1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the permitted
docking facility, all as expressly and specifically set forth in the modification request. No other structure,
whether floating or stationary, shall become a permanent part of this reconfigured docking facility without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit authorizes a maximum of 4 formalized boat slips.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.

Mr. Ed Flynn with F & S Marine Contractors, Inc., acting as agent for Mr. Brook Taube, is requesting the
modification of State Permit No. 144-15, originally issued on December 16, 2015 authorizing construction of a private
docking facility at 29 Sandy Point, Figure Eight Island, adjacent to Banks Channel and Middle Sound. State Permit
No.144-15 is due to expire on December 31, 2018.
Mr. Flynn is requesting modification to State Permit No.144-15 to allow for the addition of a 10' x 10' section
of floating dock, and to relocate the existing boatlift due to limited access and shallow waters at the existing location.
It appears that the reconfiguration could potentially accommodate up to six (6) vessels. However, the agent states
that no increase to the number of slips is being requested due to limited water depths.
This office has no objection to the modification of State Permit No.144-15, provided there are no objections
or concerns from commenting agencies. Mr. Flynn has submitted a check (check No. 5543) in the fee amount of
$100.
By copy of this memo, DCM is requesting that the USACE, DWR, DCM Fisheries Specialist, Shellfish
Sanitation, and NH Co. provide any comment that your agency may have on the proposed project to Heather
Coats, DCM Wilmington office within 14 days of receipt of this memo.

This letter is to request a minor modification to LAMA Major Permit issued
on 16 December 2015 to Brook Taube, 29 Sandy point, Wilmington, NC
28411
The request is to add a 10'x10'section of floating dock to the existing dock
and relocate the existing boatlift from the landward side of the dock to the
north end of the dock.
Because of limited access and shallow water, the lift that is currently
located on the landward side of the dock is not useable during the low tide
cycle.
The request is not to increase dockage potential but to make the dock
facility more useable.

Dockina Facility
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other

2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed
six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured
from the bottom of the decking.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of 4 formalized boat slips.
7) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's riparian access corridor.
8) No portion of the authorized docking facility shall extend more than one quarter of the width of the water
body. Measurements to determine the width of the water body shall be made from the waterward edge of
any coastal wetland vegetation which borders the water body.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of;
waters at or adjacent to the authorized work. R

11) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 22 July 2016, which are a part of this permit.

I would like to explore my original comments on the project. 1 understand that this now means movement of
the 2nd lift, but I feel it is worth the effort to discuss again. If the floating dock is shifted to locate the ramp more
towards the mid -point of the floating dock, with the lifts at each end, this would accomplish their needs and eliminate
the potential for additional dockage on the landward side of the floating dock. Just want to provide another option.

7/18. The proposed modification would reconfigure a permitted docking facility to add a 10' x 10' section to the floating
dock and would relocate a lift from the back side of the dock to the side of the dock. The change, as proposed, would
result in 4 formal slips, although it could also potentially accommodate 2 more vessels (for a total of 6) on the back side
of the dock, due to the length of the float. I believe the waters here are open to the harvest of shellfish.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-'
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance.'By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.
