This permit, issued on March 100 2015 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, all development shall be carried out in accordance with the
attached workplan drawings (13), 1 dated 1/28/15, 2 dated 12/16/14, 3-6 and 8-13 dated 11/5/14, 7
dated 12/16/14 and AEC Hazard Notice dated 2/5/5.
Upland Development
2) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, including the force mains, pump stations and taps,
all as expressly and specifically set forth in the attached permit application and workplan drawings.
Any additional land disturbing activities and/or construction may require a modification of this
permit. Contact a Division of Coastal Management representative at (910)796-7215 for WSEivED

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

December 31, 2018
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive standard shall apply.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Division of Energy, Mineral and
Land Resources, 127 Cardinal Drive Extension, Wilmington, NC 28405.
4) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
5) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

6) This permit does not convey any property rights either in real estate or materials.
7) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) The pemrittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a utility permit
from the NC Division of Water Resources.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in writing before a permit for
development can be issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (_') years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual tong -term

photographs of the coastline taken over the past 50 years.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive storms and
erosion. Permits issued for development in this area expire on
December 31 of the third year following the year in which the
permit was issued. Shortly before work begins on the project
site, the Local Permit Officer must be contacted to determine the
vegetation line and setback distance at your site. If the property
has seen little change since the time of permit issuance, and the
proposeddevelopment can still meet the setback requirement,
the LPO will inform you that you may begin work. Substantial
progress on the project must be made within 60 days of this
setback determination, or the setback must be re -measured. Also,
the occurrence of a major shoreline change as the result of a
storm within the 60-day period will necessitate re -measurement
of the setback. It is important that you check with the LPO
before the permit expires for official approval to continue the
work after the permit has expired. Generally, if foundation

The purpose of this project is to modify the original application that was granted in 2003 in
order to provide sewer service to those areas not already serviced by North Topsail Utilities, Inc.
This application is not specific to any one area of the project but rather a general coverage permit
for those facilities not yet constructed. These facilities would include but are not limited to the
installation of individual pump stations for single-family residences, gravity sewer lines and
regional pump stations. In addition to the proposed improvements, activities may also include
maintenance for existing facilities. Estimated total land disturbance is approximately 400,000
square feet. All land disturbances will be located in the NCDOT right-of-way. The application
is being submitted by Pluris, LLC on behalf of the individual landowners.
With no specific landowner applicant and no specific location, several of the requested
items for the application package have not been provided. No property deed, wetland delineation
or adjacent property owner information is provided. When improvement locations are finalized,
this information will be submitted. Stormwater Management Plan Certification and Ocean and
Inlet Hazard Notices should not be required for this project as no improvements are planned in
these areas.
On the enclosed plans, we have delineated the items requested be your agency. The
erosion rate for oceanfront properties is given along with the appropriate AEC setback. In the
sound area, the division between ORW and SA waters is labeled as well as the AEC zones adjacent

