O. Box 131. Beaufort. NC 28586 authorizing development in Carteret County at Shark's Creek, off of Pivers Island Road , as requested in the permittee's application dated 4/18/97 including attached workman drawings 6 all dated 6/4/97 and 1 section for dredging dated 2/12/98. This permit, issued on A - 3 - 9 is subject to compliance with the application (where consistent with die permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) Before any excavation may take place, the permittee shall contact the Division of Marine Fisheries for direction regarding the relocation of the shellfish resource. Only after this relocation has been accomplished to the satisfaction of the Division of Marine Fisheries can excavation begin. 2) Excavation will not exceed 5 feet below the elevation of mean low water (MLW). 3) No vegetated wetlands will be excavated 4) Excavation shall terminate a minimum of 10' waterward from the edge of the marsh. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 2001 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Rod Hoell (Knasty Harbour) Permit #47-98 Page 2 of 3 ADDITIONAL CONDITIONS 5) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 6) All excavated material will be properly contained above mean high water and landward of any wetlands until such time as to be used as bulkhead backfill material. Any excess spoil material will be trucked to a high ground location and contained above mean high water and landward of any wetlands. The site must be approved by the Division of Coastal Management, in coordination with the Groundwater Section of the Division of Water Quality. NOTE: The project was authorized on March 16, 1998 by the Division of Water Quality under General Water Quality Certification No. 3112. Dock Construction 7) Deleted Section. The 84' section of new dock proposed is hereby deleted. This section of dock would elevate the facility to "marina" status under the Rules of the Coastal Resources Commission and subsequently require prior review under the N. C. Environmental Policy Act. NOTE: Prior to any dock construction in the public trust waters of the state, i.e., Shark Creek, an Easement is required from the Council of State through the State Property Office. 8) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 9) No sewage, whether treated or untreated, shall be discharged at any time from boats using the docking facility. Any such discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 11) If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U. S. Coast Guard will be installed and maintained by, and at the expense of, the permittee. The issuance f this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will not hold the United States liable for any such damage. 13) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third party. Bulkhead 14) The breaches of the bulkhead will be repaired, a wing wall constructed on the west end, and the entire structure lined with filter cloth to any backfrlling of the structure. As well, all unacceptable debris, such as tires and shingles, shall be removed before any backfilling activity. NOTE: The permittee is advised that he should consult with the United States Coast Guard concerning complying with the attached list of United States Coast Guard Regulations. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans. 2. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. 3. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 4. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5. No excavated or fill materials will be placed at any time, including temporarily, in any vegetated wetlands or waters. 6. No vegetated wetlands will be excavated. 7. Excavation will not exceed 5 feet below the elevation of mean low water (MLW). 8. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. This observation has been confirmed by the Division of Marine Fisheries. However, they have stated that the area will probably always be closed to the taking of shellfish for consumption, and consequently, they would be open to the idea of relaying the resource to allow excavation. The4q' x 8' extension of the dock serves no obvious purpose. However, the configuration of this structure gains access to deep water and has the potential to serve as additional dockage. Because the proposed slips can be construed to accommodate 9 vessels, this additional dock would possibly cause the project to be defined as a marina, and undergo additional scrutiny, such as fulfilling the requements of the State Environmental Policy Act. Additionally, the configuration of this x 8' section unnecessarily incorporates public trust area between the docks. As such, I would recommend the elimination of this portion of the project. I recommend the project be authorized if it is the official position of the DMF that there will be no significant resource loss from the excavation pursuant to the relocation of the resource, and contingent upon the following conditions: 1) The 48' x 8' section of the docking facility extending from the east end of the property in a southwestward direction is not authorized. V'4 � 2) Excavation shall terminate a minimum of 10' from the edge of the marsh. 3) The breaches of the bulkhead will be repaired, a wing wall constructed on the west end, and the entire structure lined with filter cloth prior to any backfilling of the structure. As well, all unacceptable debris, such as tires and shingles, shall be removed before any backfilling activity. 