NC 28460 Authorizing development in Onslow County at Stump Sound, 123 Page Street, Sneads Ferry , as requested in the permittee's application dated 10/24/14 including the attached worknlan drawings (3) 1 of 3 dated 4/12/11 2 of 3 dated 10/24/14 and 3 of 3 dated 10/14/14 This permit, issued on Janunry 27 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockina Facility 1) Unless specifically altered herein, this permit authorizes the docks, piers and other structures and uses that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Mark Lewis Permit # 11-15' Page 2 of 4 ADDITIONAL CONDITIONS 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit does not authorize any additional boat slips in association with this docking facility. Bulkhead 8) The alignment of the permittee bulkhead shall be staked by the permittee and approved on site by a Division of Coastal Management representative prior to initiation of construction. 9) No portion of the bulkhead shall be located more than 5' waterward of the existing dilapidated bulkhead. 10) The bulkhead shall be constructed prior to any backfrlling activities. 11) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 12) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 13) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 14) All backfill material shall be clean and free of any pollutants except in trace quantities. Excavation 15) No excavation shall take place outside the area indicated on the attached workplan drawings. 16) Excavation shall not exceed -6 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of the connecting waters. Mark Lewis ADDITIONAL, CONDITIONS Permit # 11-15 Page 3 of 4 17) In order to protect juvenile finfish resources, no excavation shall be permitted between April 1 and September 30 of any year without prior approval of the Division of Coastal Management and the US Army Corps of Engineers. 18) The temporary placement of double handling of excavated materials within waters or vegetated wetlands is not authorized. Spoil Disposal 19) All excavated materials shall be confined above normal high water level and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 20) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the initiation of any dredge activities. Sedimentation and Erosion Control 21) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Maintenance Clause 23) The Division of Coastal Management will be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit and that notification include: a. The number of the original permit b. A statement that no dimensional changes are proposed c. A copy of the original permit plan(s) with cross -hatching indicating the area to be maintained and the area to be used for dredge spoil, and the estimated amount of material to be removed. d. The date of plan revision and the permittee's signature shown anew on the original plan General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. Mark Lewis ADDITIONAL CONDITIONS Permit # 11-15 ' Page 4 of 4 25) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/ne- es/mammal/manatee_guidelines.pdf. 26) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification. 27) No open water areas shall be excavated or filled, even temporarily, outside of the areas indicated on the attached workplan drawings. 28) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 29) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No. 90-0267. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW-2014-02301, which was issued on 1/23/15. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 9. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 10. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents• associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 15. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 16. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 17. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. RECEWD NOY 19 1014 DCM-MHD CITY Swan Point Marina Page 2 9. PROJECT DESCRIPTION: The project site is located at 123 Page Street, adjacent to Stump Sound/New River, in Sneads Ferry, Onslow County. To locate the project site from the WiRO take US-17 N for approximately 29 miles and turn right on NC-172. Travel approximately 6 miles and turn right onto Sneads Ferry Road and then travel approximately 1 mile and turn right onto Peru Road. Swan Point Road is at the end of Peru Road to the right. Turn left off of Swan Point Road onto Page Street and the property will be located on your left. The property is adjacent to Stump Sound/New River to the north and east and to residential properties on the west and south sides. Highground development on the project site includes a Marina Store/Storage building, decking, associated parking, boat storage, gravel drive, community marina and bulkhead. Upland vegetation consists of sparse lawn grass and almost the entire lot is gravel. The lot is approximately 1.65 acres in size and has an average elevation of approximately 4 feet above mean sea level. The entire project site has 960 linear feet of shoreline frontage all of which is stabilized by an aging bulkhead. The applicant has received numerous maintenance excavation permits in the past, but does not currently have an active State Permit. The original marina property was developed prior to CAMA regulations. State Permit No. 30-90 was issued to Swan Point Marina on February 23, 1990 for a travel lift and excavation in the existing marina basin. This permit expired on December 31, 1993. General Permit No. 43295 was issued on January 9, 2006 and General Permit No. 59166 was issued on March 8, 2012 for maintenance excavation. The applicant states that there are 54 existing slips due to the size of the vessels at this marina facility. According to the April 26, 2011 field data report from the Division of Shellfish Sanitation the existing marina has the potential for up to 73 slips. Swan Point Marina consists of Two Tracts that have been combined to form one property. There is an existing 4800 sq. ft. storage building/marina store on Tract 1 with a wooden deck. Two wooden piers extend to the east from Tract 1, each measuring approximately 215 ft. in length by 6 ft. in width. The southernmost pier has existing boatlifts along the northern side. Tract 2 contains a concrete pad with wooden ramps for the existing travel lift. There is a gravel access area that extends waterward to the east of Tract 2 measuring approximately 320 ft. in length by 25 ft. in width. The entire gravel access area is stabilized with an existing bulkhead and there are existing boatlifts on the southern side. The gravel access area terminates in an access pier measuring 30 ft. in length by 6 ft. in width and a T- head measuring 150 ft. in length by 6 in width. The existing bulkhead on the north side of the property meets Normal High Water (NHW). There is rip rap and debris water ward of the bulkhead below NHW along this entire 400 ft. section. The remaining 560 linear feet of bulkhead within the marina also meets NHW. No coastal wetlands were observed adjacent to the stabilized shoreline. The Onslow County Land Use Plan classifies adjacent waters and high ground area of project site as Community Growth Area/Conservation. There are no known archaeological sites located in the project vicinity. The