The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of formalized 4 boat slips. 6) The reconfigured pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the south, as depicted on the attached workplan drawing 3 of 4 dated Received DCM Wilmington 4/22/15. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. PROJECT DESCRIPTION: The project site is located at 1713 Canady Road, adjacent to Pages Creek, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO), travel north on Market Street (US Highway 17) for approximately 2.7 miles until you reach Middle Sound Loop Road. Turn right onto Middle Sound Loop Road and travel east approximately 2.0 miles past the travel circle located at Ogden Elementary School. Turn left on Mason Landing Road and travel approximately 0.2 miles just until it reaches Canady Road. Turn left onto Canady Road and continue until you reach the property of interest, which is accessed from a shared gravel driveway. The site is approximately 0.68 acres of highground area approximately 8' above normal high water (NHW). The applicantcurrentiy maintains a single-family residence. The adjacent properties in this area of the Middle Sound community are primarily residential; however, a commercial manna (Mason's Marina) is located a couple of properties to the east of the applicant's property. There is approximately 163' of shoreline on the site that overlooks Pages Creek, which is currently stabilized by vegetation. Existing high ground vegetation on this tract consists of grasses, ornamental landscaping and hardwoods including Oak. Waterward of the highground towards Pages Creek the vegetation on the property transitions to an area of vegetation consisting of mixed Coastal Wetlands and "Section 404 type" vegetation, which include: Wax Myrtle (Wca cerifera) and Salt Meadow Grass (Spartina patens). The vegetation transitions to an area, approximately 150' in width, consisting primarily of Smooth Cordgrass (Spartina altemiflora). The applicant currently maintains an existing docking facility located at this property, which was issued to the previous property owner (J. Sifly) through CAMA General Permit No. 51932-D on January 22, 2008. This authorization included an access pier, uncovered platform and floating docks adjacentto an existing access channel to Pages Creek. It should be noted that the previous owner was authorized by the previous adjacent riparian property owners to the south (Spivey) to cross the shared riparian corridor line to build the existing docking facility adjacent to this access channel. The adjacent riparian properties to the south maintain private docking facilities within the access channel, which the immediate owner to the south (A. Murphy) is currently in the process of construction of a new docking facility. Based on the location of the existing docking facilities a riparian corridor was created by the N.C. Division of Coastal Management (DCM), by establishing a pier head line and a riparian corridor from the existing docking facilities, which would allow the existing structures at these docking facilities to continue to meet the 15' riparian condor setback requirement. This was done through a riparian survey through the assistance of the adjacent riparian property owner's surveyor. Based on historical aerial photography review and information provided in the application, dimensions of the existing access channel are approximately 365' in length by 60' in width with existing water depth ranging from approximately -4' to -5' @ normal low water (NIL". The existing access channel originates from a property to the east currently owned by Mr. David Anderson, and extends in a northerly direction where it connects to the main channel of Pages Creek and adjacent to the applicant's property. The DCM was unable to locate previous State Permits for the excavation for the creation of the access channel, however, through conversations with Mr. Anderson the previous owner of his property (Corbett) had the basin and channel excavated in the 1970's. As stated, this is also evident through review of historical aerial photography (See Sheets 1 through 4 of 4 and Project Narrative). The City of Wilmington -New Hanover County Land Use 2006 Update Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Pages Creek are classified SA Nand Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine ffi 5�and they are Conditionally Approved -CLOSED to the harvest of shellfish by the N.C. Division of Environmental HeaR.r ti In PROPOSED PROJECT: M` '"-uur7u } 44 The applicant requests authorization to reconfigure an existing docking facility within Pages Creek. The applications states a new floating dock, measuring approximately 25' in length by Fin width would extend towards the north from the existing floating dock, which would run parallel to the existing channel. A new boatlift, measuring approximately 12' in length by 13' in width would be constructed on the landward side of this proposed floating dock. The application states the new docking facility would accommodates up to four (4) vessels at this location within proposed water depth of approximately -5' @ NLW within the maintained access channel to Pages Creek. The application also states a new uncovered platform, measuring approximately 12' in length by 16' in width would be constructed on the highground area along the shoreline adjacent to the access pier (See Sheets 1 through 4 of 4 and Project Narrative). ANTICIPATED IMPACTS: The proposed docking facility would incorporate an additional approximately 276 sq. ft. of Estuarine Waters and Pubic Trust Area and would not encroach into the adjacent 15' riparian corridor setback requirement, as established by the DCM. The proposed docking facility would extend approximately 85' into a waterbody, which measures approximately 350' across. This distance conforms to the 1/4 width rule and the established pier head line, per the riparian survey. The proposed new docking facility would accommodates up to four (4) vessels at this location within proposed water depth of approximately -5' @ NLW. Minor increases in turbidity should be expected during the construction; however no