This permit, issued on March 16, 2015 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to tines, imprisonment or civil action; or may cause the permit to be nuu ana vata.
Docking Facility
1) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become apermanent part of this reconfigured
docking facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2) Any portion of the permitted docking facility built over wetlands shall be elevated a minimum of
three feet over the wetland substrate as measured from the bottom of the decking.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
water at or adjacent to authorized work.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) . This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make them more visible during hours of darkness
or inclement weather.
7) This permit authorizes three formalized boat slips.
Upland Development
8) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including but not limited to the
boardwalk and retaining wall, all as expressly and specifically set forth in the attached permit
application and workplan drawings. Any additional land disturbing activities and/or construction may
require a modification of this permit. Contact a Division of Coastal Management representative at (252)
808-2808 for this determination.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
General
11) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.

ADDITIONAL CONDITIONS
12) No open water areas or vegetated shall be excavated or filled, outside the area indicated on the attached
workplan drawings.
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) The permittee and/or contractor shall meet with a representative of the Division of Coastal Management
prior to project initiation in order to discuss the conditions set forth in this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2014-01857.
NOTE: An application processing fee of $250 was received by DCM for this project.

Project Narrative
Introduction
Elmer "Skip" and Allyson Sprinkle are the owners of a single-family residential property located
adjacent Bogue Sound at 243 Deep Bay Drive in the Deep Bay Subdivision in Carteret County.
They propose to construct a pier with two boatlifts and one single -pole jet -ski lift, construct a
high ground retaining wall with fill, and build a high ground walkway connecting the existing
residence with the retaining wall and pier.
Site Description
The Sprinkle property is comprised of Lot Number 1 of the Deep Bay Subdivision. The entrance
to the subdivision is located on Highway 24 in Carteret County, just east of the intersection with
Hibbs Road.
An existing single-family residence and shed are located on the property, with traditional
landscaping consisting of trees, grass, and shrubs. The shoreline along Bogue Sound measures
134 linear feet along Normal High Water (NHW) and is bordered by a fringe of coastal wetlands
measuring approximately 20' to 25' in width. A narrow area of 404 wetlands adjoins the coastal
wetlands.
NHW and coastal wetland lines were recently delineated by staff of the Division of Coastal
Management and are depicted on project plans, as surveyed by Charles A. Rawls and
Associates, PA. Federal (404) wetlands on the site have been delineated as shown on project
plans and verified by Christy Wicker of the US Army Corps of Engineers. The Notification of
Jurisdictional Determination dated November 28, 2014 is included with this narrative.
The average high ground elevation of the property is approximately +11' NHW. The property
slopes 12%to 15% beginning approximately midway between the back of the existing residence
and the shoreline.
A 15' wide drainage easement for the Deep Bay Subdivision is located along the western
boundary of the lot. An 8' walkway easement is located within the drainage easement.

Submerged aquatic vegetation (SAVs) is observed in shallow waters adjacent the shoreline.
Deep water (-2' NLW/MLW or greater) is found approximately 500' offshore measuring from
the waterward edge of coastal wetlands.
An historic channel used by local residents to access deep water is visible on aerial photos of
the area. The location and orientation of the historic channel were used to determine the
riparian corridor for the Sprinkle project site and adjacent properties. The Atlantic Intracoastal
Waterway (ICW) is located approximately 863' beyond the edge of the deep water historic
channel.
The waters of Bogue Sound at the project site are classified as SA HQW by the Environmental
Management Commission and are open to the harvesting of shellfish. Bogue Sound is
approximately 13,000 feet wide at this location. There are no known shellfish leases adjacent to
or within close proximity of the project.
Several large single-family residential parcels are located to the west along Bogue Sound. Ted
and Jewel Ivey are the owners of the adjacent property to the west. To the east, Clyde Case III
owns Lot Number 2 of the Deep Bay subdivision.
The project area is within the Carteret County planning jurisdiction. Residences in the project
area are served by individual septic systems, with drinking water provided by West Carteret
Water Corporation.
Project Description
The owners propose to build a new fixed pier with platform, two boat lifts, and a single -pole
jet -ski lift. They also propose to place fill in the low area of the backyard and construct a
retaining wall to contain the fill. An elevated, slatted walkway is proposed for construction on
highground to connect the existing residence to the top of the retaining wall and pier.
The proposed pier will extend 502' from the waterward edge of coastal wetlands and will
measure 4.5' in width. Water depths at the waterward end of the proposed pier are a RECEIVE,
minimum of -2' NLW/MLW. The pier will extend an additional 72' landward from the
waterward extent of coastal wetlands to reach the top of the proposed retaining wall. DFr

