This permit, issued on November 3, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation >f these terms may be subject to fines, imprisonment or civil action; or may cause me permit to ne min ana vota. Shoreline Stabilization 1) The authorized alignment of the bulkhead shall adhere to the alignment depicted on the attached workplan drawings. 2) The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -verified by DCM within a maximum of 30 days prior to the new expected start of construction. 3) No backfill material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No.123-15 Page 2 of 3 !l ADDITIONAL CONDITIONS 4) The bulkhead shall be constructed prior to any backfilling activities. 5) The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 8) No excavation, or other land disturbing activities, is permitted except for that which may be required for the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. 9) All backfill material shall be clean and free of any pollutants except in trace quantities. 10) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 13) This permit does not authorize the interference with any existing or proposed Federal project, and the pemuttee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No open water areas shall be excavated or filled, even temporarily, outside of the area as indicated on the attached workplan drawing. 15) No excavation or filling of any vegetated wetlands is authorized by this permit. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2015-02253). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 95-1026 Ver. 2. NOTE: Future development of the pemtittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is finther advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. PROJECT SUMMARY: The applicant proposes to construct 1,854 linear feet of new vinyl bulkhead an average 2 ft waterward of normal water level (NWL). Field Investigation Report Page 2 Project Setting The proposed project is located at 4419 Mill Landing Rd (SR 345) in the village of Wanchese in Dare County. The property is adjacent Mill Creek which empties into the Roanoke Sound. There is a manmade canal that empties into Mill Creek located entirely within the property. The canal is approximately 370 ft long and between 50-60 ft wide with a `T' at the end that is approximately 200 ft long and 35 ft wide. The property is approximately 8.89 acres and has approximately 2,200 linear feet of shoreline. The elevation of the tract is approximately 3 ft above normal water level (NWL) and is vegetated with typical yard grasses and pine trees. The property is currently developed with over 1,000 feet of existing wooden docks used for docking commercial fishing boats and two storage sheds and a crab shedder area. Most of the wooden docks are located within the manmade canal with only about 150 ft of dock located on Mill Creek. Mill Creek and the Roanoke Sound are classified as SA in this area and are closed to shellfish harvesting. The water depths at the proposed bulkhead alignment are approximately 2 ft. The water bottom in both the canal and Mill Creek are sandy loam and there were no submerged aquatic vegetation (SAV) observed in the area. No areas of archaeological significance are known in the project area. Development Proposal The applicant proposes to construct 1,854 linear feet of new vinyl bulkhead and fill behind the proposed bulkhead. Approximately 285 ft of the bulkheading is proposed along the shoreline adjacent to Mill Creek. This portion of the bulkhead alignment would maintain 2 ft from NWL with only a small 20 ft section proposed at 6 ft from NWL. This portion of the alignment is proposed due to the turn into the canal and the large amount of broken concrete and debri along the shoreline. The bulkhead alignment within the manmade canal/basin also maintains an average of 2 ft from NWL with a few spots proposed at the maximum distance of 6 ft from NWL due to erosion. The project area has several hundred feet of existing docks and the shoreline behind the docks is experiencing severe erosion due to the boat traffic in the area. Approximately 150 ft of the existing shoreline is already bulkheaded and the applicant would tie into the existing bulkhead. The sand for the fill material would be hauled in from an upland source. Anticipated Impacts The proposed project would result in the filling of 3,708 sq ft of Estuarine Waters Public Trust Area of Environmental Concern and 27,810 sq ft of Estuarine Shoreline, also 137 cubic yards of fill material would be placed below NWL. The site of the proposed development is at 4419 Mill Landing Rd, Wanchese, Dare County. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW) and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 07H.0206 Estuarine Waters (c) Management Objective. To conserve and manage the important features of estuarine haters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for RECEIVED coastal wetlands, estuarine waters, and public trust areas described in Rule 07H.0208. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The applicant proposes to construct a bulkhead to prevent erosion. This development will be consistent with the use standards and would not interfere with the public's right for navigation and recreation. 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The applicant proposes to construct a bulkhead. This sub -paragraph lists this structure as water dependent. Paragraph (a)(2)(A) requires that the location, design and need for development, as well as the construction activities involved be consistent with the stated management objective. Consistent: The proposed bulkhead is consistent with the management objectives. Paragraph (a)(2)(B) requires that no suitable alternative site or location outside of the AEC exists for the use of development. Consistent: This development will not violate water and air quality. Paragraph (a)(2)(D) requires no major or irreversible damage to valuable documented archaeological or historic resources. Consistent: There are no known archaeological or historic resources on the property. Paragraph (a)(2)(E) requires that the development shall not measurably increase siltation. Consistent: It does not appear that this development will measurably increase siltation. Paragraph (a)(2)(F) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that this development will create stagnant water bodies. Paragraph (a)(2XH) requires that development shall not impede navigation or create undue interference with access to, or use of, PTA or EW. Consistent: The proposed bulkhead, associated backfill and pier will not impede or create undue interference with access to, or use of, PTA or EW. Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (6) Docks and Piers and (7) Bulkheads and Shore Stabilization Measures pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (7) is Bulkheads and Shore Stabilization Measures Subparagraph (7)(A) states, 'Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate normal water level." Subparagraph (7)(B) states, "Bulkheads shall be constructed landward of significant marshland or marsh grass fringes." Consistent: No wetlands exist on the property. Subparagraph (7)(C) states, 'Bulkhead fill material shall be obtained from an upland source approved pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead." Consistent: The applicant's have indicated that clean upland fill will be used. RECE SEp 14 206 00"010 e O Etheridge Seafood Major Permit Recommendations Page 4 Subparagraph (7)(D) states, "Bulkheads or other structures employed for shoreline stabilization shall be permitted below approximate mean high water or normal water level only when the following standards are met: (i)the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule." Consistent: The applicant's property does have an identifiable erosion problem and has lost a significant portion of land. (ii)the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features. Consistent: The proposed bulkhead alignment would align it with adjacent bulkheads. (iii)the bulkhead alignment will not result in significant adverse impacts to public trust rights or to the property of adjacent riparian owners. DATE: September 8, 2015 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The subject property consists of approximately 8.89 acres with a total of 2,200 linear feet of shoreline along a manmade canaUbasin, a drainage ditch and Mill Creek, which connects to the Roanoke Sound. A large amount of broken concrete and debris is located along the shoreline at Mill Creek. The canal/basin is centrally located on the property. The canaVbasin is approximately 370 feet long and between 50 and 60 feet wide with a 35 foot wide by 200 foot long "r terminus. The drainage ditch connects to Mill Creek north of the canal/basin. The shoreline is experiencing severe erosion due to boat traffic. Water depths are approximately 2 feet at a distance of 2 to 6 feet from the shoreline. The subject property is approximately 3 feet above Normal Water Level (NWL) and is located within the AE (EL 10) Floodzone. The site is vegetated with lawn grasses and pine trees. Existing site improvements consist of a two (2) storage sheds, a crab shedder and two (2) driveways located on either side of the canal/basin. Existing shoreline improvements consist of 150 linear feet of bulkhead, 150 linear feet of wooden dock on Mill Creek, and over 850 linear feet of wooden dock along the canal/basin. The site is used by commercial fishing boats. Installation of 1,854 linear feet of bulkhead with associated fill is proposed. Approximately 285 linear feet of bulkhead will be located along Mill Creek. This portion of bulkhead will be located 2 feet from NWL with a 20 foot section located 6 feet from NWL due to the turn in the canal and the large amount of broke concrete and debris along the shoreline. Approximately 102 linear feet of bulkhead will be installed along the drainage ditch near its connection to Mill Creek. The remainder of bulkhead will be installed within the canaVbasin. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. RECENED SEP 0 3 20b Field Investigation Report Page 2 Project Settina The proposed project is located at 4419 Mill Landing Rd (SR 345) in the village of Wanchese in Dare County. The property is adjacent Mill Creek which empties into the Roanoke Sound. There is a manmade canal that empties into Mill Creek located entirely within the property. The canal is approximately 370 ft long and between 50-60 ft wide with a "T" at the end that is approximately 200 ft long and 35 ft wide. The property is approximately 8.89 acres and has approximately 2,200 linear feet of shoreline. The elevation of the tract is approximately 3 ft above normal water level (NWL) and is vegetated with typical yard grasses and pine trees. The property is currently developed with over 1,000 feet of existing wooden docks used for docking commercial fishing boats and two storage sheds and a crab shedder area. Most of the wooden docks are located within the manmade canal with only about 150 ft of dock located on Mill Creek. Mill Creek and the Roanoke Sound are classified as SA in this area and are closed to shellfish harvesting. The water depths at the proposed bulkhead alignment are approximately 2 ft. The water bottom in both the canal and Mill Creek are sandy loam and there were no submerged aquatic vegetation (SAV) observed in the area. No areas of archaeological significance are known in the project area. Development Proposal The applicant proposes to construct 1,854 linear feet of new vinyl bulkhead and fill behind the proposed bulkhead. Approximately 285 ft of the bulkheading is proposed along the shoreline adjacent to Mill Creek. This portion of the bulkhead alignment would maintain 2 ft from NWL with only a small 20 ft section proposed at 6 ft from NWL. This portion of the alignment is proposed due to the turn into the canal and the large amount of broken concrete and debri along the shoreline. The bulkhead alignment within the manmade canal/basin also maintains an average of 2 ft from NWL with a few spots proposed at the maximum distance of 6 ft from NWL due to erosion. The project area has several hundred feet of existing docks and the shoreline behind the docks is experiencing severe erosion due to the boat traffic in the area. Approximately 150 ft of the existing shoreline is already bulkheaded and the applicant would tie into the existing bulkhead. The sand for the fill material would be hauled in from an upland source. Anticipated Impacts The proposed project would result in the filling of 3,708 sq ft of Estuarine Waters Public Trust Area of Environmental Concern and 27,810 sq ft of Estuarine Shoreline, also 137 cubic yards of fill material would be placed below NWL. Temporary water turbidity would occur in the project area. It was received complete on August 26, 2015, and appears to be adequate for processing at this time. The projected deadline for making a decision is November 9, 2015. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended.
