I W VV...1 PVY YVIY. 1) Unless specifically altered herein, this Minor Modification/Renewal authorizes the modifications to the upland development and nine (9) foot extension of the boat ramp, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional Iand disturbing activities and/or construction may require a modification of this permit, Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. 2) The two relocated; benches, the fresh water faucet, and dog waste station depicted on Sheet 1 of 2 shall be located a minimum thirty (30) feet from normal high water at the time of construction. 3) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. (See Attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: Permittee is encouraged to implement measures to insure that users of the ramp do not trespass on adjacent private properties. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Wilson y w DCM District Manager, Wilmington DATE: August 13, 2018 SUBJECT Permit Modification Request to State Permit #117-15 8344 and 8540 Bald Eagle Lane Wilmington, New Hanover County Mr. John Starling, with the Porters Neck Board of Directors, is requesting a minor modification to State Permit #117-15 on behalf of the Porters Neck Home Owners Association (PNHOA). State Permit #117-15 was issued on October 16, 2015, authorizing the replacement of floating docks, extension of the existing boat -ramp, excavation within the boat -ramp area to the AIWW, and a new bulkhead, adjacent to the Intracoastal Waterway at 8344 and 8540 Bald Eagle Lane, near Wilmington, New Hanover County. State Permit #117-15 is due to expire on December 31, 2018. Mr. Starling is requesting a modification to State Permit # 117-15 to allow for modifications to the existing community boat ramp (Site A) located at 8540 Bald Eagle Lane, and to the existing park (Site B) located at 8344 Bald Eagle Lane. Modifications to Site A include the placement of a new concrete slab, maintenance dredging, and landscaping. The precast concrete slab would measure 9' by 15' and placed at the end of the existing boat ramp at a water depth of -2' Normal Low Water (NLW) (see Site Plan A). The applicant states that maintenance dredging at Site A would comprise of removing 520 cubic yards of sand to reach -2' NLW within the original approved dredge footprint (see Site Plan B). Dredging would occur outside the April 1 — October 1 moratorium and excavated material would be deposited on authorized spoil island 0228. The applicant proposes upland disturbance associated with the planting of one tree, approximately 50 medium shrubs, 26 small shrubs, sod, fencing, and the installation of sprinkler and drip irrigation systems (see Sheet 1 and 2 of 2). The applicant proposes to install a concrete entrance drive measuring 8.5' wide and 80' long (see Sheet 1 and 2 of 2). The applicant has submitted a check (check No. 1991) in the amount of $100 for the modification request along with the letters and proof of notification to the adjacent riparian property owners. As proposed, this office has no objection to the proposed project modification as long as there are no objections from the other agencies to this proposal. It appears that the project continues to be CONSISTENT with the use standards set forth in 15A NCAC 07H .0206 and 15A NCAC 0711.0209. Nwth Caroima 28405 910.796.7215 01 Porters Neck Homeowners Association (PNHOA) PNHOA Marine Facilities Maintenance and Improvement Project Narrative -Revision 1 July 16, 2018 Porters Neck Plantation is a private community of 600+ homes tucked away peacefully near the Intracoastal Waterway in Wilmington, NC. The community boasts many amenities but its two main features are the secure commu- nity boat ramp and pier and waterfront park. Residents can enjoy fishing, swimming, outdoor recreation and have direct access to the Atlantic Ocean and numerous picturesque creeks and marshes by paddle craft and boat. This modification request to Permit #117-15 began in early December of 2017 with a request for modification to extend the boat ramp by 8' because of washout occurring from boats requiring power to place on trailers. Following several e-mail exchanges, a field meeting was held with Courtney Spears on March 11, 2018 at the boat ramp site. The information below reflects that discussion. The neighbors to each site and the Porters Neck Quality of Life Association have been notified by registered mail. Site A — North Site — 8540 Bald Eagle Lane — Zoned R-20S -Community Boat Ramp 1. Extend boat launching ramp Prepare one 9'x15' slab that will be poured on the current ramp and above water. Clean off the current ramp of silt and prepare the area for installation of new slab. Slide the slab into place and confirm that the depth at the end of the extended ramp will be 2' at normal low tide. We understand this will not be considered "in water" work and is therefore not subject to the moratorium 2. Maintenance Dredging Dredge 520 cubic yards of sand to return to 1992 and 2015 water depth levels and allow floating docks to float over 2' normal low tide depth as per original and current permit, removing time shifted sands and restore boat ramp area to its usefulness. This 2' normal low tide depth area was reviewed and confirmed by Courtney Spears field visit late afternoon on 03/11/2018. Sand will be excavated via a bargee mounted backhoe and will be barged and deposited on spoil island 0228 — Northeast New Hanover Conservancy. We understand this dredg- ing is subject to the April 1-October 1 moratorium 3. Landscaping Plant one tree, approximately 50 medium shrubs, 26 small shrubs and decorative ground cover to improve the appearance of the boat ramp from the road. The type of plants are included in the drawings but will be deter- mined by availability. Place a fence behind the plantings for additional privacy and to be the anchor for the locked swinging gate entrance for ingress and egress control. The fence may be phased later than the landscap- ing due to budget constraints. Install a sprinkler system for irrigation of the current grass areas, a drip irrigation system for watering newly planted