This permit, issued on December 16, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to fines, imprisonment or civil action; or may cause the Dockina Facility to be null ana vola. 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days. of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of 4 formalized boat slips. 7) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 8) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine the width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-02206), which was issued on 11/17/15. NOTE: The N.C. (2,000 sq. ft. allowable) Proposed platform = 20 ft. x 20 ft. = 98 sq. ft. = 400 sq. ft. Proposed floating dock= 50 ft. x 8 ft. and 20 ft. x 6 ft. = 400 sq. ft. Total = 800 sq. ft. It is the staffs recommendation the replacement and expansion of the existing docking facility would provide docking space for four (4) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the'% width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard permit conditions for private docking facilities. Areas of Environmental Concern (AEC's) impacted by the proposal are PT, EW and CW. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County Joint CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Residential while the AECs impacted by the work are classified as Conservation. In general, Wilmington -New Hanover County allows development in residential and conservation classified AECs, which is consistent with the State's minimum use standards. The 2006 Wilmington -New Hanover County Joint Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. PROJECT DESCRIPTION The project site is located at 29 Sandy Point on Figure "8" Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.5 miles until you reach Sandy Point, which will be located on the right hand side. Turn right onto Sandy Point until it terminates at the property of interest. Existing structures on the vacant lot includes a new timber bulkhead and a private docking facility. The timber bulkhead was authorized under CAMA General Permit No. 65098-D on 02/19/2015. The project site is approximately 0.715 acres and is vegetated primarily with Wax Myrtles, Cedar Trees and native grasses. The project site has approximately 460 linear feet of shoreline frontage along Banks Channel. Located waterward of the bulkhead is an area of coastal wetlands consisting primarily of Smooth Cordgrass (Spartina altemiflora), which measures approximately 40' in width. The applicant currently maintains an existing private docking facility on the property, which is located on the northeastern side of the property within the mouth of a canal and Banks Channel. An existing access pier, measuring approximately 78 ft. in length by 6 ft. in width extends in a northeasterly direction into Banks Channel. The pier terminates onto an uncovered platform, measuring approximately 16 ft. in length by 10 ft. in width, creating an "L-shaped" configuration towards the east. And access ramp leads onto a floating dock, measuring approximately 20 feet in length by 12 feet in width within water depths of approximately -4 feet @ normal low water (NLW). There is also a mooring piling approximately 34 feet towards the west of the existing floating dock. The NC DCM was not able to locate a permit for the existing docking facility; however, based on aerial photography the existing facility has been in this location since the 1980's. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace and expand existing docking facility within Banks Channel. Once the existing docking facility is entirely removed, a new access pier, measuring approximately 52 feet in length by 6 feet in width into Banks Channel. The pier would terminate onto a fixed uncovered platform, measuring approximately 20 feet in length by 20 feet in width, extending from the access pier in a westerly direction, which would create an "L-shaped" configuration. An access ramp would then lead onto a floating dock, measuring approximately 50 feet in length by 8 feet in width, which would extend in an easterly direction rennin g parallel to the shoreline and channel. Two (2) boat lifts, each measuring approximately 16 feet in length by 16 feet in width would be installed, one on the landward side and one on the most eastern end of the proposed floating dock. The application states that the proposed new docking configuration would provide docking space for four (4) vessels within existing water depths ranging from approximately -2 feet to -6 at NLW (See Sheets 1 through 3 of 3 and Project Narrative). 10. ANTICIPATED IMPACTS The proposed new docking facility would shade approximately 240 sq. ft. of coastal wetlands, primarily consisting of Smooth Cordgrass (Spartina altemiflora) and would incorporate approximately 1,348 sq. ft. of Estuarine Waters and Pubic Trust Area, which is essentially usurped by the existing docking facility. The proposed structure would extend approximately 43 ft. into a waterbody, which measures approximately 175 ft. across. This distance would conform to both the 1/4 width rule and the established pier lengths. The proposed new docking configuration would provide docking space for four (4) vessels within existing water depths ranging from approximately -2 feet to -6 at NLW. The proposed structure would not encroach into the channel or the adjacent 15' Riparian Corridor Setback Area requirement. Minor increases in turbidity should be expected during construction.
