SEE 1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the permitted docking facility, all as expressly and specifically set forth in the modification request. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit authorizes a maximum of 4 formalized boat slips. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. ! State Permit No.144-15 is due to expire on December 31, 2018. Mr. Flynn is requesting modification to State Permit No.144-15 to allow for the addition of a 10' x 10' section of floating dock, and to relocate the existing boatlift due to limited access and shallow waters at the existing location. It appears that the reconfiguration could potentially accommodate up to six (6) vessels. However, the agent states that no increase to the number of slips is being requested due to limited water depths. This office has no objection to the modification of State Permit No.144-15, provided there are no objections or concerns from commenting agencies. Mr. Flynn has submitted a check (check No. 5543) in the fee amount of $100. By copy of this memo, DCM is requesting that the USACE, DWR, DCM Fisheries Specialist, Shellfish Sanitation, and NH Co. provide any comment that your agency may have on the proposed project to Heather Coats, DCM Wilmington office within 14 days of receipt of this memo. Dockina Facility 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of 4 formalized boat slips. 7) The reconstructed pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 8) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine the width of the water body shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of; waters at or adjacent to the authorized work. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. If the floating dock is shifted to locate the ramp more towards the mid -point of the floating dock, with the lifts at each end, this would accomplish their needs and eliminate the potential for additional dockage on the landward side of the floating dock. A memo was sent out describing the proposed mod on or. around 7/18. The proposed modification would reconfigure a permitted docking facility to add a 10' x 10' section to the floating dock and would relocate a lift from the back side of the dock to the side of the dock. The change, as proposed, would result in 4 formal slips, although it could also potentially accommodate 2 more vessels (for a total of 6) on the back side of the dock, due to the length of the float. I believe the waters here are open to the harvest of shellfish. Please let me know when possible if you have any questions, concerns or if you need more time to review the request. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733- 2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application.
