Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. 02-07 Permit Number 1. A silt fence or natural buffer must be positioned between any land disturbance and adjacent waters or wetlands. In no case, shall erosion of disturbed areas result in deposition of this material into adjacent waters or wetlands. 2. All proposed development and associated construction must be done in accordance with the permitted workplat drawing(s) [Single Family Residence/Double Garage] submitted on 07-Nov-02. 3. All construction must conform to the N.C. Building Code requirements and all other Local, State, and Federal regulations. 4. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (SEE ATTACHED CONDITIONS) This permit action maybe appealed by the permittee or other(��1l�JU qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m,.st cease until the appeal is resolved. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surface areas shall not exceed 30% of the lot area within the 75 feet Area of Environmental Concern. However, no land disturbing activity shall occur within 30 feet of normal water level. 6. No impermeable surfaces shall be allowed over any functional part of the septic tank system. 7. All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. 8. All disturbed areas shall be vegetatively planted and mulched within fourteen days of construction completion. 9. The first floor elevation must be in compliance with Federal Flood Insurance Rate Map Elevations. 10. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party unless done so by the Director of the Division of Coastal Management. 11. The Marston paid a considerable sum to purchase this lot and spent months planning and designing their new house plan. As you can see from the copy sent to you, this home will be a great asset to the Lockwood Folly community as well as to the adjoining property owners. Because your lot is not as deep as Lot 325, the Marston's wanted to position their house at the specified location in order to have views of the marsh as well as a view of the Lockwood Folly river. This positioning of their house does not block your view of the marsh directly in front of your lot or the fantastic view of the river to the right of your lot. The house line location adjacent to your lot is located 25' off the property line, which far exceeds the 10, set back imposed by the county requirements and Lockwood Folly restriction. The house line location next to the marsh is 48' back from the high water mark and also exceeds the 30' set back required by CAMA and the Lockwood Folly restriction. We met with Connie Marlowe, the Brunswick County permit officer, on November 15, 2002 to ensure that we are in compliance with all set back restrictions. She agreed that we are well within the restriction. The enclosed survey clarifies the actual location and set backs that are in full compliance with all requirements and restriction that are needed to build this home. Once the appropriate approvals have been made we will proceed with the building process. I am the adjoining property owner located at Lot 324 in Lockwood Folly. My comments on the proposed project are as follows: The proposed location of the dwelling is at the extreme right rear comer of the property, (the northeast corner) and as such, will place it approximately 18 feet off the side property line and 4 feet from the Wetland Setback at the rear of the property. The stairs from the deck extend to approximately 2 feet from the setback line of the side of the property. Another set of stairs from the deck at the rear of the dwelling extend into the 30-foot setback line from the mean high-water line. This location may visually impair my view of the Lockwood River and the location of my residence will probably impair Mr. Marston's view of the river. I believe that the proposed dwelling should be more centrally located on the property.
