1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property including the 8' wide boardwalk, gazebo,
observation deck, signage, kiosks, restrooms, parking areas, swings, benches and bike rack, all as

3) The observation platform shall not exceed 200 square feet.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Division of Energy, Mineral and
Land Resources, 127 Cardinal Drive Extension, Wilmington, NC 28405.
4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or beans, etc.).
5) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.

6) No wetlands or open water areas shall be excavated or filled, even temporarily, without additional
authorization.
7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a Stormwater
Permit from the Division of Energy, Minerals and Land Resources.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 7215 prior to the commencement of any such
activity for this determination. The permittee is further advised that many non -water dependent
activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWR Project No. 14-
1322.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-

Vegetation consists of a sparse canopy of live oak trees, with a groundcover or maintained bermuda grass and weeds. The
understory was historically removed when the site was a private residence, and the Town continues to mow/maintain the site
for passive recreation use by the public.

The site contains an existing dock in Mary's Creek, as well as several concrete pads that are remnants from when the
property was a private residence.

The proposed project will consist of a town park open to the public. Daily operations will consist of the general public
accessing the site for recreational purposes including education, excerise and relaxation.

Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The proposed project will be constructed using typical commercial construction equipment and techniques. No special
construction equipment will be used. Anticipated construction equipment will consist of bobcats, front end loaders, and
potentially a small bulldozer or excavator for grading. However, the exact type of equipment and number of each type of
equipment is unknown at this time. All equipment will be stored onsite within the permitted construction limits when not in
use.
d.
List all development activities you propose.
The proposed development activities consist of construction of a mixed -use public park, which includes select grading for
installation of the walkway and boardwalk, and construction of the walkway, boardwalk, gazebo, observation deck, signs,
three educational kiosks, a restroom building, parking area, eight swings, four benches and bike racks.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for
compliance. Please sign both the original and the copy and return the copy to this office in the enclosed
envelope. Signing the permit and proceeding means you have waived your right of appeal described below.
If you -object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
I I3A-121.1 or 113-229; Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another
qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

9. PROJECT DESCRIPTION
The applicant's property is located at 206 Sunset Boulevard North adjacent to the Mary's Creek and the Atlantic
Intracoastal Waterway (AIWW) in the Town of Sunset Beach, Brunswick County. Directions from Highway 17
south of Shallotte: Turn Left onto Highway 904 and travel south for approximately 3.6 miles to the intersection of
Sunset Boulevard North. Turn Right onto Sunset Boulevard and travel approximately 1.7 miles and proceed south
thru the traffic circle. Proceed south thru the intersection with Shoreline Drive West. The project site will be
located immediately on the left side of the road. The project site is bordered by the waters of the Marys Creek to
the north and east, the AIWW to the south and Sunset Boulevard to the west.
The project site is comprised of one parcel totaling approximately 5.22 acres (+/-227,383 sq. ft.) in size. The site is
vegetated primarily with lawn grasses and mature oak trees. The elevation of the tract is approximately 13 feet
above mean sea level. A portion of the shoreline of the site adjacent to Mary's Creek has been stabilized with a
bulkhead (approximately 490 linear feet). Coastal wetland vegetation is present water ward of the existing
bulkhead and is approximately 5-10 feet in width. The remainder of the shoreline along Mary's Creek is natural
with an approximately 3 foot change in elevation from the high ground to the coastal wetlands. The shoreline in
this area is stabilized with vegetation. Coastal Wetland vegetation in this area ranges in width from 10 -20 feet.
The Coastal Wetland vegetation consists primarily of Smooth Cord Grass (Spartina alterniflora) and Salt Meadow
Hay (Spartina patens). The shoreline along the AIWW is void of wetland vegetation and an approximately 2-3 foot
erosion escarpment is present due to wave wash.
The Town Park project received a Sedimentation and Erosion Control permit (BRUNS 2015-011) from the Division
of Energy, Mineral and Land Resources. The applicant states a State Storm Water permit will be applied for from
the Division of Water Resources. CAMA Minor Permit #SB13-14 was issued for the development of the Town
Park, however the project now exceeds the thresholds for minor development, which requires additional State
authorization and therefore, now requires CAMA Major Permit authorization.
The waters of the AIWW are classified as SA-HQW by the North Carolina Division of Water Resources and are
closed to the harvest of shellfish. This area of AIWW has been designated as Primary Nursery Area. The entire
property lies within the jurisdictional limits of the Town of Sunset Beach.
10. PROPOSED PROJECT
The applicant is proposing to construct a public park with boardwalks, gazebo, observation deck, signage,
educational kiosks, restroom building, parking area, swings, benches and bike racks. The applicant is
proposing a restroom building, gazebo, parking area, boardwalks, educational kiosks, and bike racks located
on the high ground of the property. As proposed, a portion of the pervious boardwalks, eight (8) "Southport
swings", one (1) educational kiosk and four (4) benches would be located within the 75-foot Estuarine
Shoreline AEC. The applicant is proposing a series of boardwalks throughour the project area, some of which
will be 8 feet in width and some 5 feet in width. The applicant states that all proposed boardwalks located
within the 30-foot Coastal Shoreline Buffer would be elevated and slatted. The applicant is also proposing a
200 sq. observation deck at the terminus of the boardwalk located adjacent to the AIWW (see sheet C2.0)