A partially roofed t-head platform measuring 16' x 30' will be located at the waterward end of
the dock. The dimensions of the platform roof are 18' x 20'.
A 13' x 13' boatlift will be placed on each side of the platform, for a total of two slips with lifts.
A single -pole jet- ski lift measuring 5' x 8' is also proposed for storing a personal watercraft over
the platform.
This area of Bogue Sound is characterized by shallow water, shoals, and SAVs, while pier length
has traditionally been controlled by the length of existing piers that typically end in less than -2'
NLW/MLW. By constructing longer piers, boat traffic through shallow shoal/SAV areas is
avoided, thus minimizing or avoiding impacts to SAVs. The photos of a neighboring shoreline
attached to this summary, taken while standing on an adjacent existing shorter pier located in
-1' NLW/MLW, clearly show scrape marks through SAVs caused by boats attempting to
navigate the shallow water near the shoreline.
A major permit (#20-14) was recently issued to Ted and Jewel Ivey, adjacent riparian neighbors,
for construction of a pier extending to -2' NLW/MLW. The recently permitted pier exceeds the
previous pier head line along this shoreline, yet avoids boat traffic through SAVs. Consistent
with the permitted Ivey pier, the Sprinkles' proposed pier is located at the point requiring the
shortest distance along their shoreline to reach -2' NLW/MHW and terminates beyond SAVs, as
shown on project plans.
The length and location of the proposed Sprinkle pier is consistent with the general navigational
route for boats using this area of Bogue Sound and does not significantly extend beyond the
recently permitted pier. Compared to the old pier head line, the Sprinkles' proposed pier length
reduces impacts to resources while allowing boating access to their property.
The proposed Sprinkle pier extends approximately 50 feet waterward of the adjacent permitted
Ivey pier. While the proposed Sprinkle pier extends farther than the recently permitted pier to
reach -2.0' NLW/MLW, note should be made that the edge of the Intracoastal Waterway is
about 28' farther from the historical channel at the proposed Sprinkle pier than at the
permitted Ivey pier. Consequently there should be no impediments to navigation from the
proposed Sprinkle pier, given the width of Bogue Sound at this point, distances to both the
historical and ICW channels, and the widening space between the two navigational channels.

Along the shoreline of the Sprinkle property water depths at 400' from the waterward extent of
coastal wetlands measure -.5' at NLW/MLW. Low water depths increase to -2' or greater at 500'
from the edge of marsh. As such, the proposed location and length of the Sprinkle dock
complies with CAMA standards for increased water depths for piers exceeding 400'.
The portion of the pier located waterward of NHW will be elevated a minimum of 6.5' above
any substrate with SAVs. The bottom of the pier decking over wetland substrate will be
elevated a minimum of 3'. The pilings supporting the pier will be at least 10' apart, other than
terminal instances, in order to lessen shading impacts to the vegetation and substrate.
The proposed dock will not encroach into the federal channel setback, as designated by the US
Army Corps of Engineers. At its closest point, the waterward end of the dock will be
approximately 863' landward of the edge of the Intracoastal Waterway channel. Bogue Sound is
about 13,000' wide at this point; therefore, the proposed pier length is consistent with the one -
quarter width rule for piers. As previously noted, the proposed length of the pier will not create
any impediments to navigation.
The Sprinkle dock will be located 151' on the west and 82' on the east from adjacent piers. It
will be located 40' from the adjacent riparian property line on the east and 30' from the
riparian property line on the west.
The owners also propose to level the rear sloping yard by placing fill material in an area
measuring approximately 113' in length and varying in width from 18' to 38'. The overall
average depth of the fill will be 1.75', requiring 170 cubic yards of fill material to be brought to
the site. The amount of fill within the AEC will be 3,408 cubic feet, based on an average fill
depth of 2'.
All fill will be placed in highground areas, with no fill proposed for placement in wetlands.
The fill will be contained by a retaining wall measuring 184 feet in length, located landward of
404 wetlands along the width of the property. The top of the retaining wall will be no greater
than 12" in width and will not encroach on the neighborhood drainage easement located on
the western boundary of the property. The retaining wall will include "turn backs' on either
side to prevent discharge of fill material onto neighboring properties or the drainage easement.
The turn backs will be a minimum of 15' in length at a maximum exposed height of 5', subject
to soil conditions.

