DCM Wilmington 5/8/17) including the attached workplan drawing (1)C4 0 dated revised 5/19/17.
This permit, issued on June 29, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the pier and fixed observation
platform, riprap, the structure referenced as an elevated Hatteras Ramp, and relocated gazebo, all as
expressly and specifically set forth in the attached permit application and workplan drawings. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification. Any additional land disturbing activities and/or construction may require a
modification of this permit. Contact a Division of Coastal Management representative at (910)796-
7215 for this determination.
2) This Minor Modification does not authorize any docking spaces along the new pier and fixed
observation platform.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

3) Any portion of the permitted access pier built over Coastal Wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The pennittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
8) The authorized structure referenced in the plans and application letter as a Hatteras Ramp shall be
elevated and shall not exceed 6 feet in width.
9) The authorized riprap shall be located landward of normal high water and Coastal Wetlands.
10) The alignment of the authorized riprap shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
11) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the approved alignment by wave or current action.
12) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
mar] or broken concrete.
13) This Minor Modification shall be attached to the original permit, which was issued to the permittee on
4/23/15, and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
14) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.
15) The permittee and/or his or her contractor shall meet with a representatiREGEiNVfor to
project initiation.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 7215 prior to the commencement of any such
activity for this determination. The permittee is further advised that many non -water dependent
activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 14-
1322.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2015-00113.
NOTE: A minor modification processing fee of $100 was received by DCM for this project.

measuring approximately 6'x10', located entirely in open water, in the Sunset Beach Town Park,
located at 206 Sunset Boulevard North, at the intersection of NC Highway 179 Business,
adjacent to the AIWW, in Sunset Beach, Brunswick County, North Carolina. Coordinates are:
33.8834 N,-78.51025 W.
On January 1, 2017, we renewed General (Regional) Permit No. 197800056, (copy
enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks,
boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in
navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the
Rivers and Harbors Act of 1899. General Permit No. 198700056 expires December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to

Mr. Lewis acting as agent for the Town of Sunset Beach, is requesting to modify State Permit #52.15, which
was issued April 23, 2015 for upland development within the public park including the existing 8' wide boardwalk,
gazebo, observation deck, restrooms, and parking areas. State Permit # 52.15 is set to expire December 31, 2018.
Mr. Lewis is requesting the authorization of a proposed new pier measuring approximately 6' in width by
approximately 65' in length which would terminate at a proposed fixed observation platform measuring approximately
10' in width by 10' and length and located entirely over open water. The proposed pier and T-head would extend
approximately 25' into the adjacent Mary's creek which measure approximately 132' in width, therefore not exceeding
the Ya width distance of the waterbody. The pier and T-head would be located slightly landward of the pier head line
established by the existing pier and floating dock to the north. Mr. Lewis is also proposing to construct a 6' wide by
43-foot-long elevated upland walkway that would extend off the existing boardwalk and run approximately 43' before
terminating landward of the coastal wetland boundary. Due to erosion from Hurricane Matthew, Mr. Lewis is
proposing a new rip -rap revetment located along the shoreline between the existing pier and the proposed pier. The
proposed rip -rap would measure approximately 48' in length by 4' in width by 2' in height and would be located
landward Mean High Water mark and Coastal Wetland boundary.
A revised stormwater plan has been approved by the Division of Energy, Mineral, and land Resources
under permit number SW8150401 for the proposed upland modifications located outside of the Coastal Shoreline 75'
AEC (see attached site plan). These proposed modifications include an approximately 400 sq. ft. shelter, an
approximately 1500 sq. ft. gazebo and an approximately 8' in width by 25' in length permeable paver walkway. Mr.
Lewis has included a check (ck. No. 002179) in the amount of $100 for the modification request. This office has no
objections to the proposed modification of State Permit #52-15. By copy of this memo, DCM is requesting
that all pertinent resource agencies provide any comments to Heather Coats of DCM's Wilmington
Regional Office within 14 days of receipt. RECEIVED

