Docking Facility
1) Unless specifically altered herein, this permit authorizes the reconfiguration of the existing docking
facility and other structures and uses that are expressly and specifically set forth in the attached
permit application and workplan drawings. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over public trust waters without permit
modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the dockingfacility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or, local permits,
approvals, or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (9 1 10).796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high 'water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
15-0204.
NOTE: The U.S. Army, Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2015-00584,,which-was issued on 3/27/15.

4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit does not authorize any additional formalized boat slips in association with this docking
facility.

8) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or. work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
9) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

package to be complete. Items (a) - (f) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish
between work completed and proposed.
c. A site or location map that is sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
d. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties.
e. The appropriate application fee. Check or money order made payable to DENR.
f. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such
owners have received a copy of the application and plats by certified mail. Such landowners must be advised that they have 30 days in

I. BACKGROUND

Under the CAMA, a third party may file a contested case hearing petition to challenge the
granting or denial of a CAMA permit to someone else only if the Coastal Resources Commission
(CRC or Commission) first determines that a contested case hearing is appropriate. N.C.G.S.
§113A-121.1(b) provides that along with being timely filed, the determination as to whether a
hearing is appropriate should be based upon a consideration of whether the petitioner:
1. Has alleged that the decision is contrary to a statute or rule;
2. Is directly affected by the decision; and
3. Has alleged facts or made legal arguments that demonstrate that the hearing
request is not frivolous.
The CRC has delegated the authority to its Chairman to determine whether a third party
request for a hearing should be granted or denied. Rule 15A NCAC 7J .0301(b). A third party
whose hearing request is granted may file a contested case hearing petition with the Office of
Administrative Hearings. N.C.G.S. § 113A-121.1(b). A third party whose hearing request is
denied may seekjudicial review. Id.

agency has made a decision that is contrary to astatute or rule. N_C.G.S_§_113A-121.1(b)(1);
Petitioner alleges that because it is an adjacent ripariagpmper_ty- owner, the Permit for the dock

complies with the CRC's riparian access rule _15A—NCAC. 7H .0208(b)(6)(I). The authorized
development is located ,from the riparian line of division which exceeds le.15' minimum
setback. Furthermore, based upon multiple visits to the site by Staff, it is the position of Staff

jeopardize the use of adjacent waters for navigation_ or for other public trust rights in public mist

Petitioner's: property has not been adversely_impacted by the docking facility authorized by the
minor modification to CAIvIA permrt #_ Accordingly Staff disagrees that Petitioner meets

B. Is the Petitioner Directly Affected by the Decision?
Yes. Petitioners contend that "Dockside WB Investments, Inc. is directly adjacent to the
Petititoner's [sic] proposed project, which directly affects and impedes the waters of Wrightsville i
Sound lying between the corporate jurisdictions of City of Wilminton and the Town of
Wrightsville Beach and directly adjacent to the Petitioenr's riparian corridor and waters. Based
upon CAMA rules, Petitoiner's additional written consent to these improvements by Seagate
Offfice Park UOA and/or Brady Semmel is regired. This consent has not beenobtained from the

No. Staff contends that Petitioner has failed to demonstrate that the hearing request is not I
frivolous as required by N.C.G.S. § I13A-121.1(b)(3).

In conclusion, Staff maintains that Petitioner has not met the criteria justifying a '
contested case hearing. For the reasons stated herein, the DCM Staff, through its undersigned
attorney, recommends that Petitioner's Third Party Hearing Request be DENIED by the
Chairman.

