Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Personal Watercraft Lift Addition 1) This permit authorizes only the lift and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floatingor stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee William & Helen Wilcox Permit No. Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of three formalized boat slips. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does.not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Tier II Programmatic General Permit 198000291 (SAW 201502396). NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 15-1169. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $250 was received by DCM for this project. The property is situated along 229' of Yeopim Creek, a tributary of the Yeopim River and the Albemarle Sound. Existing development along Yeopim Creek is residential and agricultural, with one private subdivision marina within a mile of the property. Zoning of property within the subdivision is RA-25 (residential/Agricultural with a minimum lot requirement of 25,000sf). The property is bounded on the east and west by residential lots, to the north by Yeopim Creek and to the south by Virginia Court. Existing development associated with the applicant's property includes a dwelling, a bulkhead, a 6' x 80' pier with a 25' x 25' roofed boathouse/ platform with an 8' x 24' stepdown, and a personal water craft lift (PWC). I have reviewed the rules as they pertain to marinas, piers and docks and would like to offer the following: 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. The property is situated along 229' of Yeopim Creek, a tributary of the Yeopim River and the Albemarle Sound. Existing development along Yeopim Creek is residential and agricultural, with one private subdivision marina within a mile of the property. Zoning of property within the subdivision is RA-25 (residential/Agricultural with a minimum lot requirement of 25,000sf). The property is bounded on the east and west by residential lots, to the north by Yeopim Creek and to the south by Virginia Court. Existing development associated with the applicant's property includes a dwelling, a bulkhead, a 6' x 80' pier with a 25' x 25' roofed boathouse/ platform with an 8' x 24' stepdown, and a personal water craft lift (PWC). The existing PWC lift is used to hold a small sailboat. Current shading from the existing platform, step down and lift is 842sf, shading from the pier is 480sf. Yeopim Creek is approximately -975' wide at the applicant's property, is classified as SC waters and is closed to shellfish harvesting. There are no know archeological sites on or adjacent to the applicant's property and there are no unusual geologic formations associated with the property. There is no submerged aquatic vegetation within the project footprint, or adjacent to the proposed project site. Vegetation on the applicants property is a mix of ornamentals and domestic grasses along the high ground adjacent to the dwelling and typical vegetation found within a non -coastal wetland in the area (loblloy pine, bald cypress, wax myrtle, cattail, and pennywort). Water depths along the applicant's bulkhead vary from -1.25' to -2' and up to -3' approximately 25' waterward of the bulkhead. Development Proposal Proposed development includes the installation of a single piling adjacentto an existing pierfor a used personal watercraft that will hold a small sailboat. The lift will be placed approximately 25' from normal water level in 3' of water. Area enclosed by the lift is = -50sf If permitted, there will be a total of three formal recreational mooring facilities associated with the applicant's property.