11. ANTICIPATED IMPACTS:
As proposed, the public park would result in approximately 12,776 sq. ft. of pervious concrete walking trails within
the Estuarine Shoreline AEC. This would result in a total of 5,302 sq. of impervious surface within the Estuarine
Shoreline AEC. Approximately 2,750 square feet of elevated, slatted walkway is proposed within the 30-foot
Coastal Shoreline Buffer AEC. An additional 200 sq. ft. of observation deck is proposed within the 30-foot Coastal
Shoreline AEC. As proposed, all other development including parking, bathrooms, etc. would be located outside
of the Estuarine Shoreline AEC. The proposed development of the Town Park would result in the land disturbance
of approximately 164,714 square feet (3.78 acres).

Project Narrative
The Town of Sunset Beach requests a CAMA Major Development Permit for the construction of the
Sunset Beach Town Park. The proposed project is located at 206 Sunset Blvd North, east of the
intersection of Sunset Beach Blvd and Shoreline Drive in Sunset Beach, Brunswick County (Lat:
33.883456°N; Long:-78.510351°W). The Sunset Beach Town Park project is located on at5.22 acre
parcel (PIN 104408886993) and is bordered by Mary's Creek to the east and the ICWW to the south.
This section of ICWW (Stream Index: 15-25) is classified as SA;HQW and is located within the Lumber
River basin (HUC 03040207).
Proposed Project
The proposed project consists of a multi -use public town park. The proposed amenities to be constructed
within the park include the following:
• Pervious concrete walking trails (12,776 sq ft) of both 5' and 8' widths, constructed outside of the
30' Coastal Shoreline Setback, with both 5' and 8' widths.
• Elevated, slatted walkways (2,750 sq ft) constructed within the 30' Coastal Shoreline Setback.
Please note that the support structure/framework will be constructed of wood, and Trex composite
boards are proposed to be used for the decking boards. Please refer to the enclosed Stage 1
Construction Drawings for details on the design of the elevated, slatted walkway and proposed
materials. There are 5ft and 8ft portions of elevated, slatted boardwalk proposed. The boardwalk
within the main loop trail will be 9 ft wide from back of curb to back of curb, while the section
leading to the observation deck will be t6 ft wide from back of curb to back of curb. Please note
that the proposed 9 ft wide elevated, slatted walkway has been designed to allow for a clear 8 ft
walking surface, with 6 inch curbs on both sides, for a total width of f9' as shown on Sheet S 1.3
of the Stage 1 Construction Drawings. The curb is necessary for visitor safety, most specifically
visitors in wheelchairs as the curbs will help prevent wheelchairs from accidentally rolling off the
site of the elevated boardwalk. 15A NCAC 07H .0209 (d)(10)(D) specifies that boardwalks
within the 30' Coastal Shoreline Setback may be greater than 6 ft in width if it is to serve a public
use or need. Therefore, the proposed 9 ft wide elevated, slatted boardwalk is allowable since it is
being constructed for public use within a public park.

