This permit, issued on November 13, 2015 , is subject to compliance with the application (where

Observation Pier
1) This permit authorizes only the pier and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this observation pier without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) The permittee shall maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having it transferred to a third party.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit does not authorize any formalized boat slips. In order to ensure compliance with this
condition handrails shall be placed around the perimeter of the authorized observation platform.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
6) No portion of the pier and platform shall exceed one quarter of the width of the water body as depicted
on the attached workplan drawings.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
9) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
10) To reduce direct impacts to oyster resources, the permittee shall, in consultation with DCM, relocate all
oysters falling within the footprint of pilings to an area immediately adjacent to the project area.
Upland Development
11) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the fence as expressly and
specifically set forth in the attached permit application and work drawings. Any additional land disturbing
activities or construction may require a modification of this permit.
General
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

13) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2015-02179).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3883 and assigned the project DWR Project No. 20071367 V4.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The owner would like to construct an observation pier from the uplands portion over coastal wetlands to the edge of the
channel per the attached drawings. Also proposed is a fence around the back yard of the property with a gate opening up to
the pier for access.

of equipment and where it is to be stored.
Pile installation will be top down over the wetlands and surface waters. Hand construction will be used to build the stringers,
bracing and surface platform of the dock. Typical wood construction will be used for the fence on high ground.

Construction of a 6wide dock from the uplands portion of the site across the coastal wetlands that will terminate in a

9. Narrative Description:
The lot 71 project is located at 1508 Galley Circle of Oglesby Rd which is part of the existing
Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for
infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N.
2CP St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site
to the east and north.
Lot 71 is .363 acres (15812.28) in its entirety and is an average of 3.1' above NHW. The total
length of the shoreline is 148'. There is a 148' x 280' fringe of Coastal Wetlands present along
the shore adjacent to Dill Creek. This fringe contains Smooth Coordgrass S artina
altemiflora), Salt Grass (Distichlis spicata) and Salt Meadow Grass (Spartina patens). Within
the waters of Dill Creek expanses of oyster beds are present. The water depths in Dill Creek
are shallow (less than -2'nlw) and according to the applicant, reach —2.7' NLW within the
channel portion and —1.4 at NLW at the waterward end of the proposed structure. Extensive
field work confirms the soundings. The substrate in this area is thick organic mud. The lot is
developed with a single family structure and all infrastructure.
This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine
Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in
which the proposed project would take place is closed to the taking of shellfish. Morehead
City's Land Use Plan dated 2007 classifies this area as Low Density Residential and
Conservation within the AECs.
10. Project Description:
The applicant is proposing a 6' x 233.99' pier and a 14' x 28.5' L- head platform. The only
upland development proposed is for the placement of 172' long x 42 inch high wood fence
within the Estuarine Shoreline AEC.
The pier would cross high ground for approximately 3', coastal wetlands and oyster beds for
approximately 294'and open water for 29' with a total length of 323' (area over the coastal
wetlands/oyster beds and open water'). It would then intersect a 14' x 28.5' platform. There
are no slips proposed. The water depths along the platform area are -1.4' nlw. The most water
ward portion of the structure would be located 35' landward of the edge of the exisRE C E 1 V E D
channel.

The Division has determined through previous permit activity, that the configuration of marsh
and oyster beds along the shoreline of this property establishes the point from wDCM_ IV-
measure the water body for the immediate area, creating a width of 135'. In consideration of
this, the impedance into the water body by the structure consequently extends approximately
34' into the 135' body of water. The pier and platform would be located 105' from the west
riparian access line and 15' from the east riparian access line. Riparian access lines where

determined on the original major permit submittal for the subdivision as well as through field
visits and aerial photography and are drawn relative to the channel location. All water depths
and the outermost limit of the oyster rock, channel location and water body width have been
field verified by DCM staff.
11. Anticipated Impacts:
The proposed pier as would incorporate 18 ft2 of high ground while shading and
incorporating 1620ft2 of coastal wetlands and oyster beds. A total 519 ft2 of open water of
would be shaded and incorporated by the pier. Oyster beds containing healthy (productive)
populations existing along the shoreline would be disturbed during the construction
process. There would also be temporary turbidity during piling placement. The Division of
Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440)
on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the
existing s/d. Based on the determination of the water body widths by the Division and the
District, the structure should not cause a hindrance to navigation due to the location of the
existing oyster beds. The oyster beds/coastal wetland area terminates approximately 280'
waterward of NHW. The channel edge is located 65' from the edge of the oyster beds.

