HomeMy WebLinkAbout138-15 Amended Onslow CountyPe?rnit Class AMENDED Permit Number 138-15 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern . pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to K.CGS 113-229 Issued to Onslow County, 4024 Richlands Highway Jacksonville, NC 28540 Authorizing development in Onslow County at New River Inlet, AIWW & Atlantic Ocean beach along a 2 mile section of North Topsail Beach, as requested in the permittee's application dated 5/12/15, including attached drawings (13) as referenced in Condition No. 1 of this permit, & attached Ocean Hazard AEC Notice dated 4/1/15. This permit, issued on December 10, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. This Amended Permit alters the moratorium dates found in Condition No. 2 of the original of Permit No. 138-15, which was issued on 12/3/15. Based upon additional coordination with the N.C. Wildlife Resources, Condition No. 2 now reads as follows. 2) In order to protect threatened and endangered species and to minimize adverse impacts to offshore, nearshore, intertidal and beach resources no excavation or beach nourishment activities shall occur from. May 1 to November 15 of any year without prior approval .from the Division of Coastal Management, in consultation with appropriate resource agencies. This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and tl other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2018 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program.