Existine Conditions
The proposed project site currently consist of an undeveloped, wooded parcel which is currently being
used as a passive recreation park. The project site contains an existing bulkhead along Mary's Creek, an
existing wooden pier within Mary's Creek, and several concrete pads from previous structures which
have been demolished. The project site also contains coastal wetlands along the ICWW and Mary's
Creek.
The project site contains numerous mature live oak trees with an open understory. The understory was
historically removed when the parcel was previously a private residence. The site is regularly
mowed/maintained by the Town to allow passive recreational use by the public.
Project History
The Sunset Beach Town Park was previously issued a CAMA Minor Permit (SB#13-14) on September
19, 2013, as the proposed design did not require any other state or federal permits (i.e. Stormwater
Management Permit, Sediment & Erosion Control Permit, etc.) because the proposed disturbance was less
than 1.0 acres the proposed impervious area was less than 10,000 sq ft. During construction activities,
construction materials were stored outside of the approved construction limits, resulting in the issuance of
an Erosion Control Notice of Violation, which resulted in the project requiring an Erosion Control Permit,
and subsequently, a Stormwater Management Permit. The requirement of these State permits elevated the
project to a CAMA Major Permit.
The Sediment & Erosion Control Permit (Project ID: Bruns-2015-011) was issued on September 24, 2014
and has been provided as an Attachment.
The Stormwater Management Permit application is being prepared for submittal, and NCDMLR review is
anticipated to run concurrently with the CAMA Major Permit Application review.
Areas of Environmental Concern (AEC)
This section of ICWW, including all sloughs, sounds, inlets and connecting channels (i.e. Mary's Creek),
has a Water Quality Classification of SA;HQW and is subject to a 75' AEC from the Mean High Water
Line (MHWL) of both the ICWW and Mary's Creek. The 75' AEC encroaches onto the eastern and
southern portion of the project and encompasses 79,064 sq ft (f1.8 acres) of the project site. The project
will result in 5,302 sq ft (f0.12 acres) of impervious area within the 75' AEC from construction of the
pervious concrete walking trails, the concrete piers/footers for the elevated boardwalk and the concrete
pads for the benches and Southport Swings.

Coastal Wetlands & Mean High Water
The project site contains coastal wetlands jurisdictional to NC Division of Coastal Management (DCM)
which were delineated by Withers & Ravenel in 2013. The Mean High Water Line was established by
East Coast Engineering & Surveying locating the 2.9' contour (NAVD 88), which is the established
MHWL elevation for this area of Brunswick County. Through issuance of the previous CAMA Minor
Permit for the project, DCM has approved the delineation of the coastal wetlands, as well as the location
of the Mean High Water Line. Please note that there is no proposed disturbance/impacts to the onsite
coastal wetlands as part of this application.
Upland Development
The entire project will be constructed entirely within uplands, and includes pervious concrete walking
trails, elevated, slatted walkways, an observation deck overlooking the ICWW and Mary's Creek, three
educational kiosks, a restroom building, a gazebo, pervious concrete parking area, eight "Southport
Swings", four benches, informational Signs and bike racks.

Dear Ms. Parker,
You have our approval, in accordance with the attached conditions to construct a public park as
described in your application received by the N.C. Division of Water Resources (DWR) on December
23, 2014, with additional information received on January 9, 2015, and February 2, 2015. After
reviewing your application, we have decided that the impacts are covered by General Water Quality
Certification Number 3900 (GC 3900).
This Certification allows you to use the Regional General Permit #198000291 (GP 291) when
issued by the U.S. Army Corps of Engineers and the CAMA permit when issued by the Division of
Coastal Management. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to)
Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your application
shall expire upon expiration of the 404 or CAMA Permit. This Certification can also be found on

This approval is for the purpose and design that you described in your application. If you change