9. PROJECT DESCRIPTION:
By way of Water Water Quality permit Nos. WQ0005849 and WQ0037183, Pluris Holdings, LLC operates an
existing 1,542,635 GPD wastewater treatment facility which is located along NC Highway 210, between the
intersection of NC Highway 172 and the Atlantic Intracoastal Waterway (AIWW), in the community of Sneads
Ferry, in Onslow County. The utility company has a service area which includes the entire Town of North
Topsail Beach as well as parts of the community of Sneads Ferry (see sheet 1 through 13 of 13, and sheet 1 of
14 of 14, for location of distribution lines and pump stations).
The project area in question has a previous permit history with the NC Division of Coastal Management, and
was authorized under CAMA Major Permit No. 148-03 on October 20, 2003. At the time, the permit was issued
to North Topsail Utilities, Inc. for the same/similar sewer expansion reported in this request. A field report,
completed by Jim Gregson, and circulated on August 28, 2003, described the expansion of the facility to include
hundreds of individual stations and lines, essentially mirroring that included in this request.
The previous CAMA expired on December 31, 2006, and the applicant failed to renew the permit to allow for
continued development. In addition, somewhere along the line the property owner/operating entity was changed
from North Topsail Utilities, Inc. to Pluris Holdings, LLC.
On June 25, 2014, the Division of Water Resources issued a permit (WQ0037183) for the construction and
operation of a waterwater collection system extension, which covers a portion of the service area requested
herein. However, the applicant does not currently have an active CAMA Major permit authorizing development
of the expansion.
The following citing from Mr. Gregson's original field investigation report (circulated on August 28, 2003) has
been referenced below to provide historical information on the project. Mr. Gregson wrote: "On July 11, 2003,
the North Carolina Division of Water Quality issued North Topsail Utilities, Inc. a Surface Irrigation System
Permit which authorized the continued operation of 629, 000 GPD surface irrigation and disposal facilities,
consisting of a three -cell, 42.2 acre facultative lagoon and 127 acres of irrigation area. The permit also
authorized the construction and operation of approximately 11.86 acres of additional irrigation area to manage
additional,Jlow of 45,133 GPD (referred to as Phase I Expansion), and the construction and operation of
approximately 52.2 acres of irrigation area with no additional permitted capacity (referred to as Phase II
Expansion). Unlike most typical sewer collection systems, which are gravity lines, the majority of the sewer
lines associated with the North Topsail Utility Company's collection system are force mains or pressurized
sewers. The North Carolina Division of Water Quality does not require a sewer extension permit for atypical
"building sewer". As defined in 15 NCAC 2H.0203(8), a typical building sewer is a sewer line that serves a
single building with the sole purpose of conveying wastewater from that building into a gravity sewer that runs
on or adjacent to the building's property. These are typically referred to as individual sewer "taps". Individual
taps into force mains, or pressurized sewers do require sewer extension permits from the Division of Water
Quality. A typical building sewer tap into a gravity line is usually authorized by the local building inspector.
CAMA Minor Permits can be issued to authorize these type taps and associated development if it is located
within a CAMA AEC. The requirement for a NC Division of Water Quality Sewer Extension Permit for taps
into North Topsail Utility Company's force mains has necessitated the need for this CAMA Major Permit
Application request.
The waters of the Atlantic Ocean are Classified SB by the NC Division of Water Ressources. The majority of
the waters of Stump Sound are Classified SA ORW (see submitted plans for ORW boundaries). All other
waters adjacent to the project area are classified SA (this includes portions of the AIWti€ca *Chadwick Bay).

(PNA).

PROPOSED PROJECT:
The purpose of this CAMA Major Permit Application is to request authorization to construct/install
approximately 1,000 additional taps and or individual and regional pump stations under one CAMA Major
Permit instead of each individual property owner. Typically, these pressurized connections or taps would be
permitted individually to the property owner by the NC Division of Water Resources, which would require all
affected property owners to apply for individual CAMA Major Permits. Similarly, the Division of Water
Resources is seeking to permit the entire pressurized system, including existing, proposed and future taps which
would be under the control and ownership of the utility company. Under this scenario, the utility company
would be responsible for the construction, operation and maintenance of the pump stations and force mains
associated with each tap.
Development would include the construction of up to 9 miles of 2" force main and 4" force main; up to 1,000
simplex (single pump) lift stations; and multiple duplex lift stations. The locations of the individual taps are
indicated on the applicant's plans (sheets 1-13 of 13 and 1 of 14). Existing taps are numbered and are indicated
by a circle (simplex pumps) or square (duplex pumps). Proposed taps are not numbered and are indicated by a
broken circle (proposed simplex pump) or broken square (proposed duplex pump). The main difference
between a pressurized tap and a gravity connection is the requirement for a pump or lift station which is needed
to overcome the head pressure in the force main. The simplex lift stations would be connected to the force main
via 2" force mains.
The vast majority of these individual stations are located within the public right-of-way of NC Highway 210,
with most located within the Ocean Hazard Area of Environmental Concern. If a permit is granted to authorize
the proposed taps, setback determinations for the construction of the pump stations, sewer lines, and associated
residential development, would be determined prior to construction. Additionally, this field report is not
intended, nor does it define whether or not a lot served by an individual tap would be "buildable" based on
setbacks, buffers, coastal wetlands, etc. This determination would need to be made by DCM or their
representative(s) prior to construction, on a case by case basis.
10. ANTICIPATED IMPACTS:
The proposed construction of approximately 1,000 additional pressurized taps would result in the overall
disturbance of approximately 400,000 sq. ft. (9.18 acres) of high ground for the installation of the pump stations
and force mains. This acreage is based on an average of approximately 400 sq. ft. of disturbance per
connection. As designed, no impacts to Coastal Wetlands or Open Water areas should occur as a result of the
project.