The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and review
all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to
be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

Dear Mr. Davis:
We represent Dockside WB Investments, LLC--the above -referenced opponent and
owner of riparian property immediately south of and adjacent to the property which is the subject
of the LAMA Major Permit Application being objected to herein.
Recently, our client received notice regarding an Application for a CAMA Major
Development Permit (the "Application"), for property located at 1310/1312 Airlie Road,
Wilmington, N.C.' by the Seagate Office Park UOA at 1310 Airlie Road, The Application
addresses a proposed relocation of a pier and other improvements (the "Project"),
By way of an initial response to the Application, my client strongly objects to the
Application and proposed project and desires to have this objection deemed timely and
considered in any deliberation on the matter and the Application. We are still investigating the
issues raised by this Application and Will Supplement this objection in due course.
r Based upon a review of the Application dated January 14, 2015, it is unclear to us who the
applicant is. The "Business Name" listed on the first page of the Application states: "Seagate
Aidie Office Parr'. The word "Seagate" is crossed through. Applicant 1 on page I is listed as
Brady Semmel. The application is signed by neither, and is signed by Ed Ryan as agent.

However, initially, my client does not waive any of Its riparian rights vested under
Statutory or Common Law of the State of North Carolina, and secondly does nW waive any of
the riparian rights accruing to my client by virtue of applicable Rules and Regulations adopted
by the Coastal Resources Co+. miFaion (the "CRC") and NCDENR-DCM and the Common Law
of this State.
Moreover, my client objects to any extension of the existing pier structures into the
public waters of Wrightsville Sound toward the corporate limits of the Town of Wrightsville
Beach ("Town'7. By copy of this letter, we are putting the Town and the City of Wilmington
("City") on Notice of our objections.
My client has significant concerns with the adverse impact that the proposed Application
will have to my client's well -established commercial use as a waterfront restaurant and marina.
The Dockside Restaurant remains one of the very few restaurants in all of Wilmington where
customers can arrive by boat and have a place to dock their boat or other watercraft while they
dine. The boat slips at the Dockside Restaurant are designated for restaurant customer use, and
the boat slips and the safety and ease of navigability of the Dockside marina in general are a
paramount concern to my client and are critical to the Dockside Restaurant, which relies heavily
on its water-dapeadent structures and boating customers for its commercial viability.
We would also note, that based upon our preliminary review, the subject property is
zoned CB (Community District) Zoning District by the City of Wilmington under Wilmington
Land Development Code ('LDC) § 1.8-194 and the Wilmington Official Zoning Map. The
Application lists that the property is zoned commercial, which is also consistent with the
development's toame ("Seagate Office Park") and the Declaration creating unit ownership
(condominium) for this property under Chapter 47A of the North Carolina General Statutes,
recorded on December 31, 1985, in Book 1313 at Page 1287, New Hanover County, and
amendments thereto, which Declaration appears to restrict the property to commercial use (See
Article V., Use Restrictions, Section A) ("Each unit is hereby restricted to the business use by
the owner hereof, ... "). The First Amendment to the Declaration recorded on July 18, 1997, in
Book 2212 at Page 456 of the New Hanover County Registry, also states in Section 1 that
"Seagate Office Park is a commercial use condominium ...."
At a recent Public Hearing in the City of Wilmington, Dr. Semmel stated that he Is a
residen of the subject property, which we understand is his primary residence.
The Wilmington LDC allows residential uses only in limited instances in the CB District,
and only then under prescribed conditions, generally either as part of an approved Commercial
District Mixed Use ("CDMU") project under Wilmington LDC § 18-257, of as a qualifying
residential unit contained within a principal use under Wilmington LDC § 18.299. See
Wilmington LDC § 18-194(c). We are not aware of any approvals by the City of Wilmington for
this property as a CDMU project in a CB District under Wilmington LDC § 18-257. We are also
not aware of circumstances that would qualify this property as a residential unit contained within
a principal use under WRtaimgton LDC § 18-299, but an analysis of this would require a fairly

