Observation Pier 1) This permit authorizes only the pier and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this observation pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall maintain the authorized work in good condition and in confommtce with the /terms and conditions of this permit. The permittee is not relieved of this requirement riGsiviee permitted activity without having it transferred to a third party. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Brian Vick Permit No. 127-15 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any formalized boat slips. In order to ensure compliance with this condition handrails shall be placed around the perimeter of the authorized observation platform. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted on the attached workplan drawings. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. GG General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior tg0v %% project initiation. M 12) This permit does not authorize the interference with any existing or proposed Federal projecM9 the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 13) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. Narrative Description: The lot 74 project is located at 1514 Galley Circle of Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20's St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. Lot 74 is 3.26 acres (14,916.08at) in its entirety and is an average of 3.1 above NHW and has 151' of shoreline along the normal high water contour. There is an expanse (approximately 151' x 200') of Coastal Wetlands present along the shore adjacent to Dill Creek. This coastal wetland area contains Smooth Coordgrass (Spartim alterniflora).There are typical lawn grasses and scrub oaks along the high ground portion of the property. The lot to the west has an existing dock. There are scattered oyster beds within Dills Creek and along areas within the vicinity of this property. The water depths in Dill Creek are shallow (less than -2'nlw), and according to the applicant, reach -2.4' NLW within the channel portion and -1.3 to -1.9 at NLW at the waterward end of the proposed structure. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Proiect Description: RECEIVED OCT 2 0 Z015 The applicant is proposing a 6' x 209' pier and a 14' x 28.5' L- head platform. They Fe not proposing any upland development at this time. DC M- M H D CITY The proposed pier would cross high ground for 3', coastal wetlands for approximately 206'and open water for 14' with a total length of 209'. It would then intersect a 14' x 28.5' platform area along the western portion of the platform. There are no slips proposed. The water depths along the platform area are -1.3' to 1.9' nlw. The most water ward portion of the structure would be located 2'-4' landward and parallel with the edge of the existing channel depending on location. Through previous permit activity in this area, the Division has determined that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 61'. In consideration of this, the impedance into the water body by the structure consequently extends approximately 14' into the 61' body of water. The pier and platform would be located 165' from the west riparian access line and 45' from the east riparian access line. The riparian access lines where determined on the previous original major permit submittal for the subdivision in addition to field visits and aerial photography. The riparian access line is drawn perpendicular to the channel location that runs east to west. All water depths as well as the Field Investigation Report: Vick Lot 74 Mariners Point Page 03 outermost limit of the coastal wetland(oyster beds), channel location and water body width have been field verified by DCM staff. 11. Anticipated Impacts: The proposed pier as would incorporate 18 ft2 of high ground while shading and incorporating 1,212 ftz of coastal wetlands. A total 399 ft2 of open water of would be shaded and incorporated, by the pier. There are no oyster beds containing healthy populations existing along the shoreline and therefore should not be disturbed during the construction process. There is the potential for temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing coastal wetlands and oyster beds in the area. The coastal wetland area terminates approximately 205' waterward of NHW. The channel edge is located 21' from the north edge of the coastal wetlands. Since no formalized slips are proposed, there should be no turbidity or impacts from prop scarring. The address for the project is 1514 Galley Circle, Morehead City, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anytime development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 151LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot is currently under construction with a 3 story house. Completion is expected this fall, 2015. The owner is requesting to construct 209 LF of a 6' wide wooden pier from the upland of Lot 72 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. There are no oyster rocks in the vicinity of the proposed platform. This platform is beyond the extent of the coastal wetland but not impacting the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. Attached is an exhibit from a previously approved CAMA Major Permit for an observation pier on lot 56 of Mariner's Point Subdivision that demonstrates the extents of the channel. The proposal is for the construction of an observation pier with an 1-head platform. The water depths within this area RANGE FROM -1.4 TO -1.9 nlw. The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office recommends the project be authorized as proposed on plats dated received 8/25/15 contingent upon all applicable general conditions and the following standard conditions: The pier and platform should not exceed a maximum distance of 220' waterward of NHW and should not exceed a maximum of 14' from the coastal wetland edge due to the 61' wide water body width. Due to the shallow water depths and silty sediment (mud fluff) substrate within a PNA the District recommends no slips should be authorized. The applicant proposes to construct a pier, platform for lot 74 of the Mariners Point subdivision. The project is located at 1514 Gallery Circle in Morehead City adjacent to Dill Circle. I have reviewed this proposal for consistency with the Carteret County Land Use Plan and offer the following comments. The general area of the project is classified as Low Density Residential/Conservation. Waters at the project site are classified as SA/HQW and are not open to the harvesting of shellfish. The area is a Primary Nursery area. Areas of Environmental Concern are CW, EW and PTA. Carteret County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The Carteret County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. This project appears to be consistent with the Carteret County Comprehensive Land Use Plan Update. A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to construct a 6' x 209' pier that will terminate in a 14' x 28.5' L-head. The project located in Dill Creek, a small tidal creek, will span coastal wetlands, soft mud bottom, and oyster bars. The waters are classified as PNA (Primary Nursery Area) by the DMF.(Division of Marine Fisheries); a PNA habitat is an area that has been deemed critical to the larval and juvenile life -stages of fish and shellfish. A site visit by DCM staff on 10/14/15 to the area revealed an extensive oyster resource throughout the waterbody as well as an abundance of shrimp and finfish. The edge of the marsh, mudflat, and oysters are dry at low tide and drop off rapidly to approximately I'to Vat the channel edge. Even though no boat slip is proposed the proximity to the channel and the availability of water at high tide temporary docking could occur and was observed on a dock upstream of the proposed project. Due to the limited depths and the sensitive habitat and resources present in the project area it is recommended that a railing be added to the platform to discourage docking of vessels that could smother or potentially prop -kick the bottom. This modification would alleviate concerns about possible negative impacts of potential vessel use.. The property's upland shoreline is 151LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot is currently under construction with a 3 story house. Completion is expected this fall, 2015. The owner is requesting to construct 209 LF of a 6' wide wooden pier from the upland of Lot 72 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. There are no oyster rocks in the vicinity of the proposed platform. This platform is beyond the extent of the coastal wetland but not impacting the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any formalized boat slips. In order to ensure compliance with this condition handrails shall be placed around the perimeter of the authorized observation platform. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted on the attached workplan drawings. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. General 11) - The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 13) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
