Docking Facility 1) Unless specifically altered herein, this permit authorizes the additional boathouse to the existing docking facility and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Roper, Jr. Permit # 07-15 Page 2 of 3 AIDIDITIONAL CONIDITIONS 3) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit does not authorize any additional slips. General 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. The permittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar Pamlico River Basin. Linwood W. Roper, Jr. Bayview Beaufort County Proiect settin¢ The project site is located off SR 1746 at 2187 Bayview Road, in the Bayview Subdivision on the Pamlico River, near the Town of Bath in Beaufort County, North Carolina. The lot is approximately 0.5 acres (23,000 ftZ) in size and has approximately 123 linear feet of shoreline. Man- made features on the lot include a single-family residence, bulkhead with rip rap on the waterward side, 120' long pier with a ±20' by ±20' L-head platform, ±16' by t16' platform adjacent the bulkhead, ±12' by ±12' uncovered boatlift and a single -pile Personal Watercraft Lift. The water depth at the waterward end of the boatlift is 5.0' below Normal Water Level. The existing shaded impact is approximately 1,376 ftz. Landward of the existing bulkhead the elevation gradually slopes upward to an approximate elevation of ±15' above the normal water level. The lot is mostly vegetated with pines, mixed hardwoods, lawn grasses and ornamental shrubs. Both adjacent properties on the upstream (west) side and downstream (east) side are developed lots. A residence with a riprap shoreline are located on both adjacent properties. The upstream (west) property has a 300' long pier while the downstream (east) side has a badly damaged pier and boathouse. Both the adjacent properties are similarly vegetated with pines, mixed hardwoods, lawn grasses and ornamental shrubs. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is Coastal Waters and is not open to shell fishing. Proiect description The applicant proposes to attach a 10' wide by 26' long (drip line) touchless boat cover to the existing boatlift pilings creating a boathouse. The total platform shaded impact will be 916ft2 and with 123' of shoreline the applicant is allowed 984 ft2. Anticipated impacts The installation of the touchless boatcover will result in an additional 260ft2 of shaded impact. Roper, Jr. Bayview Beaufort County Linwood Roper has submitted a CAMA Major Permit application request for the attachment of a 10' wide by 26' long touchless boat cover (roof) to existing boatlift pilings to create a boathouse at his property, located off SR 1746 at 2187 Bayview Road in the Bayview Subdivision, on the Pamlico River near the Town of Bath in Beaufort County, North Carolina. I have reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet." The applicant has 123 linear feet of shoreline which provides a maximum shaded impact of 984 ft. The applicant is proposing 916 ftz of shaded impact. Staff recommend the following conditions be included if the project is permitted. 1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 4. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 5. This permit authorizes a maximum of two boat slips.
