This permit, issued on June 13, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may

1) Unless specifically altered herein, this Minor Modification authorizes the riprap extensions and river
rock swale stabilization, all as expressly and specifically set forth in the attached permit application
and workplan drawings. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification. Any additional land disturbing activities and/or
construction may require a modification of this permit. Contact a Division of Coastal Management
representative at (910)796-7215 for this determination.
2) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
3) The authorized riprap used for shoreline stabilization shall be located landward of normal high water
and Coastal Wetlands.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The alignment of the authorized riprap shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
4) The riprap and river rock material shall be free from loose dirt or any pollutant. The riprap shall be of a
size sufficient to prevent its movement from the approved alignment by wave or current action.
5) The authorized river rock swale stabilization shall be located a minimum of 30' landward of the normal
high water line at the time of construction.
6) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl or broken concrete.
7) This Minor Modification eliminates the previously authorized Hatteras ramp structure.
8) The Division of Energy, Mineral & Land Resources approval of this project under stormwater
management rules of the Environmental Management Commission is covered by way of Stormwater
Permit No. SW8 150401, which was issued on 5/24/18. Any violation of the permit approved by the
DEMLR shall be considered a violation of this CAMA permit.
9) This Minor Modification shall be attached to the original permit, which was issued to the permittee on
4/23/15, and the Minor Modification issued on 6/29/17, and copies of all documents shall be readily
available on site when Division personnel inspect the project for compliance.
10) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.
11) The pernuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: - Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 7215 prior to the commencement of any such
activity for this determination. The permittee is further advised that many non -water dependent
activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 14-
1322.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2015-00113.
NOTE: A minor modification processing fee of $100 was received by DCM for this project.

Hey Christy,
Sorry- I'll also ask you since I know Liz and Thekla are out- we sent out a minor mod request for the Town of Sunset
Beach's park back in late February for some riprap. It's located landward of MHW and coastal wetlands, so I don't
believe it should require any permit authorizations from you all, but do you have any record of any determination made
on that? We've had it on hold for stormwater permitting and they've just issued so I'm trying to wrap that up and just
realized I didn't receive any comments from Tyler.

On March 16, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
received and accepted a complete minor modification application for changes to the approved plans for Stormwater
Management Permit Number SW8 150401, It has been determined that the nature of the proposed change meets
the definition of a minor modification in that it does not result in an increase in the size of the permitted stormwater
control measure (SCM) and does not increase the amount of built -upon area.
Please refer to Attachment I for a detailed description of the current proposed minor modification and a list of all
the past modifications approved during the effective period of the permit. We are forwarding you an approved
copy of the modified plans for your files. Please replace the old approved plan sheet(s) with the new one(s).
Please be aware that all terms and conditions of the permit, last issued on May 5, 2017, remain is full force and
effect. Please also understand that the approval of this minor modification to the subject State Stormwater Permit is
done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to
construction. The approval of this minor modification does not preclude the perm ittee from complying with all
other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity,
and obtaining a permit or approval prior to construction.

Mr. Lewis acting as agent for the Town of Sunset Beach, is requesting to modify State Permit # 52-15,
which was issued April 23, 2015 for upland development within the public park including the existing 8' wide
boardwalk, gazebo, observation deck, restrooms, and parking areas. A Minor Modification was issued on June 29,
2017 which authorized a new pier, foxed observation platform, walkway, and rip -rap. State Permit # 52-15 is set to
expire December 31, 2018.
Mr. Lewis is requesting the authorization of two (2) proposed rip -rap extensions which would be into the
existing bulkhead and riprap features which are currently existing along the park's shoreline. The first proposed new
section of riprap would be located between the existing bulkhead and the section of existing riprap and would
measure approximately 8' in base width by 45' in length with a 2:1 slope. The second proposed section of riprap
would be located on the south side of the existing riprap and would measure approximately 8' in base width by 140'
in length with a proposed slope varying between 2:1 and 3:1. These areas currently lack any structures for shoreline
stabilization and exhibit a defined erosion escarpment. The proposed riprap would be located landward of the Mean
High -Water (MHW) mark and Coastal Wetland boundary. The riprap authorized by the previous Minor Modification
exceeded the base width and height dimensions shown on the approved workplan (C4.0) dated revised 05/19/2017.
The applicant has provided the as built dimensions on the proposed site plan. Mr. Lewis is also asking for approval to
lay river rock measuring approximately 6" deep in an area measuring approximately 6' in width by 23' in length, in the
same location where an elevated Hatteras style ramp was authorized under the previous Minor Modification. The
applicant is asking to remove the Hatteras ramp from the project at this time. The purpose of the proposed rock
would be to stabilize an existing swale that has formed due to runoff and foot traffic. As proposed, the rock for the
swale would not encroach into the 30' buffer and would not increase impervious area according to state stormwater
regulations. A check (ck. No. 2336) in the amount of $100 has been received for the modification request. This office
has no objections to the proposed modification of State Permit # 52-15. By copy of this memo, DCM is requesting
that all pertinent resource agencies provide any comments to Heather Coats of RCM's Wilmington Regional
Office within 14 days of receipt.