The proposed pier will be accessed by a 94' x 4.5' elevated, slatted walkway located on high
ground. The walkway will connect the house with the top of the proposed retaining wall and
pier, as shown on project plans.
Total disturbed area above NHW is calculated by the project engineer to be 4,400 square feet.
No new impervious surfaces are proposed as part of this project.
Construction Methods
Conventional marine construction methodology will be employed. A barge with pile -driving
equipment will be used for construction of the docking facility. The barge will be stored in deep
water. Construction of the retaining wall and placement of fill will be accomplished with a small
track hoe, dump trunk, and front-end loader, to be stored on highground. The elevated, slatted
walkway connecting the house and top of retaining wall will be built using conventional wood
framing methods.

objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization from the State of North Carolina. Therefore, you may

1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/ne-es/mammal/manatee guidelines.pdf.
2. Dredging is not authorized.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
5. The docks and piers extending over wetlands will be elevated sufficiently (a
minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate,
or other elements of the aquatic environment.
6. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, RECEivED
relocate, or alter the structural work or obstructions caused thereby, without expense to the

7. Approval of the structure is based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
8. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.

9. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
10. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
11. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
12. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
13. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
14. The perntittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this RECEIVED

saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not

17. The permittee, upon receipt of a notice of revocation of this permit or upon its

time and. manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.

The proposed project is for the construction of a retaining wall with fill, high ground
boardwalk, and a two slip docking facility with platform, single pole jet -ski lift and two
boatlifts along Bogue Sound.
9. Narrative Description:
The Elmer and Allyson Sprinkle project is located at 243 Deep Bay Drive within Newport,
Carteret County. The site is found by following highway 24 east past the Gales Creek
Bridge. It is approximately 3,623' (.69 miles) east of the Gales Creek Bridge. You will turn
south onto the entrance road of Deep Bay subdivision (Deep Bay Drive), which is the next
road east of the Ted and Jewel Ivey property. The Ivey Property is distinguished by a black
rod iron type fence with stone columns. Turn right onto Deep Bay Drive once you pass this
area (stone columns for the Ivey Property). The property is located at the end of Deep Bay
Drive and along the North Side of Bogue Sound.
The residential property is .81 acres (35196sf) in its entirety and 11' above nhw. Bogue Sound
runs along the south side of the property. The upland vegetation mainly consists of lawn
grasses, shrubs, and oak trees. There is a 70' x 134'section (total combined wetland area) of
404 jurisdictional transitional wetlands and coastal wetlands along the 134' of shoreline on
Bogue Sound which consists of SRartina alternaflora (smooth cordgrass), Snartina patens (salt
meadow cordgrass and Juncus romerianus (black needlerush). The waters of Bogue Sound
have approximately 2.5'to 3' lunar tidal amplitude.
The Division of Water Quality classifies this area as HQW/SA Waters. This area of Bogue
Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The
Carteret County Land Use Plan classifies this area as Limited Transition with Conservation
within the AECs. Although the ICW is located approximately 1,402' from the proposed pier
there is a historic navigation channel north of the ICW that is utilized within this area. This
channel would be located approximately 539' south from the proposed development. Water
depths within this project location range from-2.1'nlw/mlw to -2.3' nlw/mlw with connecting
water depths of -2.9' plus nlw/mlw. The bottom substrate is sand. Bogue Sound is
approximately 11,528' wide at this location.
10) Proposed Development:
The applicant wishes to construct a high *round board, running perpendicular to the
shore, that would connect from the house to the proposed docking facility; install a
retaining wall with fffi, depending on location, approximately 1' to 25' landward of the
404 jurisdictional wetland area; JJWhind the retaining wall and low ano as well as