The Additional Conditions of the Certification are:
1. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices:
a. Erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual.
b. Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The
devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil)
projects, including contractor -owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
d. Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
e. Sufficient materials required for stabilization and/or repair of erosion control measures
and stormwater routing and treatment shall be on site at all times.
2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre -Construction Notification and authorized by this
written approval, including incidental impacts. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management
Practices, shall be performed so that no violations of state water quality standards, statutes, or
rules occur.
3. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters without prior
approval by DWR. If placement of sediment and erosion control devices in wetlands and
waters is unavoidable, then design and placement of temporary erosion control measures shall
not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or
banks, adjacent to or upstream and downstream of the above structures. All devices shall be
removed and the natural grade restored within two (2) months of the date that the Division of
Energy, Mineral, and Land Resources has released the project.

4. Turbidity
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B .0200. Appropriate sediment and erosion control practices must be
used to meet this standard.
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal Law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, then the Division may
reevaluate and modify this General Water Quality Certification.
6. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Resources, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permits.
You can contest this Certification as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings. You may
obtain a petition form from the Office of Administrative Hearings at http://www.ncoah.com or call
(919) 431-3000 for information. Within sixty (60) calendar days of receipt of this Certification, you
must file the petition with the Office of Administrative Hearings. A petition is considered filed
when the original and one (1) copy is received in the Office of Administrative Hearings during
normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state
holidays). The petition may be faxed to the Office of Administrative Hearings at (919) 431-3100,
provided the original and one copy of the petition is received by the Office of Administrative
Hearings within five (5) business days following the faxed transmission.

the Rules of 15A NCAC 7H.0209 (d) Use Standards for Coastal Shorelines (10)(D) which states "Elevated, slatted,
wooden boardwalks exclusively for pedestrian use and six feet in width or less. The boardwalk may be greater
than six feet in width if it is to serve a public use or need". The proposed 8 feet wide boardwalk would be
necessaryto provide handicapped accessibility and a consistentwidth forthe trail system. The boardwalkswould
be located within a public park and therefore, would serve the public's needs and provide a public use.
It is staffs recommendation the proposed Town Park would be CONSISTENT with the Rules of 15A NCAC 7H.0209
(d) Use Standards for Coastal Shorelines (10)(F) which states "Decks/Observation Decks limited to slatted,
wooden, elevated and unroofed decks that shall not singularly or collectively exceed 200 square feet;" The
applicant has stated the proposed observation deck would not exceed 200 square feet.
It is staffs recommendation that the proposed Town Park would be CONSISTENT with The Rules of 15A NCAC
07H.0600 Development Standards Applicable to all AECS.
I have no objections to the proposed project. Any permit issued should include the following conditions:
1. The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of normal high
water (Estuarine Shoreline Area of Environmental Concern), in this case, 5,302 square feet is
authorized.
2. Unless specifically allowed in 15A NCAC 07H. 0209(d) (10), and shown on the permitted plan drawing,
all development/construction shall be located a distance of 30 feet landward of normal high water.
3. All unconsolidated material resulting from associated grading and landscaping shall be retained on site
by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a
barrier line of filter cloth must be installed between the land disturbing activity and the adjacent
marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover.
4. All other disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of
construction completion.
5. The boardwalks located within the 30-foot Coastal Shoreline shall be wooden, elevated and slatted.
6. The observation deck shall be wooden, elevated, slatted, unroofed and shall not exceed 200 square
feet.
7. The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third -party.