detailed site inventory to determine if the 50% floor area ratio is not exceeded, wbetber there is
sufficient off-street parking, whether there is additional open space provided on the property, and
other criteria under Wilmington LDC § 18-299. It is our understanding that other persons are
residing in other units within the Seagate Office Park. As you know, this is important because,
among other reasoas,.North Carolina Administrative Code, Title 15A. Environment and Natural
Resources, Chapter 07. COASTAL MANAGEMENT, Subchapter H. STATE GUIDELINES
FOR AREAS OF ENVIRONMENTAL CONCERN, provides in relevant part as follows:
§ 0711.0601. NO VIOLATION OF ANY RULE
No development shall be allowed in any AEC which would result in a
contravention or violation of any rules, regulations, or laws of the State of
North Carolina or of local government in wbich the development takes
place.
Rule 07H .0601.
Accordingly, we object to the Application on these grounds as well, and by copy of this
letter to the City of Wilmington, we are requesting that the City of Wilmington Code
Enforcement inquire into the zoning compliance status of the subject property for a residential
use in a CB Zoning District. We reserve the right to supplement this objection depending upon
the outcome of City Code Enforcement's inquiry. We note also that even if the residential use of
this property is deemed to be a valid nonconforming use, my client would continue to object to
the Application on the ground of a potentially impermissible expansion or modification of a
nonconforming use. Additionally, the application lists the proposed use as "private" rather than
"commercial". No zoning compliance certificate is attached to the Application.
At your convenience, we would appreciate the opportunity to meet with you or Ms.
Debbie Wilson to address the findings of our investigation of this pier structure associated with
Seagate Office Park, which is a commercial structure and use and not a residential use.

1) Unless specifically altered herein, this permit authorizes the reconfiguration of the existing docking
facility and other structures and uses that are expressly and specifically set forth in the attached
permit application and workplan drawings. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility without permit modification. No non water
dependent uses of structures shall be. conducted on, in or over public trust waters without permit
modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
Permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or Signed by the authority of the secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission,

3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party. '
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6) The permittee shell install and maintain at his expense any signal lights or signals prescribed by the U.S,
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit does not authorize any additional formalized boat slips in association with this docking
facility.
General
8) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
9) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) the permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

dependent activities are not authorized within 30 feet of the normal high water level.

We have processed the renewal request for Mr. Holding's permit, so hopefully we will have it reissued soon. As
discussed, we are onboard with your latest proposal under a letter of refinement once this permit is reissued.
We are not sure about why you or Mr. Semmel did not receive a copy of the permit when issued, but we will look into it.
As discussed, this was during the transition when Jonathan Howell and Daniel Govoni with the Major Permits Section
moved into new positions, so Doug Huggett was very shorthanded. Also, this permit was appealed so there was a lot of
effort from staff through the assistance of our attorney to defend our decision to issue the permit. As you are aware,
the 3rd party appeal was denied. Attached is a copy of Mr. Semmel's permit and we look into having the original sent to
the applicant for his signature.

right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of
this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance

The Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major
Permit Application for the subject project on February 18, 2015. Staff review of the plans and specifications has determined
that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management
permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to
the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have
an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with
the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

Through coordination with the North Carolina Division of Coastal Management we have learned of your request
to reconfigure an existing docking facility for the Seagate Office Park UOA located at 1310 and 1312 Airlie Rd. along the
AIWW in Wilmington, New Hanover County, North Carolina. Coordinates: 34.245906 N,-77.815505 W.
Your project has been assigned the Action ID: SAW-2015-00584. Please reference this for any future
correspondence.
On January 1, 2011, we renewed general permit No. 197800056, (copy attached), that authorizes the maintenance,
repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and
breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of
the Rivers and Harbors Act of 1899.
Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed
general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the submitted plans and the
plans received on 23 February, 2015, which are a part of this permit.
Please read the attached permit to prevent an unintentional violation of Federal law. As this Department of the
Army regional general permit does not relieve you of the responsibility to obtain any other required approvals, you
should contact appropriate State and local agencies before beginning work. All special conditions and all applicable
general and regional conditions must be strictly adhered to in order for this authorization to remain valid. The
expiration date of this permit is 31 December, 2016.