Sunset Beach Town Park is a Town owned Park located at 206 Sunset Blvd. N at the
intersection of NC Highway 179 Business and Sunset Blvd. N in Sunset Beach, North
Carolina. The Tax ID number for the property is 256GA1010. The total project area is 5.22
acres, and is currently covered by an active 12% low density stormwater permit # SW8
150041 dated April 15, 2015, CAMA Major Permit 52-15 dated April 23, 2015 and CAMA
General Permit 64086D dated January 13, 2015. The project consists of areas of permeable
pavement and redevelopment.
The purpose of the plan revision is to reallocate previously permitted BUA to account for
changes made during the construction of the Phase 1 portion of the project and additional
items desired for the final Phase 2 portion of the project. Permitted BUA amounts are shown
on the Stormwater Plan Revision, Sheet C4.0 revised March 9, 2017 (revised plan) by this
office per the table "Previously Approved Post Development Site Areas". The BUA
allocations for the plan revision are shown on the above referenced Stormwater Plan Revision
by this office per the table "Revised Post Development Site Areas".
Changes to the previously approved plan desired by the Town include the following:
• The Town desires to retain the existing pier and floating dock located along Mary's
Creek. The Town will handle any required construction upgrades of the existing pier
and floating dock to commercial building standards for piers and floating docks.
• The Town desires to eliminate the previously proposed Concrete or Block Bank
Stabilization Benches.
• The Town desires to construct a covered picnic shelter in the area of the existing
gravel/marl parking lot (which is considered impervious) so that no new impervious
surface (BUA) is created.

• The Town desires to eliminate the former Phase 2 wooden boardwalk #3 and
associated wooden observation deck facing the Atlantic Intracoastal Waterway. The
Town desires to now construct a 6-foot wide elevated wooden pier connected to
existing wooden boardwalk #2 to a new 10'x10' uncovered observation deck and will
retain a structural engineer to design the pier and observation deck. The pier will be
designed such that there will be at least 3-feet of clearance between the bottom of the
decking and the substrate of the coastal wetlands. The attached updated plan shows the
uncovered observation deck will be located over open water in an area currently void
of wetland vegetation between the existing marsh lines recently located by our survey
department. The observation deck building limits is well within the 25% distance
between marsh lines as shown on the attached updated plan and is in line with the
existing adjacent floating dock.
• The Town has eliminated all prior proposed concrete pads under the Southport Swings.
• The Town has relocated the bicycle racks as shown on the revised plan.
• The Town, working with the Veteran's Memorial Committee, has allowed minor
changes to the permeable paver walkway between the memorial concrete pad to the
main permeable paver loop system walkway as shown on the revised plan.
• The Town desires to construct a 6-foot wide by 43-foot long Hatteras ramp that will
terminate landward of the coastal wetlands as shown on the revised plan.
• The Town desires to install riprap shoreline protection through a revision to the
General Permit 64086D issued on January 13, 2015. All rip rap shoreline protection
will be located landward of the Coastal Wetland Line as shown on the attached
updated plan.

On May 1, 2017, the Wilmington Regional Office received a complete request to revise the approved
plans for Stormwater Management Permit Number SW8 150401. The revisions include reallocating the
impervious area as summarized in Attachment A. The previously -permitted impervious area has been
reallocated, but it has not increased. There is also no change to the previously -permitted Stormwater flow.
Therefore, this Plan Revision has no impact on the redevelopment component of this permit. It has been
determined that a formal permit modification is not required for the proposed changes. We are forwarding
you an approved copy of the revised plans for your files. Please replace the old approved plan sheet with
the new one.
The approval of this revision to the approved plans and to the permit for the subject State Stormwater
project is done on a case -by -case basis. Any other changes to this project must be approved through
this Office prior to construction. The issuance of this plan revision does not preclude the permittee
from complying with all other applicable statutes, rules, regulations or ordinances which may have
jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction.
