has not been issued (if required). Section 401 of the Clean Water Act requires that prior to the issuance of any Federal permit that may result in a discharge into waters or wetlands, the State agency responsible for water pollution control (N. C. Division of Environmental Management) must certify that the discharge will not violate applicable Water Quality Standards. c. The proposed work would have a significant effect on the quality of the human environment. The District Engineer will make this determination prior to the conclusion of the State process. d. There is a significant and substantive unresolved objection from any individual, group, or.agency. If your application is withdrawn from this general permit process, you will be so notified and informed of its further management in writing.. When your application is successfully processed to conclusion under this general permit, you will receive written notice from the District Engineer. Only after receiving such confirmation should you begin work.