Recommendations for State Permit — Seagate Office Park c/o Brady J. Semmel 2/1712015
It is the.staffs recommendation that the proposal to reconfigure the existing docking facility is CONSISTENT with
the Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas and with the use standards set forth in
NCAC 07H .0208(b)(6), including the %width rule; the USACE AI WV setback requirement and the adjacent 15'
riparian corridor setback requirement and would continue to provide docking space for up to seven (7) vessels. This
office has no objection to the proposed work, provided it is consistent with all other state and federal permitting
requirements. Any permit issued should include the following conditions:
This permit authorizes only the docks, piers, and other structures and uses located in or over the waterthat
are expressly and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of the structure without permit modification. No non -water
dependent uses of structures may be conducted on, in, or over public trust waters without permit
modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with
navigation and shall not exceed the established pierhead line.
4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S.
Coast Guard, through regulations or otherwise, on authorized facilities.
5. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
6. This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure orwork, or injurywhich
may be caused from existing or future operations undertaken by the United States in the public interest.
7. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third -party.
8. This permit continues to authorizes a maximum of seven (7) boat slips. At no time shall more than seven
(7) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all
marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft.
9. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or
'authorization which may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact a
representative of the Division at 91.0-796-7215 prior to the commencement of any such activity for this
determination.
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with
the docking facility. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be subject
to frequent wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking
all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold
the State of North Carolina or the United States liable for any damage to the structure or moored boats.

9. PROJECT DESCRIPTION:
The project site is located at 1310-1312 Airlie Road in Wilmington, New Hanover County. To locate the
project site from the WiRO take US Hwy 74/76 towards Wrightsville Beach. Turn right onto Airlie Road just
before the drawbridge to Wrightsville Beach and travel approximately 0.1 mile until you reach the property of
interest, which will be located on the left. The property is located at the confluence of the AIWW and Motts
Channel within Greenville Sound.
The property is approximately 0.19 acres in size, which is located on the east side of Airlie Road and has an
average elevation of approximately 5 feet above normal high water (NHW). Highground development on the
project site includes a five (5) unit condominium buildings uncovered decking, timber bulkhead and a
floating dock system, which currently accommodates up to seven (7) slips. The entire project site has
approximately 133 linear feet of shoreline frontage stabilized by a timber bulkhead. Upland vegetation
consists of ornamental landscaping. There are currently no coastal wetlands along the property.
The previous owner (J.B. Gerald) obtained State Permit No. 84-84 in 1984, which authorized the excavation
of the existing boat basin and the placement of fill onto the property for the construction of an office building
and the construction of a docking facility. State Permit No. 84-84 was modified in 1985 forthe construction
of a new bulkhead. An access ramp leads from the highground on the southern end of the property onto an
existing floating dock, measuring approximately 102' in length by 6' in width, which runs parallel to the
existing bulkhead. There are four (4) floating finger piers extending towards the AIWW from this main
floating dock. Two (2) measuring approximately 31' in length by 4.5' in width located on the northern end,
one measuring approximately 16' in length by 4.5' in width located in the center portion and one measuring
approximately 50' in length by 5' in width located on the southern end, which includes another floating dock,
measuring approximately 16' in length by 5' in width located on the landward end of this floating dock,
creating an "L-shaped" configuration. The existing docking facility currently accommodates up to seven (7)
vessels within water depth of approximately -60' @ normal low water (NLW).
There is an existing timber breakwater, measuring approximately 60' in length, which extends perpendicular
from the shoreline at the southern property boundary and shared riparian line. The adjacent riparian
property to the south is a commercial restaurant business (dba Dockside Restaurant), which maintains a
floating dock system currently accommodating approximately 22 transient vessels. There is an existing
docking facility serving the property owner to the north (M. Lopez), which crosses the northern riparian line
(See Sheets 1 through 3 of 5 and Project Narrative).
The New Hanover County and the City of Wilmington 2006 Joint Land Use Plan classifies adjacent waters
and high ground area of project site as Conservation. There are no known archaeological sites located in
the project vicinity. The waters of the AIWW and Motts Channel.are classified SB by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to reconfigure existing boat slips within shared docking facility. The application
states that the existing floating dock, measuring approximately 50' in length by 5' in width would be moved
approximately 4' towards the north and the existing floating dock, measuring approximately 16' in width by
4.5' in width would be relocated to the waterward end of this floating dock with final dimensions of 64.4' in
length by 5' in width. The application states the new configuration would continue to accommodate slip #1
and #2 of the shared docking facility within water depths of approximately -6.0'@ NLW) (See Sheets 4 and
5 of 6 and Project Narrative).