area), single polejet-skilift and two boatlifts.
Due to the shallow water depths over SAV habitat and a sandy shoaled SAV area with
water depths < -1' nlw/mlw, the applicant is proposing to construct a 4.5' x 502' pier
(from the edge of marsh), a 16' x 30' partially covered platform and two boatlifts. The
distance of all portions of the docking facility would be a maximum of 518' from the
waterward edge of marsh. In order to achieve the necessary depths to span this shallow
bottom SAV habitat, according to the applicants, the pier would need to exceed 400' from
the waterward edge of marsh. Field observations by DCM staff verified that the water
depths from 400' to 518' would maintain the required rate of 1' of fall as well as the
deeper water depths (> 2' nlw) over SAV habitat.
The applicants propose to construct a 4.5' x 100' high ground boardwalk that would
extend perpendicular from the house in a southerly direction towards Bogue Sound. It
would be elevated, slatted and wooden, and would continue over 404 jurisdictional
transitional wetlands and coastal wetlands for approximately 96'. It would be elevated a
minimum of 3' above the 404 and coastal wetland substrate. Once the boardwalk reaches
the waterward edge of marsh it would convert to a pier access.
The pier would continue south over SAV habitat and open water for 502'. Due to SAV
habitat and shallow water depths within this area, the applicants are proposing a height of
6.5' above the SAV substrate and a pilings span of 10' wide within the SAV area. The
SAV habitat appears to end approximately 410' from the waterward edge of marsh. The
pier would intersect a 16' x 30' T-head platform (which includes an 18' x 20' roofed area).
There would be a 5' x 8' single -pole jet -ski lift located along the south east side of the
proposed platform. The jet -ski lift would be stored over the proposed platform when not in
use. There would also be two 13' x 13' boatlifts located on the east and west side of the
proposed platform. The most waterward portion of the boatlifts and platform would not
exceed a maximum distance of 518' from the waterward edge of marsh. All parts of the
docking facility would be landward of the historical channel (approximately 539'
landward) and a distance of 32' from the western riparian access line and 40' from the
eastern riparian access line. There would be a total of two slips. The water depths within
the proposed slip areas are an average of -2.0' nlw/mlw with connecting water depths of -
2.9' plus nlw/mlw. There are piers along the shoreline to the west of this property that
extend farther offshore than this proposal. The pier to the west along the same shoreline is
approximately 2000' away and extends into Bogue Sound approximately 539'. The
adjacent neighbor to the west (Ivey) was also permitted for a docking facility that extended
a total length of 470' from the waterward edge of marsh. The longest pier to the east is
approximately 1,430' away and extends a maximum of 420' into Bogue Sound. The
proposed docking facility (518' from the waterward edge of marsh) would remain within
the existing pier head length if it did not exceed a maximum of 515' from the edge of
coastal wetlands, however, the SAV shoal within the applicants riparian area extends
farther than the adjacent properties, therefore the proposal of 3 additional feet (max of
518') beyond the established pier head length is proposed.

The final portion of the project would be the placement of a retaining wall and fill along
the high ground portion of the property. The applicants propose to install a 184' long x 1'
wide x 1'-5' high retaining wall, 1' to 25' (depending on location) landward (north) of the
404 jurisdictional wetlands. The wall would be stabilized by 15' long tie backs at exposed
heights of 5' depending on the soil conditions. There would be a total of 3,408 cubic feet
(fill area of 1,704 square feet) of fill material within the 75' Estuarine Shoreline AEC. All
fill material would be a distance of 50' to 60' landward of nhw as well as landward of any
404 and coastal wetlands.
11. Anticipated Impacts:
The proposed dock would shade and incorporate 1,845 ft2 of shallow -bottom SAV habitat;
shade 1,193 ft2 and incorporate 1,605 ft2 of open water (non SAV), shade 67.5 ft2 of high
marsh and 40.5 ft2 of low marsh. The boardwalk would shade and incorporate a total of
450 square feet of high ground with the retaining wall (including fill) filling a total of 1,
704 square feet of high ground. The development would provide a total of two slips. The
placement of the jet -ski lift would not be considered a permanent slip due to the fact it
would be stored over the platform when not in use. The. proposed placement of the pier,
platform and boatlifts would reduce the likelihood of prop scarring and incidental prop
dredging of the existing SAV habitat. This is due to the deeper water depths (>2' nlw)
within the proposed pier location and the shorter distance that the applicants would need to
traverse in order to reach the deeper water. This also has the potential to help preserve
SAV habitat and shoal area closer inland. The increase in suspended sediment and
turbidity levels from the pier placement would be temporary, and occur while the pier
placement is taking place and should be minimal given the bottom composition. The
location of the proposed docking facility should not be a hindrance to navigation as the
proposed development would be located 539' landward (north) of the historic navigation
channel. It is recommended to add reflectors to the proposed platform (meeting Coast
Guard Standards) for safety. The proposed pier would exceed the established pier head
length within the area by 3'; however, due to a larger shoal area within the applicant's
riparian area, the additional.3' would help conserve the shallow -water SAV habitat.

