This permit, issued on November 2, 2015 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconstructed docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this perm? for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
4) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted
on the attached workplan drawings.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or

9) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-02148).
NOTE: The N.C. Division of Water Resources authorized the project by way of General Certification
(GC) 3883 and assigned DWR Project # 15-0964.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

On March 9, we received your CAMA Major Permit Application, acting as agent for Timber
Creek Condominium Association, for authorization to replace two community docks, a boardwalk
and to install riprap waterward of an existing bulkhead, located at the Timber Creek community
docking facility of N. Bald Head Wynd, on Bald Head Island, Brunswick County. However, your
application lacks information necessary for complete processing. The attached checklist indicates
the deficiencies of your application. If you respond within three working days from the date of this
E-mail, processing of your application will promptly continue and will not be placed on hold. If
you are not able to respond within three days, your application will not be accepted as complete for
processing. Additional information may be required pending further review by the fifteen (15)

Dear Heather,
Southern Environmental Group, Inc. (SEGi) has been retained by the Timber Creek Home Owner's
Association (herein referred to as the "Applicant", see Attachment I for Agent Authorization) to respond to
the Division of Coastal Management's request for additional information (RFAI), which is necessary to
complete the processing of the previously submitted CAMA Major Permit Application. Below is a summary
of the 12 March 2015 RFAI, issued by your office, each followed by SEGi's response (bold text):
1. On DCM Form MP-2, please complete Section 5. And indicate that Section 4. Is not applicable (unless
fill other than riprap is proposed, in which case, please complete Section 4.).
Since the date of your RFAI, the Applicant has decided to remove some of the proposed work
from the permit request, which includes the stabilization of 1110 linear feet of shoreline and the
replacement of 1185 linear feet of 4' wide wooden boardwalk. The exclusion is due to time
constraints associated with performing the remaining proposed work (i.e. maintenance and
repair of the boat docking structures). Therefore, MP-2 is not longer applicable and should be
discarded.
2. On DCM Form MP-4, please complete Sections l and 2. List the dimensions of the proposed docks in 1" FIVW
the spaces provided in Section 1. Include proposed dimension of landing flaps. Please also give the 1 4 2015
dimensions of the proposed walkway placement/extensions in Section 8. SEp

The boat docking facility will be used by the residents and guests of the Timber Creek Condominium complex to launch their
person watercraft. The boat slips are for day docking only.

The pilings will be set with a pile driver that will be brought to the site on a small barge. The floating platforms will be
constructed in sections and then placed in the water. Work is to take place between the hours of 7 am and 8 pm, Monday
through Saturday.

The Applicant intends to replace the two floating platforms with the same length structures (1 @ 36', with 4' x 4' gangway
platform and 1 @ 50' with 4' x 4' gangway platform), but proposes to increase the width of each, from V to 8' wide. The
floating platforms will be relocated 6.5' waterward of their existing position. New piling will be installed to accommodate the
move. In addition, the two 12' x 4' fixed piers will be replaced with two 12' x 6' fixed piers.

6. Additional Information
In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) — (f) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

9. PROJECT DESCRIPTION
Bald Head Island is part of an island group known as Smith Island, located east of the mouth
of the Cape Fear River, between Fort Fisher to the north and the Atlantic Ocean to the south
with Oak Island/Caswell Beach to the west. The island is accessed by private boat or private
ferry service from Southport. The project site is located within the Timber Creek Condo
complex offN. Bald Head Wynd, within the Village of Oak Island, in Brunswick County.
The project area consists of two existing community docks with a boat ramp facility and a 4'
wide wooden walkway along the shoreline which is predominantly bulkheaded. The upland
portion of the site is vegetated primarily with lawn grasses. The docks were constructed by
Bald Head Island Limited, LLC under State Permit # 151-84. According to the applicant's
original agent, much of the structures date to the late 1980's. There is a dock located both to
the north and to the south of the existing boat ramp. The pier to the north measures 12' from
the bulkhead and leads to a floating dock measuring 36' in length by 6' in width. The pier to
the south also measures 12' from the bulkhead and leads onto a floating dock measuring 50'
in length by 6' in width. There is a narrow fringe of Salt Marsh Cordgrass (Spartina
alternii fora) along this stretch of shoreline measuring approximately 10' in width. The
marsh vegetation is located immediately waterward of the bulkhead and landward of the two
docks. Both floating docks are aligned parallel to the channel. Water depths measured
approximately -5' to -6' on the landward side of the dock during a site visit on 8/21/15 and
-T to -8' on the waterward side of the dock. The site visit was not conducted at low tide. It
is estimated that relative to normal low water, depths could range from as little as -1 to -2'
on the landward side of the existing docks and -3' to -4' on the exiting waterward side.
*Note that this estimate is less than what is shown on the plans. The waterbody measures
approximately 200' in width in this location. The bulkhead runs the majority of the length of
the shoreline, with short gaps along areas of where the coastal wetlands extend landward of
the bulkhead. The overall shoreline length for the property exceeds 1000' linear feet in
total.
The waters of Bald Head Creek are classified SA by the North Carolina Division of Water
Resources. The area is not designated as a Primary Nursery Area (PNA) by the North
Carolina Division of Marine Fisheries and is OPEN to the harvesting of shellfish. RECEIVED

The applicant is proposing to replace and expand the two existing docks. The floating dock
to the north of the boat ramp would measure 36' in length. The dock to the south would
measure 50' in length. Both docks would be increased from a width of 6' to 8' and would
have a 4'in length by 4' in width access ramp landings. Both docks would also be shifted
waterward towards the '/. width limit (a distance of approximately 6.5') to gain access to
deeper water, but would otherwise be replaced in the same lateral location. Both access
piers would also be replaced at the existing length of 12', but would be expanded to measure
6' in width.