9. PROJECT DESCRIPTION
The applicant's property is located at 206 Sunset Boulevard North adjacent to the Mary's Creek and the Atlantic
Intracoastal Waterway (AIWW) in the Town of Sunset Beach, Brunswick County. Directions from Highway 17
south of Shallotte:Turn Left onto Highway 904 and travel south for approximately3.6 milesto the intersection of
Sunset Boulevard North. Turn Right onto Sunset Boulevard and travel approximately 1.7 miles and proceed south
thru the traffic circle. Proceed south thru the intersection with Shoreline Drive West. The project site will be
located immediately on the left side of the road. The project site is bordered bythe waters of the Mary's Creekto
the north and east, the AIWW to the south and Sunset Boulevard to the west.
The project site is comprised of one parcel totaling approximately 5.22 acres (+/-227,383 sq. ft.) in size. The site is
vegetated primarily with lawn grasses and mature oak trees. The elevation of the tract is approximately 13 feet
above mean sea level. A portion of the shoreline of the site adjacent to Mary's Creek has been stabilized with a
bulkhead (approximately 490 linear feet). Coastal wetland vegetation is present water ward of the existing
bulkhead and is approximately 5-10 feet in width. The remainder of the shoreline, along Mary's Creek is natural
with an approximately 3 foot change in elevation from the high ground to the coastal wetlands. The shoreline in
this area is stabilized with vegetation. Coastal Wetland vegetation in this area ranges in width from 10 -20 feet.
The Coastal Wetland vegetation consists primarily of Smooth Cord Grass (Spartina olterniflora) and Salt Meadow
Hay (Spartina patens). The shoreline along the AIWW is void of wetland vegetation and an approximately 2-3 foot
erosion escarpment is present due to wave wash.
The Town Park project received a Sedimentation and Erosion Control permit (BRUNS 2015-011) from the Division
of Energy, Mineral and Land Resources. The applicant states a State Storm Water permit will be applied for from
the Division of Water Resources. CAMA Minor Permit #SB13-14 was issued for the development of the Town
Park, however the project now exceeds the thresholds for minor development, which requires additional State
authorization and therefore, now requires CAMA Major Permit authorization.
The waters of the AIWW are classified as SA-HCIW by the North Carolina Division of Water Resources and are
closed to the harvest of shellfish. This area of AIWW has been designated as Primary Nursery Area. The entire
property lies within the jurisdictional limits of the Town of Sunset Beach.
10. PROPOSED PROJECT
The applicant is proposing to construct a public park with boardwalks, gazebo, observation deck, signage,
educational kiosks, restroom building, parking area, swings, benches and bike racks. The applicant is
proposing a restroom building, gazebo, parking area, boardwalks, educational kiosks, and bike racks located
on the and of the property. As proposed, a portion of the pervious boardwalks, eight (8) "Souihpo
swin s�Iducationa a four 4 1 nche would be located within the 75-foot Estuarine
oreline AEC. a applicant is proposing a series of boardwalks throughour the project area, some of which
will be 8 feet in width and some 5 feet in width. The applicant states that all proposed boardwalks located
within the 30-foot Coastal Shoreline Buffer would be elevated and slatted. The applicant is also proposing a
200 sq. observation deck at the terminus of the boardwalk located adjacent to the AIWW (see sheet C2.0)

11. ANTICIPATED IMPACTS:
As proposed, the public park would result in approximately 12,776 sq. ft. of pervious concrete walking trails within
the Estuarine Shoreline AEC. This would result in a total of 5,302 sq. of impervious surface within the Estuarine
Shoreline AEC. Approximately 2,750 square feet of elevated, slatted walkway is proposed within the 30-foot
Coastal Shoreline Buffer AEC. An additional 200 sq. ft. of observation deck is proposed within the 30-foot Coastal
Shoreline AEC. As proposed, all other development including parking, bathrooms, etc. would be located outside
of the Estuarine Shoreline AEC. The proposed development of the Town Park would result in the land disturbance
of approximately 164,714 square feet (3.78 acres).

understory was historically removed when the site was a private residence, and the Town continues to mow/maintain the site

The proposed project will be constructed using typical commercial construction equipment and techniques. No special

equipment is unknown at this time. All equipment will be stored onsite within the permitted construction limits when not in
use.

