This is in reference to your request, acting on behalf of Porters Neck HOA to modify State Permit No.117-
15, which was originally issued on October 16, 2015 authorizing enhancing an existing community common areas
located at 8344 and 8540 Bald Eagle Lane, adjacent to Middle Sound in New Hanover County. State Permit No.
117-15 is due to expire on December 31, 2018.
The action proposed in this submittal is additional New Hanover County required landscaping, one (1)
additional kayak storage rack and replacement of timber railroad ties at the terminal end of existing boat ramp at the
community boat ramp site located at 8540 Bald Eagle Lane. The proposed action also includes one (1) additional
kayak storage rack with additional landscaping and the construction of access steps approximately 6' in width with 2e
x 6° pressure treated lumber to be constructed waterward of the authorized bulkhead towards the water for ease of
kayak launch/access at the community park/picnic area located at 8344 Bald Eagle Lane.
Upon reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and
intent of the permit. This Letter of Refinement authorizes the modification of State Permit No. 117-15 as described
in your plans dated receive by our office on January 19 and 22, 2016. By copy of this letter we are also notifying the
U. S. Army Corps of Engineers and the New Hanover County Inspections Department of our action. Please note this
refinement does not alleviate the need to obtain any other local, state or federal permits.

PNHOA requests a modification to CAMA permit #117-15 to include the following minor
enhancements and repairs.
Community Boat Ramp - 8540 Bald Eagle Lane
1. Add County required landscaping (NHC Building Permit and Drawings (Attachment A)
2. Add 1 additional kayak rack, 9 storage capacity (Attachment B)
3. Replace rotted and broken boards/railroad ties at end of riprap adjacent to boat launch
area (Attachment C)
Park/Picnic Area - 8344 Bald Eagle Lane
1. Add 1 additional kayak rack,9 storage capacity (Attachment B)
2. Add 6' wide wooden steps and kayak launch (built with 2"x6" pressure treated lumber)
off encapsulated seawall to ease kayak from top of seawall to ground below. No marsh
grass will be disturbed with this build (Attachment D)
3. Add landscaping at entrance and to shield kayak racks from street. Landscaping will
included a combination of deciduous, evergreen shrubs and grasses. (Attachments D&E)
Jimmy North of Coastal Marine Contractors will complete the marine contracting work and
Gunnell Landscaping will complete both landscaping projects. Attachments include updated
scope of work.

The Community Boat Ramp located at 8540 Bald Eagle Lane is owned by Porters Neck
Homeowner's Association (PNHOA) for the benefit and use of its residents. This waterfront
lot, zoned R20 — special use — Community Boat Ramp, is adjacent to the Intracoastal
Waterway in a residentially zoned area in northern New Hanover County. This lot received a
CAMA Permit (#117-15) to make repairs and enhancements to its facility. The PNHOA
Community Boat Ramp is a peaceful, shady, picturesque park -like lot with mature trees and
grass. The grassy lot contains a small parking lot (1125 sq.ft) and driveway, sandy beach,
docks, boat ramp, rip rap, bike rack, bench, mature trees and pampas grasses. The lot is used
for boating, water recreation and park/picnic recreation.
The lot size, .4535 acres, is only 60' wide which is significantly narrower than its residential
neighbors. 9 mature trees and 3 mature clumps of grass live within the property boundaries.
There is no electricity or irrigation. The northern and southern riparian owner's side yard
buffers overhang well into the lot. Along the north side yard property line (riparian owner,
James and Theresa Wicker), are overhanging plantings which include 6 mature trees (live oak
and other), 4 mature crape myrtles, and 24 mature holly trees along a concrete wall which
reaches 15'ta11. Along the south side yard property line, (riparian owner Mr. and Mrs. William
Norman) is a 6' fence, extending the length of our property, with a 16+' buffer of overhanging
of trees, wax myrtles and other shrubs growing over and through the fence. RECEIVED