10. ANTICIPATED IMPACTS:
The project would result in the incorporation of approximately 720 square feet of Public
Trust Area and Estuarine Waters as a result of dock replacement. The pier replacement
would result in the shading of 144 square feet of Coastal Wetlands. The docks would not
exceed the 1/4 width limit, extend into the channel, nor extend into either 15' riparian
corridor setback. The relocation of the docks would reduce impacts to shallow bottom
habitat. Temporary increases in turbidity can be expected during construction.

Project Narrative (Revised 8/21/15)
A. Introduction:
The Timber Creek Condominium Association (herein referred to as the "Applicant") is seeking approval, in
the form of a CAMA Major Permit, to perform work on their existing boat launching / docking facility. The
work consists of repairs and replacement of existing water dependant structures at the facility, which were
permitted in the name of Bald Head Island Limited and under Permit 4151-84. The work will consist of
greater than 50% of the cost of replacing the structures, thus a CAMA Major Permit is required.
B. Existing Conditions
The property contains approximately 1110 linear feet of shoreline, along Bald Head Creek, a waterbody is
not classified as Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and SA;HQW by the
NC Division of Water Resources. Currently a community docking facility exists within the property limits.
The docking facility consists of two fixed piers (both 4' wide by 12' long), with floating platforms (1 @ 6' x
36, with a 4' x 4' gangway platform, and 1 @ 6' x 50', with a 4' x 4' gangway landing). Water depths at the
terminus of the existing structure (approximately 38.5' from the marsh) ranges from approximately 4.0' to
5.5' deep at normal low water (NLW). The distance across the creek, from marsh to marsh, is approximately
181 linear feet.
In addition, approximately 1185 linear feet of boardwalk, as well as an unknown amount of bulkhead is
present within the 75' Estuarine Shoreline Area of Environmental Concern.
C. Proposed Work
The Applicant proposes to perform the following work:
1. Replace/repair the two 4' x 12' fixed docks with two 6' x 12' fixed docks.
2. Replacement of the 6' x 36, with a 4' x 4' gangway platform, and 6' x 50', with a 4' x 4' gangway
landing with 8' x 36, with a 4' x 4' gangway platform and 8' x 50', with a 4' x 4' gangway landing
respectively.
3. The two floating structures will be relocated approximately 6.5' waterward of their existing locations.
Water depth, at the proposed terminus of the floaters, is approximately 5.5', at NLW. This proposed
location is within the ''/. width of the waterbody distance (i.e. 45.25' from the marsh line).
4. No work to the boat ramp, the bulkheads and/or boardwalks is being proposed at this time.

the CAMA Major Permit. It also allows a permitted "venue" for future/ ongoing bulkhead repairs or
riprap replacement.
One of the plans is to replace the Eastern/Longer of the two floating docks this year. It is over 25 years
old. The existing docks sit on the bottom at low tide, and we request of CAMA to allow the new
dock(s) to be shifted creekward into deeper water. CAMA has a r%4 Creek Width Maximum. And we
intend to stay within this limitation, and have any sucjh placement verified by the CAMA Field Agent.
I have included the Division of Coastal Management Notification/Waiver Form. If you could so

Timber Creek Condo Association, for State approval for development of the subject property located at the Timber
Creek subdivision off N. Bald Head Wynd, in Bald Head Island, Brunswick County. It was received as complete on
August 212015 and appears to be adequate for processing at this time. The projected deadline for making a decision is
November 5, 2015. An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 21, 2015, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the

This project is consistent and not in conflict`with,the Village of Bald Head'I'sland Land"
tJse Plan'' -Update:
The applicant is proposing to replace and expand the two community docks in the
Timbercreek Development off N Bald Head Wynd in the Village of Bald Head Island in
Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PTA, EW and
CW. Waters at the site are classified as SA and is open to the harvesting of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Bald Head Island Land Use Plan
and offer the following comments.
The general area of the project is classified as Developed.
In general, Bald Head Island allows development in Developed classified AECs, which is
consistent with the State's minimum use standards. The Village of Bald Head Island
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these standards appear to be applicable to this proposal.
This project is consistent with the Village of Bald Head Island Land Use Plan.

It is the opinion of this office that the proposed work is consistent with the Use Standards for docks and
piers, as set forth in NCAC 07H .0208(a) and (b)(6). In the absence of any concerns from the commenting
agencies, it is recommended that a permit be issued subject to the standard dock and pier conditions.