Recommendations for State Permit — Pluris Holdings, LLC — February 5, 2015
It appears the proposed project (installation of the proposed sewer lines and pump stations) is CONSISTENT
with the Rules established in 15 NCAC 7H.0306 Use Standards for Ocean Hazard Areas and 15 NCAC
7H.0308 (c) Specific Use Standards for Ocean Hazard Areas.
Additionally, it appears the proposed project is CONSISTENT with the Rules established in 15A NCAC 07H
.0209 COASTAL SHORELINES, Section (d) Use Standards.
This office has no objection to the proposed work, provided it is consistent with all other local, state and federal
permitting requirements. Any permit issued should include the following conditions:
(1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings(s) dated received on January 30.2015.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and
Federal regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 796-7215 for a
final inspection at completion of work.
(5) The permittee is required to contact the DCM Representative at (910) 796-7215 shortly before he plans
to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major
shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is
void and must be redone.
(6) All buildings constructed within the ocean hazard area shall comply with the NC Building Code,
including the Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood
Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the
building code or a flood damage prevention ordinance are inconsistent with any of the following AEC
standards, the more restrictive provision shall control.
(7) All unconsolidated material resulting from associated ground disturbance shall be retained on site by
effective sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted
and mulched) within 14 days of construction completion. No dune disturbance is authorized under this permit.
(8) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two
years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence.
However, if natural shoreline recovery or beach renourishment takes place within two years of the time the
structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need
not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek
authorization of temporary protective measures allowed under CRC rules.
(9) This permit does not involve the excavation or filling of any wetlands or open water areas, even

(10) In order to avoid weakening the protective nature of ocean beaches and primary and frontal dunes, no
development shall take place that involves the removal or relocation of primary or frontal dune sand or
vegetation thereon which would adversely affect the integrity of the dune. Other dunes within the ocean hazard
area shall not be disturbed unless the development of the property is otherwise impracticable. Any disturbance
of these other dunes is allowed only to the extent permitted by 15A NCAC 07H .0308(b).
NOTE: The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project
without having the permit transferred to a third -party.
NOTE: Future development on the permittee's property may require a modification of this permit. Contact a
representative of this Division at (910) 796-7215 prior to commencement of any such activity for this
determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required

This project is consistent with the North Topsail Beach and Onslow County Land Use
Plan.
The applicant proposes to add additional pressurized sewer connections and pump
stations to the existing Pluris sewer system. The project is located in North Topsail
Beach and Sneads Ferry in Onslow County. The project is located at the end of Marina
Way Road, within a 4-acre conservation area.
Areas of Environmental Concern (AEC's) impacted by the proposal are OH and ES.
Waters at the project site are classified as SB and SA-ORW and are open to the
harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of North Topsail Beach and
Onslow County Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, North Topsail Beach and Onslow County allows development in Conservation
classified AECs which is consistent with the State's minimum use standards. The Town
of North Topsail Beach Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of North Topsail Beach Land Use Plan.

Dear Mr. Hoffer:
On February5, 2015, the Wilmington Regional Office received notification that the subject proposed project requires a CAMA
Major Permit. The North Carolina Administrative Code requires any project that proposes more than 10,000 square feet of
new built -upon area, or is part of a larger common plan of development, or that must receive Sedimentation and Erosion
Control Plan approval for the disturbance of more than 1 acre, or that must receive a CAMA Major permit, to apply for and
receive a Stormwater Management Permit from the Division of Energy, Mineral and Land Resources. Please understand
that the NPDES 010000 Federal Construction Stormwater Permit that is issued with the Erosion Control Plan approval letter is
NOT the same as a Coastal Stormwater Management Permit. Any construction on the subject site, prior to receipt of the
required Coastal Stormwater permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Therefore, either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and
supporting documentation, or a written response regarding the status of this project and the expected submittal date, must be
received in this Office no later than May 9, 2015. Failure to respond to this request may result in the initiation of enforcement
action, and construction may experience a subsequent delay. If the project is located within the jurisdiction of any local
government holding an NPDES post -construction stormwater permit issued by the Division of Energy, Mineral and Land
Resources, please contact that unit of local government and submit the stormwater application to them.

Dear Mr. Fentress:
The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Pluris
Holdings, LLC, whereby you are requesting State approval for development of property located at North Topsail Beach
and Sneads Ferry, North Carolina, adjacent to the Atlantic Ocean, the AIW W, and Stump Sound, in Onslow County. It
was received as complete on January 30, 2015, and appears to be adequate for processing at this time. The projected
deadline for making a decision is April 15, 2015. An additional 75-day review period is provided by law when such time
is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from January 30, 2015, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of
my field report and/or comments from reviewing agencies.
