This permit, issued on November 13, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Observation Pier 1) This permit authorizes only the pier and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this observation pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Edwin & Gaye Orr ADDITIONAL CONDITIONS Permit No.129-15 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit does not authorize any formalized boat slips. In order to ensure compliance with this condition handrails shall be placed around the perimeter of the authorized observation platform. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted on the attached workplan drawings. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. Upland Development 11) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the fence as expressly and specifically set forth in the attached permit application and work drawings. Any additional land disturbing activities or construction may require a modification of this permit. General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. �I j.� Vdwin & Gaye Orr ADDITIONAL CONDITIONS Permit No.128-15 Page 3 of 3 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2015-02179). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3883 and assigned the project DWR Project No. 20071367 V4. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: An application processing fee of $250 was received by DCM for this project. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 2CP St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. Lot 71 is .363 acres (15812.28) in its entirety and is an average of 3.1' above NHW. The total length of the shoreline is 148'. There is a 148' x 280' fringe of Coastal Wetlands present along the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass S artina altemiflora), Salt Grass (Distichlis spicata) and Salt Meadow Grass (Spartina patens). Within the waters of Dill Creek expanses of oyster beds are present. The water depths in Dill Creek are shallow (less than -2'nlw) and according to the applicant, reach —2.7' NLW within the channel portion and —1.4 at NLW at the waterward end of the proposed structure. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. The lot is developed with a single family structure and all infrastructure. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: The applicant is proposing a 6' x 233.99' pier and a 14' x 28.5' L- head platform. The only upland development proposed is for the placement of 172' long x 42 inch high wood fence within the Estuarine Shoreline AEC. The pier would cross high ground for approximately 3', coastal wetlands and oyster beds for approximately 294'and open water for 29' with a total length of 323' (area over the coastal wetlands/oyster beds and open water'). It would then intersect a 14' x 28.5' platform. There are no slips proposed. The water depths along the platform area are -1.4' nlw. The most water ward portion of the structure would be located 35' landward of the edge of the exisRE C E 1 V E D channel. OCT 2 0 2015 The Division has determined through previous permit activity, that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from wDCM_ IV- measure the water body for the immediate area, creating a width of 135'. In consideration of this, the impedance into the water body by the structure consequently extends approximately 34' into the 135' body of water. The pier and platform would be located 105' from the west riparian access line and 15' from the east riparian access line. The project site is located at 1508 Galley Circle, lot #71 in the Mariner's Point subdivision in Morehead City, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). Due to resource concerns during the original subdivision development, each lot must apply for a major permit for individual docks. Dill Creek is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the permit application and supports recommendations presented by the NC Division of Coastal Management's fisheries specialist and / NC Division of Marine Fisheries. However, we would like to state our concerns with the project. The structure terminates in a 14' by 28.5' platform Shall water habitat shading could be minimized by reducing the width of this structure. Also, the water depths in the area are below -2' NLW within a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anytime development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 147LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot currently has an existing 3-story dwelling. The owner is requesting to construct 310 LF of a 6' wide wooden pier from the upland of Lot 71 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. This platform is beyond the extent of the coastal wetland, beyond the oyster rock that is adjacent to the coastal wetland but not impacting the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. Attached is an exhibit from a previously approved CAMA Major Permit for an observation pier on lot 56 of Mariner's Point Subdivision that demonstrates the extents of the channel. This lot is approximately 175 LF downstream from Lot 72. Also included in this application is a proposed 42" tall wooden privacy fence. This fence encroaches the 30' CAMA setback but does not impact any wetlands or go beyond the property's high ground.