shrubs or trees and a lockable fresh water tap near the parking area for watering and equipment rinsing. This proposed project to the ramp would increase the number of users, escalating the noise level and traffic volume. At the current time, patrons arrive in early hours of the morning, 5a.m. swinging the gate open, arming their vehicle alarms, screeching their tires down the ramp, and closing their car doors. In the middle of the day, they pull their boats for periods of time obstructing traffic in front of our driveway. The amount of unauthorized users is extremely high on holidays - Good Friday, Mother's Day, and Father's Day. Documentation of all named occurrences above can be provided to your office for reference. As a private residence and neighbor to the Porters Neck Boat Ramp, we kindly ask you to not approve the permit for the modifications to this ramp. The community boasts many amenities but its two main features are the secure commu- nity boat ramp and pier and waterfront park. Residents can enjoy fishing, swimming, outdoor recreation and have direct access to the Atlantic Ocean and numerous picturesque creeks and marshes by paddle craft and boat. This modification request to Permit #117-15 began in early December of 2017 with a request for modification to extend the boat ramp by 8' because of washout occurring from boats requiring power to place on trailers. Following several e-mail exchanges, a field meeting was held with Courtney Spears on March 11, 2018 at the boat ramp site. The information below reflects that discussion. The neighbors to each site and the Porters Neck Quality of Life Association have been notified by registered mail. Site A —North Site — 8540 Bald Eagle Lane — Zoned R-20S -Community Boat Ramp 1. Extend boat launching ramp Prepare one 9'xl5' slab that will be poured on the current ramp and above water. Clean off the current ramp of silt and prepare the area for installation of new slab. Slide the slab into place and confirm that the depth at the end of the extended ramp will be 2' at normal low tide. We understand this will not be considered "in water" work and is therefore not subject to the moratorium 2. Maintenance Dredging Dredge 520 cubic yards of sand to return to 1992 and 2015 water depth levels and allow floating docks to float over 2' normal low tide depth as per original and current permit, removing time shifted sands and restore boat ramp area to its usefulness. This 2' normal low tide depth area was reviewed and confirmed by Courtney Spears field visit late afternoon on 03/11/2018. Sand will be excavated via a barge mounted backhoe and will be barged and deposited on spoil island 0228 — Northeast New Hanover Conservancy. PROJECT DESCRIPTION: The project sites are located at 8344 and 8540 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the properties from Market Street (NC Highway17), turn right onto Porters Neck Road and continue east through the traffic circle approximately miles. At the stop sign, turn left onto Bald Eagle Lane and travel north approximately 0.2 miles and the first property at 8344 Bald Eagle Lane (Site B) will be located on the right. To access the second property (Site A), continue to travel approximately 0.5 miles until you reach the property of interest, which will also be on the right. Porters Neck HOA, Inc. obtained State Permit No. 57-92 on 8/14/1992 for the development of the existing sites and associated structures described below. State Permit No. 57-92 was modified on 2/15/1993 to reconfigure the authorized docking facility towards the south. The authorized development and associated structures were constructed and have been in use by the applicant since. State Permit No. 57-92 expired on December 31,1995. Site A is the northern project site, which is approximately 0.44 acres and ranges approximately 3' to 18' above normal high water (NHW). The property is currently being utilized for a community boat -ramp with associated parking area, access pier and floating docks with approximately 60' of shoreline, which is bordered by an intertidal strip of sand approximately 24' in width. There are currently no Coastal Wetlands along the shoreline of the property. There is an area of rip -rep along the southern side of the property, which appears to address stormwater off the highground area of the site. Upland vegetation of the property is maintained lawn grass and bordered by shrubbery and trees including Wax Myrtle, Cherry Laurel, Crepe Myrtle and Live Oak trees. The existing pier extends approximately 65' in length by 5' in width from the highground area towards the AIWW. An access ramp leads from the access pier onto a floating dock, measuring approximately 32' in length by 6' in width, which runs in the same alignment as the access pier. A small finger pier, measuring approximately 12' in length by 6' in width extends towards the north from the main floating dock, which runs parallel to the shoreline and channel. The application states that the existing docking facility currently accommodates transient vessels using the existing boat -ramp. Based on a review of State Permit No. 57-92 permit application, the docking facility was authorized at this distance to address a natural channel, which was in existence at the time of the permit application. Since then, based on aerial photography review it appears that this channel has shoaled or shifted towards the northeast of the existing docking facility and boat -ramp. Further, the adjacent riparian property owner to the north (J. Wicker) received CAMA General Permit No. 32518-D on 3/3/2003, which authorized extension of his existing docking facility approximately 200' waterward to the established pier length to the south and into water depth of approximately -2.5' at NLW. State Permit No. 57-92 application indicated the proposed boat -ramp and associated docking facilitywere to be located within waterdepths ranging from 0.0' to -2.0' at mean low water (MLW). The application states that the existing docking facility and boat -ramp are located in water depths of approximately —0.5' at NLW (See Sheets 1 and 15 of 21 and Project Narrative). Site B is the southern project site, which is approximately 0.46 acres and ranges approximately 3' to 15' above NHW. This property is currently undeveloped and the 60' of shoreline is currently stabilized by an existing asbestos bulkhead. Waterward of the bulkhead is an area of Coastal Wetlands measuring approximately 30' in width consisting primarily of Smooth Cordgrass (Sparfina altemiflora). Upland vegetation of the property is maintained lawn grass and bordered by shrubbery and trees including Wax Myrtle (Myrica cerfera), Pine and Live Oak trees. The property appears to be utilized as an outdoor park for picnicking and open space for the HOA and is bordered by residential properties to the north, south and west. The City of Wilmington/New Hanover County 2006 Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA- ORW by the Division of Water Resources. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. RECEIVED PROPOSED PROJECT: JUN 01 20b The applicant proposes to enhance existing community common areas adjacent to Middle Sound. The following are the proposals for each site, aforementioned: Porters Neck HOA Page 3 Site A (Boat -ramp) - The application states that maintenance excavation is proposed to maintain the previous waterdepths when the facility was authorized in 1992. The proposed dredge limits dimensions would be approximately 159' in length by45' in width to a final project depth of -2.0' @ NLW, which would result in the removal of approximately 600 cubic yards of sandy substrate. The material would be mechanically excavated and placed onto a privately owned spoil island (USACE DA-0228) at the confluence of the AIWW and Nixon's Channel directly across the AIWW from the project site. It appears the spoil site would be outside the USACE 1000' easement; however, the access location from Nixon's Creek would be within the easement. The application states that existing concrete boat -ramp would be extended approximately 16' in length by 15' in width and the existing floating docks would be replaced within the same dimensions, aforementioned. The application also states that kayak racks would be installed within the grass area west of the existing parking area of the community boat -ramp (See Sheets 13 and 14 of 21 and Project Narrative). Site B (Park) - The applicant proposes to construct 63 linearfeet of new bulkhead waterward of the existing asbestos bulkhead. The proposed bulkhead would be located approximately 1' waterward of the existing bulkhead and would be into the existing bulkheads to the north and south. The applicant states that this alignment is necessary to avoid impacts and disturbance to the existing deteriorating asbestos bulkhead. The application states that the additional kayak racks would also be constructed on the northern and of the highground area of the site (See Sheets 13,14,17, 21 of 21 and Project Narrative). The high ground area would then be vegetated for stabilization in an area of approximately 1,260 sq. ft. within the Estuarine Shoreline. The proposed excavation would impact approximately 7,155 sq. ft. of shallow bottom area, which would result in the removal of approximately 600 CY of material to be deposited on approximately 2,500 sq. ft. of the highground area of an existing spoil island. The proposed new floating docks would continue to incorporate approximately 264 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed boat -ramp extension would impact approximately 240 sq. ft. of shallow bottom area. The proposed kayak racks would impact approximately 240 sq. ft. of highground area. The proposed floating dock replacement would not encroach into the adjacent 15 foot Riparian Corridor Setback Area requirement. The community boasts many amenities but its two main features are the secure, commu- nity boat ramp and pier and waterfront park. Residents can enjoy fishing, swimming, outdoor recreation and have direct access to the Atlantic Ocean and numerous picturesque creeks and marshes by paddle craft and boat. This modification request to Permit #117-15 began in early December of 2017 with a request for modification to extend the boat ramp by 8' because of washout occurring from boats requiring power to place on trailers. Following several e-mail exchanges, a field meeting was held with Courtney Spears on March 11, 2018 at the boat ramp site. The information below reflects that discussion. The neighbors to each site and the Porters Neck Quality of Life Association have been notified by registered mail. Site A — North Site — 8540 Bald Eagle Lane — Zoned R-20S -Community Boat Ramp 1. Extend boat launching ramp Prepare one 9'xl5' slab that will be poured on the current ramp and above water. Clean off the current ramp of silt and prepare the area for installation of new slab. Slide the slab into place and confirm that the depth at the end of the extended ramp will be 2' at normal low tide. We understand this will not be considered "in water" work and is therefore not subject to the moratorium 2. Maintenance Dredging Dredge 520 cubic yards of sand to return to 1992 and 2015 water depth levels and allow floating docks to float over 2' normal low tide depth as per original and current permit, removing time shifted sands and restore boat ramp area to its usefulness. This 2' normal low tide depth area was reviewed and confirmed by Courtney Spears field visit late afternoon on 03/11/2018. Sand will be excavated via a barge mounted backhoe and will be barged and deposited on spoil island 0228 —Northeast New Hanover Conservancy. We understand this dredg- ing is subject to the April 1-October 1 moratorium 3. Landscaping Plant one tree, approximately 50 medium shrubs, 26 small shrubs and decorative ground cover to improve the appearance of the boat ramp from the road. The type of plants are included in the drawings but will be deter- mined by availability. Place a fence behind the plantings for additional privacy and to be the anchor for the locked swinging gate entrance for ingress and egress control. The fence may be phased later than the landscap- ing due to budget constraints.