Street Yard

Streetyard area calculation: Streetyard factor x linear street frontage of the property less the
road fronting width of the driveway = 12 x (60% 35') = 300 square feet. The minimum 300
square feet will be separated by the driveway into 2 sections: North streetyard - 200+ square
feet and South streetyard —100+ square feet. A major consideration for recommending the
following plantings listed below is there is no irrigation system in place to help establish these
new plantings or maintain them once established. These plants have been selected by the
PNHOA Landscaping Committee for hardiness and tolerance to seaside conditions. Thesj�ECEIVED

plants are already on site or on neighboring properties. The intent is to continue an appearance
that has always been there and incorporate the look of each neighbor's property.
1) North side of entrance: Planting bed minimum of 20ft. by 1 Oft: 6 yaupon hollies, 1 yucca,
10 cast iron, 12-15 liriopes and mulch. This street yard bed would incorporate the 18 foot
maple tree growing in this location.
2) South side of entrance: Planting bed minimum of 1 Oft. by 1 Oft: 3 yaupon hollies, 1 yucca,
8 cast iron plants and mulch.
Parking Lot
PNHOA would like the following waiver considered for the parking lot landscaping
requirements. The landscaped lot is intended for recreational purposes and unlike traditional
commercial property the parking lot is is used seasonally and intermittently. In addition, there
is only 10' of grassed area between the north edge of the parking lot to the property line.
Along this property line is Mr. and Mrs. Wicker's concrete wall with mature hollies. This 10'
of width is also used as a walkway for pedestrians (as the parking lot and driveway are
surrounded by linked bollards to prevent cars and boat trailers from driving and parking on the
grass). This area is also intended to be a safe pathway for residents to retrieve their stored
kayaks and walk to the beach area for launching. Planting trees required to meet the
landscaping requirements would impede this pedestrian use. Also, any plantings in this area
would be next to the concrete wall and would not serve the purpose of a barrier. There is 1
mature crape myrtle tree on the west side of the parking lot. Our plan (3) below is to plant a
matching crape myrtle and tie the two together with a connected mulched bed. In addition,
PNHOA requests permission to paint parking lines to designate parking spaces on the concrete
parking pad.
Waivers - Section 62.3(A)
The County Zoning Administrator may waive all or part of the requirements of this section for
any facility which is limited to periodic or intermittent use for vehicular parking lots for
churches or recreation facilities, provided New Hanover County Zoning Ordinance Page 141
the facility is completely covered by grass or otherwise presents a landscaped effect.
3) Parking lot screen: 1 additional crape myrtle to match the one in place and mulch to create
a planting bed and aid in soil retention and foster root growth. One pampas grP t 6 E I V E D

Kayak Racks

Approved CAMA permit #117-15 includes the build of 2 kayak racks to hold 9 kayaks each.
These two freestanding kayak racks (6'x 10' each) will be constructed using pressure treated
lumber in an area, roughly IO'x 26,' designated on the attached survey. The racks will be
placed and leveled on the grass. These racks will be screened from the road by 2 pampas
grasses, 1 existing and 1 new, as indicated in (3) above.
Side Yard Buffer

We ask for consideration to leave the north and south side yard buffers as is. The lot is quite
narrow and there are 9 mature trees and 3 mature pampas grasses already growing. A
stormwater rip rap takes up over half the length of the south side and the lot's elevation is
lower than the street. With the shady and picturesque overhanging limbs of each neighbor's
side yard trees, additional trees and plantings on our lot would not grow well. Shade, mature
root systems, poor soil and storm water runoff would inhibit the growth of new plantings. In
addition, the south side of the driveway is less than 20' from the property line. This driveway
is used by residents with boats and trailers and constant pruning of existing trees, to prevent
damage to both tree and boat, is ongoing.
The north side yard already benefits from existing mature trees on the lot and the riparian
neighbor's 4 overhanging crape myrtles, mature oaks and other mature deciduous trees planted
just over and along our property line. Any additions to this existing row of trees would impair
their growth.
Although the work should not disturb existing trees PNHOA will comply to the following (6),
(Section 62.6 page 143 of the NHC Zoning Ordinance) with regards to tree protection:
(6) Note on plan stating that prior to any clearing, grading or construction activity, tree
protection fencing will be installed around protected trees or groves of trees. And no
construction workers, tools, materials, or vehicles are permitted within the tree
protection fencing.