long term adverse impacts are anticipated. The proposed uncovered deck would impact approximately 192 sq. ft. of highground area. Species within this area are early post -larval and juvenile and include finfish, crabs, and shrimp. Species inhabit PNA's and SNA's areas because they afford food and protection during vulnerable periods of their life history. The proposed construction location is situated within a SNA and in proximity to a PNA. In addition the location is in a conditionally approved shellfish area which can experience shellfish openings if criteria are met. It is suggested that the applicant take measures to not visibly increase the amount of suspended sediment and its associated transport during tidal flow that may impact these habitats. To locate the property from the Wilmington Regional Office (WiRO), travel north on Market Street (US Highway 17) for approximately 2.7 miles until you reach Middle Sound Loop Road. Turn right onto Middle Sound Loop Road and travel east approximately 2.0 miles past the travel circle located at Ogden Elementary School. Turn left on Mason Landing Road and travel approximately 0.2 miles just unfit it reaches Canady Road. Turn left onto Canady Road and continue until you reach the property of interest, which is accessed from a shared gravel driveway. The site is approximately 0.68 acres of highground area approximately 8' above normal high water (NHW). The applicant currently maintains a single-family residence. The adjacent properties in this area of the Middle Sound community are primarily residential; however, a commercial marina (Mason's Marina) is located a couple of properties to the east of the applicant's property. There is approximately 163' of shoreline on the site that overlooks Pages Creek, which is currenfly stabilized by vegetation. Existing high ground vegetation on this tract consists of grasses, ornamental landscaping and hardwoods including Oak. Waterward of the highground towards Pages Creek the vegetation on the property transitions to an area of vegetation consisting of mixed Coastal Wetlands and "Section 404 type" vegetation, which include: Wax Myrtle (Wca cerffera) and Salt Meadow Grass (Sparfina patens). The vegetation transitions to an area, approximately 150' in width, consisting primarily of Smooth Cordgrass (Sparfina aftemiflora). The applicant currently maintains an existing docking facility located at this property, which was issued to the previous property owner (J. Silly) through CAMA General Permit No. 51932-D on January 22, 2008. This authorization included an access pier, uncovered platform and floating docks adjacent to an existing access channel to Pages Creek. Itshould be noted that the previous owner was authorized by the previous adjacent riparian property owners to the south (Spivey) to cross the shared riparian corridor line to build the existing docking facility adjacent to this access channel. The adjacent riparian properties to the south maintain private docking facilities within the access channel, which the immediate ownerto the south (A. Murphy) is currently in the process of construction of anew docking facility. Based on the location of the existing docking facilities a riparian corridor was created by the N.C. Division of Coastal Management (DCM), by establishing a pier headline and a riparian corridor from the existing docking facilities, which would allow the existing structures at these docking facilities to continue to meet the 15' riparian corridor setback requirement. This was done through a riparian survey through the assistance of the adjacent riparian property owner's surveyor. Based on historical aerial photography review and information provided in the application, dimensions of the existing access channel are approximately 365' in length by 60' in width with existing water depth ranging from approximately -4' to -5' @ normal low water (NLW). The existing access channel originates from a property to the east currently owned by Mr. David Anderson, and extends in a northerly direction where d connects to the main channel of Pages Creek and adjacent to the applicant's property. The DCM was unable to locate previous State Permits forthe excavation for the creation of the access channel, however, through conversations with Mr. Anderson the previous owner of his property (Corbett) had the basin and channel excavated in the 1970's. As stated, this is also evident through review of historical aerial photography (See Sheets 1 through 4 of 4 and Project Narrative). The City of Wilmington -New Hanover County Land Use 2006 Update Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Pages Creek are classified SA by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are Conditionally Approved -CLOSED to the harvest of shellfish by the N.C. A new boatlift, measuring approximately 12' in length by 13' in width would be constructed on the landward side of this proposed floating dock. The application states the new docking facility would accommodates up to four (4) vessels at this location within proposed water depth of approximately -5' @ NLW within the maintained access channel to Pages Creek. The application also states a new uncovered platform, measuring approximately 12' in length by 16' in width would be constructed on the highground area along the shoreline adjacentto the access pier (See Sheets 1 through 4 of 4 and Project Narrative). ANTICIPATED IMPACTS: The proposed docking facility would incorporate an additional approximately 276 sq. ft. of Estuarine Waters and Pubic Trust Area and would not encroach into the adjacent 15' riparian corridor setback requirement, as established by the DCM. The proposed docking facility would extend approximately 85' into a waterbody, which measures approximately 350' across. This distance conforms to the 1/4 width rule and the established pier head line, per the riparian survey. The proposed new docking facility would accommodates up to four (4) vessels at this location within proposed water depth of approximately -5' @ NLW. Minor increases in turbidity should be expected during the construction; however no long tern adverse impacts are anticipated.