Below are the recommended conditions for the Sprinkle docking facility project (243 Deep Bay Drive) in Carteret County.
I will send out the hard -copy of these to Doug today, but wanted to get you electronic version so you can start on your
permit.
We recommend that the following conditions be included in the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The
guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.
2. Dredging is not authorized.
3. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast
Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact
the U.S. Coast Guard Marine Safety Office at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a
part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior
to implementation.
5. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the
wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment.
6. The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the
Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free
navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of
Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
7. Approval of the structure is based on determinations that there would be no obstruction to navigation. The
structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as
relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave
wash.
8. The authorized structure and associated activity must not interfere with the public's right to free navigation on
all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by
the public of all navigable waters at or adjacent to the authorized work for reason other than safety.,
9. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities
shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal
flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands.

10. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within
waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill
material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
11. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and
wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or
any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control
Act will be followed.
12. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from
an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic
materials (including debris from land clearing activities), or unsightly debris will not be used.
13. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the
authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination
procedures.
14. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit
in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated
with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of this project.

The following is my assessment and consequent recommendations of the above referenced proposal:
The property does not currently have a pier therefore the applicant has proposed a private residential 2-
slip docking facility. Because of the shallow water depths and submerged aquatic vegetation, and a
shallow shoal area, the applicants are proposing the placement of a 4.5' x 502' pier, a 16' x 30' platform
with an 18' x 20' covered area, a 5' x 8' jet -ski lift stored over the proposed platform and two 13' x 13'
boatlifts. There would be a total of 2 slips along this parcel. The proposed docking facility (includes pier,
boatlifts and platform) would extend a maximum of 518' from the waterward edge of marsh. All
portions of the development would be landward 539' of the historical channel. The development
conforms to the guidelines set forth unde115A NCAC 07H .0208 with the exception of the total docking
facility length. Although the established pier head length pursuant to 7H.208 9b)(6)(G)(i) restricts the
proposed docking facility to 515' from the waterward edge of marsh, DCM staff recommends
consideration of the additional 3' for a total of 518'. This minimal allowance would locate the
proposed platform and slip areas outside of the SAV habitat area and help preserve shallow bottom
SAV habitat from the effects of incidental prop scarring and prop wash typically associated with boats
and boat lifts. Assuming that state and federal agencies concur with the proposal, the District
recommends the project be authorized as proposed, contingent upon the following conditions:

covered by General Water Quality` Certification Number 8900 (GC '3900). This Certification allows you. to
use the General Permit.No. 198000291 permit when issued by the'US Army Corps of Engineers and the"
CAMA Major Permit When issued by the Division of Coastal Management. Irradditioni you should obtain or
otherwisecomply with any other required federal, state or local permits before you -go ahead with your
project including (but not limited to) Erosion and Sediment Control,,Non-discharge, Water Supply
Watershed, and"siormwater regulations. Also; this approval to proceed with your proposed. impacts or to
conduct impacts to waters as depicted in your application shall expire upon expiration ofthe 404 or

of this Certification, and shall provide each of Its contractors (and/or agents) a copy of this
Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B..0221. Appropriate sediment and erosion control practices must be
used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this
Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same'day as the expiration date of the corresponding
General Permit. The conditions in effect on the date of issuance of the Certification for a specific
project shall remain in effect for the life of the project, regardless of the expiration of this
Certification.
S. The permitee shall require its contractors and/or agents to comply with the terms of this permit in
the construction and maintenance of this project, and shall provide each of its contractors and/or
agents associated with the construction or maintenance of this project a copy of this certification.
A copy of this certification including all conditions shall be available at the project site during the
construction and maintenance of this project. [35A NCAC 02H .0507 (c) and 15A NCAC 02H .0506
(b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, than the Division may
reevaluate and modify this General Water Quality Certification. [35A NCAC 02H .0507(d)]
All mechanized equipment operated near surface waters or wetlands will be regularly inspected
and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic
fluids or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the
permitee/contractor shall immediately contact the Division of Water Quality, between the hours of
8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after hours and on weekends
call (800) 858.0368. Management of such spills shall comply with provisions of the North Carolina
Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A
NCAC 028.0200 (3)(f), and GS 143 Article 21A].
8, - Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3) and
(c)(3) and 15A NCAC 02B .0200 (3)(f)].