Stroud Engineering, P.A. is requesting a CAMA Major Permit for an observation pier construction
and a 42" tall wooden fence on Lot 71 of Mariner's Point Subdivision. The address for the project is
1508 Galley Circle, Morehead City, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit
conditions required that anytime development were to occur within the 75' AEC line and waterward
that the work must be permitted through the CAMA Major process. The property's upland shoreline is
147LF along coastal wetlands that are part of Crab Point Bay, Stream Index k: 21-30; Class SA;HQW. The
lot currently has an existing 3-story dwelling. The owner is requesting to construct 310 LF of a 6' wide
wooden pier from the upland of Lot 71 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter
Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with
this pier construction. This platform is beyond the extent of the coastal wetland, beyond the oyster rock
that is adjacent to the coastal wetland but not impacting the channel. The extent of the channel within
this body of water is determined from previously approved CAMA Major Permits for adjacent lots within
Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this
elevation or gets deeper going toward the center of the water body. Attached is an exhibit from a
previously approved CAMA Major Permit for an observation pier on lot 56 of Mariner's Point Subdivision
that demonstrates the extents of the channel. This lot is approximately 175 LF downstream from Lot 72.
Also included in this application is a proposed 42" tall wooden privacy fence. This fence
encroaches the 30' CAMA setback but does not impact any wetlands or go beyond the property's high
ground. Approximately 175 If of fence is within the 75' AEC line with approximately 67 If being within
the 30' CAMA setback. As part of the fence, a gate is proposed in line with the proposed pier. r

This project is consistent with the Carteret County ComprehensiveLand-Use Plan Update.
The applicant proposes to construct a high ground wooden fence, pier, platform for lot 71
of the Manners Point subdivision. The project is located at 1508 Gallery Circle in
Morehead City adjacent to Dill Circle.
I have reviewed this proposal for consistency with the Carteret County Land Use Plan
and offer the following comments.
The general area of the project is classified as Low Density Residential/Conservation.
Waters at the project site are classified as SA/HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery area. Areas of Environmental Concern are CW,
EW and PTA.
Carteret County allows development in Conservation classified AECs, which is
consistent with the State's minimum use standards. The Carteret County Land Use Plan
contains some policies, which exceed the State's minimum use standards. However,
none of these policies appear to be applicable to this project.
This project appears to be consistent with the Carteret County Land Use Plan
Update.

The following are my comments and recommendations regarding the aforementioned proposal. The
proposal is for the construction of an observation pier with an 1-head platform. The water depths within
this area are an average of -1.4' nlw.
The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office
recommends the project be authorized as proposed on plats dated received 8/25/15 contingent upon all
applicable general conditions and the following standard conditions:
The pier and platform should not exceed a maximum distance of 310' waterward of NHW and
should not exceed a maximum of 28' from the oyster bed/coastal wetland edge due to the 135'
wide water body width.
Due to the shallow water depths and silty sediment (mud fluff) substrate within a PNA the
District recommends no slips should be authorized.

After reviewing your application, we have decided that the impacts.are covered by General Water
Quality Certification Number 3883 (GC 3883). This Certification allows you to use the General Permit
198700056 when issued by the US Army Corps of Engineers and the:CAMA Major Permit when issued by
the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also,,this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted inyour application
shall expire upon expiration of the General Permits or CAMA Permit.
This approval islfor the'purpose and design that you described in your,application. If you change your
project, you mustnotify us and you may be required to send us a new application. If the property is
sold, the new owner must be given a copy of this General. Certification and approval letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the future)
exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation maybe required as,
described.in 15A NCAC 2H .0506 (h). This approval requires you to follow the.conditions listed in the
attached certification and any additional conditions listed on following pages.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and specifications for
this project are incorporated by reference as part of the Certification. If you change your project, you must
notify the Division and you may be required to submit a new application package with the appropriate fee.
If the property is sold, the new owner must be given a copy of this approval letter and General Certification
and is -responsible for complying with all conditions. Any new owner must notify the Division and.request
the Certification be issued in their name (15A NCAC 02H .0501 and .0502).