10. ANTICIPATED IMPACTS:
The proposed new floating dock configuration would incorporate approximately 325 sq. ft. of additional
Public Trust Area and Estuarine Waters; however, this too is currently usurped by the existing floating dock
system. The new configuration would continue to accommodate up to seven (7) vessels within water depths
of approximately -6.0' @ NLW. The proposed new docking facility would extend approximately 70' into a
waterbody measuring approximately 470' across and would not encroach into the USACE AIWW setback
requirement nor the adjacent 15' riparian corridor setback requirement. It should be noted that portions of
the reconfigured floating dock would not encroach into the 15' riparian corridor setback requirement;
however, existing portion, measuring approximately 16' in length by 5' in width to remain does encroach. It
does not appear the proposed reconfiguration would hinder the navigation of the established adjacent
docking facilities. Minor increases in4urbidity should be expected during construction.

The enclosed CAMA Major Permit application for A*t4 Vffice Park c% Dr.
Brady Semmel, 131011312 Airlie Road, Wilmington, N.C. 28403, proposes to
relocate an existing 5'x50' floating dock four feet north of its existing
location, remove an existing 55(16' floating finger dock and relocate to the
end of the existing 5'v50' dock and replace the guide pilings.
No addition to the existing facility are proposed and no additional slips are
proposed.
The proposed dock renovations are only to provide easier dockage for the
applicants' vessel.

Dear Mr. Semmel,
You have our approval, in accordance with the attached conditions to reconfigure existing boat slips
within an existing shared docking facility as described in your application received by the N.C. Division
of Water Resources (DWR) on February 20, 2015. After reviewing your application, we have decided
that the impacts are below the threshold for written authorization as long as all conditions of General
Water Quality Certification Number 3883 (GC3883) are met. This certification may also be viewed on
our website at http://portal.ncdenr.orgLweb/wA/swp /ws/401 /certsandpermits. This Certification allows
you to use the Regional General #197800056 Permit when issued by the US Army Corps of Engineers.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the
future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions of Certification:
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
Certificate of Completion to the 401/Wetlands Unit, North Carolina Division of Water Resources,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms
to Chapter 150B of the North Carolina General Statutes to -the Office of Administrative Hearings,

and binding unless you ask for a hearing.

Dear Mr. Davis:
We represent Dockside WB Investments, LLC—the above -referenced opponent and
owner of riparian property immediately south of and adjacent to the property which is the subject
of the CAMA Major Permit Application being objected to herein.
Recently, our client received notice regarding an Application for a CAMA Major
Development Permit (the "Application"), for property located at 1310/1312 Airlie Road,
Wilmington, N.C.' by the Seagate Office Park UOA at 1310 Airlie Road, The Application
addresses a proposed relocation of a pier and other improvements (the "Project').
By way of an initial response to the Application, my client strongly objects to the
Application and proposed project and desires to have this objection deemed timely and
considered in any deliberation on the matter and the Application. We are still investigating the
issues raised by this Application and will supplement this objection in due course.
1 Based upon a review of the Application dated January 14, 2015, it is unclear to us who the
applicant is. The "Business Name" listed on the first page of the Application states: "Seagate
Airlie Office Park". The word "Seagate" is crossed through. Applicant 1 on page 1 is listed as
Brady Semmel. The application is signed by neither, and is signed by Ed Flynn as agent.