Reference the application of 'Mr. Elmer Sprinkle to construct an upland retaining wall with
fill, a high ground boardwalk and waterw rd pier (4.5' x 502'), a two slip docking facility with
platform (16' x 30'), single pole jet -ski lift (5' x 8') and two boatlifts (13' x 13) within Bogue
Sound. This project is located at 243 Deep Bay Drive, adjacent to Bogue Sound, in Newport,
Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.726802 N,-76.888153
W.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S, Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at RECEIVED

2. Dredging is not authorized.

3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the
Boa
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
5. The docks and piers extending over wetlands will be elevated sufficiently (a
minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate,
or other elements of the aquatic environment.
6. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
7. Approval of the structure is based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
8. The authorized structure and associated• activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent RECEIVED

9. Except as specified in the plans attached to this permit, no excavation, fill or DCM,MHD CIN
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
10. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
11. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,

Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
12. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
13. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
14. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
15. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter I I3A Article 4).
16. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
17. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.
18. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. RECEIVED

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located on Bogue Sound in Carteret County. The site is at 243
Deep Bay Drive in Newport, Carteret County. The application was received as complete on 12/9/14, and
appears to be adequate for processing at this time. The projected deadline for making a decision is
2/23/15. An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 12/9/14, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card

Project Narrative
Introduction
Elmer "Skip" and Allyson Sprinkle are the owners of a single-family residential property located
adjacent Bogue Sound at 243 Deep Bay Drive in the Deep Bay Subdivision in Carteret County.
They propose to construct a pier with two boatlifts and one single -pole jet -ski lift, construct a
high ground retaining wall with fill, and build a high ground walkway connecting the existing
residence with the retaining wall and pier.
Site Description
The Sprinkle property is comprised of Lot Number 1 of the Deep Bay Subdivision. The entrance
to the subdivision is located on Highway 24 in Carteret County, just east of the intersection with
Hibbs Road.
An existing single-family residence and shed are located on the property, with traditional
landscaping consisting of trees, grass, and shrubs. The shoreline along Bogue Sound measures
134 linear feet along Normal High Water (NHW) and is bordered by a fringe of coastal wetlands
measuring approximately 20' to 25' in width. A narrow area of 404 wetlands adjoins the coastal
wetlands.
NHW and coastal wetland lines were recently delineated by staff of the Division of Coastal
Management and are depicted on project plans, as surveyed by Charles A. Rawls and
Associates, PA. A jurisdictional determination by staff of the US Army Corps of Engineers has
been requested to confirm the extent of 404 wetlands as indicated on the plans.
The average high ground elevation of the property is approximately +11' NHW. The property
slopes 12%to 15% beginning approximately midway between the back of the existing residence'
and the shoreline. C
A 15' wide drainage easement for the Deep Bay Subdivision is located along the western \ j
boundary of the lot. An 8' walkway easement is located within the drainage easement. v

Submerged aquatic vegetation (SAVs) is observed in shallow waters adjacent the shoreline.
Deep water (-2' NLW/MLW or greater) is found approximately 500' offshore measuring from
the waterward edge of coastal wetlands.
An historic channel used by local residents to access deep water is visible on aerial photos of
the area. The location and orientation of the historic channel were used to determine the
riparian corridor for the Sprinkle project site and adjacent properties. The Atlantic Intracoastal
Waterway is located approximately 835' beyond the edge of the deep water historic channel.
The waters of Bogue Sound at the project site are classified as SA HC W by the Environmental
Management Commission and are open to the harvesting of shellfish. Bogue Sound is
approximately 13,000 feet wide at this location. There are no known shellfish leases adjacent to
or within close proximity of the project.
Several large single-family residential parcels are located to the west along Bogue Sound. Ted
and Jewel Ivey are the owners of the adjacent property to the west. To the east, Clyde Case III
owns Lot Number 2 of the Deep Bay subdivision.
The project area is within the Carteret County planning jurisdiction. Residences in the project
area are served by individual septic systems, with drinking water provided by West Carteret
Water Corporation.
Project Description
The owners propose to build a new fixed pier with platform, two boat lifts, and a single -pole
jet -ski lift. They also propose to place fill in the low area of the backyard and construct a
retaining wall to contain the fill. An elevated, slatted walkway is proposed for construction on
highground to connect the existing residence to the top of the retaining wall and pier.
The proposed pier will extend 502' from the waterward edge of coastal wetlands and will
measure 4.5' in width. Water depths at the waterward end of the proposed pier are a
minimum of -2' NLW/MLW. The pier will extend 72' landward from the waterward extent of
coastal wetlands to reach the top of the proposed retaining wall.
A partially roofed t-head platform measuring 16' x 30' will be located at the waterward end of
the dock. The dimensions of the platform roof are 18' x 20'.