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the application. All construction activities, including the
design, installation, operation, and maintenance of sediment and erosion control Best Management
Practices, shall be performed so that no violations of state water quality standards, statutes, or rules
occur Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of this permit (15A NCAC 02H .OS01 and .0502).
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B..0221. Appropriate sediment and erosion control practices must be used
to meet this standard. Turbidity curtains s hall be used as appropriate. Please notify this Office if
any turbidity issues arise at 910.796.7215
4. Primary Nursery Area (PNA)
Please understand that the waters around your project area have been identified by the Division of
Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed
project area arise in the future, please be aware that new dredging within a PNA is not allowed
under 15A NCAC 02B .0221 and is a degradation of water quality standards and therefore
considered a water quality violation. [15A NCAC 02B .0221]
5. Any final construction plans for this project must include or reference the application and plans
approved by the DWR under the authorization letter and certification. The applicant will also be
required to evaluate all acquired permits to assure that they are consistent and all relative
Impacts are accounted for and shown on the construction plans .[15A NCAC 02H .0502 (b) and 15A
NCAC 02H .0506 (4)]
6. The permitee shall require its contractors and/or agents to comply with the terms of this permit in
the construction and maintenance of this project, and shall provide each of its contractors and/or
agents associated with the construction or maintenance of this project a copy of this certification. A
copy of this certification Including all conditions shall be available at the project site during the

7. All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from hydrocarbons or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the Division of
Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional Office at
910.796.7215 or Steve Lewis at 919.807.6308 and after hours and on weekends call the USCG
National Response Center at 1.800.424.8802, management of such spills shall comply with
provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H

8. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbodyor wetlands to prevent contamination by fuel and oils. [15A NCAC 62H .0506 (b)(3) and
(c)(3)and 15A NCAC 02B .0200 (3)(f)]
9. This General Certification shall expire on the same day as the expiration date of the corresponding
General Permit. The conditions in effect on the date of issuance of the Certification for a specific
Project shall remain in effect for the life of the project, regardlessof the expiration of this
Certification.
Continuing Compliance:
10. The applicant/permiteeand their'authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from compliance
with 303(d) of the Clean Water Act), and 'any other appropriate requirements of State and Federal
law. If the Division determines that such standards or laws are not being met, including failure to
sustain a designated or.achieved use, or that State or Federal law is bein&violat'ed, or that further
conditions are necessary to assure compliance, than the Division may reevaluate and modify this
General Water Quality Certification. [15A NCAC 02H..0507(d)]
11. Certificate of Completion
The applicant and/or authorized agent shall provide a completed Certificate of Completion form to
the Division within 30.(thirty) days of project completion. Mail to: NCDEQ DWR 401 and Buffers Unit

result In criminal and/or civil penalties: The authorization to proceed,with your proposed impacts or to
conduct impacts to waters as depicted in your application and as authorized by this Certification shall