waters of Stump Sound/New River are classified SA by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fgk"" and they are CLOSED to the harvest of shellfish. NOY 19 2014 10. PROPOSED PROJECT: DCM-W0CrfY The applicant proposes to construct 850 linear feet of vinyl bulkhead water ward of the existing deteriorating bulkhead, add a fixed platform (walkway) over open water along the north side of the new bulkhead and conduct maintenance dredging within the existing marina basin. The applicant states that on the northern side of the property the proposed new 400 ft. section of vinyl bulkhead would be constructed approximately 5 ft. water ward of the existing wall. The applicant states this alignment is Swan Point Marina Page 3 necessary to avoid existing debris that is located waterward of the deteriorating bulkhead. The remaining 450 linear feet of new proposed bulkhead would be located approximately 2 ft. waterward of the existing wall (See drawing dated received October 29, 2014). The applicant is also proposing a fixed platform (walkway) measuring approximately 360 ft. in length by 6 ft. in width that would extend waterward along the entire northern section of bulkhead to the property line. No additional slips are proposed in this location. The waterbody in this area of Stump Sound/New River measures approximately 650' in width According to the application package the applicant proposes maintenance dredging (bucket to barge) of approximately 1053 cubic yards of material around existing designated slips within the marina footprint. The proposed excavation area is located on the south side of the existing gravel access area and measures approximately 325 ft. in length by 35 ft. in width. The existing average water depth in this location is -4 ft. at Normal Low Water (NLW). The applicant is proposing excavation to a final depth of - 6 ft. at NLW. The dredged material will be placed upland area located on the property measuring approximately 50 ft. in length by 50 ft. in width. The proposed spoils site would be located on a parcel owned by the applicant to the west and would be stabilized with silt fencing. No changes are proposed to the upland portion of the project site. 11. ANTICIPATED IMPACTS: The proposed new vinyl bulkhead would result in the filling of 3,730 sq. ft. of Estuarine Waters/Public Trust Area. Minor increases in turbidity should be expected during construction. The proposed fixed platform (walkway) would incorporate approximately 2,160 sq. ft. of open water within the applicants area of riparian access and within % of the width of the waterbody. The proposed maintenance dredging would disturb approximately 11,375 sq. ft. of previously excavated shallow bottom area. Approximately 2,500 sq. ft of high ground would be filled at the spoil site on an adjacent property owned by the applicant within the 75 ft. Estuarine Shoreline Area outside of the Estuarine Shoreline 30 ft. buffer . The proposed maintenance excavation within the existing boat basin is in the same footprint as previously authorized maintenance events. Minor increases in turbidity should be expected during the dredging event; however no long term adverse impacts are anticipated. Sedimentation and erosion control structures would be installed to prevent transport of material off the property. It is recommended that a permit be issued to authorize the construction of a new vinyl bulkhead waterward of an existing deteriorating bulkhead. It is our opinion that the proposed alignment does not create any significant adverse impacts to the resource due to the presence of existing debris and rip rap. The proposed fixed platform (walkway) appear to be CONSISTENT with 15 NCAC 07H.0208 (b)(6). This office has no objection to the proposed work provided that it is consistent with all other state and federal permitting requirements. The proposed excavation within the area within the existing marina basin appears to be CONSISTENT with15 NCAC 07H.0208 (b)(1). It is the opinion of this office that the area for the proposed excavation is located in an area that has been historically impacted and in continuous use for docking and navigational purposes. This office has no objection to the proposed work provided that it is consistent with all other state and federal permitting requirements. Any permit issued should include the following conditions: The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of coQ?tbn. 2. The bulkhead must be constructed prior to any backfilling activities. NOV 10 1014 3. The bulkhead must be structurally tight so as to prevent seepage of backfill material00#60"M structure. 4. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 5. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 6. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 8. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 9. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 10. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 12. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Recommendations for State Permit - Swan Point Marina Paget 13. In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in conjunction with the Division of Marine Fisheries. 14. Excavation shall not exceed -6.0' below MLW. 15. The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 16. All unconsolidated material resulting from associated grading and dredge spoil placement shall be retained on site by effective sedimentation and erosion control measures and shall be confined to the area above mean high water and landward of any regularly or irregularly flooded marsh behind adequate retaining structures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. 17. All spoil material shall be placed at least 30' from mean high water. 18. The disturbed areas will be properly graded and provided with ground cover sufficient to restrain erosion within thirty (30) working days of project completion. 19. The spoil area shall be inspected prior to beginning work by a DCM Representative. 20. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 21. The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site must be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plans 22. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 23. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. 24. Future development on the permittee's property may require a modification of this permit. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. 6. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-3282 at least two weeks prior to beginning work and upon completion of work. 7. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. S. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 9. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 10. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 11. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733- 5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 12. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 13. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 14. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 15. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 16. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 17. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 18. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