Project Narrative
The Town of Sunset Beach requests a CAMA Major Development Permit for the construction of the
Sunset Beach Town Park. The proposed project is located at 206 Sunset Blvd North, east of the
intersection of Sunset Beach Blvd and Shoreline Drive in Sunset Beach, Brunswick County (Lat:
33.883456°N; Long:-78.510351°W). The Sunset Beach Town Park project is located on a t5.22 acre
parcel (PIN 104408886993) and is bordered by Mary's Creek to the east and the ICWW to the south.
This section of ICW W (Stream Index: 15-25) is classified as SA;HQW and is located within the Lumber
River basin (HUC 03040207).
Proposed Project
The proposed project consists of a multi -use public town park. The proposed amenities to be constructed
within the park include the following:
• Pervious concrete walking trails (12,776 sq ft) of both 5' and 8' widths, constructed outside of the
30' Coastal Shoreline Setback, with both 5' and 8' widths.
• Elevated, slatted walkways (2,750 sq ft) constructed within the 30' Coastal Shoreline Setback.
Please note that the support structure/framework will be constructed of wood, and Trex composite
boards are proposed to be used for the decking boards. Please refer to the enclosed Stage 1
Construction Drawings for details on the design of the elevated, slatted walkway and proposed
materials. There are 5ft and 8ft portions of elevated, slatted boardwalk proposed. The boardwalk
within the main loop trail will be 9 ft wide from back of curb to back of curb, while the section
leading to the observation deck will be f6 ft wide from back of curb to back of curb. Please note
that the proposed 9 ft wide elevated, slatted walkway has been designed to allow for a clear 8 ft
walking surface, with 6 inch curbs on both sides, for a total width of t9' as shown on Sheet S 1.3
of the Stage I Construction Drawings. The curb is necessary for visitor safety, most specifically
visitors in wheelchairs as the curbs will help prevent wheelchairs from accidentally rolling off the
site of the elevated boardwalk. 15A NCAC 07H .0209 (d)(10)(D) specifies that boardwalks
within the 30' Coastal Shoreline Setback may be greater than 6 ft in width if it is to serve a public
use or need. Therefore, the proposed 9 ft wide elevated, slatted boardwalk is allowable since it is
being constructed for public use within a public park.
• An observation deck overlooking the IC W W and Mary's Creek, which will not exceed 200 sq ft.
• Three educational kiosks (only 1 kiosk located within 75' AEC and none within 30' COaSWCEiVED
Shoreline Setback)

Existing Conditions
The proposed project site currently consist of an undeveloped, wooded parcel which is currently being
used as a passive recreation park. The project site contains an existing bulkhead along Mary's Creek, an
existing wooden pier within Mary's Creek, and several concrete pads from previous structures which
have been demolished. The project site also contains coastal wetlands along the ICWW and Mary's
Creek.
The project site contains numerous mature live oak trees with an open understory. The understory was
historically removed when the parcel was previously a private residence. The site is regularly
mowed/maintained by the Town to allow passive recreational use by the public.
Proiect History
The Sunset Beach Town Park was previously issued a CAMA Minor Permit (SB#13-14) on September
19, 2013, as the proposed design did not require any other state or federal permits (i.e. Stormwater
Management Permit, Sediment & Erosion Control Permit, etc.) because the proposed disturbance was less
than 1.0 acres the proposed impervious area was less than 10,000 sq ft. During construction activities,
construction materials were stored outside of the approved construction limits, resulting in the issuance of
an Erosion Control Notice of Violation, which resulted in the project requiring an Erosion Control Permit,
and subsequently, a Stormwater Management Permit. The requirement of these State permits elevated the
project to a CAMA Major Permit.
The Sediment & Erosion Control Permit (Project ID: Bruns-2015-011) was issued on September 24, 2014
and has been provided as an Attachment.
The Stormwater Management Permit application is being prepared for submittal, and NCDMLR review is
anticipated to run concurrently with the CAMA Major Permit Application review.
Areas of Environmental Concern (AEC)
This section of ICWW, including all sloughs, sounds, inlets and connecting channels (i.e. Mary's Creek),
has a Water Quality Classification of SA;HQW and is subject to a 75' AEC from the Mean High Water
Line (MHWL) of both the ICWW and Mary's Creek. The 75' AEC encroaches onto the eastern and
southern portion of the project and encompasses 79,064 sq ft (11.8 acres) of the project site. The project
will result in 5,302 sq ft (f0.12 acres) of impervious area within the 75' AEC from construction of the
pervious concrete walking trails, the concrete piers/footers for the elevated boardwalk and the concrete
pads for the benches and Southport Swings.