4) No work can begin on this site until such time that all stormwater requirements of the Division of Water Quality have been met. 5) Before any excavation can take place, the applicant shall contact the Division of Marine Fisheries for direction regarding the relocation of the shellfish resource. Only after this relocation has been accomplished to the satisfaction of the Division of Marine Fisheries can excavation begin. 6) Excavation will not exceed 5 feet below the mean low water level. � 7) No marsh grass will be excavated and/or filled. s 8) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 9) All sppoill material will be properly contained above mean high water and landward of any wetlands until such time as to be used as backfill material. Any excess spoil material will be trucked to a high ground location and contained above mean high water and landward of any wetlands, to a site approved by the Division of Coastal Management in coordination with the Groundwater Section of the Division of Water Quality. 10) No sewage, whether treated or untreated, shall be discharged at any time from boats using 9 the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. The area is known as Knasty Harbour, in Shark's Creek. The applicant proposes to excavate an area measuring 120' by 60', stabilize and fill behind the existing bulkhead, reconstruct the existing 6 slips and construct 2 additional slips. In addition, parking and a gazebo are proposed for users of the docking facility. Areas of Environmental Concern (A> Cs) impacted by the proposed work include the Estuarine Shoreline, Estuarine Waters and Public Trust Areas, Waters at the project site are classified as $A and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1991 Carteret County Land Use Plan (LUP) Update, as amended September 24, 1993, and offer the following comments. The general area of the project is classified as Developed, while the AECs impacted by the proposed works are classified as Conservation, Allowed uses in Conservation classified areas are addressed in the Resource Protection and Resource Production and Management policy sections of the LUP. Applicable policies include those for Marine Resource Areas. The plan states Carteret County's support for the Use Standards contained in 15A NCAC 7H for estuarine waters and public trust areas. A few exceptions are specified, but none of these more restrictive local requirements appear to be applicable to this proposal. Policies regarding Residential, Commercial, and Industrial Development Impacts on Resources restrict commercial and industrial uses in Estuarine Shoreline areas to those that are water dependent and which cannot function elsewhere or are supportive of commercial fishing. The plan specifies that all uses must be consistent with established zoning, where applicable. The field investigation report notes that the area was rezoned by Carteret County to B-2 Marine Related Business in November, 1997. Bulkhead policies contained in the Plan state that the County does not oppose bulkhead construction in all areas of the County, provided all applicable state standards can be satisfied. Biologists on the Wildlife Resources Commission staff have reviewed this permit application and are familiar with habitat values of the project area. A site visit was conducted on March 3, 1998. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U. S.C. 661 et seq.). The applicant proposes to excavate within an area known as Knasty Harbor, stabilize and fill behind an existing bulkhead, construct a dock with 8 slips, and provide parking and a gazebo for the users of the docking facility. Waters at the site are designated as SA but are closed to shellfish harvest. The proposed dock will have 8 designated slips that will accommodate boats up to 40 feet in length. The section of the dock associated with the 8 boat slips is 236 feet long. There is an additional 110 ft. of dock but the applicant does not indicate its use or provide justification for its construction. The entrance to Knasty Harbor is currently cluttered with docks, piers and large fishing vessels. To increase navigational safety in this confined area we request that the waterward most extensions of the dock and finger piers be equipped with lights and/or reflective bands. PROJECT SUMMARY: Applicant proposes to excavate within an area known as Knasty Harbour, in a waterbody called Shark's Creek, stabilize and fill behind the existing bulkhead, and reconstruct the existing 6 slips with the addition of two, providing parking and a gazebo for the users of the docking facility. FIELD INVESTIGATION REPORT: Rod HoelVKnasty Harbour PAGE #2 9. NARRATIVE DESCRIPTION: The project site is a high ground spit of relic fill located south of Highway 70 East, on the east side of Piver's Island Road. This is .44 acre tract of land, averaging 6above mean high water in elevation. The spit is largely void of vegetation, with a fringe of transitional wetland shrubs along the north side. The peninsula faces a basin on its north side which is surrounded with Soartina alterniflora, transitioning to Snartina patens and Borrichia frutescens along the upper edges. The substrate within this basin is exposed at low tide, and is composed of sand and silt. There is evidence of a live shellfish resource in this area. This area is known locally as Knasty Harbour, and this embayment off of Gallant's Channel is known as Shark's Creek. Shark's Creek is approximately 160' across at the project site. A bulkhead exists to the south and east sides of the peninsula extending 2.5' to 3' above the substrate. The wall is constructed of asbestos sheeting, and has been reinforced on its