REVISONS
Sunset Beach Town Park is a Town owned Park located at 206 Sunset Blvd. N at the
intersection of NC Highway 179 Business and Sunset Blvd. N in Sunset Beach, North
Carolina. The Tax ID number for the property is 256GA1010. The total project area is 5.22
acres, and is currently covered by an active 12% low density stormwater permit # SW8
150041 dated April 15, 2015, prior CAMA Major Permit 52-15 dated April 23, 2015, prior
CAMA Major Permit 52-15 Minor Modification dated June 29, 2017 and prior CAMA
General Permit 64086D dated January 13, 2015.
The purpose of the modified plan is to update the previously approved plan to reflect as -built
conditions of the initial riprap shoreline protection and to allow the Town to install additional
riprap shoreline protection through a Minor Modification to the CAMA Major Permit 52-15
issued on June 29, 2017. The modified plan reflects the existing compliant as -built conditions
of the previously approved riprap shoreline protection, the proposed additional riprap
shoreline protection and all other existing and previously approved features of the project.
The existing riprap is 8-feet wide by 60-feet long for a total of 480 square feet. Three cross -
sections within the area of existing riprap are shown as Existing Rip Rap Sections 1, 2 and 3.
The two additional riprap revetments are shown on the modified plan. The first additional
proposed revetment, located between the end of the existing wood bulkhead and the existing
revetment, is 8-feet wide by 45-feet long for a total of 360 square feet. Two cross -sections
within this revetment are shown as Rip Rap Sections A and B. The second additional
proposed revetment, located from the end of the existing rip rap toward the AIWW, is 8-feet
wide by 140-feet long for a total of 1,144 square feet. Three cross -sections within this
revetment are shown as Rip Rap Sections C, D and E. All of the rip rap revetments will match
the existing escarpment cross slopes of either 3:1 or 2:1 (horizontal to vertical) as� V E
each section view. This cross slope is within the required base -width to h i

The previously proposed Hatteras Ramp has been removed from the plan and substituted in
the same location with proposed existing swale protection in order to prevent continued
erosion from occurring along this naturally occurring drainage pathway. An Existing Swale
Protection Detail and Existing Swale Protection Section has been added to the plan. It is
important to note that the addition of the rock channel lining for the existing swale protection
as well as the existing and proposed rip rap shoreline protection will not add any new
impervious area to the project.
The Coastal Wetland Line was updated and marked on November 22, 2017 along the full
length of the existing and proposed additional riprap by Land Management Group,
Wilmington, NC, This updated Coastal Wetland Line is reflected on the modified plan. The
existing and additional riprap shoreline protection does/will not encroach beyond and has/will
be placed completely landward of the updated and marked Coastal Wetland Line.

I looked at this quickly and it appears that they will need a minor mod for the stormwater permit because they have
removed some ramps and are installing (or have installed?) a rip rap swale. I am giving this to Linda to do a more
detailed review and send them a letter to request a minor mod.
By the way, they quoted the wrong state stormwater permit # in your application document. Correct number is listed in
subject line.
