This permit, issued on June 15, 2015 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; ormay cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the above referenced property, including the single family residence and driveway; all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this determination. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee John Brinkley Permit # 66-15 Page 2 of 3 ADDITIONAL CONDITIONS 2) No fill material shall be placed at any in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the approved workplan drawing(s). 3) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive standard shall apply. 4) All fill material shall be clean and free of any pollutants except in trace quantities. 5) Prior to the initiation of construction within the Ocean Hazard AEC, the permittee shall determine, and a Division representative shall approve, the first line of stable, natural vegetation and the corresponding structure setbacks. In this case, the first line of stable natural vegetation is defined as the vegetation line that existed prior to the onset of the 1998 large-scale beach renourishment project. These setback determinations shall replace those done at the time the permit application was processed and approved. Construction shall begin within sixty days of this determination or the measurement is void and shall be re-established. In the case of a major shoreline change within that period, anew setback determination shall be required before construction begins. 6). All buildings in the Ocean Hazard Area of Environmental Concern shall be on pilings not less than 8 inches in diameter if round, or 8 inches to a side if square. 7) All foundations shall be adequately designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100-year storm. 8) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structures. % 9) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Mules. RECEIVED Sedimentation and Erosion Control JUN 19 1013 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 11) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. ;l John.Brinldey Permit # 66-15 Page 3 of 3 ADDITIONAL, CONDITIONS U.S. Army Corps of Engineers Condition 12) In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined in the U.S. Army Corps of Engineers, Wilmington District, Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. Please contact the US Army Corps of Engineers at (910)-251-4555 for assistance. General 13) . The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to a Stormwater Permit from the Division of Energy, Minerals and Land Resources. NOTE: Future development of the perm ittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. Nos. SAW-2015-00739. NOTE: An express permit application processing fee of $2,000 was received by the Department of Environment and Natural Resources for this project.. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located on Lot 17, Block 4A, Ph-1, SE 63 a Street adjacent the Atlantic Ocean in Oak Island, NC'. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 etseq). The applicant proposes to construct a single family residence on a 14,804 W lot that has approximately 1,933 ft of uplands. The remaining 12,871 W of the properly is Section 404 wetlands. To facilitate the residence and driveway construction, approximately 3,914 ftx of wetlands are proposed to be filled. The applicant proposes to mitigate for wetland impacts by purchasing 0.2 acre of non -riparian wetlands within the Lower Cape Fear Umbrella Mitigation Bank. The NCWRC has reviewed the project and has the following; concerns; • In general the NCWRC believes residential lots should be designed to be buildable without the need RECEIVED for wetland fill. It is concerning that the amount of fill needed to construct on this lot is greater than the amount of available uplands. PROJECT DESCRIPTION The project site is located at Lot 17 Block 4A Ph -I, SE 63 d Street, Turtle Creek Subdivision, near the Atlantic Ocean, within the Town of Oak Island, in Brunswick County. To find the project site, travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Travel on NC-133 to Oak Island and turn right on East Oak Island Drive. Travel approximately 1.6 miles to SE 63rd Street. Make a left on SE 63rd Street and travel 0.1 miles and the lot will be located on right, directly across the street from 114 SE 63`d Street. The vacant lot has a total area of approximately 14,804 square feet, of which approxamately 1933.3 sq. ft. are considered uplands that are located across the front of the lot along the road. According to the application, the property has an approximate elevation of 8 feet above normal high water. The site is heavily vegetated with Lololly Pine (Pinus taeda), American Holly (Ilex opaca), Red Bay (Persea borbonia), Red Maple (Acer rubrum), Yaupon (Ilex vomitoria), Wax Myrtle (Myrica cerifera) and various other §404 Wetland species. There are no Coastal Wetlands located on the site. The application states the wetland line was delineated by Land Management Group and verified by Kyle