Permit Class NEW Permit Number 45-15 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Roger Teague, 32 Pelican Drive, Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at adi. to Banks Channel and Greenville Sound- 12 Corbett Road Wrig tsville Beach, as requested in the permittee's application dated 12/26/14. incl'g the attached workplan drawings (3), 2 dated 12/26/14 and 1 dated received in the MHC office on 1/29/15 This permit, issued on April 1, 2615 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers, boatlifts and other structures and uses that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Roger Teague Permit #45-15 Page 2 of 3 ADDITIONAL CONDITIONS 3) No portion of the authorized docking facility shall exceed the established pier head line. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes 2 additional formalized boatslips for a total of 4 formalized boat slips in association with this docking facility. Army Corns of Engineers Conditions 9) An as built survey of the authorized structure shall be provided to the US Army Corps of Engineers. General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 11) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Roger NOTE: Permit #45-15 Page 3 of 3 ADDITIONAL CONDITIONS This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 15-0125. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2015-00395, which was issued on 3/6/15. NOTE: An application processing fee of $250 was received by DCM for this project. PROJECT DESCRIPTION: The project site is located at 12 Corbett Street, adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound within the Town of Wrightsville Beach, in New Hanover County. To locate the property, from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Boulevard (U.S. Highway 76) and travel south approximately 1 mile until you come to South Lumina Avenue. Take the immediate right onto South Lumina and travel approximately 0.2 miles and take a right onto Corbett Street. The property of interest will be located on the right, just before the street end. The lot average approximately 3'-6' above normal high water (NHW). The applicant currently maintains a single-family residence on the property currently under renovations through CAMA Minor Permit No. 14-24. Highground vegetation consists of shrubbery and wild grasses. The lot is approximately 0.13 acres with approximately 50' of shoreline frontage, which is currently stabilized with upland vegetation and a narrow band of Coastal Wetlands in an area of approximately 6' in width consisting primarily of Salt Meadow Grass (Spartina pantens). Waterward of the NHW boundary is an intertidal strip of sand, which is approximately 10' in width. The applicant currently maintains an existing docking facility on the property, which was authorized under CAMA General Permit No. 60734-D issued on 10/03/2012. An access pier measuring approximately 125' in length by 6' in width extends in a westerly direction into Banks Channel, which terminates to a roof covered platform, measuring approximately 13' in length by 12' in width, which is located on the southern side of the access pier creating an 1-shaped" configuration. An access ramp leads waterward from covered platform onto a floating dock, measuring approximately 24' in length by 6in width, which essentially runs in the same alignment as the access pier. There is an existing boatlift, measuring approximately 13' in width by 13' in width located on the northern side of the floating dock. There are also three (3) mooring pilings located landward of the southern side of the existing floating dock, which two of the pilings appear to encroach into the adjacent riparian corridor 15' setback requirement. The application states the existing docking facility currently provides docking space for up to two (2) vessels (See attach Riparian Survey dated December 4, 2012). The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicant proposes to expand an existing docking facility within Banks Channel. An access ramp would lead onto a new floating dock, measuring approximately 24' in length by 6' in width, which would extend from the landward end of the existing gazebo in the same alignment as the access pier. Based on the provided drawings, it appears that the existing mooring pilings which are currently located within the applicant's adjacent riparian 15' corridor setback would remain. The application states the proposed structures would be constructed to provide docking space for up to four (4) vessels and would be located in approximately A' at normal low water (NLW) (See Sheets 1 through 2). 10. ANTICIPATED IMPACTS: The proposed floating dock would incorporate an additional 124 sq. ft. of Estuarine Waters and Pubic Trust Area. The structure would extend approximately 115into a waterbody, which measures approximately 1,100' across. This distance would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town of Wrightsville Beach Pier head Line and would not encroach into the adjacent 15 foot Riparian Corridor Setback Area requirement. PROJECT DESCRIPTION: The project site is located at 12 Corbett Street, adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound within the Town of Wrightsville Beach, in New Hanover County. To locate the property, from the Wilmington Regional Office (WiRO) travel east from Eastwood Road approximately 3 miles towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge over Banks Channel. Take the immediate right onto Waynick Boulevard (U.S. Highway 76) and travel south approximately 1 mile until you come to South Lumina Avenue. Take the immediate right onto South Lumina and travel approximately 0.2 miles and take a right onto Corbett Street. The property of interest will be located on the right, just before the street end. The lot average approximately 3'-6' above normal high water (NHW). The applicant currently maintains a single-family residence on the property currently under renovations through CAMA Minor Permit No. 14-24. Highground vegetation consists of shrubbery and wild grasses. The lot is approximately 0.13 acres with approximately 50' of shoreline frontage, which is currently stabilized with upland vegetation and a narrow band of Coastal Wetlands in an area of approximately 8' in width consisting primarily of Salt Meadow Grass (Spattina pantens). Waterward of the NHW boundary is an intertidal strip of sand, which is approximately 10' in width. The applicant currently maintains an existing docking facility on the property, which was authorized under CAMA General Permit No. 60734-D issued on 10/03/2012. An access pier measuring approximately 125' in length by 6' in width extends in a westerly direction into Banks Channel, which terminates to a roof covered platform, measuring approximately 13' in length by 12' in width, which is located on the southern side of the access pier creating an "L-shaped" configuration. An access ramp leads waterward from covered platform onto a floating dock, measuring approximately 24' in length by 6' in width, which essentially runs in the same alignment as the access pier. There is an existing boatlift, measuring approximately 13' in width by 13' in width located on the northern side of the floating dock. There are also three (3) mooring pilings located landward of the southern side of the existing floating dock, which two of the pilings appear to encroach into the adjacent riparian corridor 15' setback requirement. The application states the existing docking facility currently provides docking space for up to two (2) vessels (See attach Riparian Survey dated December4, 2012). . The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicant proposes to expanian-exLsting docking facility within Banks Channel. An access ramp would lead onto a new floating dock, measuring approximately 24' in length by 6' in width, which would extend from the landward end of the existing gazebo in the same alignment as the access pier. ANTICIPATED IMPACTS: The proposed floating dock would incorporate an additional 124 sq. ft. of Estuarine Waters and Pubic Trust Area. The structure would extend approximately 115' into a waterbody, which measures approximately 1,100' across. This distance would conform with the 1/4 width rule and the established pier lengths. As proposed, the applicant's proposal would not extend beyond the Town of Wrightsville Beach Pier head Line and would not encroach into the adjacent 15 foot Riparian Corridor Setback Area requirement. Existing covered platform=156 sq. ft. Existing floating dock= not calculated due to alignment. Proposed floating dock=124 sq. ft. Total = 280 sq. ft. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the Y. width rule, the eight square foot rule and the pier width rule. The proposed floating dock would be located entirely overopen water. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. If the project is determined to be consistent with NCAC 07H .0208(b)(6), it is recommended that any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures maybe conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permiftee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pier length. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at 910-796-7215 prior to the commencement of any such activity for this determination. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats.