Coastal Wetlands & Mean Hiah Water
The project site contains coastal wetlands jurisdictional to NC Division of Coastal Management (DCM)
which were delineated by Withers & Ravenel in 2013. The Mean High Water Line was established by
East Coast Engineering. & Surveying locating the 2.9' contour (NAVD 88), which is the established
MHWL elevation for this area of Brunswick County. Through issuance of the previous CAMA Minor
Permit for the project, DCM has approved the delineation of the coastal wetlands, as well as the location
of the Mean High Water Line. Please note that there is no proposed disturbance/impacts to the onsite
coastal wetlands as part of this application.
Upland Development
The entire project will be constructed entirely within uplands, and includes pervious concrete walking
trails, elevated, slatted walkways, an observation deck overlooking the ICWW and Mary's Creek, three
educational kiosks, a restroom building, a gazebo, pervious concrete parking area, eight "Southport
Swings", four benches, informational Signs and bike racks.

206 Sunset Boulevard North adjacent to the Atlantic Intracoastal Waterway, in the Town of Sunset Beach, Brunswick County. It was
received complete on 12/15/14, and appears to be adequate for processing at this time. The projected deadline for making a decision is
03/02/15. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from December 15, 2014, you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a
"Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal

and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management'
Issuea to I own or Sunset beach, authorizing development In the Estuarine Shoreline (ES) at 206 Sunset Boulevard
North, east of the intersection of Sunset Blvd. and Shoreline Drive, adjacent to Mary's Creek and AIWW, in Sunset
Beach, Brunswick County. This permit, issued on September 19, 2013, is subject to compliance with the application and
site drawings (where consistent with the permit), all applicable regulations and special conditions and notes set forth
below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the
permit to be null and void.
This permit authorizes: construction of a multi -use town park consisting of a pervious concrete walking trail, wooden
slatted boardwalk walking trails, an observation deck (not to exceed 200 sq ft), three educational kiosks, a restroom
building, a gazebo, and a pervious concrete parking area.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on September 5, 2013.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a final

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. A.II work must cease when this permit expires on:
December 31, 2016
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances, This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion.
(7) All other disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of construction
completion.
(8) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of normal high water
(Estuarine Shoreline Area of Environmental Concern), in this case, 9,093 square feet is authorized.
(9) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
developmenticonstruction shall be located a distance of 30 feet landward of normal high water.

This letter is in response to your email, dated 12/9/14, requesting additional information for the review of the
CAMA Major Permit application for the Sunset Beach Town Park project in Sunset Beach, Brunswick County.
Below are the responses to the items addressed in your email.
• Please mail the certified mail receipts (green cards) from the adjacent riparian property owners.
The original certified mail receipts have been enclosed with this letter.
• Updated Agent Authorization Form signed by both parties.
The executed Agent Authorization Form has been enclosed with this letter.
• The drawing Sheet C2.0 shows the access at the shoreline on the Mary's Creek side where once a pier was
proposed Please clarify if this remains part of the proposal.
The access to the previously proposed pier location was an error, and is not part of this proposal. This access has
been removed from the enclosed plans.
• Also, a notation on Sheet C2.0 indicates an existing beach access. Clam is this should remain.
The beach access referenced on Sheet C2.0 is an unimproved, pedestrian access that has existed for years. This
access shall remain as an unimproved pedestrian access, and has been noted as such in the enclosed plans.
However, since there are no proposed improvements to the pedestrian beach access (i.e. a boardwalk or walking
trail), and it will continue to exist in its current state, it is not considered part of this proposal.
• /f the to -scale drawings are larger than llxl7, you will need to submit 17 copies of the large drawings (Sheet
C1.0 and C2.0 only.
As requested, 27 copies of Sheets C 1.0 and C2.0 have been provided with this letter.