landward side with tires, shingles, concrete and assorted debris over the years. The substrate behind the wall is composed of sand and shell, with patches of Borrichia frutescens. Extreme tides are breaching the wall through the two voids on the east end, and around the end of the structure on the west end, due to the lack of a wing wall. There is an existing marina on the south side of the peninsula which is controlled and operated by Ron Hardee under a 200 year lease. There is also an existing docking system on the north side of the peninsula which provides mooring for 6 vessels. There is a partially sunken derelict shrimp trawler, "Jarestal" within the basin at the location of these docks. This system is owned and operated by the owner of the property, Dudley's Seafood. An unimproved roadway provides access to both of these docking systems. There is an existing well on the site. Shark's Creek is classified SA by the Division of Water Quality. The area is not designated as Primary Nursery by the Division of Marine Fisheries, and it is closed to the taking of shellfish for consumption by the Division of Health Services. The Carteret County Land Use Plan has classified this area as Developed, with all areas within Areas of Environmental Concern classified Conservation. Upon original submittal of this application, the area was zoned Residential. It was re -zoned B-2 for Marine Related Business on November 3, 1997. The applicant has an option to purchase this piece of property with the agreement to construct and maintain five slips for the current owner, Dudley's Seafood, for 199 years. The applicant proposes to expand the existing basin on the north side of the property. The proposal is to excavate an area approximately 120' x 60' for a finished depth of -5'. This area is currently shoaled to an average depth of -1' mean low water. Connecting water depths are from - 6' to -12'. The dredge area includes no wetlands. There is no indication that this area has been excavated previously. The excavation would be accomplished by clambucket to barge, offloaded to trucks, and placed on the high ground portion of the tract to dry. The material will then be used to backfill the existing bulkhead. Excess material will be trucked to an approved high ground spoil disposal area. Approximately 1067 cubic yards of material will be removed over an area of approximately 7200 square feet. rr Next the applicant proposes to construct a docking system to accommodate 8 boats, averaging 25' in length and having a maximum length of 40'. This facility will have a 262.5' x 8' dock with 9 finger piers, each 30' x 6'. This forms slips that are 22' wide and 30' long. It would appear that the potential to dock a ninth vessel exists at the east end. There is a 10' x 10' access to this dock between the fifth and sixth slip. There are no mooring pilings associated with the docks. The applicant proposes a 48' x 8' section of this dock to extend from the east end in a westward direction, effectively closing off the waters around the point of the peninsula in a triangular fashion. There is no stated justification for this portion of the structure; however, because it extends to the south side of the peninsula, the water depths are sufficient to allow for "side to" docking. Overnight dockage will be allowed at this facility. The applicant operates a mobile marine pumpout service which will serve as the pumpout for the facility. There are to be no fuel or maintenance services offerred. This docking facility terminates ±75' from the adjacent riparian corridors. Next, the applicant wishes to backfill the bulkhead which was never backfilled when constructed. He proposes to do maintenance in the form of repairing the two breaches, placing filter cloth behind the wall, and extending a wing wall on the west end to tie into high ground. He will then fill behind the wall to the adjacent grade, filling approximately 1900 square feet of sandy beach area. Lastly, the applicant proposes to supply parking and a gazebo for the users of the facility. The gazebo will be a 12' x 12' covered timber structure, located at the point of the peninsula. Parking will be in the form of two 90' x 20' areas on the northwest and southwest sides of the property. Marl will be placed on the parking area which will provide parking for 18 vehicles. 10. ANTICIPATED IMPACTS: Excavation of the proposed basin will require the disturbance of approximately 7200 square feet of productive shallow bottom habitat. The area is closed to the taking of shellfish for consumption, and may lend itself to the relaying of the resource. Water depths in the area will be converted from -1' to -5', removing the possibility of wetland expansion. Turbidity impacts can be expected during excavation. The area has historically been used as a dumping area for derelict vessels and spent commercial fishing equipment. Much illegal dumping has taken place in the area in years past. In 1986, Rod Hoell and his wife, Deborah, purchase a portion of the land on the north side of the harbor. They obtained a CAMA permit to clean up the north side and did so successfully, with extreme environmental awareness. The Hoells plan to purchase the spit of land on the south side of the harbor and clean that area as well. As it exist today the spit of land to be purchased is littered with old lumber, roofing materials, and rusted and useless fishing gear. There is an existing dock with space for six vessels. There is a sunken ninety -foot shrimp trawler, the removal of which, is within the scope of this proposed project. All foreign