Olde Point S/D Hampstead; as requested in the permittee's application dated 12/11/14 (MP-1) and 12/29/14 (MP-4), including the attached workplan drawings (2), both dated 12/11/14 This permit, issued on Mnreh 10, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the addition of a boat lift to the existing docking facility and other structures and uses that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee John Thompson Permit #36-15' Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 7) This permit authorizes one (1) additional formalized boatslip for a total of three (3) formalized boatslips associated with this docking facility. General 8) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. PROJECT SUMMARY: The applicant proposes to install a boatlift expanding the existing docking facility to a private three (3) slip docking facility in Old Topsail Creek (Nixon Creek). RECEIVED 1AN 16 2015 6�w�x-x�nw wi+,r, John Thompson Page 2 9. PROJECT DESCRIPTION The project site is located at 115 White Heron Cove Road, adjacent to Old Topsail Creek, in Pender County. To locate this property travel north on US-17 for approximately 14 miles and turn right onto Country Club Road. Travel approximately 0.7 miles to Olde Point Road and turn right. Take the next right onto Olds Point Loop Road in approximately 1.1 miles. White Heron Cove Road is the second right off of Old Point Loop Road. The subject property will be on the left in approximately 0.2 miles. Existing structures on the project site include a single family residence and private docking facility. The project site is approximately 1 acre and is vegetated primarily with native trees, domestic grasses and ornamental landscaping. The project site has approximately 220 feet of shoreline frontage along Old Topsail Creek. The existing docking facility consists of an existing access pier that extends into Old Topsail Creek measuring approximately 24 ft. in length by 6 ft. in width which terminates in a fixed "T" head measuring approximately 10 ft. wide by 6 ft. in length. An access ramp leads from the pier onto a floating dock measuring approximately 42 ft. in length by 8 ft. in width running parallel to the shoreline (See Sheet 1 of 2). A CAMA Permit was not found for the existing docking facility but according to aerial imagery it has been in place in the existing configuration since at least 2003 and appears to be consistent with current regulations. The Pender County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Resource Protection. The waters of Old Topsail Creek and the AIWW are classified SA-HQW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The applicant states that a boatlift, measuring 13 ft. in length by 13 ft. in width would be installed on the eastern side of the existing floating dock. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels be moored or docked at the facility. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first.