Dahl (USACOE) on January 28, 2015. However, verification of the wetland boundaries was not submitted with the application package. The frontal dune and the static line are located over 800' oceanward of the southern property lines. The long term erosion rate for this portion of Oak Island is 2 feet per year. The 100-year storm recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 420 feet. The Ocean Erodible Area of Environmental Concern (AEC) boundary falls oceanward of the lot. The lot falls entirely within the High Hazard Flood AEC as indicated by zones V 1-30 on the Flood Insurance Rate Maps of the Federal Insurance Administration. Setbacks in this portion of Oak Island are measured from a static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more restrictive. This static vegetation line represents the fast line of stable, natural vegetation that existed prior to the large-scale spoil deposition project. The vegetation line used for Oak Island is based on the 1998 vegetation line, as described in NCAC 07H .0305(a)(6). With a 2 feet per year erosion rate, structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet landward from the static line. The 60 foot setback is located approximately 800 feet oceanward of the southern property lines of the lot. The actual first line of stable, natural vegetation is located oceanward of the surveyed static vegetation line. There are no man-made structures currently on the property other than municipal sewer hook-up. The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North Carolina Division of Water Resources. The area is not designated as a Primary Nursery area by the North Carolina Division of Marine Fisheries. PROPOSED PROJECT: The applicant is proposing to construct a 1-story pile -supported single-family residence with associated §404 wetland fill and concrete driveway. As proposed, the total heated floor area of the house would be approximately 2,600 square feet. With the covered porches and driveways, a total built -upon area of 3,649 square feet is proposed. The application states State Stormwater Management Permit No. SW8 920418 was issued for this phase of the Turtle Creek Subdivision which allows a maximum of 5,128 square feet of built upon area for this lot. The site is located within an Ocean Hazard Area, specifically, a High Hazard Flood Area. Wetland impacts are necessary for lot development. Existing Conditions The lot is located off of SE 63rd Street and is 0.34-ac in size. The lot is approximately one thousand feet north of the Atlantic Ocean and is within a FEMA-designated VE flood zone (VE-17). The project area is located within the Cape Fear River Basin (HUC 03030005). Freshwater wetlands were delineated by Land Management Group and approved by Mr. Kyle Dahl of the US Army Corps of Engineers on January 28, 2015. No coastal wetlands exist on site. Freshwater wetlands contain red maple (Acer rubrum), American holly (Ilex opaca), red bay (Persea borbonia) and yaupon (Ilex vomitoria). Uplands are limited to an approximately 20' width along the road front and support loblolly pine (Pinus toedo), American holly (Ilex opaco), red bay (Persea borbonia) and yaupon (Ilex vomitoria). The existing land use map in the CAMA Land Use Plan for the Town of Oak Island (2009) classifies this lot as Vacant Land since it is currently undeveloped. The future land use map classifies the project area as Medium Density Residential. The lot is also zoned R-6MF by the Town of Oak Island. The R-6MF district is established to provide areas for the preservation and development of quiet residential neighborhoods and for higher density residential development with a range of housing types. Total area of disturbance within the lot will be approximately 5,859 square feet, and the overall impervious area will be 3,649 square feet. Water service will be provided by Brunswick County and sewer service will be provided by the Town of Oak Island. Environmental Impacts The applicant proposes to fill a total of 0.089 acre of freshwater wetlands in order to provide sufficient area on which to build a residence. Because of the location and amount of wetlands within the lot, avoiding or reducing the amount of impacts was not possible. Uplands on the property are limited to a 20 foot to 35 foot width along the road frontage. The majority of this upland is located within the 25 foot front building setback required by the Town, so that wetland impacts were not avoidable. Building heights in VE flood zones in the R6MF zoning district are limited to 41 feet. In combination with the first floor elevations required by FEMA, multiple stories are limited. Therefore, a 40 foot by 65 foot building footprint was the minimum house footprint practicable. Parking will be underneath the structure and will minimize wetland impacts compared to a site plan with additional parking sited in front of the house. Fill side slopes also have been minimized to 5 feet in width. The applicant proposes to mitigate for these impacts by buying into the Lower Cape Fear Umbrella Mitigation Bank.