debris will be removed and natural vegetation restored. The Hoells are sensitive to the fragile environmental concerns of a project of this nature. Rod Hoell is the operator of North Carolina's only Mobile Marine Pumpout Vessel. This vessel pumps raw sewage off of vessels and delivers the cargo to the Town of Beaufort's municipal system. Although a project of this size would not normally be required to have a pumpout, Mr. Hoell will make this service mandatory for all vessels in the marina. The Mobile Marine Pumpout was made possible to the boating public by a matching grant from CAMA to Mr. Hoell. All possible precautions will be taken to prevent environmental impact. All materials to be dredged are bottom materials that were kicked or washed in by vessels attempting to deepen the existing slips. There is approximately one -thousand cubic yards of material to be removed. The area is closed to shellfishing and there is no marsh or other vegetation to be disturbed in this project. The docks proposed are floating systems. There are eight slips, twenty feet wide and thirty feet long with finger docks on each side. The vessels to moored in this facility are to be twenty-five to thirty foot fishing vessels and small sailing vessels. There is no upland development other than restoration o natural vegetation involved with this project. The area of this proposed development is currently an environmental hazard and a terrible eyesore. This project will remove all debris, restore vegetation to minimize current runoff, and make what is now ugly and environmentally detrimental into a useful, clean, environmentally harmonious, asset. The permit is set to expire on December 31, 2001. The excavation was ;requested and authorized for clambucket method. The applicant is asking for a one time change to allow for hydraulic excavation. The contractor has enclosed information on his equipment, which he says is different than other hydraulic excavators in that the 'slurry is a lower percentage of water. The request is for the removal of 500 cubic yards of material. ,I recommend the one time change be authorized under a minor modification to the original permit, with the additional conditions as follow: disposal area effluent will be contained by pipe, trough, or similar device to a point at or nd the mean low water level to prevent gully erosion and unnecessary siltation. Disposal is on site in a prepared, excavated and bermed disposal pit approximately 150' X 25' X 4' located above the high water mark on high ground. EQUIPMENT PD & D Co. will utilize a small 8" MDS-177 dredge built by H & H Pump & Dredge Co. The dredge is small and compact measuring 8' wide by 31' long and is designed to fit in a standard shipping container for rapid deployment in emergencies. This machine is of the "new technology" type. It was developed in response to a need for small portable dredges to work in sensitive environmental areas and for remediation of contaminated areas where it is most important to contain contaminated material in the disposal area as well as minimize the re -suspension and escape of contaminates. This "new technology" is a much cleaner and far less invasive method of dredging than bucket or dragline methods. This is accomplished by the use of hydraulic powered, submersible pumps mounted on the 8-foot wide augerhead of the dredge. The augerhead has tines to break loose the material and angled "flukes" which feed the material directly into the pump resulting in minimal re -suspension of the material being dredged. (See Figure 1) The rotational speed of the augerhead is synchronized with the speed of the dredge pump so that the augerhead always produces only the maximum amount of material that the pump can handle at any given pump speed. The material enters the pump volute and is "pushed" through the discharge pipe rather than sucked up to a hull mounted pump. The "new technology" pumps can result in efficiencies of up to 60% solids being transported through the pipeline with minimal turbidity and re -suspension of dredged materials at the augerhead. This method also requires much less water as a transport medium than traditional pipeline dredging methods where a 10% solids, 90% water content is considered a very good production rate. DISPOSAL AREA The disposal area for this project is immediately adjacent on the south side of the area to be dredged. An earthen containment area approximately 3' to 4' deep, 150' long and 25' wide has been excavated in the disposal area. The excavated material has been placed around the edge to create a berm approximately 2' to 3' in height. The resulting containment area has a capacity of approximately 700 cubic yards. Upon completion of the dredging operations, the dredged material will be removed by truck and stored while a beneficial use for the material is sought. The disposal area will be returned to its original state. Additional measures employed to create a more environmentally secure containment area include the following: (a) Strengthening of the existing temporary bulkhead with additional support post and corrugated metal sheet. (b) Lining the existing temporary bulkhead with geotextile filter -cloth, in addition, to the silt fence already in place. (c) Constructing a 3' X 3' rubber anti -seep barrier to be installed around the return water drainpipe and embedded in the containment berm. (See figure 2). (d) Separating the material inlet pipe from the return water drainpipe by approximately 100' to allow for the additional precipitation of silt and solids from the dredged materials.