North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at
1508 Galley Circle, lot #71 in the Mariner's Point subdivision in Morehead City, NC. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a high ground wooden fence, a 6' by 233.99' pier, and a 14'
by 28.5' L-shaped platform. The pier would cross coastal wetlands and oyster beds for 294' and open
water for 29' to intersect with the L-shaped platform. Water depths at the platform are -1.4' NLW. No
formal slips are proposed. The platform terminates 35' landward the channel. Due to resource concerns
during the original subdivision development, each lot must apply for a major permit for individual docks.
Dill Creek is classified SA HQW by the Environmental Management Commission and is designated a
primary nursery area (PNA) by the NC Division of Marine Fisheries.
The NCWRC has reviewed the permit application and supports recommendations presented by
the NC Division of Coastal Management's fisheries specialist and / NC Division of Marine Fisheries.
However, we would like to state our concerns with the project. The structure terminates in a 14' by 28.5'
platform Shall water habitat shading could be minimized by reducing the width of this structure. Also,
the water depths in the area are below -2' NLW within a PNA. PNAs are defined as those areas inhabited
by the embryonic, larval or juvenile life stages of marine or estuarine fish or crustacean species due to
favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important
rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that Impact fish and fish habitats. The applicant
proposes to construct a 6' x 233.99' pier that will terminate in a 14' x 28.5' L-head and construct of a
fence on high ground. A single slip is proposed on the L-head platform. The project is located far up Dill
Creek, a small tidal creek, will span coastal wetlands, soft mud bottom, and oyster bars. The waters are
classified as PNA (Primary Nursery Area) by the DMF (Division of Marine Fisheries); a PNA habitat is an
area that has been deemed critical to the larval and juvenile life -stages of fish and shellfish. A site visit
by DCM staff on 10/14/15 to the area revealed an extensive oyster resource throughout the waterbody
as well as an abundance of shrimp and finfish. The edge of the marsh, mudflat, and oysters are dry at
low tide and drop off to approximately V to 2' in the channel.
Based upon the site conditions and other docking facilities observed in the project area it is highly likely
that the docking of a vessel in this location would result in the vessel resting on bottom during low tide.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct a 6' x 233.99' pier that will terminate in a 14' x 28.5' L-head and construct of a
fence on high ground. A single slip is proposed on the L-head platform. The project is located far up Dill
Creek, a small tidal creek, will span coastal wetlands, soft mud bottom, and oyster bars. The waters are
classified as PNA (Primary Nursery Area) by the DMF (Division of Marine Fisheries); a PNA habitat is an
area that has been deemed critical to the larval and juvenile life -stages of fish and shellfish. A site visit
by DCM staff on 10/14/15 to the area revealed an extensive oyster resource throughout the waterbody
as well as an abundance of shrimp and finfish. The edge of the marsh, muciflat, and oysters are dry at
low tide and drop off to approximately 1' to 2' in the channel.
Based upon the site conditions and other docking facilities observed in the project area it is highly likely
the docking of a vessel in this location would result in the vessel resting on bottom during low tide. Due
to the limited depths combined with the sensitive habitat and resources present in the project area it is
recommended that a railing be added to the platform to discourage docking of vessels that could
smother or potentially prop -kick the bottom. This modification would alleviate concerns about possible
negative impacts of potential vessel use.

During project construction care should be taken to minimize disturbance to the oyster resources
present by leaving oyster beds in place and not smothering oysters with equipment or sediment.
However where impacts are unavoidable due to piling placement or the need to get equipment to the
project site the oysters should be moved to an area of open bottom adjacent to the project area.

Stroud Engineering, P.A. is requesting a CAMA Major Permit for an observation pier construction
and a 42" tall wooden fence on Lot 71 of Mariner's Point Subdivision. The address for the project is
1508 Galley Circle, Morehead City, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit
conditions required that anytime development were to occur within the 75' AEC line and waterward
that the work must be permitted through the CAMA Major process. The property's upland shoreline is
147LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The
lot currently has an existing 3-story dwelling. The owner is requesting to construct 310 LF of a 6' wide
wooden pier from the upland of Lot 71 to a 28.5' x 14' (399 sf) platform that borders the "One Quarter
Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with
this pier construction. This platform is beyond the extent of the coastal wetland, beyond the oyster rock
that is adjacent to the coastal wetland but not impacting the channel. The extent of the channel within
this body of water is determined from previously approved CAMA Major Permits for adjacent lots within
Mariner's Point Subdivision. This is generally where -2' at NLW is met and the bottom remains at this
elevation or gets deeper going toward the center of the water body. Attached is an exhibit from a
previously approved CAMA Major Permit for an observation pier on lot 56 of Mariner's Point Subdivision
that demonstrates the extents of the channel. This lot is approximately 175 LF downstream from Lot 72.
Also included in this application is a proposed 42" tall wooden privacy fence. This fence
encroaches the 30' CAMA setback but does not impact any wetlands or go beyond the property's high
ground. Approximately 175 If of fence is within the 75' AEC line with approximately 67 If being within
the 30' CAMA setback. As part of the fence, a gate is proposed in line with the proposed pier.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State approval
for development of your property located on Dills Creek in Carteret County. The site is at 1508 Galley Circle
in Morehead City, Carteret County. The application was received as complete on grAlWand appears to be
adequate for processing at this time. The projected deadline for making a decision is 1118/15. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period