A 13' x 13' boatlift will be placed on each side of the platform, for a total of two slips with lifts.
A single -pole jet- ski lift is also proposed for storing a personal watercraft over the platform.
This area of Bogue Sound is characterized by shallow water, shoals, and SAVs, while pier length
has traditionally been controlled by the length of existing piers that typically end in less than -2'
NLW/MLW. By constructing longer piers, boat traffic through shallow shoal/SAV areas is
avoided, thus minimizing/avoiding impacts to SAVs. The photos of a neighboring shoreline
attached to this summary, taken while standing on an adjacent existing shorter pier located in
-1' NLW/MLW, clearly show scrape marks through SAVs caused by boats attempting to
navigate the shallow water near the shoreline.
Permits were recently issued for a neighboring pier (not yet built) extending to -2' NLW/MLW.
The recently permitted pier exceeds the previous pier head line along this shoreline, yet avoids
boat traffic through SAVs. Consistent with the permitted pier, the Sprinkles' proposed pier is
located at the point requiring the shortest distance along their shoreline to reach -2'
NLW/MHW and terminates beyond SAVs, as shown on the project survey. The length and
location of the proposed Sprinkle pier is consistent with the general navigational route for
boats using this area of Bogue Sound and does not significantly extend beyond the recently
permitted pier. Compared to the old pier head line, the Sprinkles' proposed pier length reduces
impacts to resources while allowing boating access to their property.
Along the shoreline of the Sprinkle property, water depths at 400' from the waterward extent
of coastal wetlands measure -.5' at NLW/MLW. Low water depths increase to -2' or greater at
500'. As such, the proposed location and length of the Sprinkle dock complies with CAMA
standards for increased water depths for piers exceeding 400'.
The portion of the pier located waterward of NHW will be elevated a minimum of 6.5' above
any substrate with SAVs. The bottom of the pier decking over wetland substrate will be
elevated a minimum of 3'. The pilings supporting the pier will be at least 10' apart, other than
terminal instances, in order to lessen shading impacts to the vegetation and substrate.
The proposed dock will not encroach into the federal channel setback, as designated by the US
Army Corps of Engineers. At its closest point, the waterward end of the dock will be
approximately 835' landward of the edge of the Intracoastal Waterway channel. Bogue Sound is

about 13,000' wide at this point; therefore, the proposed pier length is consistent with the one -
quarter width rule for piers. The proposed length of the pier will not create any impediments to
navigation.
The Sprinkle dock will be located 151' on the west and 82' on the east from adjacent piers. It
will be located 40' from the adjacent riparian property line on the east and 30' from the
riparian property line on the west.
The owners also propose to level the rear sloping yard by placing fill material in an area
measuring approximately 113' in length and varying in width from 18' to 38'. The average depth
of the fill will be 1.75', requiring 170 cubic yards of fill material to be brought to the site. All fill
will be placed in highground areas, with no fill proposed for placement in wetlands.
The fill will be contained by a retaining wall, located landward of 404 wetlands along the width
of the property. The top of the retaining wall will be no greater than 12" in width and will not
encroach on the neighborhood drainage easement located on the western boundary of the
property. It will include "turn backs" on either side to prevent discharge of fill material onto
neighboring properties or the drainage easement.
The proposed pier will be accessed by a 72' x 4.5' elevated, slatted walkway located on high
ground. The walkway will connect the house with the top of the proposed retaining wall and
pier, as shown on project plans.
Total disturbed area above NHW is calculated by the project engineer to be 4,400 square feet.
No new impervious surfaces are proposed as part of this project.
Construction Methods
Conventional marine construction methodology will be employed. A barge with pile -driving
equipment will be used for construction of the docking facility. The barge will be stored in deep
water. Construction of the retaining wall and placement of fill will be accomplished with a small
track hoe, dump trunk, and front-end loader, to be stored on highground. The elevated, slatted
walkway connecting the house and top of retaining wall will be built using conventional wood
framing methods.