However, initially, my client does not waive any of its riparian rights vested under
Statutory or Common Law of the State of North Carolina, and secondly does not waive any of
the riparian rights accruing to my client by virtue of applicable Rules and Regulations adopted
by the Coastal Resources Commission (the "CRC") and NCDENR-DCM and the Common Law
of this State.
Moreover, my client objects to any extension of the existing pier structures into the
public waters of Wrightsville Sound toward the corporate limits of the Town of Wrightsville
Beach ('Town'). By copy of this letter, we are putting the Town and the City of Wilmington
("City") on Notice of our objections.
My client has significant concerns with the adverse impact that the proposed Application
will have to my client's well -established commercial use as a waterfront restaurant and marina.
The Dockside Restaurant remains one of the very few restaurants in all of Wilmington where
customers can arrive by boat and have a place to dock their boat or other watercraft while they
dine. The boat slips at the Dockside Restaurant are designated for restaurant customer use, and
the boat slips and the safety and ease of navigability of the Dockside marina in general are a
paramount concern to my client and are critical to the Dockside Restaurant, which relies heavily
on its water -dependent structures and boating customers for its commercial viability.
We would also note, that based upon our preliminary review, the subject property is
zoned CB (Community District) Zoning District by the City of Wilmington under Wilmington
Land Development Code ("LDC") § 18-194 and the Wilmington Official Zoning Map. The
Application lists that the property is zoned commercial, which is also consistent with the
development's name ("Seagate Office Park") and the Declaration creating unit ownership
(condominium) for this property under Chapter 47A of the North Carolina General Statutes,
recorded on December 31, 1985, in Book 1313 at Page 1287, New Hanover County, and
amendments thereto, which Declaration appears to restrict the property to commercial use (See
Article V., Use Restrictions, Section A) ("Each unit is hereby restricted to the business use by
the owner hereof, ...."). The First Amendment to the Declaration recorded on July 18,1997, in
Book 2212 at Page 456 of the New Hanover County Registry, also states in Section 1 that
"Seagate Office Park is a commercial use condominium ...."
At a recent Public Hearing in the City of Wilmington, Dr. Semmel stated that he is a
resident of the subject property, which we understand is his primary residence.
The Wilmington LDC allows residential uses only in limited instances in the CB District,
and only then under prescribed conditions, generally either as part of an approved Commercial
District Mixed Use ("CDMU") project under Wilmington LDC § 18-257, or as a qualifying
residential unit contained within a principal use under Wilmington LDC § 18-299. See
Wilmington LDC § 18-194(c). We are not aware of any approvals by the City of Wilmington for
this property as a CDMU project in a CB District under Wilmington LDC § 18-257. We are also
not aware of circumstances that would qualify this property as a residential unit contained within
a principal use under Wilmington LDC § 18-299, but an analysis of this would require a fairly

detailed site inventory to determine if the 50% floor area ratio is not exceeded, whether there is
sufficient off-street parking, whether there is additional open space provided on the property, and
other criteria under Wilmington LDC § 18-299. It is our understanding that other persons are
residing in other units within the Seagate Office Park. As you know, this is important because,
among other reasons, North Carolina Administrative Code, Title 15A. Environment and Natural
Resources, Chapter 07. COASTAL MANAGEMENT, Subchapter H. STATE GUIDELINES
FOR AREAS OF ENVIRONMENTAL CONCERN, provides in relevant part as follows:
§ 07H .0601. NO VIOLATION OF ANY RULE
No development shall be allowed in any AEC which would result in a
contravention or violation of any rules, regulations, or laws of the State of
North Carolina or of local government in which the development takes
place.

Accordingly, we object to the Application on these grounds as well, and by copy of this
letter to the City of Wilmington, we are requesting that the City of Wilmington Code
Enforcement inquire into the zoning compliance status of the subject property for a residential
use in a CB Zoning District. We reserve the right to supplement this objection depending upon
the outcome of City Code Enforcement's inquiry. We note also that even if the residential use of
this property is deemed to be a valid nonconforming use, my client would continue to object to
the Application on the ground of a potentially impermissible expansion or modification of a
nonconforming use. Additionally, the application lists the proposed use as "private" rather than
"commercial". No zoning compliance certificate is attached to the Application.
At your convenience, we would appreciate the opportunity to meet with you or Ms.
Debbie Wilson to address the findings of our investigation of this pier structure associated with
Seagate Office Park, which is a commercial structure and use and not a residential use.
